STATEMENT OF WORK
North Texas Veterans Health Care System Dishwasher, Conveyor Type Replacement
Nutrition and Food Services
1. Introduction/Background
The North Texas Veterans Health Care System (VANTHCS) requires the purchase of one
(1) dishwasher, conveyor type for VANTHCS. Located at 4500 Lancaster Rd., Dallas, Texas 75216, as well as uninstalling and disposal of old dishwasher and components and installation of new dishwasher.
2. Objectives
The Dishwashers, Conveyor Type are needed for the Dallas VAMC. These items will be used by Nutrition and Food for their dishwashing needs. There is no need for training on this equipment due this equipment has been used previously at this facility. All work to be done M-F 8-4:30.
3. Scope of Work
Dallas VA Kitchen
Contractor shall provide all tools, equipment, materials, labor, supervision, and transportation to perform the installation of the (1) Dishwasher, Conveyor Type Installation work shall be performed at the Dallas VA Medical Center Bldg. 2, 3rd Floor in specified times and dates; alteration of dates and times is prohibited without prior written approval from the COR or VA point of contact.
Scope of work to consist of remove existing dishwasher, Blower Dryer, and Steam Booster.
Cut portion of clean end table so unit can be removed. Replace with new unit and add in a Water Softening System.
Plumbing - Brought up to City of Dallas Codes
• Lockout/tagout water supply to areas being served.
• On first visit, demo (or remove) old water and steam piping and drains as needed to remove old dishwasher.
• From existing water supply lines, install (2) ¾” RPZA’s and run drain lines to floor drain in center.
• Tie in and route water lines to new dishwasher once assembly is started.
• Make new connections of steam pipe as needed back into new dishwasher, re-using as much as possible.
• Solder new drain lines back into existing drain hubs in floor.
• Test water lines for leaks.
• Clean work areas and remove debris and trash from jobsite.
• Provide permit.
• Follow up inspection to be performed by city.
• Work to be performed during regular working hours Monday through Friday.
Electrical - Supply material, labor and equipment to complete the scope of work per local, state codes and laws for electrical portion. Electrical - will Kill power to existing dish machine in existing 100amp sub panel in dish room.
• Will demo existing circuit from machine back to sub panel.
• Will label existing 30amp breaker as spare.
• Excludes sealing floor or demoed floor conduits to prevent leaks.
• Will run power from riser room/electrical room in sleep center approximately 200’ away.
• Will use existing spare 60amp breaker in panel LKQ CKT 2,4,6.
• Will provide and install 1, new 60amp, 208volt, 3 phase Nema 3R fused disconnect.
• Will install 3, 35amp fuses.
• Will install new load side whip from disconnect to machine.
• Will make all wire terminations.
• Will check and verify rotation and operation.
• Will label disconnect and panel.
• Will clean and remove all trash daily.
Fabrication - Cut existing clean end of the table off at required spot to be able to remove existing dishwasher. Once new unit is set in place reweld end of clean dish table back in place. Remove existing ductwork make adjustment and reconnect to new dishwasher
• New equipment must match the location’s current specifications: electrical, gas lines, plumbing/drains, and venting.
• Installations completed during normal business hours. Monday – Friday; 8:00am – 4:30pm.
• Receipt of equipment at local installer’s office or delivery to facility at a pre-scheduled time.
• Uncrating and set-in place in existing location on the ground level.
• Final hook-ups (within 5 feet) to existing utilities.
• Validation equipment is working properly upon completion of installation
• Removal of packaging materials and rubbish
4. Services Agreement for the Dishwasher
• The contractor shall warrant all services and repair work.
• The contractor shall be responsible and incur all freights costs incurred for the shipments of replacement parts.
• The contractor shall be responsible for employing technically qualif ied personnel to perform the work specified in this Statement of Work.
• The contractor shall maintain the personnel, organization and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements.
• The contractor shall maintain a record of all maintenance and repairs.
5. Additional Requests
The Contractor is responsible as part of the installation process for identifying any utilities needing repair and or replacement and requesting the necessary equipment from the Engineering Service and providing an installation quote. The contractor should be able to accept the government purchase card if necessary, as payment for services less than $2,500.00 with prior approval. All installation, setup work will be completed within one week of request and/or availability of necessary equipment.
6. Summary of Work Provide completed written service report of the work. Information shown in the report shall include the following:
1. Company’s name, address, telephone & FAX numbers.
2. Name and signature of contractors who perform the maintenance and testing.
3. Date and Time of work.
4. Location, Type of service
5. Descriptions of work performed.
7. Contractor Employees
Health: Health Requirements: Contractor’s employees are not required to have a physical examination prior to work on this contract, however, each employee is expected to be in good physical health and able to work in patient use/visit areas without risk to the patients.
No personnel shall be assigned to this contract that are not in good physical health or pose a risk to patients. Contractor’s personnel who acquire a communicable illness will be replaced by the contractor.
All contractors shall clearly display their hospital badge. All personnel shall obtain a VANTHCS issued ID badge prior to starting work. The badge will be displayed on the upper torso, picture side out at all times. Failure to obtain or wear a badge is grounds for removal from site until the situation is resolved, i.e. “No badge, no work.”

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplif ied acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after f inal payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.3 52.217-6 OPTION FOR INCREASED QUANTITY (MAR 1989)
The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within 15 calendar days. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree.

