Introduction:

22495 Van Buren Boulevard, Riverside CA 92518

a) The Contractor shall provide all necessary supervision, professional advice, labor, equipment, materials and transportation necessary to perform various equipment maintenance at the Riverside National Cemetery. The Riverside National Cemetery is a National Shrine, the standards of maintenance, appearance and operational procedures performed by the contractor at this cemetery shall reflect this nation’s concern for those interred. For this reason, the contract’s strict adherence to the specification shall be required and shall be essential.

General Parameters:

a) Work shall be scheduled and conducted in a cooperative manner to effect the least possible interference with cemetery operations or annoyance to others. Work shall be done in a manner that safeguards all Department of Veterans Affairs visitors, employees, and the public. It shall be the contractor’s responsibility to work out any cooperative work schedules regarding cemetery operation. Contractor shall be fully responsible for all actions initiated and/or completed by the contractor in the performance of the specified work.

b) Routine and seasonal services and maintenance will be according to manufacturer’s measures, standards and schedules. A detailed service and maintenance report will be submitted to the Contracting Officer Representative (COR) after every service or visit.

c) The Government will not provide and allow on-site storage of equipment, tools, supplies and chemicals to be used in the performance of this job.

d) The Government will provide electric power, where available, and water needed to perform the tasks. The contractor (to include subcontractors) shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off water faucets or valves after using the required amount to accomplish the task.

e) Contractor shall make sure that its foreman has a 30 Hour OSHA certification in Construction Safety and current TB test.

f) Contractor shall make sure that its personnel has a 10 Hour OSHA certification in Construction Safety and current TB test.

g) The Contractor shall possess a current C20 license issued by California Contractor State License Board and all other licenses and certifications as required by law.

Description of Work:

Contractor to provide all necessary supervision, labor, equipment, cleaning solutions, filters, belts, and all required materials to do the following:

a) HVAC Preventative Maintenance (Monthly):

1. Service all Air Conditioning Heat Pump Units according to manufacturer’s recommendations. NOTE: (SEE “APPENDIX A” FOR LIST & LOCATIONS)

2. Clean or replace filters and adjust or replace belts as needed.

3. Inspect and lubricate all motors, bearings and adjust all belts.

4. Check all flow and line voltage controls for proper operation, to include all thermostats.

5. Check for proper voltage and amperage.

6. Check high and low side refrigerant pressures.

7. Check the performance of the refrigeration system and controls.

8. Check for proper air flow at both the units and buildings.

9. Wash condenser coil.

10. Verify economizer operation.

11. A detailed report for each unit must be submitted to the COR after the service.

b) Ice Machines (Semi-Annual):

1. Service all ice machine units according to manufacturer’s instructions. Below is the minimum acceptable procedure. If the unit needs descaling, the contractor will follow the manufacturer’s instructions. NOTE: (SEE “APPENDIX B” FOR LIST & LOCATIONS)

2. Replace the water filter. Remove all ice from the bin.

3. Remove the front panel. Push and release the Harvest button. Wait for the machine to finish the Harvest cycle and stop.

4. Remove the evaporator cover. Push and release the Clean button. The clean indicator light will be blinking, and the pump will restart.

5. Pour 12 ounces of Scotsman ice machine cleaner into the reservoir water. Return the evaporator cover to its normal position. Wait 10 minutes while the cleaning solution circulates.

6. Push and release the Clean Button again. This starts the rinsing process. The Clean indicator light will be ON. Note: The rinse process flushes any residual cleaner out of the ice machine’s water system. Wait 20 minutes for the rinsing process to remove any residual cleaning solution. Push the OFF button to switch the machine off.

7. Mix 2 gallons of Sanitizer solution (follow local codes and sanitizer instructions). Note: Some sanitizers must be rinsed off and some must air dry.

8. Push and release the Clean button. Pour 16 ounces of Sanitizer solution into the reservoir water. Wait 10 minutes while the sanitizing solution circulates. Push and release the Clean button again. This starts the rinse process.

9. Sanitize the ice storage bin while waiting for 20 minutes for the rinsing process to remove any residual sanitizer. Push the Off button to switch the machine off.

10. Remove the evaporator cover and spray or wash all interior surfaces of the freezing compartment including the evaporator cover with sanitizer solution. Return the evaporator cover to its original position. Push and release the Freeze button.

