SECTION 01 00 00

GENERAL REQUIREMENTS

1.1 SAFETY REQUIREMENTS

Refer to section 01 35 26, SAFETY REQUIREMENTS for safety and infection control requirements.

1.2 GENERAL INTENTION

A. Contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials and perform work for _the project to Improve

Facility Condition Assessment Findings Plumbing Upgrades _____________ as required by drawings and specifications.

B. Visits to the site by Bidders may be made only by appointment with the

Medical Center Contracting Officer’s Representative (COR).

C. Offices of ______Barry Davis Architects, P.C

________________, as Architect-Engineers, will render certain technical services during construction. Such services shall be considered as advisory to the Government and shall not be construed as expressing or implying a contractual act of the Government without affirmations by

Contracting Officer or his duly authorized representative.

D. Before placement and installation of work subject to tests by testing laboratory retained by Department of Veterans Affairs, the Contractor shall notify the COR in sufficient time to enable testing laboratory personnel to be present at the site in time for proper taking and testing of specimens and field inspection. Such prior notice shall be not less than three work days unless otherwise designated by the COR.

E. All employees of general contractor and subcontractors shall comply with VA security management program and obtain permission of the VA police, be identified by project and employer, and restricted from unauthorized access.

1.3 STATEMENT OF BID ITEM(S)

A. ITEM I, Plumbing Work: Work includes all labor, material, equipment and supervision to perform the required plumbing construction work on this project including demolition of existing water heaters, tanks, and associated piping; installation of new water heaters, tanks, and associated piping; installation of new mixing valves at indicated lavatories; and associated electrical work.

A. ALTERNATE NO. 1: _Omit canopy over water heaters at Building 3A.

B. ALTERNATE NO. 2:_Omit installation of new hot water mixing valves at indicated lavatories._____________________________ ______

1.4 SPECIFICATIONS AND DRAWINGS FOR CONTRACTOR

A. Drawings and contract documents may be obtained from the website where the solicitation is posted. Additional copies will be at Contractor's expense.

1.5 CONSTRUCTION SECURITY REQUIREMENTS

A. Security Plan:

1. The security plan defines both physical and administrative security procedures that will remain effective for the entire duration of the project.

2. The General Contractor is responsible for assuring that all sub-contractors working on the project and their employees also comply with these regulations.

B. Security Procedures:

1. General Contractor’s employees shall not enter the project site without appropriate badge. They may also be subject to inspection of their personal effects when entering or leaving the project site.

2. Before starting work the General Contractor shall give one week’s notice to the Contracting Officer so that security arrangements can be provided for the employees. This notice is separate from any notices required for utility shutdown described later in this section.

3. No photography of VA premises is allowed without written permission of the Contracting Officer.

4. VA reserves the right to close down or shut down the project site and order General Contractor’s employees off the premises in the event of a national emergency. The General Contractor may return to the site only with the written approval of the Contracting Officer.

C. Key Control:

1. The General Contractor shall provide duplicate keys and lock combinations to the Contracting officers representative (COR) for the purpose of security inspections of every area of project including tool boxes and parked machines and take any emergency action.

D. Document Control:

1. Before starting any work, the General Contractor/Sub Contractors shall submit an electronic security memorandum describing the approach to following goals and maintaining confidentiality of

“sensitive information”.

2. The General Contractor is responsible for safekeeping of all drawings, project manual and other project information. This information shall be shared only with those with a specific need to accomplish the project.

3. Certain documents, sketches, videos or photographs and drawings may be marked “Law Enforcement Sensitive” or “Sensitive Unclassified”.

Secure such information in separate containers and limit the access to only those who will need it for the project. Return the information to the Contracting Officer upon request.

4. These security documents shall not be removed or transmitted from the project site without the written approval of Contracting

Officer.

5. All paper waste or electronic media such as CD’s and diskettes shall be shredded and destroyed in a manner acceptable to the VA.

6. Notify Contracting Officer and Site Security Officer immediately when there is a loss or compromise of “sensitive information”.

7. All electronic information shall be stored in specified location following VA standards and procedures using an Engineering Document

Management Software (EDMS).

a. Security, access and maintenance of all project drawings, both scanned and electronic shall be performed and tracked through the

EDMS system.

b. “Sensitive information” including drawings and other documents may be attached to e-mail provided all VA encryption procedures are followed.