C.4 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)
The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

C.5 VAAR 852.219-73 VA NOTICE OF TOTAL SET-ASIDE FOR CERTIFIED
SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (JAN 2023)
(DEVIATION)
(a) Definition. for the Department of Veterans Affairs, ‘‘Service-disabled Veteran-owned small business concern or SDVOSB’’:
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.201, Surviving Spouse definition);
(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran;
(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identif ied in the solicitation document;
(iv) The business has been certif ied for ownership and control pursuant to 38 U.S.C. 8127, 13 CFR 128, and is listed as certif ied in the SBA certif ication database at https://veterans.certify.sba.gov/; and
(v) The business agrees to comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size, government contracting, and the Veteran Small Business Certif ication Program at 13 CFR parts 121, 125, and 128.
(2) The term ‘‘Service-disabled Veteran’’ means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
(3) The term ‘‘small business concern’’ has the meaning given that term under section 3 of the Small Business Act (15 U.S.C. 632).
(4) The term ‘‘small business concern owned and controlled by Veterans with service-connected disabilities’’ has the meaning given the term ‘‘small business concern owned and controlled by service-disabled veterans’’ under section 3(q)(2) of the Small Business Act (15 U.S.C. 632(q)(2)).
(5) The term “SDVOSB participant” or certified SDVOSB means a small business that has been certif ied in the SBA Veteran Small Business Certif ication Program and listed in the SBA certif ication database (see 13 CFR 128.102).
(b) General. In order for a concern to submit an offer and be eligible for the award of an SDVOSB set-aside or sole source contract, the concern must qualify as a small business concern under the size standard corresponding to the NAICS code assigned to the contract and be listed as an SDVOSB participant in the SBA certif ication database as set forth in 13 CFR 128.
(1) Offers received from entities that are not certif ied SDVOSBs and listed in the SBA certif ication database at the time of offer shall not be considered.
(2) Any award resulting from this solicitation shall be made to a certif ied SDVOSB listed in the SBA certif ication database who is eligible at the time of submission of offer(s) and at the time of award.

(3) The requirements in this clause apply to any contract, order or subcontract where the firm receives a benefit or preference from its designation as an SDVOSB, including set-asides, sole source awards, and evaluation preferences.
(c) Representation. Pursuant to 38 U.S.C. 8127(e), only certif ied SDVOSBs listed in the SBA certif ication database are considered eligible to receive award of a resulting contract. By submitting an offer, the prospective contractor represents that it is an eligible and certif ied SDVOSB as defined in this clause, 13 CFR 121, 125, and 128, and VAAR subpart 819.70.
(d) Agreement/LOS certification. When awarded a contract action, including orders under multipleaward contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size, and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting (LOS) requirements in 13 CFR 121.406(b) and 13 CFR 125.6. For the purpose of limitations on subcontracting, only certif ied SDVOSBs listed in the SBA certif ication database (including independent contractors) shall be considered eligible and/or ‘‘similarly situated’’ (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to comply with the required LOS certif ication requirements in this solicitation (see 852.219–75 or 852.219–76 as applicable). These requirements are summarized as follows:
(1) Services. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not certif ied SDVOSBs listed in the SBA certif ication database (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/ VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
(2) Supplies/products.
(i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certif ied SDVOSBs listed in the SBA certif ication database. When a contract includes both supply and services, the 50 percent limitation shall apply only to the supply portion of the contract.
(ii) In the case of a contract for supplies from a non-manufacturer, the SDVOSB prime contractor will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) has been granted. Refer to 13 CFR 125.6(a)(2)(ii) for guidance pertaining to multiple item procurements.
(3) General construction. In the case of a contract for general construction, the SDVOSB prime contractor will not pay more than 85% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certif ied SDVOSBs listed in the SBA certif ication database.
(4) Special trade construction contractors. In the case of a contract for special trade contractors, no more than 75% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, may be paid to firms that are not certif ied SDVOSBs listed in the SBA certif ication database.
(5) Subcontracting. An SDVOSB subcontractor must meet the NAICS size standard assigned by the prime contractor and be certif ied and listed in the SBA certif ication database to count as similarly situated. Any work that a first tier SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, the cost of materials is excluded and not considered to be subcontracted. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the portion of the contract with the preponderance of the expenditure upon which the assigned NAICS is based. For information and more specific requirements, refer to 13
CFR 125.6.
(e) Required limitations on subcontracting compliance measurement period. An SDVOSB shall comply with the limitations on subcontracting as follows:
[X] By the end of the base term of the contract or order, and then by the end of each subsequent option period; or
[] By the end of the performance period for each order issued under the contract.
(f) Joint ventures. A joint venture may be considered eligible as an SDVOSB if the joint venture complies with the requirements in 13 CFR 128.402 and the managing joint venture partner makes the representations under paragraph (c) of this clause. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants.
(g) Precedence. The VA Veterans First Contracting Program, as defined in VAAR 802.101, subpart 819.70, and this clause, takes precedence over any inconsistencies between the requirements of the SBA Veteran Small Business Certif ication Program and the VA Veterans First Contracting Program.
(h) Misrepresentation. Pursuant to 38 U.S.C. 8127(g), any business concern, including all its principals, that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB status is subject to debarment from contracting with the Department for a period of not less than five years (see VAAR 809.406–2 Causes for Debarment).
