A.1 STATEMENT OF WORK

SCOPE OF WORK

Improve Patient Spaces 1A Renovate/Replace Original Finishes 548-18-601 Department of Veterans Affairs (VA) Veterans Integrated Service Network (VISN) 8 West Palm Beach VA Medical Center (VAMC), Florida

1.0 Overview:

Building-1 area 1A has original finishes that is highly visible traffic area for Veterans, Family and Patients. This project will provide better access as well new finishes. The areas include Telehealth, Enrollment, Compensation & Pension, Post Deployment and Women’s Clinic. West Palm Beach VA Medical Center strives to support both patients and staff in a healthcare setting. Protection of patient’s, visitor’s and staff’s health from risks associated with the environment and construction activities is the highest priority.

2.0 Design/Build:

The contractor will provide design and build services. There are 27,000 square feet (sf) of finishes that include new doors, wall finishes, floors, ceilings, lighting, diffusers/grills and wall protection. Included in the project is approximately 7,000 sf of area that is to be studied, designed and remodeled to improve Women’s Health and add additional office space.

The work generally includes but is not limited to:

a. The contractor shall be responsible for taking and applying accurate field measurements including all mechanical and electrical services for the area. Notification to the Contracting Officer’s Representative (COR) if services are undersized to meet the project needs.

b. The contractor shall submit a detailed phasing plan for approval by the COR to include infection control risk assessment (ICRA) (see attached), transition time of up to 15 days between phases.

c. At the end of each daily shift, spaces must be patient ready.

d. Area shall be broom swept/mopped hourly or as needed to maintain a clean hospital environment.

e. Contractor shall remove, protect, store, in a Medical Center provided area, and reinstall all signage, artwork and other similar wall mounted items.

f. Trim plates within the area of work, at electrical and fire devices, shall be removed and replaced.

g. All materials must be on site before demolition of existing materials commencements. An appropriately sized lay-down area with reasonable proximity to the Medical Center will be provided for use.

h. Contractor employees shall be required to maintain a professional appearance including a shirt bearing the company logo. All contractor employees will be required to acquire and wear approved Medical Center Contractor badge. Per Medical Center policy, badge must be visible and located above the waist.

2.1 Designs: The project design will have four phases.

a. Phase I - Programing: The contractor will meet with the VA staff to determine the size and function of each department that is to be developed. Provide an approved program that the meets the space and VA needs. Include phasing criteria.

b. Phase II - Schematic: Provide multiple schemes that meet approved program. Include cost and phasing plan and any mechanical/electrical systems. The approved scheme must be approved by the design IPT prior to moving into the next phase of the project. The final Scheme must include a 50% drawing and specification set for review. Include a 21 day VA drawing review.

c. Phase III - Design Development (DD): With an approved schematic plan, meetings are to be scheduled with end user to finalize room layout. The final DD drawings must be approved by the design team, with a 95% drawing and specification review process. Include a 21 day VA drawing/Specification review.

d. Phase IV - Construction Documentation: Finalize drawings and specifications to be used for construction.

2.2 Deliverables:

The designs must be done in AutoCAD REVIT, review set and final set must be in AutoCAD 12 compatible. The finale set of drawings will include one set of full scale drawings, a half size, and electronic version of the AutoCAD and REVIT model. Each phase of the project must include a full and a half set of drawings.

The work generally includes but is not limited to:

3.0 Safety:

The Contractor will be required to verify that safety equipment is OSHA approved and that the employees have been trained on the proper use of this equipment. The Contractor will be required to follow all safety policies as set forth by OSHA in reference to this type of work. The Contractor will be required to provide the above information as well as a safety plan in performing this work. Failure to provide this information will not be reason for additional time or delay claim for the Contract. Superintendent and all sub-contractor supervisors must submit current OSHA 30-hour training certificates. All others must submit current OSHA 10-hour training certificates. Temporary construction partitions must meet the guidelines set forth in the ICRA specific to the Contract.

4.0 Phasing Plan:

The contractor shall be required to provide the Contracting Officer a phasing plan to perform this contract. The Contractor shall be required to update this plan on a regular basis and submit to the Contracting Officer.

