B.3 PERFORMANCE WORK STATEMENT

B.3.1 Purpose: VA Puget Sound Health Care System replacing current stationary rack system with a rolling rack system in Logistics warehouse. INSTALLATION OF SYSTEM WILL OCCUR IN THREE (3) PHASES.

B.3.2 Background: Logistics Service Line within the VA Puget Sound Health Care System Seattle is seeking to have a rolling rack system installed in the warehouse at the Seattle campus. The rack system is needed to create additional optimal storage space for medical supplies which has continually been added to inventory and storage space is increasingly limited. Additionally, installation of an updated rack system shall ensure increased safety.

B.3.3 Scope: The Contractor shall be required to furnish all items, to include but not limited to, project management/supervision, labor, equipment, materials, transportation and any incidentals required to satisfy the requirements of this Performance Work Statement. The Contractor shall be responsible for successful completion of removal of old stationary rack system and installation of a new electronic sliding rack system. Service shall be conducted in such a manner as to ensure the safety and allow continuous receiving, storing, and distribution of medical supplies. The Contractor shall perform service according to Occupational Safety and Health Administration (OSHA) guidelines, regulations, and laws. is needed to be installed to allow optimal storage of medical supplies.

B.3.4 Description of Work: The Contractor shall provide and perform installation of electronically operated rolling rack system. The storage system shall be of shelving pallet rack, with bottom shelf 8 inches above floor. Construction material must be made of steel. Racks shall meet power supply requirement of 120-volts. Drive system shall meet requirement of 90-volts. Carriages must provide control units with directional movement buttons, visual and audible alerts to operate sliding racks safely. Weight capacity shall be 16-32K pounds. The Contractor shall remove and dispose of old rack system as well as install new sliding electronically operated rack system. System will by seismic-rated.

B.3.5 System Requirements: The rolling rack system shall possess the following characteristics to meet the minimum needs of the Government:

· One single faced stationary row of pallet rack, 20’9” long x 48” deep x 10’0” high

· One single faced stationary row of pallet rack, 25’0” long x 48” deep x 10’0” high

· Two single faced stationary row of pallet rack 70’0” long x 24” deep x 10’0’ high

· One double faced stationary row of pallet rack 25’0” long x 104” deep x 10’0’ high

· Four double faced moving carriages, 25’0” long x 104” deep x 10’7” high

· Installation of one double faced moving carriages 16’9” long x 104” deep x 10’7” high

· All rack bays shall have three (3) adjustable beam levels with waterfall wire decking.

· Track shall be surface mounted on top of concrete slab.

· Rail profile is 3/8” high with beveled edges and shall be ADA compliant

· Electric powered carriages to move by ¼ hp; 90-volt DC gear motors

· Motor controllers provide soft start/soft stop

· Overhead buss bar system provide power require 120 volts

· Contractor shall provide and install VCT flooring

B.3.6 Hours of Service & National Holidays. Contractor employees shall perform the services required Monday through Friday, from 8:00 a.m. to 4:30 p.m.

National Holidays. The following Federal holidays are observed by the Federal Government: The Contractor is not required to provide services on the following National Holidays.

B.3.7 Invoicing: VA published the final rule requiring vendors to submit invoices electronically to the Financial Services Center (FSC) in the November 27, 2012 Federal Register. The rule became effective December 27, 2012. The rule includes a new contract clause to be inserted in all solicitations and contracts by the contracting officer (VAAR 852.232-72). Vendors can comply with the rule by using either of the two methods below:

1. The FSC uses a third-party contractor, Tungsten Network, to transition vendors from paper to electronic invoice submission. For information on Tungsten Network electronic invoicing set-up, vendors should call 1-877-489-6135, or email VA.Registration@Tungsten-Network.com.

Vendors are required to register with Tungsten Network and submit invoices electronically as a condition of acceptance of this contract or order.

FSC and VA’s Office of Acquisition, Logistics and Construction (OALC) will assist existing commercial vendors in migrating to the electronic process. Until the transition to electronic format is complete, FSC will continue to process paper invoices for commercial vendors.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor prior to the end of the contract.

C.3 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

(End of Clause) C.5 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service-Disabled Veteran-Owned Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

Cost of materials are excluded and not considered to be subcontracted.

(2) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.

(3) If VA determines that an SDVOSB/VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:

(i) Referral to the VA Suspension and Debarment Committee;

(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and

(iii) Prosecution for violating section 1001 of title 18.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