E. Motor Vehicle Restrictions

1. Vehicle authorization request shall be required for any vehicle entering the site and such request shall be submitted 24 hours before the date and time of access. Access shall be restricted to picking up and dropping off materials and supplies.

2. A limited number of (2 to 5) permits shall be issued for General

Contractor and its employees for parking in designated areas only.

1.6 OPERATIONS AND STORAGE AREAS

A. The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer. The Contractor shall hold and save the

Government, its officers and agents, free and harmless from liability of any nature occasioned by the Contractor's performance.

B. Temporary buildings (e.g., storage sheds, shops, offices) and utilities may be erected by the Contractor only with the approval of the

Contracting Officer and shall be built with labor and materials furnished by the Contractor without expense to the Government. The temporary buildings and utilities shall remain the property of the

Contractor and shall be removed by the Contractor at its expense upon completion of the work. With the written consent of the Contracting

Officer, the buildings and utilities may be abandoned and need not be removed.

C. The Contractor shall, under regulations prescribed by the Contracting

Officer, use only established roadways. When materials are transported in prosecuting the work, vehicles shall not be loaded beyond the loading capacity recommended by the manufacturer of the vehicle or prescribed by any Federal, State, or local law or regulation. When it is necessary to cross curbs or sidewalks, the Contractor shall protect them from damage. The Contractor shall repair or pay for the repair of any damaged curbs, sidewalks, or roads.

(FAR 52.236-10)

D. Working space and space available for storing materials shall be as determined by the COR.

1. The COR will make space available behind Buildings 13 and 50 as indicated on the drawings.

2. The contractor may use these areas to set up a temporary office trailer, portable toilets, secure storage, laydown, and other staging activities.

3. The contractor may install temporary gated chain link fences around the areas.

4. The contractor shall organize and maintain these areas in a manner that is acceptable to the COR, and shall post signs restricting unauthorized access.

5. If the contractor fails to maintain these staging areas in a condition that is suitable to the COR, the COR may, at any time, direct the contractor to immediately remove all temporary facilities, equipment, material, and anything else that is the property of the contractor and restore the areas to their conditions at the time of commencement of the work.

6. Upon completion of all work of this contract and when directed by the COR, the contractor shall remove all temporary facilities, equipment, material, and anything else that is the property of the contractor and restore the areas to their conditions at the time of commencement of the work.

E. Workmen are subject to rules of Medical Center applicable to their conduct.

F. Execute work so as to interfere as little as possible with normal functioning of Medical Center as a whole, including operations of utility services, fire protection systems and any existing equipment, and with work being done by others. Use of equipment and tools that transmit vibrations and noises through the building structure, are not permitted in buildings that are occupied, during construction, jointly by patients or medical personnel, and Contractor's personnel, except as permitted by COR where required by limited working space.

1. Do not store materials and equipment in other than assigned areas.

2. Schedule delivery of materials and equipment to immediate construction working areas within buildings in use by Department of

Veterans Affairs in quantities sufficient for not more than two work days. Provide unobstructed access to Medical Center areas required to remain in operation.

3. Where access by Medical Center personnel to vacated portions of buildings is not required, storage of Contractor's materials and equipment may be permitted subject to fire and safety requirements.

G. Phasing:

The Medical Center must maintain its operation 24 hours a day 7 days a week. Therefore, any interruption in service must be scheduled and coordinated with the COR to ensure that no lapses in operation occur.

It is the CONTRACTOR'S responsibility to develop a work plan and schedule detailing, at a minimum, the procedures to be employed, the equipment and materials to be used, the interim life safety measure to be used during the work, and a schedule defining the duration of the work with milestone subtasks, all in accordance with section 01 32

16.15 PROJECT SCHEDULES. The work to be outlined shall include, but not be limited to:

1. Demolition of existing water heaters, tanks, and associated piping serving Buildings 3A, 4A, 120, and 129.

2. Install a temporary water heating system, first at Building

120, then at Building 129.

3. Perform all work with no interruption of hot water service to

Buildings 120 and 129, and with minimal disruption at all other buildings.

4. Install new water heaters, tanks, and associated piping and electrical work to serve Buildings 3A, 4A, 120, and 129.

5. Install a new electrical circuit at the water heater in

Building 68.

