Contractor shall furnish all supervision, tools, labor, materials, equipment and transportation necessary for project 636A6-19-312 Replace Water Heaters - VA Central Iowa Health Care System Building 1 - 3600 30th Street., Des Moines, IA 50310. Work includes, but not limited to general construction, including demolition, piping, insulation, plumbing, electrical( power, systems, etc.) and other work as required by the scope of work and attached documents.

This solicitation is issued in accordance with Public Law 109-461, the Veterans Benefits, Healthcare Information and Technology Act of 2006, Sections 502 and 503, as a set-aside for Service Disabled Veteran Owned Small Business (SDVOSB) contractors. Pursuant to 38 USC 8127(d), Veterans First Contracting Program, competition is restricted to SDVOSB construction firms, as there is an expectation that offers will be received from two (2) or more SDVOSB contractors under this solicitation. In accordance with VAAR 819.7003(b), at the time of submission of bid and prior to award of a contract, the bidder must represent to the Contracting Officer that it is a

(1) SDVOSB eligible under VAAR 819.70; (2) small business concern under the NAICS code assigned to this acquisition; and (3) listed as a verified SDVOSB in VIP database at www.vip.vetbiz.gov.

The NAICS Code is 236220 with the applicable size standard is $36.5 million. Magnitude of construction is between $100,000 and $250,000 IAW VAAR 836.204.

There is only one site visit as identified in FAR 52.236-27. Site visit will be 1:00 PM local time, Wednesday July 10, 2019 Building 2 room 2007, enter Bldg 2 Main Entrance and take either elevator C or stair 2-1 to 2nd floor.

Bid Item I: (Base Bid) 100 Calendar Days from Notice of Proceed Construction work shall include, but shall not be limited to providing all labor, materials, equipment, etc. necessary to complete Fargo VA Central Iowa Health Care System construction project 636A6-19-312, Replace Water Heaters in accordance with the Scope of Work, the contract documents, NFPA, local building codes, and other applicable requirements.

SCOPE OF WORK

Replace Domestic Water Heaters VA Central Iowa Health Care System Project Number: 636A6-19-312

A. General Intention The contractor will remove and replace two existing instantaneous domestic water heaters and related work in the Basement of Building 1. The water heaters are approximately 25 years old and supply domestic hot water to Building 1 and 1W. Currently the south water heater is not operational.

B. Location VA Central Iowa Health Care System, Building 1 3600 30th St., Des Moines, IA, 50310

C. Mandatory Pre-bid Site Investigation The contractor must attend the mandatory Pre-bid Site Investigation tour to observe existing conditions at 1:00 PM Local Time on Wednesday, July 10, 2019. Meet the COR in Building 2 Room 2007 on the VA campus. This room can be found by entering the Building 1 Main Entrance.

D. Phasing of the Work

1. At least one of the water heaters must always be operational because of a critical patient care need.

2. Currently the north water heater is operational, and the south water heater is not operational.

3. First remove, replace, test and commission the south water heater.

4. After the south water heater is fully operational, remove, replace, test and commission the north water heater.

5. If there is an absolutely necessary reason both water heaters must be shut down, the contractor will provide a temporary supply hot water to the areas in building 1 and 1W. This must be approved by the COR.

E. Scope of Work Requirements

1. Provide two new horizontal instantaneous water heaters to replace two existing vertical - mounted water heaters. They shall be oriented and located so the tubes can easily be removed and the heaters be maintained from all sides required. Propose to VA for acceptance the layout of the heaters before proceeding with installation.

2. Remove the two existing water heaters, associated piping, controls, accessories and housekeeping pads. and dispose of them in the VA metal recycle dumpster or trash dumpster as designated by the COR.

3. Provide new concrete housekeeping pads for each water heater.

4. Provide approximately 30” of bundle pull space from flange of the head.

5. Provide analog gauges on supply hot water, return hot water, and cold water.Remove and dispose of existing insulation off pipes in the immediate area of the water heaters. (steam, condensate, cold & hot water) as needed.

