STATEMENT OF WORK

Central Texas Veterans Health Care System Cable Television & Internet Service

Requirements

The Central Texas Veterans Health Care System (CTXVHS) is requesting a Base plus four (4) option years contract of Cable Television and Internet Service. The contractor will be responsible for all labor, materials, and equipment needed to perform this service. The facility needs this service to provide broadcast television and public Wi-Fi to the veterans at the various locations in the Central Texas Veterans Health Care System.

The contractor shall provide all personnel, services, vehicles, transportation, tools, equipment, materials, supplies, facility supervision, administration supervision and any other item(s) necessary to perform and accomplish this service. It is the sole responsibility of the contractor to meet the requirements of this project without any assistance from the Government. The Government will provide access and information only for this project. All equipment must be function tested and verified by COR/VA Team after contract award. All work must comply with federal, state, and local regulations.

“The C&A requirements do not apply, and that a Security Accreditation Package is not required for this contract.”

1. The contractor shall be responsible for providing all labor, materials, and equipment needed for the performance of this service. All equipment must be function tested and verified by COR/VA Team after contract award.

2. The contractor shall provide a fiber/coax based service.

1. The Government hereby provides notice and Contractor hereby acknowledges receipt that Government personnel observe the listed days as holidays:

2. In addition to the days designated as holidays, the Government observes the following days:

a. Any other day designated by Federal Statute

b. Any other day designated by Executive Order

c. Any other day designated by the President’s Proclamation

It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or mailto:Bradley.Arndt@VA.gov mailto:Keith.Pearce1@va.gov other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.

A. Invoices and Payment

1. Payment to be made monthly, in arrears, following satisfactory performance by contractor’s personnel and upon receipt of a properly prepared invoice.

2. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.

3. The contractor shall have current registration in the System for Award Management (SAM) for this solicitation; URL: www.sam.gov and in Veteran Small Business certification (VetCert); URL: https://veterans.certify.sba.gov.

4. The invoice MUST be itemized to include the following information. Any information listed below, and not provided on an invoice, will render that invoice incomplete and the invoice will be returned for immediate correction.

i. Time period being invoiced for.

ii. Description of services performed.

iii. Unit Cost billed.

iv. Extended amount due.

v. Invoice number, date, and amount partial or full

vi. Contract and obligation numbers.

Period of Performance: April 1, 2024, through March 31, 2025, plus four (4) option years.

Codes and Standards The project shall be in accordance with the latest Uniform Building Code (UBC), National Fire Protection Associate (NFPA) standard, Uniform Federal Accessibility Standard (UFAS), Inspectors Manual, VA Specifications and Standards, and local facility requirements. In the event there is a conflict between any of the standards/codes, the more stringent standard/code shall apply.

The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004-012 and all VA Center Policy Memorandums, including but not limited to the following:

(a) Protection of patients, visitors, and employees from traumatic injury, as well as occupational and facility–associated infections.

(b) Compliance with OSHA and State construction safety regulations. Construction contracts require that the general contractor’s on-site “competent person” have completed the OSHA 30-hour construction worker course and that all other general and sub-contractor’s workers have completed the OSHA 10-hour construction worker course or other relevant competency training. The determination for training is based on the project hazards and complexity, State and Federal regulations and VA requirements. Verification of completion of training will be required prior to performing work.

(c) Compliance with EPA and State environmental regulations.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 calendar days of contract expiration.

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days of contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

C.7 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT

REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.

Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

1) Offeror shall submit offers by Due Date/Time specified in Block 8 of the Standard Form (SF) 1449 of the solicitation directly to Jose Campa, Contract Specialist, at Jose.Campa@va.gov.

2) By signing the Standard Form (SF) 1449/Solicitation, Contractor attests acknowledgement of receipt of all solicitation amendments if applicable.

3) Offeror must complete and return the signed SF 1449, first page minimum.

4) Offeror must respond to the representation in paragraph (b)(2) and (v)(2) of Provision

52.212-3.

5) Offer must submit any required evaluation information stated in the Basis for Award.

