3. INVOICES:

c. The VA has mandated electronic invoice submission to the Veterans Affairs Financial Services Center (VAFSC). VAFSC has partnered with Tungsten Network e-Invoicing network, for submissions of all electronic invoices to VA. Tungsten Network electronic invoicing is free to all VA vendors. In order to submit electronic invoices, all VA vendors must register with Tungsten Network by submitting an email to VA.Registration@Tungsten-Network.com or calling 1-877-752-0900 option 2 for Enrollment.

d. Contractor shall submit an electronic invoice by the tenth (10th) of the following month services were performed to the Veterans Affairs Financial Services Center (VAFSC) e-Invoice through the website at https://portal.Tungsten-Network.com/Login.aspx. For questions regarding the submission of VA electronic invoices, Tungsten Network customer service may be contacted at 1-877-489-6135.

e. All invoices shall reference the vendor name and address, customer name, contract number, appropriate obligation/funding order number, description of services provided, quantity, unit price, and total invoice amount (any additional info). Invoices shall also include any payment discount terms.

4. GOVERNMENT INVOICE ADDRESS (See SF1449 Block 18):

a. All invoices from the contractor shall be submitted electronically in accordance with 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

b. Facsimile, e-mail, and scanned documents are not acceptable forms of submission for payment requests.

c. VA’s Electronic Invoice Presentment and Payment System – The Veterans Affairs Financial Services Center (VAFSC) uses a third-party contractor, Tungsten Network e-Invoice, to transition vendors from paper to electronic invoice submission. Please go to this website: http://www.tungsten-network.com/customer-campaigns/veterans-affairs-us/ to begin submitting electronic invoices, free of charge.

d. As of July 1, 2020, the VA10091 form has been eliminated and the VAFSC is requiring our vendors to update and add their information in the Customer Engagement Portal (CEP) at https://www.cep.fsc.va.gov/. This is for new vendors being added to FMS only.

5. ACQUISITION OF COMMERCIAL ITEMS:

This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. FAR Part 15 will not be used. The procedures in Part 12 used in conjunction with Part 13 allow the Government to procure services resembling those in the commercial marketplace and streamline the procurement process. From this RFQ, the Government intends to award a firm fixed price contract where the contractor provides a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract.

6. RFQ QUESTIONS:

In order to maintain integrity of this solicitation and subsequent award date, all offerors are advised that any question and answer requests must be submitted in a written form via e-mail to the Contracting Officer brandon.harris@va.gov no later than TUESDAY, AUGUST 24th AT 3:00 PM LOCAL TIME. Contracting will issue a consolidated response via solicitation amendment to https://sam.gov Contract Opportunities.

7. CONTRACTING OFFICER AUTHORITY:

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.

8. IDENTIFICATION, PARKING, SMOKING AND VA REGULATIONS:

a. All VA property is considered Federal property and all Federal laws are applicable.

b. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VA will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.

c. All VA facilities are drug free. Possession of drugs, to include Marijuana and all Marijuana bi-products are prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

d. All contractor personnel are required to adhere to all VA rules and regulations.

e. Smoking is prohibited on the entire campus, both inside and outside the VA Facility

f. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

g. VHA DIRECTIVE 1192: This Veterans Health Administration (VHA) directive establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities through the vaccination or masking of health care personnel (HCP). AUTHORITY: Title 38 United States Code (U.S.C.) 7301(b), 7318(b). Contractor is responsible in ensuring that all aspects of this directive are implemented, including providing face masks and influenza vaccines for all employees working at a VA facility.

B.3 STATEMENT OF WORK

1. Background.

The mission of the Department of Veterans Affairs (DVA) is to provide the highest quality health care to our nation’s veterans. In order to accomplish this mission, we must protect the health and safety of patients, employees, and visitors. Recent cases of healthcare-associated Legionella disease in VHA facilities have served to remind us that we must continue to enhance our Legionella prevention activities within our network.

