VAMC Columbia, SC Valet Parking Services Statement of Work

STATEMENT OF WORK

Valet Parking Services

1. SCOPE OF WORK:

The contractor shall provide all resources necessary to accomplish valet parking at the Wm. Jennings Bryan Dorn VAMC, 6439 Garners Ferry Road, Columbia, South Carolina for an initial period of one (1) year from date of award with four (4) options to extend if successful results are achieved per VA Medical Center evaluation. The requirement for valet parking services shall alleviate the severe parking problems experienced at this facility. The contractor shall utilize both valet parking and high-density assisted parking to accommodate the parking needs at this facility.

The Valet Parking area is located in parking lot 1A. The numbers of spaces as identified for valet parking is 100 spaces and 6 handicap marked spaces.

The park hours are between 8:00 A.M. – 2:00 P.M. Monday through Friday. The number of vehicles on these peak days and hours average between 150-200 cars. The contractor shall staff, and/or adjust staff as appropriate, throughout the performance of the contract to ensure the valet parking operation with as many employees as needed to ensure efficient operation (no long delays or traffic back-ups), ensuring that vehicles do not block emergency right of way, taking into consideration the peak days and hours as stated above The VA shall make every effort to notify contractor in advance concerning special event that might cause parking problems as a result of an increase in visitors to the Facility. Currently, a monthly new patient orientation is held the 3rd Tuesday of each month from 10:00 A.M.- 12:00 P.M. Up to 125 patients are anticipated at this event.

2. VALET PARKING-HANDICAPPED VEHICLES

Contractor shall provide attendants trained to operate handicapped vehicles. Handicapped patients and visitors will be encouraged to utilize valet parking to ease their access into the Medical Center. Attendants shall have designated space in the front parking area for the loading and unloading of handicapped persons so as not to interfere with normal valet operations.

3. DESCRIPTION OF TASKS and ASSOCIATED DELIVERABLES:

All parking attendants shall:

1. Patrons shall be greeted by valet parking attendants. Valet parking attendants will park all vehicles that enter the valet parking area requesting valet parking services. Parking attendants will be responsible for sagely parking patrons’ vehicles in authorized areas and storing the patron’s keys. A valet parking attendant will deliver the vehicle to the patron within a period not to exceed fifteen (15) minutes when ready to exit VA Medical Center premises.

2. All parking attendants must possess a valid/current driver’s license. Contractor is required to provide a certified copy of driver’s license history from issued state’s Department of Public Safety. All employees must understand and speak fluent English.

3. The contractor shall furnish and install all signs needed for operations (signage to be approved by VA), furnish claim checks, walkie-talkies or cell phones, cones, portable battery charger or other miscellaneous items necessary to facilitate valet parking operations. Signs shall be easy to read and look professional. Hand-written signs are not allowed. The contractor shall provide uniforms to all personnel working under this contract. Uniforms type will be agreed upon with VA and contractor at the pre-work meeting. Uniforms shall be worn at all times during performance of contract duties. The VA reserves the right to request replacement of any contract employees at any time who are deemed inappropriate to provide services for the VA.

4. Valet services will be available Mondays through Friday, excluding federal holidays. The hours of operation will be 8:00 A.M.-4:30 P.M. The contractor shall staff, and/or adjust staff as appropriate, throughout the contract to ensure an efficient operation (no long delays or traffic back-ups). The VA will make every effort to notify the contractor in advance concerning special events that might cause parking problems as a result of additional visitors to the Medical Center.

5. Every vehicle stopping at the valet parking area will be greeted and the driver asked if they would like valet parking. The attendants will give the driver a claim check, inspect vehicle for prior damage and park the vehicle. No car key shall be left in an unattended car to include it being visible. All attendant-parked vehicles will be locked, and the keys will be appropriately secured in contractor provided key cabinet. Cars that are claimed checked for parking should be parked in the designated parking area within 15 minutes after customer is given their claim check. The parking patron will present his/her claim check to the attendant when ready to depart and the attendant will deliver the vehicle for easy exiting. When a driver needs his/her vehicle after the hours of operation, owner can ascertain the keys from the Police Department.

6. All parking attendants shall be trained by the contractor on the importance of giving good quality customer service. Parking patrons will be treated courteously and with respect at all times. Parking attendants shall drive slowly and cautiously, paying attention to pedestrian traffic. Parking attendants may assist customers when getting in and out of their vehicles as well as assist with removal of wheelchairs and carts from their vehicles if requested. A “No Tipping” sign will be furnished and installed by the contractor, and this policy will be strictly enforced by the contractor and on-site Point of Contact.

7. The parking attendant will turn in keys of any vehicles still on the premises to the Police Department at the end of valet hours. Owners of these vehicles will pick up their keys at this location and will retrieve their vehicles themselves. Car location must be identified in order for the owner to easily locate his/her car.

8. Any claims of damage or problems with customers’ vehicles will be directed to and handled by the contractor in coordination with the Contracting Officer’s Technical Representative. Contractor shall have insurance to manage damage to vehicles.