5.0 Project Performance Time:

The total contractor performance period shall be 365 calendar days which includes the time required for all submittals, procurement of materials, construction activities, and inspections. All submittals will be returned to the Contractor within two (2) weeks of submission. Disapproved submittals are not reason for additional time or delay claim for the Contract. After work begins on the site, the Contractor shall work continuously during approved work hours. A superintendent dedicated to this contractor shall be present on-site at all times while work is being performed. The Contractor shall perform the work at the site from Monday through Friday from 4:00 AM to 12:00 AM, unless modified. The contractor shall not have access to the site for performance of any portion of the work beyond these hours, during Federal Holidays nor weekends without prior approval by COR.

5.1 Coordination:

Shutdown of utilities must be coordinated with the COR with a minimum of two (2) weeks’ notice.

6.0 Receipt of Materials:

Address all shipment of materials and supplies to the Contractor – not the Government. The Contractor must be on hand to accept shipments; the Government will not accept deliveries on the behalf of the Contractor.

7.0 Specific Environmental Requirements:

The Contractor is responsible for ensuring that materials and supplies are in accordance with VA policy for no or low Volatile Organic Compounds (VOC).

8.0 Warranties:

The Contractor will provide a one-year warranty covering all material and labor upon approved final inspection. The Contractor shall be responsible for restoring the area to its original condition at the completion of the work. The Contractor shall be responsible for repair of any damage incurred to buildings or property as a result of construction activities.

9.0 Clean-up and Disposal:

The Contractor shall be responsible for the removal and disposal of all trash/debris connected with construction activities on a daily basis. The Medical Center will provide access to necessary dumpsters. Recyclable products shall be disposed of in accordance with applicable statutes, in respective containers.

Two-Phase Design-Build Selection and Evaluation Procedures This part describes the procedures for evaluating and selecting offers for this two-phase design-build requirement for Project #548-18-601 entitled “DB Improve Patient Space 1A.”

1. Phase I Proposal Preparation and Submission Instructions:

1. Phase I Evaluation Factors and Proposal Requirements: (Phase I Proposal shall include) A. Factor 1: TECHNICAL APPROACH - 3 pages max.

(1) Include narrative describing technical methods and procedures (not to include a detailed design or technical information) the firm will employ to develop the project to achieve the Statement of Work and design criteria objectives. (3) Submit copy of current, valid General Contractor License issued by any United States federal, state, or local government agency for Construction Contractor, who will be of record.

(4) Submit copy of current, valid Architect’s or Engineer’s License as applicable, issued by the state of Florida for Architectural/Engineering Contractor, who will be of record.

(5) Disclose any and all negative licensing information and any pending litigation involving either the Architectural Contractor/firm or Construction Contractor/firm.

(6) Identity of Associations and Firm relationships: If there is a joint venture association of firms, identify the individual firms, describe the nature of the association and clearly identify contractual responsibilities of each firm. If your Firm is a construction contractor and a decision has been made to award a subcontract to an Architect-Engineer or multiple design firms for the design, the narrative shall clearly identify all firms and contractual responsibilities established between all firms. If your Firm is an Architect-Engineer Firm and a decision has been made to award a subcontract to a construction contractor the narrative shall clearly identify all firms and contractual responsibilities established between all firms.

C. Factor 3: EXPERIENCE (Offerors to use Attached Experience Form)

(1)The Government will evaluate the offeror’s prior experience as a Prime Contractor and as stipulated in below. The offeror shall complete and submit a minimum of two (2), but no more than five (5) Contractor Experience’ forms. The forms shall be used to provide descriptions of projects which show Contractor experience. “Same or similar” as referenced below, is defined as experience on projects that are the same or similar in size, scope, complexity and dollar magnitude as the project described in the solicitation. Contractor Experience blocks must be completed and all data must be accurate, current, and complete. Offerors must meet all of the following standards to receive an acceptable rating on this factor:
a.At least one (1) of the projects submitted must be the same or similar to the project described in the solicitation.
b.All projects submitted must be at least 50% complete.
c.At least one (1) of the projects submitted must be valued at between $1,000,000 and $10,000,000 in value AND within the last five (5) years.
d.At least one (1) project must design build performed at a healthcare facility.
e.At least one (1) project must identify both or either of the following Experience categories:
i.Team Experience: Provide experience form for project(s) that the designer and Prime Contractor have contractually teamed together, within the last five (5) years to accomplish.

a) Contractor/Key Subs and/or Designer: Include examples, within the last three (3) years (five (5) years for design firms), of design/build projects, in which the designer and/or contractor or key trade subcontractors have been involved, if any.

b) Joint Ventures: If Offeror represents the combining of two (2) or more companies for the purpose of this RFP, then each company must provide an experience form identifying project examples, related to its role for this project.