The Veterans Health Administration (VHA) currently has one of the most comprehensive Legionella prevention policies in the country. In an effort to enhance our program, we intend to contract the potable water testing for 13 Buildings located at the Captain James A. Lovell – Federal Health Care Center (Lovell – FHCC) in North Chicago, Illinois and 2 buildings located at the Jesse Brown VA Medical Center (VAMC) in Chicago, Illinois that host overnight stay, with the goal of preventing legionellosis associated with building water systems.

2. Scope.

a. The Contractor shall provide all labor, materials, supervision, and transportation to sample and test potable water systems to comply with VHA Directive 1061 for the presence of Legionella bacteria. Analysis will include the culture, identification, enumeration, and designation of positive results of Legionella species into the following summary: Legionella pneumophila serogroup 1, Legionella pneumophila serogroups 2-14, Non-pneumophila Legionella species L. longbeachae 1 and 2, L. bozemanii 1 and 2, L. dumoffii, L. gormanii, L. jordanis, L. micdadei, and L. anisa.”

b. The laboratory shall provide a report indicating the analytical results for each sample submitted. This report will be completed in an electronic format (MS Excel), see attachment.

c. Results will be calculated in terms of colony forming units (CFU).

d. The Contractor shall properly preserve all positive samples and protocol records kept for final Quality Assurance/Quality Control (QA/QC).

e. The laboratory must demonstrate proficiency by the Centers for Disease Control and Prevention (CDC) Environmental Legionella Isolation Techniques Evaluation (ELITE) program or the Public Health England (PHE) Legionella External Quality Assessment (EQA) scheme at performing the culture of Legionella from environmental samples.

f. The COR or designee at each location shall escort the Contractor during the sample collection.

g. The vendor shall have the availably to provide all testing services within 4 days of notification.

3. Task Identification.

a. The Contractor shall take samples from the following locations:

i. Lovell, FHCC - 20 water samples (first draw) per building. Buildings include: 7, 11, 66, 131, 132, 133, 133CA, 133EF, 134, 201, 202, 205 and 206, for a total of 260 quarterly samples. At least two (2) samples of the 20 samples must be from an ice machine or other pure cold-water source. At least two (2) of the 20 samples must be from a pure hot water source (i.e., no mixing valve present), if such water outlets are available. For the reminder of the 20 samples, where a mixing valve is in place at the outlet, the first draw sample is considered a mixed hot/cold (“mixed”) water sample. If no mixing valve is in place at the outlet, take the first draw sample from either the hot or cold side. At the time each water sample is collected, test and record the following for each sample: Location, hot, cold, or mixed water sample, water temperature, level of residual biocide, and pH.

ii. Jesse Brown VAMC - 20 water samples (first draw) per building. Buildings included in this work include: Building 11 (Damen) and building 40 (Bed Tower), for a total of 40 quarterly samples. At least two (2) samples of the 20 samples must be from an ice machine or other pure cold-water source. At least two (2) of the 20 samples must be from a pure hot water source (i.e., no mixing valve present), if such water outlets are available. For the reminder of the 20 samples, where a mixing valve is in place at the outlet, the first draw sample is considered a mixed hot/cold (“mixed”) water sample. If no mixing valve is in place at the outlet, take the first draw sample from either the hot or cold side. At the time each water sample is collected, test and record the following for each sample: Location, hot, cold, or mixed water sample, water temperature, level of residual biocide, and pH.

iii. The Contractor is required to resample all positive results using the same procedure until negative results are achieved at each location.

b. Scheduling for the retesting of positive results will be coordinated by the Contracting Officer Representative (COR). The Contractor shall provide all testing services within 4 days of notification.

4. Time Frames and Deliverables.

All environmental water lab analysis reports including retests will include: signed Chain of Custody forms for each sample batch submitted; dates for: sampling, transportation, receipt in the lab and sampling date; sample number; client information; volume submitted and processed; method; identification of Legionella bacteria.

Laboratory will provide certified testing results to the COR within 12 days of sample receipt by the laboratory. The contractor shall notify the COR as soon as any positive results are identified during incubation period.

5. Hours of Operation.

Sample collection for testing shall occur between the hours of 7:00am to 4:00pm Monday – Friday, excluding Federal Holidays listed below and any other day specifically declared by the President of the United States to be a Federal Holiday.