11. Return the front panel to its normal position and secure it to the machine with the original screws. Clean and wipe ice machine exterior.

12. A detailed report for each unit must be submitted to the COR after the service.

c) Evaporative Coolers (Semi-Annual):

1. Service all Evaporative Cooler Units according to manufacturer’s recommendations. NOTE: (SEE “APPENDIX C” FOR LIST & LOCATIONS)

2. Uncover, remove panels and clean out any debris in the water pan at the bottom. (Vinegar can be used to dissolve the buildup.) Inspect the water trough for clogged holes, clean as necessary. Thoroughly dry the tray and inspect for signs of cracking. Coat the entire tray with submarine sealer or another product to prevent rust.

3. Check the motor’s fan belt tension. When pressed it should move about one half inch. Lightly oil the bearing on the blower assembly and the motor if it has an oil receptacle.

4. Install new cooler pads. Aspenwood fiber pads are a good choice, or follow manufacturer’s recommendations.

5. Reconnect the water line and turn on the water supply. Check the float valve and make sure it is operating properly. If necessary, adjust the float arm by bending it. (The water level in the bottom tray should be about one inch below the top of the tray, and below the top of the overflow pipe.)

6. Switch on the cooler motor and recirculating pump, making sure the cooler pads are being evenly saturated with water. Look for split seams in the casement, r rusted areas in the tray, which could cause a leak.

7. When not in use for prolonged periods, drain water out of the cooler and the supply line.

8. A detailed report for each unit must be submitted to the COR after the service.

d) Exhaust Vents (Semi-Annual):

1. Service all Exhaust Vent Units according to manufacturer’s recommendations. NOTE: (SEE “APPENDIX D” FOR LIST & LOCATIONS).

2. Check belts; replace and adjust as needed.

3. Check and lubricate bearings when needed. Rotate bearings during lubrication.

4. Vacuum, wipe, clean inside and outside exhaust vent’s parts and frames.

5. A detailed report for each unit must be submitted to the COR after the service.

e) Solar Panels (Semi-Annual):

1. Wash all Solar Panels, including blanks according to manufacturer’s recommendations. NOTE: (SEE “APPENDIX E” FOR LIST & LOCATIONS).

2. Cleaning methods are to be determined by the contractor based on the conditions at each site, and may include a rinse and a brush agitation and or rinse only.

3. Only filtered/de-ionized water shall be used to wash the panels.

4. The use of a pressure washer to perform the washing is allowed however, Contractor must ensure that areas that are not effectively cleaned by the pressure washer must be manually cleaned.

5. A scissor lift or man-lift shall be used at carport and shade structures.

6. Contractor shall submit to the COR a wash report within 5 working days of completion of a wash job. This report will include photos of panels before and after washing and broken panels, and will identify any unsafe conditions that affect system productivity.

7. The cleaning is to be scheduled only on days (usually weekends and holidays) when there is no work at the cemetery.

NOTE: THIS IS FOR MAINTENANCE ONLY. ALL REPAIR/REPLACEMENT PARTS MUST BE PRE-APPROVED AND SUBMITTED ON A SEPARATE ESTIMATE AND ARE NOT COVERED UNDER THIS CONTRACT.

Labor force and equipment:

a) The contractor shall be aware of the labor, materials and equipment requirements needed to meet contract specifications. The Government expects the Contractor to use any additional resources necessary to meet the specified work requirements. The Contractor shall determine the number of employees and the amount and kinds of materials and equipment needed during the period of performance.

Site Work – Coordination and Cleanup:

a) At the end of each workday, unless otherwise specified by the COR, the contractor shall remove all trash and debris resulting from work. At all times rubbish and trash generated by the contractor shall be kept clear of vehicular and pedestrian circulation throughout the site.

Contractor Professional Appearance:

a) The contractor personnel shall maintain a neat and professional appearance throughout its workforce, vehicles, equipment and worksite. Contractor personnel must wear a uniform bearing the name of the Contractor, or by wearing badges bearing the Contractor’s name and the employee’s name in English. Other clothing in question shall require written approval by the COR. No clothing shall be worn with inappropriate phrases, logos, words or images unless approved in advance by the COR.