6. Install new mixing valves at the indicated lavatories at the third and fourth floors of Building 120.

7. Commission the new systems.

To ensure such executions, Contractor shall furnish the COR with a schedule of approximate phasing dates on which the Contractor intends to accomplish work in each specific area of site, building or portion thereof. In addition, Contractor shall notify the COR two weeks in advance of the proposed date of starting work in each specific area of site, building or portion thereof. Arrange such phasing dates to insure accomplishment of this work in successive phases mutually agreeable to

Medical Center Director, COR, and Contractor, as follows:

Phase I: All work at Building 120, with the installation of a temporary water heating system in place and functioning (hot water service shall not be interrupted during this project). Work at all other areas included in the contract except Building 129 may continue concurrently. When the installation of the new water heater and all associated work is complete at Building 120 and hot water service has resumed from the new equipment to the satisfaction of the COR, the contractor shall disconnect the temporary water heating system and install it at Building 129.

Phase II: All work at Building 129, with the installation of a temporary water heating system in place and functioning (hot water service shall not be interrupted during this project).

NOTE: The purpose of these two phases is to ensure uninterrupted hot water at Buildings 120 and 129 using only one temporary water heating system.

Phasing should not affect work in other areas of the Medical Center, and such other work shall continue concurrently.

H. When a building and/or construction site is turned over to Contractor, Contractor shall accept entire responsibility including upkeep and maintenance therefore:

1. Contractor shall maintain in operating condition existing fire protection and alarm equipment. In connection with fire alarm equipment, Contractor shall make arrangements for pre-inspection of site with Fire Department or Company (Department of Veterans Affairs or municipal) whichever will be required to respond to an alarm from

Contractor's employee or watchman.

I. Utilities Services: Maintain existing utility services for Medical

Center at all times. Provide temporary facilities, labor, materials, equipment, connections, and utilities to assure uninterrupted services.

1. No utility service such as water, gas, steam, sewers or electricity, or fire protection systems and communications systems may be interrupted without prior approval of COR. Electrical work shall be accomplished with all affected circuits or equipment de-energized.

When an electrical outage cannot be accomplished, work on any energized circuits or equipment shall not commence without a detailed work plan, the Medical Center Director’s prior knowledge and written approval. Refer to specification Sections 26 05 11, REQUIREMENTS FOR

ELECTRICAL INSTALLATIONS for additional requirements.

2. Contractor shall submit a request to interrupt any such services to

COR, in writing, 7 days in advance of proposed interruption. Request shall state reason, date, exact time of, and approximate duration of such interruption.

3. Contractor will be advised (in writing) of approval of request, or of which other date and/or time such interruption will cause least inconvenience to operations of Medical Center. Interruption time approved by Medical Center may occur at other than Contractor's normal working hours.

4. Major interruptions of any system must be requested, in writing, at least 15 calendar days prior to the desired time and shall be performed as directed by the COR.

5. In case of a contract construction emergency, service will be interrupted on approval of COR. Such approval will be confirmed in writing as soon as practical.

J. Abandoned Lines: All service lines such as wires, cables, conduits, ducts, pipes and the like, and their hangers or supports, which are to be required to be entirely removed, shall be sealed, capped or plugged at the main, branch or panel they originate from. The lines shall not be capped in finished areas, but shall be removed and sealed, capped or plugged in ceilings, within furred spaces, in unfinished areas, or within walls or partitions; so that they are completely behind the finished surfaces.

K. To minimize interference of construction activities with flow of

Medical Center traffic, comply with the following:

1. Keep roads, walks and entrances to grounds, to parking and to occupied areas of buildings clear of construction materials, debris and standing construction equipment and vehicles.

L. Coordinate the work for this contract with other construction operations as directed by COR. This includes the scheduling of traffic and the use of roadways, as specified in Article, USE OF ROADWAYS.

1.7 ALTERATIONS

A. Survey: Before any work is started, the Contractor shall make a thorough survey with the COR of areas of buildings in which alterations occur and areas which are anticipated routes of access, and furnish a report, signed by both, to the Contracting Officer. This report shall list by rooms and spaces:

1. Existing condition and types of resilient flooring, doors, windows, walls and other surfaces not required to be altered throughout affected areas of buildings.