6. Modify existing piping for installation of the new heaters in new horizontal orientation as required.

7. Provide a new water temperature probe and well and probe in the hot water being supplied by the new water heater. The well and temperature probe will be installed within 3 feet of the discharge of the water heater. The temperature probe must be wired to the nearest Johnson Controls Panel to allow for monitoring the water temperature in the Building Management System (BMS). Connect and test the temperature probe is programmed into the BMS and is operating properly. Note that the temperature probe devise must be coordinated with Johnson Controls prior to order to ensure proper function with BMS system.

8. Provide condensate piping as required and to same drain system supplied to existing water heaters.

9. Ensure the discharge water temperature meets the current Legionella requirements of 130- degree water discharged from the water heaters.

10. Replace existing with new isolation valves, one incoming line for each water heater.

11. All low voltage wire shall be installed in conduit. Note that the Johnson Controls panel is located in room B401A, immediately to the west.

12. Provide new power as required for the water heaters and associated equipment into same Power Panel that pumps are currently fed from. Verify breaker sizes are sufficient for new equipment needs. Notify the COR if electrical breakers are not sufficient. Reuse existing electrical service as allowed per code.

13. Provide pipe insulation at all new piping up to points of connection to existing all piping systems, steam, condensate same as existing, cold & hot water.

14. All insulated piping will be labeled accordingly with plastic banded name and flow direction arrows.

15. Prepare and submit for approval a complete to scale layout drawing of all new work prior to start of pipe fabrication.

16. All piping modifications will be documents with a drawing and submitted to COR as-built drawings in both AutoCad and PDF format.

17. All Closeout documentation will be provided to the COR. The documentation would include testing, warranty and all other pertinent documentation.

18. All shutdown of steam or domestic water will be coordinated with COR.

19. Any piping or components found to be defective or not functioning properly during the removal of the existing water heaters will be reported immediately to the COR for authorization to repair or replace those components.

21. Follow VA specifications for steam piping and domestic water piping, low voltage wiring/conduit and installation of water heaters.

22. Provide a one-year labor and material warranty for all equipment.

23. Provide on-site videotaped training of all Maintenance and Operation tasks for this new equipment and system operation by manufacturers representative. Provide electronic copy

Page 1 of Page 1 of of training to VA for their use. This training shall be scheduled two weeks in advance with the COR so all appropriate VA Maintenance staff can attend.

24. All maintenance manuals, directions, and contact information shall be provided with one printed set in a 3-ring binder, with table of contents and labeled, and also an electronic copy.

F. Construction Schedule

1. Time is of the essence to complete this project to provide redundancy. Construction shall be complete in 100 days from receipt of written Notice to Proceed. If this date cannot be met then the contractor shall provide a completion date which means both pumps are 100% operational tested, and automatically controlled.

2. Submit the guaranteed completion date for both water heaters to be fully operational.

3. Submit as an alternate a cost for expedited schedule of the work to be complete in 35 days from issuance of Notice to Proceed.

G. Water Heater Specification Two Hubbell horizontal STXCN-6300S-CuNi Instantaneous Steam fire water heaters or equivalent.

· Capacity to heat 105 Gallons per minute from 40F – 130F when supplied with 30psi steam to the control valve

· Vessel shall be solid 90-10 Copper Nickel

· Modulating valve shall be a 2-way 2.5” electric type valve able to operate at or below 34psi.

· 150 psig AGA/CSA &ASME approved temperature and pressure relief valve.

· 115VAC/60Hz/1Ph

A.3 CONTRACTING OFFICER’S SPECIAL INSTRUCTIONS

INQUIRIES:

In accordance with Federal Acquisition Regulations Part 4, contractual documents (e.g. bids, proposals, awards, modifications, etc.) shall be completed and signed by the Contractor as follows:

SAFETY OR ENVIRONMENTAL VIOLATIONS AND EXPERIENCE MODIFICATION RATING INFORMATION:

All Bidders/Offerors shall submit information pertaining to their past Safety and Environmental record. The information must contain a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years. If such certification cannot be made, a Bidder/Offeror shall explain why and submit as much information as possible regarding the circumstances of its past safety and environmental record, including the number of EPA violations and/or the number of serious, repeat, and/or willful OSHA violations, along with a detailed description of those violations.