Conduct of Contractor Personnel:

a) Due to the sensitive mission of the cemetery, the work often requires contact with, and exposure to grieving individuals. Contractor personnel must exercise and exhibit absolute decorum, composure and stability always.

b) The Contractor shall ensure that no work causes any funeral, ceremony, procession or visitation to be delayed, altered, or otherwise impact in such a way that the dignity or security of the event is compromised. A list of scheduled funerals will be provided, if needed, the day prior to the service.

c) The Contractor employees shall behave with appropriate decorum, courtesy, and respect while within the Cemetery or at its perimeter or entrances. Shouting, cursing, angry outburst, sleeping, intoxication and violence or criminal acts of any kind will not be tolerated and is cause for immediate removal from the Cemetery.

d) The Contractor personnel shall not:

· Lean, sit on or against headstones markers or monuments.

· Sleep or otherwise lay, rest or be idle in a manner that reflects unfavorably on the Government or the Contractor.

· Perform work of any nature on privately-owned vehicles/equipment within the cemetery’s confines to include the washing of vehicles/equipment.

e) Food and beverages shall be consumed only within areas designated by the COR. Use or sale of intoxicating beverages and/or drugs is strictly prohibited. The Contractor’s personnel shall follow the cemetery smoking policy that is available at the Cemetery’s Administration Building and Maintenance Yard.

f) The cemetery shall provide to the contractor personnel restroom facilities at areas designated by the COR. Breaks and lunch periods shall be taken at areas designated by the COR, not in the field.

g) Listed above and any misconduct shall be cause for immediate removal from the cemetery premises.

Contractor Damage:

a) Any subsequent damage by the contractor to cemetery property during contract performance shall be repaired at the contractor’s expense.

Safety:

a) The Contractor must meet all safety requirements of Riverside National Cemetery’s Safety Officer, Department of Veterans Affairs, Occupational Safety and Health Administration, and the State of California. It is incumbent upon the Contractor to be familiar with these requirements and maintain regular and routine contact with the Safety Officer of Riverside National Cemetery.

b) Contractor shall be consistent and fully compliant with all applicable Federal, State, County and City laws, Environmental Protection Agency (EPA) guidelines and regulations.

c) Contractor shall secure and label all materials and equipment according to applicable Federal, State, County and City laws, ordinances, Right-to-Know laws, EPA guidelines and regulations. Contractor shall submit to the COR a Safety Data Sheet of all chemicals and supplies used during the performance of this contract.

d) For safety reasons, contractor personnel are not allowed to be transported throughout the cemetery holding onto or riding in the back of any open pickup truck or other vehicle.

Work Hours:

a) The Contractor shall perform the services as specified herein Monday through Friday, except for National Holidays, between the hours of 8:00am – 4:30pm, the contractor must request, in writing, any deviations to these hours and receive written approval from the COR in advance of any changes. g) When it is necessary to perform work outside of the regularly scheduled hours set, the contractor shall notify the COR and Alternate Government Point Of Contact at least one

(1) day in advance.

SECTION C - CONTRACT CLAUSES

C.1 LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE (JUN 2011)

This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-Owned Small Business Set-Aside. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. C.2 VAAR 852.219-9 VA SMALL BUSINESS SUBCONTRACTING PLAN MINIMUM REQUIREMENTS (DEC 2009)

(a) This clause does not apply to small business concerns.

(b) If the offeror is required to submit an individual subcontracting plan, the minimum goals for award of subcontracts to service-disabled veteran-owned small business concerns and veteran-owned small business concerns shall be at least commensurate with the Department's annual service-disabled veteran- owned small business and veteran-owned small business prime contracting goals for the total dollars planned to be subcontracted.

C.6 52.223-2 AFFIRMATIVE PROCUREMENT OF BIOBASED PRODUCTS UNDER SERVICE AND CONSTRUCTION CONTRACTS (SEP 2013)

(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless—

(1) The product cannot be acquired—

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

C.7 52.223-10 WASTE REDUCTION PROGRAM (MAY 2011)

(a) Definitions. As used in this clause—

"Recycling" means the series of activities, including collection, separation, and processing, by which products or other materials are recovered from the solid waste stream for use in the form of raw materials in the manufacture of products other than fuel for producing heat or power by combustion.

"Waste prevention" means any change in the design, manufacturing, purchase, or use of materials or products (including packaging) to reduce their amount or toxicity before they are discarded. Waste prevention also refers to the reuse of products or materials.