2. Existence and conditions of items such as plumbing fixtures and accessories, electrical fixtures, equipment, etc., required by drawings to be either reused or relocated, or both.

3. Shall note any discrepancies between drawings and existing conditions at site.

4. Shall designate areas for working space, materials storage and routes of access to areas within buildings where alterations occur and which have been agreed upon by Contractor and COR.

B. Any items required by drawings to be either reused or relocated or both, found during this survey to be nonexistent, or in opinion of COR, to be in such condition that their use is impossible or impractical, shall be furnished and/or replaced by Contractor with new items in accordance with specifications which will be furnished by Government.

Provided the contract work is changed by reason of this subparagraph B, the contract will be modified accordingly, under provisions of clause entitled "DIFFERING SITE CONDITIONS" (FAR 52.236-2) and "CHANGES" (FAR

52.243-4 and VAAR 852.236-88).

C. Re-Survey: Thirty days before expected partial or final inspection date, the Contractor and COR together shall make a thorough re-survey of the areas of buildings involved. They shall furnish a report on conditions then existing, of resilient flooring, doors, windows, walls and other surfaces as compared with conditions of same as noted in first condition survey report:

1. Re-survey report shall also list any damage caused by Contractor to such flooring and other surfaces, despite protection measures; and, will form basis for determining extent of repair work required of

Contractor to restore damage caused by Contractor's workmen in executing work of this contract.

D. Protection: Provide the following protective measures:

1. Wherever existing roof surfaces are disturbed they shall be protected against water infiltration. In case of leaks, they shall be repaired immediately upon discovery.

2. Temporary protection against damage for portions of existing structures and grounds where work is to be done, materials handled and equipment moved and/or relocated.

3. Protection of interior of existing structures at all times, from damage, dust and weather inclemency. Wherever work is performed, floor surfaces that are to remain in place shall be adequately protected prior to starting work, and this protection shall be maintained intact until all work in the area is completed.

1.8 DISPOSAL AND RETENTION

A. Materials and equipment accruing from work removed and from demolition of buildings or structures, or parts thereof, shall be disposed of as follows:

1. Reserved items which are to remain property of the Government are identified by attached tags or noted on drawings or in specifications as items to be stored. Items that remain property of the Government shall be removed or dislodged from present locations in such a manner as to prevent damage which would be detrimental to re-installation and reuse. Store such items where directed by COR.

2. Items not reserved shall become property of the Contractor and be removed by Contractor from Medical Center.

3. Items of portable equipment and furnishings located in rooms and spaces in which work is to be done under this contract shall remain the property of the Government. When rooms and spaces are vacated by the Department of Veterans Affairs during the alteration period, such items which are NOT required by drawings and specifications to be either relocated or reused will be removed by the Government in advance of work to avoid interfering with Contractor's operation.

1.9 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND

IMPROVEMENTS

A. The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor

01 00 00 -12 shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workmen, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by the Contracting Officer.

B. The Contractor shall protect from damage all existing improvements and utilities at or near the work site and on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the

Contractor fails or refuses to repair the damage promptly, the

Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

1.10 RESTORATION

A. Remove, cut, alter, replace, patch and repair existing work as necessary to install new work. Except as otherwise shown or specified, do not cut, alter or remove any structural work, and do not disturb any ducts, plumbing, steam, gas, or electric work without approval of the

COR. Existing work to be altered or extended and that is found to be defective in any way, shall be reported to the COR before it is disturbed. Materials and workmanship used in restoring work, shall conform in type and quality to that of original existing construction, except as otherwise shown or specified.

B. Upon completion of contract, deliver work complete and undamaged.

Existing work (walls, ceilings, partitions, floors, mechanical and electrical work, lawns, paving, roads, walks, etc.) disturbed or removed as a result of performing required new work, shall be patched, repaired, reinstalled, or replaced with new work, and refinished and left in as good condition as existed before commencing work.

C. At Contractor's own expense, Contractor shall immediately restore to service and repair any damage caused by Contractor's workmen to

01 00 00 -13 existing piping and conduits, wires, cables, etc., of utility services or of fire protection systems and communications systems (including telephone) which are not scheduled for discontinuance or abandonment.

