This solicitation calls for the construction to perform Replacement of the A3 B3 Feeder Cable Project in the Loma Linda California VA Health Care System (LLVAHCS).

Job Walk: 26 June 2019 @ 9:00 a.m PST. 11201 Benton Street,Loma Linda, CA 92357 Coordinate with COR listed in Section B.9 of this solicitation.

Attendees are to meet at the the east side of the Bldg by the metal stairs to FMS of the main hospital at the Loma Linda VA Medical Center.

Contractor shall furnish all labor, equipment, certification, supervision, and materials necessary to perform all operations in connections with this order.

Awardee shall perform work in strict accordance with General Specifications, Statement of Work, Schedule, and terms and Conditions set forth in the contract.

This requirement is 100% set aside for SDVOSB concerns

Magnitude of this project is $250,000 and $500,000 Applicable NAICS Code and Size Standard for this Acquisition is 238210 / $15 Million

A3 and B3 Feeder Replacement A3 B3 Feeder are original 1977 installation and have exceeded their life expectancy for 350MCM cabling. Recent surge form SCE (Southern California Edison) caused over current and subsequent line failure on the B3 Feeder. The load B3 is designed to carry has been switched over to the A3 Feeder, but this is a short-term fix until a complete replacement project can be executed. Without the B3 feeder we cannot transfer between Substations in case of an emergency. B3 feeder not being operational affects hospital operations and veteran's safety.

Statement of Work A3 B3 Feeder 350MCM Cable Replacement Construction 23 May 2019 Loma Linda, California VA Health Care System (605)

B.1 INTRODUCTION:

This requirement is for construction services to replace the A3 B3 Feeder 350MCM Cable at the Loma Linda VA Medical Center.

B.2 BACKGROUND / DESCRIPTION OF WORK:

A3 and B3 Feeder cables were originally installed in 1977. Recently, the B3 Feeder wire was damaged by an electrical surge from Southern California Edison, the hospital’s electrical utility provider. The A3 and B3 Feeder 350MCM wire needs to be replaced due to recent damage and has exceeded the life expectancy of 350MCM cable, making it susceptible to future failures. The A3 and B3 Feeder supplies power to Sub Station US-1B and Sub Station US-3B for patient care.

B.3 OBJECTIVES:

Contractor shall furnish all the Labor and materials to Demo, replace, test, and certify the A3 and B3 Feeder 350MCM copper cabling and splices from the switch gear – to – manholes – to – substations US 1B and US-3B.

Contractor shall coordinate with VALLMC Electrical Supervisor for de-energizing each feeder. Only ONE feeder will be de-energized for removal at a time. VALLMC Electrical personnel are the only authorized technicians to perform VALLMC de-energization procedures. Contractor will follow VALLMC Electrical LOCK-OUT/TAG -OUT procedures, Arc-Flash requirements, and Confined space procedures.

Demo approx. 4,200 LF of 350MCM copper cabling and splices on the B3 Feeder.

Install approx. 4,200 LF of new 350MCM copper cabling and appropriate splices for the B3 Feeder. Test B3 Feeder for proper operation and certify.

B.4 CONFORMANCE STANDARDS:

A. All design and construction accomplished pursuant to this contract shall comply with the latest edition of the following documents unless the contractor is directed otherwise by the Contracting Officer. Any exceptions must be approved in writing by the Contracting Officer prior to construction startup.

B.5 HOURS OF COVERAGE:

A. Normal hours of operation are Monday through Friday from 7:30 am to 4:00 pm California time (no daylight savings). All work is expected to be performed generally during/outside normal hours of coverage unless requested or approved by the COTR or his/her designee.

B. Before commencement of work, the Contractor shall confer with the VA COR and Contracting Office to agree on a sequence of procedures; means of access to premises and building. All work performed, to include delivery of materials and equipment, shall be made with minimal interference to Government operations and personnel.

C. Work performed outside the normal hours of coverage must be approved by the COTR or his/her designee.

B.6 PERIOD OF PERFORMANCE:

- 3 weeks, 21 Calendar days from the issuance of the Notice to Proceed.

B.8 IDENTIFICATION, PARKING, SMOKING, AND VA REGULATIONS:

A. The Contractor's FSEs shall wear visible identification issued by NAVAHCS Police Section at all times while on the premises of NAVAHCS. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. NAVAHCS will not invalidate or make reimbursement for parking violations of the Contractor under any conditions. Smoking is prohibited inside any buildings at NAVAHCS. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

B.9 INFORMATION SECURITY:

A. In accordance with Appendix A, Handbook 6500.6 Checklist blocks 7, the C&A requirements do not apply to this requirement, and Security Accreditation Package is not required. The nature of this requirement is technical; however, there is no information to be protected.

B.10 LICENSING REQUIREMENTS:

A. Offeror must possess a 30-hour Occupational Safety and Health Administration (OSHA) safety card.

B. C-10 Electrical Contractor License C. NFPA and/ or NICET certification.

B.11 SPECIFIC REQUIREMENTS:

A. Schedule with Contracting Officer Representative (COR) or Designee five (5) business days in advance prior to start of work.