"Waste reduction" means preventing or decreasing the amount of waste being generated through waste prevention, recycling, or purchasing recycled and environmentally preferable products.

(b) Consistent with the requirements of section 3(e) of Executive Order 13423, the Contractor shall establish a program to promote cost-effective waste reduction in all operations and facilities covered by this contract. The Contractor's programs shall comply with applicable Federal, State, and local requirements, specifically including Section 6002 of the Resource Conservation and Recovery Act (42 U.S.C. 6962, et seq.) and implementing regulations (40 CFR part 247).

C.8 52.223-17 AFFIRMATIVE PROCUREMENT OF EPA-DESIGNATED ITEMS IN SERVICE AND CONSTRUCTION CONTRACTS (MAY 2008)

(a) In the performance of this contract, the Contractor shall make maximum use of products containing recovered materials that are EPA-designated items unless the product cannot be acquired—

C.9 52.203-16 PREVENTING PERSONAL CONFLICTS OF INTEREST (DEC 2011)

(a) Definitions. As used in this clause—

"Acquisition function closely associated with inherently governmental functions" means supporting or providing advice or recommendations with regard to the following activities of a Federal agency:

(1) Planning acquisitions.

(2) Determining what supplies or services are to be acquired by the Government, including developing statements of work.

(3) Developing or approving any contractual documents, to include documents defining requirements, incentive plans, and evaluation criteria.

(4) Evaluating contract proposals.

(5) Awarding Government contracts.

(6) Administering contracts (including ordering changes or giving technical direction in contract performance or contract quantities, evaluating contractor performance, and accepting or rejecting contractor products or services).

(7) Terminating contracts.

(8) Determining whether contract costs are reasonable, allocable, and allowable.

"Covered employee" means an individual who performs an acquisition function closely associated with inherently governmental functions and is—

(1) An employee of the contractor; or

(2) A subcontractor that is a self-employed individual treated as a covered employee of the contractor because there is no employer to whom such an individual could submit the required disclosures.

"Non-public information" means any Government or third-party information that—

(1) Is exempt from disclosure under the Freedom of Information Act (5 U.S.C. 552) or otherwise protected from disclosure by statute, Executive order, or regulation; or

(2) Has not been disseminated to the general public and the Government has not yet determined whether the information can or will be made available to the public.

"Personal conflict of interest" means a situation in which a covered employee has a financial interest, personal activity, or relationship that could impair the employee's ability to act impartially and in the best interest of the Government when performing under the contract. (A de minimis interest that would not "impair the employee's ability to act impartially and in the best interest of the Government" is not covered under this definition.)

(1) Among the sources of personal conflicts of interest are—

(i) Financial interests of the covered employee, of close family members, or of other members of the covered employee's household;

(ii) Other employment or financial relationships (including seeking or negotiating for prospective employment or business); and

(iii) Gifts, including travel.

(2) For example, financial interests referred to in paragraph (1) of this definition may arise from—

(i) Compensation, including wages, salaries, commissions, professional fees, or fees for business referrals;

(ii) Consulting relationships (including commercial and professional consulting and service arrangements, scientific and technical advisory board memberships, or serving as an expert witness in litigation);

(iii) Services provided in exchange for honorariums or travel expense reimbursements;

(iv) Research funding or other forms of research support;

(v) Investment in the form of stock or bond ownership or partnership interest (excluding diversified mutual fund investments);

(vi) Real estate investments;

(vii) Patents, copyrights, and other intellectual property interests; or

(viii) Business ownership and investment interests.

(b) Requirements. The Contractor shall—

(1) Have procedures in place to screen covered employees for potential personal conflicts of interest, by—

(i) Obtaining and maintaining from each covered employee, when the employee is initially assigned to the task under the contract, a disclosure of interests that might be affected by the task to which the employee has been assigned, as follows:

(A) Financial interests of the covered employee, of close family members, or of other members of the covered employee's household.

(B) Other employment or financial relationships of the covered employee (including seeking or negotiating for prospective employment or business).

(C) Gifts, including travel; and

(ii) Requiring each covered employee to update the disclosure statement whenever the employee's personal or financial circumstances change in such a way that a new personal conflict of interest might occur because of the task the covered employee is performing.

