C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT

REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.

Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.4 VAAR 852.242-71 ADMINISTRATIVE CONTRACTING OFFICER (OCT

2020) The Contracting Officer reserves the right to designate an Administrative Contracting Officer (ACO) for the purpose of performing certain tasks/duties in the administration of the contract.

Such designation will be in writing through an ACO Letter of Delegation and will identify the responsibilities and limitations of the ACO. A copy of the ACO Letter of Delegation will be furnished to the Contractor.

(d) Comptroller General Examination of Record. D.1 STATEMENT OF WORK

1. VA Cooperative Studies Program, Clinical Research Pharmacy Coordinating Center in Albuquerque, New Mexico has a Cummins GTA855 Natural Gas Generator Set (no serial number available for the generator) requiring replacement due to high exhaust gas temperature for unknown reasons. This unit was sourced from a different Federal Agency and came with some issues that have not been solved. The VA is expecting a trade in cost associated with this purchase.

2. SCOPE:

2.1. The contractor shall provide all labor, personnel, supplies, equipment, tools, materials, supervision and other items necessary to provide a turnkey solution consisting of new diesel generator (technical requirements are detailed in this document) with a noise reducing enclosure. Vendor will disconnect existing unit from utilities, remove existing unit and enclosure from pad, remove existing unit from site, place new unit on pad, connect to utilities, and perform commissioning/load bank testing to include initial fueling and refueling after completing tasks.

3. SPECIFIC TASKS:

3.1. Provide turnkey backup generator solution consisting of a 250KW diesel powered backup generator with fuel tank sized to support 48-hours continuous run under load and a noise reducing enclosure. Unit must include an audible low fuel warning system.

3.2. Provide and install spill containment system

3.3. Remove existing unit (Cummins natural gas unit) from pad

3.4. Disconnect existing generator from natural gas line and electric cables

3.5. Cap off natural gas line

3.6. Current unit to be turned in for trade in credit

3.7. Install new unit

3.8. Place new generator and enclosure on pad

3.9. Connect to utilities

3.10. Perform commissioning tasks to include the current Automatic Transfer Switch (ASCO Series 3000)

3.11. Perform Load bank testing

3.12. Assist with City of ABQ Air Quality Notification application

4. CONTRACTOR QUALIFCIATIONS AND SUBMITTALS

4.1. The contractor shall submit an offer for the trade in of the existing equipment, this amount shall be reflected in the contractor’s price offer.

4.2. Contractor shall submit Qualifications & Certifications to demonstrate the capability to provide the needed equipment installation and removal.

4.3. Contractor shall provide certification for the Technicians experience. The experience shall be largely with similar install and removal of the diesel-powered backup generator

4.4. Contractor shall provide a minimum of three (3) references to demonstrate experience installing and commissioning backup generators.

4.5. Contractor shall provide a brief description of a minimum of two (2) recent installations similar in scope to this requirement to include date and equipment details.

4.6. Contractor shall provide proposed technical solution to meet the procurement requirements

4.7. This information shall be submitted with offer to be considered for award.

9. PARKING, SMOKING, AND VA REGULATIONS:

9.3. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

10. INFORMATION SECURITY:

10.1. In accordance with Appendix A, Handbook 6500.6 Checklist blocks 7, the C&A requirements do not apply to this requirement, and Security Accreditation Package is not required. The nature of this requirement is technical; however, there is no information to be protected.

11. DELEGATION OF AUTHORITY

11.1. No additional service shall be provided without the approval from the Contracting Officer

(CO) or his/her designee of this contract. The Contractor shall not accept any instructions issued by any other person(s) other than the CO or his/her delegated representative acting within the limits of his/her authority.

12. AUTHORIZED SERVICES

12.1. Only those services specified herein are authorized under this contract. Before permitting and/or performing any service of a non-contract nature, the Contractor shall advise the CO of the reason (s) for the additional work and/or service. The Contractor is cautioned that only the CO or his/her designee may authorize additional service that are within the scope of this contract and that reimbursement shall not be made unless prior authorization is obtained from the CO. All changes to the contract shall be issued through a contract modification in writing from the CO to the Contractor.

13. COMPLAINTS

13.1. Contractor shall promptly and courteously respond to complaints within three (3) working days to the COR. Including complaints brought to the contractor’s attention by the CO. Contractor shall maintain a written record of all complaints, both written and oral showing the identity of the individual, the nature of the complaint, and contractor’s response. Contractor shall permit the Government to inspect the written records of complaints upon reasonable notice from the CO.

E.3 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM TO 52.212-2 EVALUATION-COMMERCIAL ITEMS (NOV 2021)

This is a competitive solicitation that will be evaluated and awarded using the comparative evaluation procedures in accordance with FAR 13.106-2(b)(3). The contract will be awarded to the responsible offeror/s whose offer best meets the government’s needs.

Offers submitted in response to the solicitation will be evaluated for acceptability against the requirements identified in the RFQ. Once one offer is found to meet the government’s needs, it will be compared side by side to the remaining offers in a uniform and fair manner, with the ‘best’ one being chosen. The Contracting Officer has the discretion to accept an offer other than the lowest price that provides additional benefit(s) to the government which the Contracting Officer can document and describe.

BASIS FOR AWARD

The Government reserves the rights to select a response that provides benefit to the Government that exceeds the minimum but is not required to do so. Although an offer may exceed the requirements, the government is not requesting or accepting alternate offer(s); each offer must respond to the solicitation’s requirements found in the SOW.

A Comparative Evaluation/Analysis will be conducted in accordance with FAR Part 13.106- 2(b)(3) to determine the quote that is in the ‘Best Interest’ of the Government.

Technical – Technical – the Government will evaluate the offer, on a pass or fail basis, to determine if the offeror meets the technical skills to support their ability in performing the services described in the SOW. The Offeror shall provide the following items to properly evaluate Technical Capability.

1. The contractor shall submit an offer for the trade in of the existing equipment, this amount shall be reflected in the contractor’s price offer.

2. Provide a copy of valid Contractor License and Insurance Certificate.

3. Contractor shall submit Qualifications & Certifications to demonstrate the capability to provide the needed equipment installation and removal.

4. Contractor shall provide certification for the Technicians experience. The experience shall be largely with similar install and removal of the diesel-powered backup generator

5. Contractor shall provide a minimum of three (3) references to demonstrate experience installing and commissioning backup generators.

6. Contractor shall provide a brief description of a minimum of two (2) recent installations similar in scope to this requirement to include date and equipment details.

7. Contractor shall provide proposed technical solution to meet the procurement requirements

8. This information shall be submitted with offer to be considered for award.

Technical – Pass/Fail Rating Pass Offeror submitted required documentation, certifications to support the technical requirement.

Fail Offeror, does not provide sufficient documentation, certifications to be considered technically capable.

1. Past Performance – Satisfactory performance information available on data independently obtained from Government and commercial sources to include Past Performance Information Retrieval System (PPIRS) and Federal Awardee Performance and Integrity Information (FAPIIS). Offeror will receive a neutral rating if no past performance information is found.

Past Performance – Confidence Rating Substantial Confidence Based on the offeror’s relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment can reasonably be assigned.

The offeror may not be evaluated favorable or unfavorable on the factor of past performance.

Limited Confidence Based on the offeror’s relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