6) Subject line of e-mail shall be “Quote – 36C25724Q0381 - CTX Cable & Internet”.

*Pricing: Contractor shall submit line item pricing that incorporates all the requirements within the Statement of Work. Contractor shall submit unit prices rounded to the nearest hundredth.

Please ensure unit price and total amounts are correct for Base Year and all option years.

Each Line Item should have the total monthly pricing for all locations as follows: Quantity (12), Unit (MO for Monthly), Unit Price (total monthly pricing for all locations) and Amount (Is the total annual amount).

Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers.

Failure to submit a complete offer may result in a non-responsive determination.

BASIS FOR AWARD

This is a competitive best value selection in which competing offerors' past performance, technical capability and price will be evaluated to determine who represents the greatest benefit to the Government at a price that can be determined fair and reasonable. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement or inability to perform or provide all services requested shall result in an offer being determined technically not capable. The evaluation process shall proceed as follows:

A. Following receipt of quotes, the Government will perform a comparative analysis of the quotes received. The Government will compare quotes to one another to select the quote that best benefits the Government in fulfilling the requirement. The evaluation of Government requirements outlined in this Request for Quote will determine suitability.

B. Contractors may submit more than one quote; however, contractors are strongly encouraged to submit their best technical solutions and prices in response to this request for quote. Offerors are encouraged to clearly demonstrate in their quote how their approach provides a better value to the Government beyond that of the minimum requirements.

C. Once the Government determines there is/are a contractor(s) that can provide a service that meet(s) the requirements of this request for quote, the Government reserves the right to mailto:Jose.Campa@va.gov communicate with only those contractors quoting the best-suited service to address any remaining issues.

D. The Government will evaluate quotes for award purposes using the following factors:

FACTOR 1: Past Performance

The Contractor shall provide the following documentation with their offer:

a. This factor considers the quality of the Offeror’s past performance in carrying out relevant work. Emphasis will be on recent, relevant past performance. Recent is defined as work performed within the last 5 years. Relevant is defined as work similar in size and scope of the work described in the Statement of Work.

b. The following information should be included. (a) Agency/Company name. (b) Contract Dollar Value. (c) Period of Performance. (d) Name, Address, e-mail address, telephone & fax number of the reference.

c. Past performance information may also be obtained from other sources available to the Government to include, but not limited to, CPARS (Contractor Performance Assessment Reporting System) or other databases, interviews with Program Managers, and other Contracting Officers. Lack of past performance will not be considered a “negative.”

d. Offerors with no Past Performance will not receive a favorable nor Unfavorable evaluation for this.

FACTOR 2: Technical Capability

The Contractor shall provide the following documentation with their offer:

1. Technical Capability Statement:

• Which can validate Technical Capability and explain technical approach.

• Documentation should address technical specs IAW the Statement of Work.

• Provide explanation of how contract management, communication and collaboration with the Government, documentation, and reporting, and overall technical approach will function to meet the requirements in the Statement of Work.

FACTOR 3: Price

The Contractor shall provide the following documentation with their offer:

• Pricing: Contractor shall submit unit prices rounded to the nearest hundredth. Please ensure unit price and total amounts are correct.

• Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers.

• Prices will be evaluated for completeness and reasonableness.

The Government reserves the right to amend the solicitation and remove any set-aside should pricing of all quotes be found unreasonable during the comparative evaluation process.

E. For the purposes of the award of this requirement, the Government intends to evaluate the Option to Extend Services under FAR 52.217-8 as follows:

The evaluation will consider the possibility that the option can be exercised at any time and can be exercised in increments of one to six months, but not for more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract at the time the option is exercised. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price of all offers relative to each other will not affect the ranking of offers based on price, unless, after reviewing the offers, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.

F. For the purposes of the award of this requirement, the Government intends to evaluate the Option to Extend the Term of the Contract under FAR 52.217-9 as follows:

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s).

G. The Government intends to award a contract without discussions with respective offerors.

The Government, however, reserves the right to conduct discussions if deemed in its best interest.