(2) For each covered employee—

(i) Prevent personal conflicts of interest, including not assigning or allowing a covered employee to perform any task under the contract for which the Contractor has identified a personal conflict of interest for the employee that the Contractor or employee cannot satisfactorily prevent or mitigate in consultation with the contracting agency;

(ii) Prohibit use of non-public information accessed through performance of a Government contract for personal gain; and

(iii) Obtain a signed non-disclosure agreement to prohibit disclosure of non-public information accessed through performance of a Government contract.

(3) Inform covered employees of their obligation—

(i) To disclose and prevent personal conflicts of interest;

(ii) Not to use non-public information accessed through performance of a Government contract for personal gain; and

(iii) To avoid even the appearance of personal conflicts of interest;

(4) Maintain effective oversight to verify compliance with personal conflict-of-interest safeguards;

(5) Take appropriate disciplinary action in the case of covered employees who fail to comply with policies established pursuant to this clause; and

(6) Report to the Contracting Officer any personal conflict-of-interest violation by a covered employee as soon as it is identified. This report shall include a description of the violation and the proposed actions to be taken by the Contractor in response to the violation. Provide follow-up reports of corrective actions taken, as necessary. Personal conflict-of-interest violations include—

(i) Failure by a covered employee to disclose a personal conflict of interest;

(ii) Use by a covered employee of non-public information accessed through performance of a Government contract for personal gain; and

(iii) Failure of a covered employee to comply with the terms of a non-disclosure agreement.

(c) Mitigation or waiver. (1) In exceptional circumstances, if the Contractor cannot satisfactorily prevent a personal conflict of interest as required by paragraph (b)(2)(i) of this clause, the Contractor may submit a request through the Contracting Officer to the Head of the Contracting Activity for—

(i) Agreement to a plan to mitigate the personal conflict of interest; or

(ii) A waiver of the requirement.

(2) The Contractor shall include in the request any proposed mitigation of the personal conflict of interest.

(3) The Contractor shall—

(i) Comply, and require compliance by the covered employee, with any conditions imposed by the Government as necessary to mitigate the personal conflict of interest; or

(ii) Remove the Contractor employee or subcontractor employee from performance of the contract or terminate the applicable subcontract.

(d) Subcontract flowdown. The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts—

(1) That exceed $150,000; and

(2) In which subcontractor employees will perform acquisition functions closely associated with inherently governmental functions (i.e., instead of performance only by a self-employed individual).

(a) Except as provided in paragraph (c) below, the Contractor shall display prominently, in common work areas within business segments performing work under VA contracts, Department of Veterans Affairs Hotline posters prepared by the VA Office of Inspector General.

(b) Department of Veterans Affairs Hotline posters may be obtained from the VA Office of Inspector General (53E), P.O. Box 34647, Washington, DC 20043-4647.

(c) The Contractor need not comply with paragraph (a) above if the Contractor has established a mechanism, such as a hotline, by which employees may report suspected instances of improper conduct, and instructions that encourage employees to make such reports.

C.11 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

C.12 52.228-5 INSURANCE—WORK ON A GOVERNMENT INSTALLATION (JAN 1997)

(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.

(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective—

(1) For such period as the laws of the State in which this contract is to be performed prescribe; or

(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting Officer upon request.

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from April 1, 2018 through March 31, 2023.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.16 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

C.17 VAAR 852.203-70 COMMERCIAL ADVERTISING (JAN 2008)

The bidder or offeror agrees that if a contract is awarded to him/her, as a result of this solicitation, he/she will not advertise the award of the contract in his/her commercial advertising in such a manner as to state or imply that the Department of Veterans Affairs endorses a product, project or commercial line of endeavor.

C.18 VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2016)(DEVIATION)

(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVSOB”:

(1) Means a small business concern:

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition);

(ii) The management and daily business operations of which are controlled by one or more service- disabled veterans (or eligible surviving spouses) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran;

(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

(iv) The business has been verified for ownership and control pursuant to 38 CFR 74 and is so listed in the Vendor Information Pages database, (https://www.vip.vetbiz.gov); and

(v) The business will comply with subcontracting limitations in 13 CFR 125.6, as applicable

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(b) General.

(1) Offers are solicited only from verified service-disabled veteran-owned small business concerns. Offers received from concerns that are not verified service-disabled veteran-owned small business concerns shall not be considered.

(2) Any award resulting from this solicitation shall be made to a verified service-disabled veteran- owned small business concern.

(c) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.