9. Contractor shall attend a pre-work orientation meeting after award and prior to commencement of work on site. The VA will schedule the pre-work meeting and discussion will include but not be limited to the following topics:

a. Fire and Safety

b. Disaster Procedures

c. Medical protocols to be used by valet parking attendants (i.e. procedures for medical emergencies)

d. Handling of accidents, thefts, and other parking related incidents

e. Uniforms

f. Miscellaneous

(VA will provide information to the contractor regarding these topics and will document the meeting.) It is the contractor’s responsibility to ensure that contractor staff coming to the work site receive all information required above and are fully trained and completely competent to perform the required work.

10. The contractor shall designate an employee on site to act as Point of Contact to represent the contractor in handling any valet parking concerns. The name of this individual shall be furnished to the Contracting Officer at the pre-work orientation meeting. The contractor shall also designate another employee as “acting” to ensure coverage during any periods of absence by the Point of Contract during contract working hours.

11. The contractor shall notify the VA of any areas that may pose a safety hazard to patients, employees and visitors. VA will correct any deficiencies noted and agreed upon.

12. The contractor shall provide appropriate lock boxes/key cabinets for the contractor’s use during the term of the contract. Lock boxes/key cabinets shall be mobile in order to be transported to after valet hour’s location for distribution of remaining keys. Any lock boxes/key cabinets that are damaged due to the abuse/negligence by VA employees during or after valet hours will be replaced by the VA with the same or equal product.

13. Valet parking personnel are permitted to park on site, if space is available.

14. Personal cell phone use is not permitted while parking vehicles or while on duty during scheduled work hours.

15. The contractor shall be required to track the number of vehicles parked daily in a log and provide a copy of the log to a Point of Contact to be determined at the pre-work orientation meeting indicating total number of vehicles parked during the week.

16. The government reserves the right to perform customer service survey’s during the life of the contract to include any option periods which may be exercised. Monthly patient satisfaction surveys will be conducted by the Contractor. The surveys will be submitted to the COTR for data analysis by the 10th of each month.

4. GOVERNMENT FURNISHED PROPERTY: No government issued property will be assigned.

5. PERIOD OF PERFORMANCE:

Period of performance is for a Base Year with four (4) one-year Option Year.

7. TERMINATION FOR CONVENIENCE:

In accordance with FAR 52.212-4 (l) The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience.

8. RECORDS MANAGEMENT LANGUAGE FOR CONTRACTS:

The following standard items relate to records generated in executing the contract and should be included in a typical Electronic Information Systems (EIS) procurement contract:

a. Citations to pertinent laws, codes and regulations such as 44 U.S.C chapters 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228.

b. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.

c. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.

d. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act.

e. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.

f. The Government Agency owns the rights to all data/records produced as part of this contract.

g. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.

h. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.].

i. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules.

C.1 52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (OCT 2015)

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals—

(A) Are [ ] are not [ ] presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have [ ] have not [ ], within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have," the offeror shall also see 52.209-7, if included in this solicitation);

(1) Federal taxes are considered delinquent if both of the following criteria apply:

A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

C.7 52.233-3 PROTEST AFTER AWARD (AUG 1996)

(a) Upon receipt of a notice of protest (as defined in FAR 33.101) or a determination that a protest is likely (see FAR 33.102(d)), the Contracting Officer may, by written order to the Contractor, direct the Contractor to stop performance of the work called for by this contract. The order shall be specifically identified as a stop-work order issued under this clause. Upon receipt of the order, the Contractor shall immediately comply with its terms and take all reasonable steps to minimize the incurrence of costs allocable to the work covered by the order during the period of work stoppage. Upon receipt of the final decision in the protest, the Contracting Officer shall either—

(1) Cancel the stop-work order; or

(2) Terminate the work covered by the order as provided in the Default, or the Termination for Convenience of the Government, clause of this contract.

(b) If a stop-work order issued under this clause is canceled either before or after a final decision in the protest, the Contractor shall resume work. The Contracting Officer shall make an equitable adjustment in the delivery schedule or contract price, or both, and the contract shall be modified, in writing, accordingly, if—

(1) The stop-work order results in an increase in the time required for, or in the Contractor's cost properly allocable to, the performance of any part of this contract; and

(2) The Contractor asserts its right to an adjustment within 30 days after the end of the period of work stoppage; provided, that if the Contracting Officer decides the facts justify the action, the Contracting Officer may receive and act upon a proposal submitted at any time before final payment under this contract.

(c) If a stop-work order is not canceled and the work covered by the order is terminated for the convenience of the Government, the Contracting Officer shall allow reasonable costs resulting from the stop-work order in arriving at the termination settlement.

(d) If a stop-work order is not canceled and the work covered by the order is terminated for default, the Contracting Officer shall allow, by equitable adjustment or otherwise, reasonable costs resulting from the stop-work order.

(e) The Government's rights to terminate this contract at any time are not affected by action taken under this clause.

(f) If, as the result of the Contractor's intentional or negligent misstatement, misrepresentation, or miscertification, a protest related to this contract is sustained, and the Government pays costs, as provided in FAR 33.102(b)(2) or 33.104(h)(1), the Government may require the Contractor to reimburse the Government the amount of such costs. In addition to any other remedy available, and pursuant to the requirements of Subpart 32.6, the Government may collect this debt by offsetting the amount against any payment due the Contractor under any contract between the Contractor and the Government.

C.10 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