All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR). This information shall be obtained from the Bidder’s/Offeror’s insurance carrier and be furnished on the insurance carrier’s letterhead. If a Bidder/Offeror’s EMR is above 1.0, Bidder/Offeror must submit a written explanation of the EMR from its insurance carrier furnished on the insurance carrier’s letterhead, describing the reasons for the EMR, and the anticipated date the EMR may be reduced to 1.0 or below.

Self insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.

If the NCCI cannot issue an EMR because the Bidder/Offeror lacks insurance history, Bidder/Offeror shall submit a letter indicating so from its insurance carrier furnished on the insurance carrier’s letterhead, and include a letter from the NCCI indicating that is has assigned Bidder/Offeror a Unity Rating of 1.0.

The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases, will be used to make a preliminary Determination of Responsibility.

This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.

DETERMINATION OF RESPONSIBILITY:

To be determined responsible, a prospective contractor must –

(a) Submit all required documents for submission of a bid.

(b) Have adequate financial resources to perform the contract, or the ability to obtain them.

(c) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments.

(d) Have a satisfactory performance record.

(e) Have a satisfactory record of integrity and business ethics.

(f) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors).

(g) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them.

(h) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

Note: The contracting officer shall obtain information regarding the responsibility of the prospective low bidder, including requesting pre-award surveys when necessary, promptly after a bid opening in accordance with FAR 9.105-1—Obtaining Information. INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS

1.1 BID GUARANTEE AND BONDS

This solicitation and all bidding materials must be obtained from the Federal Business Opportunities website located at www.fbo.gov. No specifications or drawings will be sent from the Department of Veterans Affairs. The contractor is responsible for printing their own specifications, drawings and contract forms.

A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

This requirement exceeds $150,000 (see FAR 28.102-1 for lesser amount), and the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum of 100% of the contract. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

GENERAL CONDITIONS

4.1 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) ALTERNATE I (APR 1984) The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 100/30 days after receipt of award. The time stated for completion shall include final cleanup of the premises.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed by 30-September-2019. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

4.2 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JUL 2013)

(a) Definitions. As used in this clause— Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts—

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. (d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.

4.3 52.223-21 FOAMS (JUN 2016)

(a) Definitions. As used in this clause— Global warming potential means how much a given mass of a chemical contributes to global warming over a given time period compared to the same mass of carbon dioxide. Carbon dioxide's global warming potential is defined as 1.0.

High global warming potential hydrofluorocarbons means any hydrofluorocarbons in a particular end use for which EPA's Significant New Alternatives Policy (SNAP) program has identified other acceptable alternatives that have lower global warming potential. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables of alternatives available at http://www.epa.gov/snap/.

Hydrofluorocarbons means compounds that contain only hydrogen, fluorine, and carbon.

(b) Unless otherwise specified in the contract, the Contractor shall reduce its use, release, and emissions of high global warming potential hydrofluorocarbons and refrigerant blends containing hydrofluorocarbons, when feasible, from foam blowing agents, under this contract. When determining feasibility of using a particular alternative, the Contractor shall consider environmental, technical, and economic factors such as—

(1) In-use emission rates, energy efficiency, and safety;

(2) Ability to meet performance requirements; and

(3) Commercial availability at a reasonable cost.

(c) The Contractor shall refer to EPA's SNAP program to identify alternatives. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables available at http://www.epa.gov/snap/.

4.4 52.225-9 BUY AMERICAN—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. As used in this clause— "Commercially available off-the-shelf (COTS) item"—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

"Component" means any article, material, or supply incorporated directly into construction material.

"Construction material" means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

"Cost of components" means—

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the end product (whether or not such costs are paid to a domestic…