D. Expense of repairs to such utilities and systems not shown on drawings or locations of which are unknown will be covered by adjustment to contract time and price in accordance with clause entitled "CHANGES"

(FAR 52.243-4 and VAAR 852.236-88) and "DIFFERING SITE CONDITIONS" (FAR

52.236-2).

1.11 AS-BUILT DRAWINGS

A. The contractor shall maintain two full size sets of as-built drawings which will be kept current during construction of the project, to include all contract changes, modifications and clarifications.

B. All variations shall be shown in the same general detail as used in the contract drawings. To insure compliance, as-built drawings shall be made available for the COR review, as often as requested.

C. Contractor shall deliver two approved completed sets of as-built drawings in the electronic version (scanned PDF) to the COR within 15 calendar days after each completed phase and after the acceptance of the project by the COR.

D. Paragraphs A, B, & C shall also apply to all shop drawings.

1.12 USE OF ROADWAYS

A. For hauling, use only established public roads and roads on Medical

Center. When necessary to cross curbing, sidewalks, or similar construction, they must be protected by well-constructed bridges.

1.13 RESIDENT ENGINEER'S FIELD OFFICE

A. At temporary field office is not required; however, the contractor may install an office trailer as provided for at 1.6.D above.

B. The Medical Center will not provide any temporary office space for the contractor.

1.14 TEMPORARY USE OF EXISTING ELEVATORS

A. Use of existing elevators for handling building materials and

Contractor's personnel will be permitted subject to following provisions:

1. Contractor makes all arrangements with the COR for use of elevators.

The COR will ascertain that elevators are in proper condition.

Contractor may use elevators Building Nos. 120 and 129 for daily use between the hours of 7:00 a.m. and 6:00 p.m. and for special nonrecurring time intervals when permission is granted. Personnel for operating elevators will not be provided by the Department of

Veterans Affairs.

2. Contractor covers and provides maximum protection of following elevator components:

a. Entrance jambs, heads soffits and threshold plates.

b. Entrance columns, canopy, return panels and inside surfaces of car enclosure walls.

c. Finish flooring.

3. Place elevator in condition equal, less normal wear, to that existing at time it was placed in service of Contractor as approved by Contracting Officer.

1.15 TEMPORARY TOILETS

A. At the area(s) indicated, provide (for use of all Contractor's workmen) suitable (as approved by the COR) dry closets. Keep such places clean and free from flies, and all connections and appliances connected therewith are to be removed prior to completion of contract, and premises left perfectly clean.

B. Restrooms in the buildings will not be made available for workmen’s use.

1.16 AVAILABILITY AND USE OF UTILITY SERVICES

A. The Government shall make all reasonably required amounts of utilities available to the Contractor from existing outlets and supplies, as

01 00 00 -15 specified in the contract. The Contractor shall carefully conserve any utilities furnished without charge.

B. The Contractor, at Contractor's expense and in a workmanlike manner, in compliance with code and as satisfactory to the Contracting Officer, shall install and maintain all necessary temporary connections and distribution lines, and all meters required to measure the amount of electricity used for the purpose of determining charges. Before final acceptance of the work by the Government, the Contractor shall remove all the temporary connections, distribution lines, meters, and associated paraphernalia and repair restore the infrastructure as required.

C. Heat: Furnish temporary heat necessary to prevent injury to work and materials through dampness and cold. Use of open salamanders or any temporary heating devices which may be fire hazards or may smoke and damage finished work, will not be permitted. Maintain minimum temperatures as specified for various materials:

1. Obtain heat by connecting to Medical Center heating distribution system.

D. Electricity (for Construction and Testing): Furnish all temporary electric services.

1. Obtain electricity by connecting to the Medical Center electrical distribution system. The Contractor shall meter and pay for electricity required for electrical welding devices and any electrical heating devices providing temporary heat. Electricity for all other uses is available at no cost to the Contractor.

F. Water (for Construction and Testing): Furnish temporary water service.

1. Obtain water by connecting to the Medical Center water distribution system. Provide reduced pressure backflow preventer at each connection as per code. Water is available at no cost to the

Contractor.

2. Maintain connections, pipe, fittings and fixtures and conserve water-use so none is wasted. Failure to stop leakage or other wastes

01 00 00 -16 will be cause for revocation (at COR discretion) of use of water from Medical Center's system.

