B.2 STATEMENT OF WORK

General: This is a non-personal services contract to provide semi-annual preventative maintenance, troubleshooting, and tuning services of 3 Williams Davis 250 hp gas fired boilers for the Columbus, Ohio Chalmers P Wylie VA Ambulatory Care Center (VAACC). The Supervisory Control and Data Acquisition (SCADA) system installed is SCADA/Flex Distributed Control from Preferred Utilities Manufacturing Corporation.

Place of Performance: Energy Center at the Chalmers P. Wylie VA Ambulatory Care Center 420 North James Road, Columbus Ohio 43219 Hours of Operation: 0700-1600 Eastern Standard Time Monday through Friday, except Federal Holidays, unless other arrangements are requested to and accepted by the Point of Contact (POC).

Work Schedule: Prior to commencing performance under this contract, the Contractor shall provide a proposed work schedule to the POC describing how services will be accomplished. All work shall be coordinated with the POC or designated representative to avoid disruptions or conflicts between the Government functions and the provision of service under this contract.

Scope of Work: Chalmers P. Wylie VAACC has a requirement for semi-annual preventative maintenance, troubleshooting and tuning of 3 250 HP boilers hereafter referred to as PM Services.

Contract Changes: Additional changes in the scope of work must be documented by a written contract modification. If the contractor receives a request from VA personnel directing or requesting work that the contractor believes is not within the terms of the SOW or the contract, then the contractor must notify the Point of Contact (POC) and the Contracting Officer of the request. The only person that has the authority to modify the terms of the contract or request work for which compensation will be provided is a Contracting Officer.

Reference Materials:

The “Qualified Boiler Technician” shall demonstrate familiarity with and ready access to the current versions of the following codes and manuals:

The VAACC shall comply with requirements of the technician that are considered reasonable by VAACC and have been presented in writing at least two weeks prior to the scheduled PM service.

The Contractor shall develop a mutual scheduling agreement with the VAACC to ensure adequate lead time to allow for any pre-boiler PM services preparation required.

The Qualified Boiler Technician shall perform all required preventative maintenance checks and services per guidance published in boiler operation and maintenance manual. PM services shall comply with industry recognized methods for testing safety devices and with VHA Boiler Plant Safety Device Testing Manual, Latest Edition.

The Qualified Boiler Technician shall perform diagnostic troubleshooting of issues via is SCADA/Flex Distributed Control from Preferred Utilities Manufacturing Corporation.

The Qualified Boiler Technician will tune boilers and ancillary devices and meet VHA Directive 1810 (latest version). Tunning must be done on both Natural Gas and #2 Fuel oil.

The Qualified Boiler Technician shall provide any updates to the Supervisory Control and Data Acquisition (SCADA), the boiler control system.

Boiler plant safety, reliability, efficiency, and equipment longevity are paramount concerns of VAACC management. Boilers and feedwater deaerators are pressurized devices containing steam and hot water. They can fail catastrophically causing injuries and death and massive property damage. Regular PM services by experts are an essential part of a program to address these concerns.

This “Performance Work Statement” describes the requirements for the boiler PM services and inspections to be performed by “Qualified Boiler Technician” under contract.

Contractor Personnel:

1. Prior to beginning performance under this contract, the Contractor shall provide the following:

a) List of employees who will provide services under this contract.

b) List of shift supervisors as applicable.

2. When applicable the Contractor shall notify the POC in writing whenever there is a change of personnel appointed to fulfill supervisory or shift leader function or when there is a planned absence of key personnel.

3. The Contractor shall not consume food, snacks, drinks or tobacco products except during specified break periods in appropriate designated break areas only.

4. The Contractor is responsible for compliance with all appropriate Joint Commission record keeping requirements.

5. The Contractor shall also be responsible for adhering to all requirements under the Privacy Act due to the possibility that confidential medical record information may be accessible and/or visible to contractor employees during performance of their daily duties. When required the Contractor shall obtain a signed “Confidentiality Certificate” from each employee prior to allowing them to start work under this contract. The contractor shall keep a copy of confidentiality certificate on site for inspection purposes.

6. The Contractor is not required to have physical examination prior to work on this contract; however, the Contractor is expected to be in good physical health and able to work in a physical plant environment. The Contractor shall not be assigned to this contract if not in good physical health or pose a risk to themselves or others. The Contractor who acquires a communicable illness shall not perform service under the contract and shall be free of illness before returning to work.

Building Security:

1. Keys, if needed, will be made available for the contactor to pick up and return daily for access to all areas and rooms requiring cleaning. Keys provided to the contractor shall not be duplicated and must be returned at the end of each shift. In the event a key is lost or duplicated, all locks and keys on that system shall be replaced by the Government. The contractor shall be responsible for the total cost involved in replacing keys and cores. The contractor shall be responsible for immediately reporting the occurrence of a lost or duplicated key to the POC or his/her designee.

