CONTINUATION PAGE

1. If we are unable to bill the VA for the contractor owned equipment refused to be returned by the patient/caregiver, may the contractor contact local authorities to provide assistance in recovering contractor’s asset?

A. Government Response:

VA is not involved and is not providing legal advice about their respective rights. The Government is editing Section 4.27 of the Performance Work Statement, Loss or Damaged Equipment.

Current language:

Section 4.27 of the PWS.

4.27 LOSS OR DAMAGED EQUIPMENT:

The VA will not pay for the Contractor’s lost or damaged equipment provided under this contract except for contractor equipment that is stored at the VAMC and may be lost or damaged by VA employees within the scope of their official duties. Accordingly, this is considered to be the cost of doing business, and is the requirement of the Contractor to pay for this type of equipment.

New/Updated language:

4.27 LOSS OR DAMAGED EQUIPMENT:

The VA will not pay for the Contractor’s lost or damaged equipment provided under this contract except for contractor equipment that is stored at the VAMC and may be lost or damaged by VA employees within the scope of their official duties.

1. Should the VA not approve to pay for the equipment not returned, may the contractor bill the patient directly?

A. Government Response:

VA is not involved and is not providing legal advice about their respective rights.

1. “In the Instructions to Offerors, under Factor 2 Quality Control Program, it states, Describe the mechanism to schedule and maintain qualified professional staff to cover the required clinic schedule.”

Can you explain where the required clinic schedule is addressed in the PWS?

A. Government Response: The language has been amended in the Evaluation Factors and Submission Instructions under Factor 2. The language is highlighted in yellow.

New factor will read as, “Describe the mechanism to schedule and maintain qualified professional staff to cover the required workload and service response times specified in this contract.”