G. Fuel: Natural and LP gas and burner fuel oil required for boiler cleaning, normal initial boiler-burner setup and adjusting, and for performing the specified boiler tests will be furnished by the

Government. Fuel required for prolonged boiler-burner setup, adjustments, or modifications due to improper design or operation of boiler, burner, or control devices shall be furnished and paid by the

Contractor at Contractor's expense.

1.17 TESTS

A. As per specification section 22 08 00 the contractor shall provide a written testing and commissioning plan complete with component level, equipment level, sub-system level and system level breakdowns. The plan will provide a schedule and a written sequence of what will be tested, how and what the expected outcome will be. This document will be submitted for approval prior to commencing work. The contractor shall document the results of the approved plan and submit for approval with the as built documentation.

B. Pre-test mechanical and electrical equipment and systems and make corrections required for proper operation of such systems before requesting final tests. Final test will not be conducted unless pre-tested.

C. Conduct final tests required in various sections of specifications in presence of an authorized representative of the Contracting Officer.

Contractor shall furnish all labor, materials, equipment, instruments, and forms, to conduct and record such tests.

D. All related components as defined above shall be functioning when any system component is tested. Tests shall be completed within a reasonably period of time during which operating and environmental conditions remain reasonably constant and are typical of the design conditions.

E. Individual test result of any component, where required, will only be accepted when submitted with the test results of related components and of the entire system.

1.18 INSTRUCTIONS

A. Contractor shall furnish Maintenance and Operating manuals (hard copies and electronic) and verbal instructions when required by the various sections of the specifications and as hereinafter specified.

B. Manuals: Maintenance and operating manuals and one compact disc (four hard copies and one electronic copy each) for each separate piece of equipment shall be delivered to the COR coincidental with the delivery of the equipment to the job site. Manuals shall be complete, detailed guides for the maintenance and operation of equipment. They shall include complete information necessary for starting, adjusting, maintaining in continuous operation for long periods of time and dismantling and reassembling of the complete units and sub-assembly components. Manuals shall include an index covering all component parts clearly cross-referenced to diagrams and illustrations. Illustrations shall include "exploded" views showing and identifying each separate item. Emphasis shall be placed on the use of special tools and instruments. The function of each piece of equipment, component, accessory and control shall be clearly and thoroughly explained. All necessary precautions for the operation of the equipment and the reason for each precaution shall be clearly set forth. Manuals must reference the exact model, actual serial number, style, and size of the piece of equipment and system being furnished. Manuals referencing equipment similar to but of a different model, style, and size than that furnished will not be accepted.

C. Instructions: Contractor shall provide qualified, factory-trained manufacturers' representatives to give detailed training to assigned

Department of Veterans Affairs personnel in the operation and complete maintenance for each piece of equipment. All such training will be at the job site. These requirements are more specifically detailed in the various technical sections. Instructions for different items of equipment that are component parts of a complete system, shall be given in an integrated, progressive manner. All instructors for every piece of component equipment in a system shall be available until instructions for all items included in the system have been completed.

This is to assure proper instruction in the operation of inter-related systems. All instruction periods shall be at such times as scheduled by the COR and shall be considered concluded only when the COR is

01 00 00 -18 satisfied in regard to complete and thorough coverage. The contractor shall submit a course outline with associated material to the COR for review and approval prior to scheduling training to ensure the subject matter covers the expectations of the VA and the contractual requirements. The Department of Veterans Affairs reserves the right to request the removal of, and substitution for, any instructor who, in the opinion of the COR, does not demonstrate sufficient qualifications in accordance with requirements for instructors above.

1.19 STATEMENT OF WORK

The following Statement of Work is attached to and supplements these General Requirements.

A. General: The Contractor shall install and commission water heaters, storage tanks, and associated piping, and hot water mixing valves at the Central Alabama Veterans Health Care system (CAVHCS) East Campus located in Tuskegee, Alabama, IAW the Statement of Work (SOW). The Veterans Affairs shall not exercise any supervision or control over the Contractor’s employees performing the tasks herein. Such contract employees shall be accountable solely to the Contractor who, in turn shall be responsible to the Veterans Affairs.