When a holiday falls on a Sunday, the following Monday shall be observed as a legal holiday by U.S. Government agencies. When a holiday falls on a Saturday, the preceding Friday shall be observed as a legal holiday.

6. Performance Monitoring.

The COR shall be responsible for monitoring the Contractor's performance. Performance deficiencies or poor performance identified during the term of the contract shall be documented by the COR and reported to the Contracting Officer and the Contractor. Upon notification of deficiencies or poor performance, the Contractor will be given a reasonable time to take corrective action. If determined appropriate, the Contracting Officer, COR and/or other VA staff members shall meet with representatives of the Contractor to review performance and resolve issues. All deficiencies or poor performance shall be documented and MUST be corrected within the timeframe specified in the letter of concern or cure notice. The Contractor shall notify the Contracting Officer and the COR when correction(s) have been made. If the appropriate correction is not made within the timeframe specified in the letter of concern or cure notice, the Government shall have the right to terminate the contract in it is entirety. Nothing in this section is intended to modify or waive the government’s rights outlined in 52.212-4.

7. Security & Privacy Control.

The Certification & Accreditation (C&A) requirements of VHA Handbook 6500.6 do not apply to this requirement; therefore, a Security Accreditation Package is not required. No C&A or MOU/ISA is required. Sensitive information exposure as part of this contract involves applicable security controls within the facility as part of the VA Information Security.

In accordance with VA Handbook 710, VISN Policy Memorandum 10N12-05-12 R3, Personnel Suitability and Security Procedures and Homeland Security Presidential Directive- 12 (HSPD-12) Personal Identity Verification (PIV), all new selectees, trainees, without compensation employees (WOCS), volunteers, and contractors are required to be fingerprinted prior to BOTH the designation of a firm Entry on Duty (EOD) and must have a favorable adjudicated SAC prior to entry on duty.

All individuals who work at or for the VA, whether they are paid or unpaid, with access to VA information systems, will be subject to background screenings prior to being granted such access. Background screenings include procedures used to verify the accuracy of an individual’s identification, credentials, and employment history. Background screenings do not constitute or substitute for any required background investigation.

If a selectee is found unsuitable, the Suitability Specialist will notify the Branch Chief/Services Chief, Contracting Officer Representatives (CORs), Chief of Voluntary Services, and the Great Lakes Acquisition Center (GLAC) of the findings.

8. Government-Furnished Equipment (GFE)/Government-Furnished Information (GFI).

VHA Directive 1061 shall form a guideline for the tasks required.

9. Other Pertinent Information or Special Considerations.

Contractor personnel shall be certified by appropriate federal and state regulatory agencies to meet federal and local certification requirements in calibrating test equipment as applicable. All licenses and permits shall be kept current throughout the period of performance of the contract. The Contractor shall provide the Government copies of such certificates upon request.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days.

(a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Definition. “Similarly situated entity,” as used in this clause, means a first-tier subcontractor, including an independent contractor, that—

(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and

(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.

(c) Applicability. This clause applies only to—

(1) Contracts that have been set aside for any of the small business concerns identified in 19.000(a)(3);

(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);

(3) Contracts that have been awarded on a sole-source basis in accordance with subparts 19.8, 19.13, 19.14, and 19.15;

(d) Independent contractors. An independent contractor shall be considered a subcontractor.

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that, in performance of a contract assigned a North American Industry Classification System (NAICS) code for—

(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract;

(2) Supplies (other than procurement from a non-manufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract;

(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 85 percent subcontract amount that cannot be exceeded; or

(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 75 percent subcontract amount that cannot be exceeded.

(f) The Contractor shall comply with the limitations on subcontracting as follows:

(1) For contracts, in accordance with paragraphs (c)(1), (2), (3), and (6) of this clause— X By the end of the base term of the contract and then by the end of each subsequent option period; or _ By the end of the performance period for each order issued under the contract.

(g) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (e) of this clause will be performed by the aggregate of the joint venture participants.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. (e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