ii.Design Firm(s) Experience: Provide experience form of project(s), within the last 5 years, in which each design firm has been involved, which are similar in scope and magnitude to their role on this project.
f.One (1) project can be used to satisfy multiple features or activities. Each offer is required to submit at least two (2) but not more than five (5) ‘Contractor Experience’ forms. Regardless of the number of forms submitted (not to exceed 5), the offeror must demonstrate all of the above features/activities.
g.Experience provided MUST be verifiable using the Point of Contact (POC) provided on Experience forms. It is the offeror’s responsibility to ensure the Government will be able to contact the POCs using the contact information listed on the experience form. Unverifiable POC information may lead to a lower rating for experience.

1. Phase I Evaluation and Selection Criteria – Order of Importance:

A. The factors for Phase I consist of Factors one (1) thru three (3), described above and will be rated using an adjectival rating system. The Technical Factors when combined are approximately equal to Price.

SUBMISSION REQUIREMENTS

(1)The offeror shall provide past performance information for each project submitted on “Experience Information Form” under Phase I Factor 3. It is the offeror’s responsibility to ensure the Government will be able to contact the POCs using the contact information provided.
(2)If the project provided has a CPAR, it must be used by the offeror to demonstrate past performance. If CPAR submission is used to validate past performance, it will be the most recent evaluation in the system (i.e. for projects submitted as completed, the final 100% completed CPAR will be provided).
(3)If the CPAR is used, the Government reserves the right to check the Past Performance Information Retrieval System (PPIRS) to verify the accuracy of the CPAR submitted. CPARs submitted by the offeror which do not match those in the system, or for which there is a more current CPAR available, may cause the offeror to receive an “Unacceptable” for this factor.
(4)The Government reserves the right to use past performance information obtained from sources other than those identified by the offeror.
(5)The Government may not obtain information from any or all of the listed contract references and/or may not contact all of the identified POCs
(6)Note: Subcontractor’s Consent – Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with proposal, a letter of consent from referenced subcontractors authorizing release of their past performance information for this requirement.

D. Factor 4 : Price Proposal The Government will evaluate price based on the total price. Total price consists of the basic requirement may include alternate bid items such as, deductive, or options.

2.2 52.215-1 INSTRUCTIONS TO OFFERORS—COMPETITIVE ACQUISITION (JAN 2017)

(a) Definitions. As used in this provision— Discussions are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer’s discretion, result in the offeror being allowed to revise its proposal.

In writing, writing, or written means any worded or numbered expression that can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

Proposal modification is a change made to a proposal before the solicitation’s closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

Proposal revision is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

Time, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals.

(1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror. Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) The first page of the proposal must show—

(i) The solicitation number;

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority, unless that evidence has been previously furnished to the issuing office.

(3) Submission, modification, revision, and withdrawal of proposals.

(i) Offerors are responsible for submitting proposals, and any modifications or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.

(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.

(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.

(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.

(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.

(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).

(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall—

(1) Mark the title page with the following legend:

This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed—in whole or in part—for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of—or in connection with—the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and

(2) Mark each sheet of data it wishes to restrict with the following legend:

Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.

(f) Contract award.

(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.

(2) The Government may reject any or all proposals if such action is in the Government’s interest.

(3) The Government may waive informalities and minor irregularities in proposals received.

(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.

(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government’s best interest to do so.

(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.

(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.

(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.

(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(i) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.

(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(iv) A summary of the rationale for award.

(v) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

2.3 52.215-5 FACSIMILE PROPOSALS (OCT 1997)

(a) Definition. "Facsimile proposal," as used in this provision, means a proposal, revision or modification of a proposal, or withdrawal of a proposal that is transmitted to and received by the Government via facsimile machine.

(b) Offerors may submit facsimile proposals as responses to this solicitation. Facsimile proposals are subject to the same rules as paper proposals.

(c) The telephone number of receiving facsimile equipment is: .

(d) If any portion of a facsimile proposal received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document—

(1) The Contracting Officer immediately shall notify the offeror and permit the offeror to resubmit the proposal;

(2) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror; and

(3) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the offeror complies with the time and format requirements for resubmission prescribed by the Contracting Officer.

(e) The Government reserves the right to make award solely on the facsimile proposal. However, if requested to do so by the Contracting Officer, the apparently successful offeror promptly shall submit the complete original signed proposal.

2.5 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.6 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

2.7 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