2. Contractor employees shall not allow any unauthorized person the use of any Columbus VAACC facility key in their possession. They shall not open locked rooms or areas to permit entrance by persons other than contractor employees performing assigned duties. All rooms/areas to which contractor personnel are provided access locked shall not be left unattended during the cleaning process and shall be relocked by contractor personnel after completing cleaning duties.

3. Contractor personnel shall turn off all lights in unoccupied areas after cleaning is performed. Unsecure areas are secured, and windows are closed and locked, the POC or his/her designee shall be notified of any unlocked doors or windows during his/her duty hours.

Safety:

1. If asked/required the contractor shall display warning signs that have been approved by the POC in all areas where maintenance operations may cause traffic obstruction or personnel hazard.

Contractor’s Attire and Identification:

1. The Contractor shall wear attire appropriate for work to be safely conducted. The Contractor shall wear appropriate footwear that will cover the entire foot for safety purposes.

2. Identification Tags/Cards. If required the Contractor shall wear on the front of the uniform, clearly readable name identification (ID) logo identifying the contractor’s and employee’s name. The Government will issue ID cards to the Contractor after background checks have been completed. The Contractor shall obtain “Visitors’ Badges” during the interim period via VA Police or Human Resource Department.

3. Contractor’s Personal Hygiene: The Contractor’s attire and presentation shall be appropriate per industry standard.

Fire Prevention and Emergency Procedures:

1. The Contractor shall take such safety precautions as necessary to protect the lives and health of occupants of the buildings.

2. Any hazardous incidents created by the Contractor shall be corrected immediately.

3. The Contractor shall comply with applicable Federal, State, Local and facility safety and fire regulations and codes which are in effect at the beginning of the contract period. The Contractor shall keep abreast of and comply with changes in these regulations and codes applicable to the contract.

4. The Contractor shall follow applicable facility policies concerning fire and/or disaster events.

5. Posting Warning Signs: The Contractor shall display warning/caution signage provided by the VA in all areas where operations may cause traffic obstruction or personnel hazard.

Interference to Normal Function:

The Contractor shall delay or interrupt their work at any time to avoid interference with patient care procedures and the normal function of the facility, including utility services, fire protection systems, and passage of facility patients, personnel, equipment, and carts.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

(End of Clause) C.5 VAAR 852.215-70 SERVICE-DISABLED VETERAN-OWNED AND VETERAN-OWNED SMALL BUSINESS EVALUATION FACTORS (JAN 2023) (DEVIATION)

(a) In an effort to achieve socioeconomic small business goals, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business certification status and their proposed use of eligible certified service-disabled veteran-owned small businesses (SDVOSBs) and certified veteran-owned small businesses (VOSBs) as subcontractors.

(b) Eligible and certified service-disabled veteran-owned small businesses offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the certified Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor. To receive credit, an offeror must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database on the SBA Veteran Small Business Certification Program portal at https://veterans.certify.sba.gov/ (see 13 CFR 128) and be otherwise eligible in accordance with SBA size standards for the acquisition and limitations on subcontracting requirements set forth in SBA regulations (see 13 CFR 121, 125 and 128.).

(c) Non-Veteran offerors proposing to use certified SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the certified SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database.

C.7 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

E.2 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

E.3 Basis for Award

Award will be based upon the best overall value to the Government considering the evaluation factors listed below utilizing Comparative Evaluation procedures.

The Government will evaluate quotations using the comparative evaluation process, where quotations will be compared to one another to determine which provides the best benefit to the Government. The Government reserves the right to consider a quotation other than the lowest price that provides additional benefit(s). Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides benefit to the Government that exceeds the minimum requirements of the solicitation but is not required to do so. Each response must meet the minimum requirements of the solicitation.

The Government may determine that a quote is unacceptable if the quoted prices are significantly unbalanced or not all required information is provided.

Questions/Clarifications: In order to maintain integrity, all quoters are advised that any questions/clarifications shall be submitted in written form via email to the Contracting Officer designated in the solicitation and shall be received no later than May 12, 2025. Questions after that date may not be accepted.

Preparation of Quotes: The Government shall not pay any costs incurred in preparation and submission of quotes.

The Items identified below detail the criteria that will be required to be included in the submission of a quote package for consideration for award. Quotes should ensure that there is enough information in addition to the required information below to adequately describe how the quoter expects to meet or exceed the requirements identified in the Performance Work Statement. Failure to meet any requirement established in this RFQ may result in rejection of the quote.