B. Prior to working, contractor shall coordinate ALL LOCK OUT /TAG OUT of energy sources . Upon completion of work, contractor shall notify VALLMC Electrical supervisor that these sources will be re-energized and verified.

C. Prior to work each day, the contractor’s designated lead or supervisor are/is to check in with VALLMC Electrical Supervisor or in their absence, check in with Graphics Control in the plant.

D. Contractor shall conform to the following standards, policies, regulations, governing agency, and any other local, state, or Federal guidelines that are not listed here

i. OSHA Regulations, www.osha.gov

ii. NFPA, www.nfpa.org

B.12 SUBMITTALS:

A. Contractor shall submit all required material/shop drawing submittals to the Contracting Officer within 10 calendar days of award, or as agreed to by the Contracting Officer for approval. No materials shall be installed prior to approval.

B. All material submittals and shop drawings shall contain, and have the Project Title, Project Number, and Contract number clearly indicated.

C. Material submittals and shop drawings shall be checked and signed by the Contractors Quality Control Manager prior to submission to the Government.

D. Submittals shall be legible, and shall include all technical data needed to verify that the item meets requirements of listed specifications, and applicable codes.

B.13 COMMENCEMENT, COMPLETION, AND PAYMENT FOR WORK:

A. The Contractor shall be required to commence work required at the time specified on the Notice to Proceed (NTP), execute the work, and complete the entire work not later than the completion time specified on the NTP. The time stated for completion shall include final cleanup of the premises. At the government’s option, it may choose to specify a two-stage performance period. For example, separating material lead-time from construction days can considerably decrease the length of time occupied buildings are inconvenienced by construction.

B. Before commencement of work, the Contractor shall confer with the VA COR and Contracting Office to agree on a sequence of procedures; means of access to premises and building; space for storage of materials and equipment; delivery of materials and use of approaches; use of corridors, stairways, elevators, and similar means of communications; location of partitions, eating spaces, and restrooms for the Contractor employees; and the like. Delivery of materials and equipment shall be made with minimal interference to Government operations and personnel.

C. The Contractor will be paid monthly upon submission of proper invoices for work completed. If the performance period exceeds 30 days and a progress schedule (approved by the Government) has been submitted, partial payment(s) may be authorized. Final payment will be withheld until all discrepancies are corrected and as-built drawings are approved by the Government.

B.14 MODIFICATIONS:

A. Modifications for this project after award will utilize the modification table and will be filled out when submitting a request. All requests must be submitted to the assigned COR who will then submit a formal request to the Contracting Officer (CO). New work is not allowed to commence unless it is signed by both parties via a Standard Form (SF) 30 modification.

C.1 52.214-31 FACSIMILE BIDS (DEC 1989)

(a) Definition. "Facsimile bid," as used in this solicitation, means a bid, modification of a bid, or withdrawal of a bid that is transmitted to and received by the Government via electronic equipment that communicates and reproduces both printed and handwritten material.

(b) Bidders may submit facsimile bids as responses to this solicitation. These responses must arrive at the place and by the time, specified in the solicitation.

(c) Facsimile bids that fail to furnish required representations or information or that reject any of the terms, conditions, and provisions of the solicitation may be excluded from consideration.

C.3 52.219-14 LIMITATIONS ON SUBCONTRACTING (JAN 2017)

(a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Applicability. This clause applies only to—

(1) Contracts that have been set aside or reserved for small business concerns or 8(a) participants;

(2) Part or parts of a multiple-award contract that have been set aside for small business concerns or 8(a) participants; and

(3) Orders set aside for small business or 8(a) participants under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).

(c) By submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for—

(1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.

(2) Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials.

(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.

(4) Construction by special trade contractors. The concern will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees.

(End of Clause) C.4 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

(End of Provision) C.5 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

However, the following statements in the annual report are not equivalent to a determination of violation:

(i) An inability to certify compliance.

(ii) An inability to conclude compliance.

(iii) A statement about compliance concerns.

(3) If so, determine whether the Offeror or any person owned or controlled by the Offeror has engaged in any activity that contributed to or is a significant factor in the determination in the report that one or more of these foreign countries is in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. Review the narrative for any such findings reflecting a determination of violation or non-adherence related to those foreign countries in the report, including the finding itself, and to the extent necessary, the conduct giving rise to the compliance or adherence concerns, the analysis of compliance or adherence concerns, and efforts to resolve compliance or adherence concerns.

(4) The Offeror may submit any questions with regard to this report by email to NDAA1290Cert@state.gov. To the extent feasible, the Department of State will respond to such email inquiries within 3 business days.

(d) Do not submit an offer unless—

(1) A certification is provided in paragraph (b)(1) of this provision and submitted with the offer; or

(2) In accordance with paragraph (b)(2) of this provision, the Offeror provides with its offer information that the President of the United States has—

(i) Waived application under U.S.C. 2593e(d) or (e); or

(ii) Determined under 22 U.S.C. 2593e(g)(2) that the entity has ceased all activities for which measures were imposed under 22 U.S.C.2593e(b).

(e) Remedies. The certification in paragraph (b)(1) of this provision is a material representation of fact upon which reliance was placed when making award.