A.1 Scope of Work: The Contractor shall furnish all management, engineering, supervision, labor, assemblies, transportation, and supplies necessary to operate system as designed. Includes operating, testing, connecting and commissioning water heaters, storage tanks, and associated electrical and piping. Also includes installation of hot water mixing valves, and other miscellaneous work as indicated in the drawings and specifications. The work shall include all labor. All workmanship shall comply with all applicable codes, specifications, local ordinances, industry standards and utility company regulations.

The Contractor is responsible for verifying dimensions, existing mechanical equipment and other information presented in this document.

The Contractor price includes all expenses to include transportation, utilities, transaction fees, incidental, all taxes, and all direct and indirect costs.

A.2 Objective. The objective is to connect and commission all indicated water heaters, storage tanks, and associated electrical and piping to serve Buildings 3A, 4A, 68, 120, and 129. The objective, further, is to install new hot water mixing valves at the indicated lavatories at the third and fourth floors of Building 120.

A.3 Required Delivery of Project. The required delivery of the total project will be one hundred fifty (150) calendar days or less from the date of contract award. The Contractor shall start work no later than forty-five (45) calendar days after contract award.

B. General Information

B.1 Quality Control (QC). The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services.

B.2 Quality Assurance (QA). The CAVHCS Engineers will monitor and inspect the Contractor's performance under this contract using the quality assurance procedures in the Federal Acquisition Regulation (FAR) clause 52.246-12.

B.3 Hours of Operations. The Contractor shall maintain the following work schedule: Monday through Friday, 7:30 a.m. through 4:30 p.m., except for listed holidays or when the Government facility is closed due to local or emergencies, administrative closings, or similar Government directed facility closings. The Contractor may schedule other work hours, as necessary, if mutually agreed upon by the COR.

B.4 Place of performance. The work to be performed under this contract will be performed at Central Alabama Veterans Health Care system (CAVHCS) East Campus located in Tuskegee, Alabama. Prior to the commencement of work, access to the installation will be coordinated with the authorities at the Campus Security.

B.5 Security Requirements. The contractor and/or associated subcontractor employees shall comply with applicable installation access and local security policies and procedures.

B.6 Physical Security. The Contractor shall be responsible for safeguarding all government equipment, information and property provided for Contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

Contractor and workforce will take appropriate security measures to protect Government critical and sensitive information. Contractor will provide sub-contractors only required specifics to accomplish services and/or products delivery. All work related paper products and removable storage material that is received, generated, or stored during the contract will be destroyed completely when no longer needed to preclude recognition of information. Installation access badges will not be worn outside Government facility where visible to the general public. The Contractor and workforce personnel shall not take photos of Government facilities or activities, unless related to service to be provided.

The Contractor shall not post or discuss government facility activities on any unauthorized public access media. Contractor will immediately report suspicious activities to security personnel.

B.7 Post Award Conference/Periodic Progress Meetings. The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal

Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the contracting officer will apprise the Contractor of how the government views the Contractor's performance and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

B.8 Contracting Officer Representative (COR). The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

B.9 Identification of Contractor Employees. Contractor personnel will be required to obtain and wear badges in the performance of this contract. The Contract personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials.

They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

C. Laws and Regulations

C.1 Compliance Required. This Veterans Health Administration (VHA) Directive establishes policy for maintaining a safe and healthy worksite for staff, volunteers, visitors, contractors, and the general public during construction and renovation-related activities. This policy applies to all construction activities as defined by Occupational Safety and Health Administration (OSHA) that are performed at VHA owned or leased facilities regardless of whether performed by VHA or contractor staff. The Contractor shall, without additional expense to the U.S Department of Veterans Affairs, be responsible for

01 00 00 -21 complying with all laws, codes, ordinances, and regulations applicable to the performance of the work, and with the lawful orders of any governmental authority having jurisdiction. In the event of a conflict between the contract and such laws, regulations and orders, the Contractor shall promptly advise the Contracting Officer of the conflict and of the Contractor's proposed course of action for resolution.

C.2 Labor, Health and Safety Laws. The Contractor shall comply with all labor laws, regulations, customs and practices pertaining to labor, safety, and similar matters, to the extent that such compliance is not inconsistent with the requirements of this contract. The Contractor is responsible for training all personnel to recognize fire and safety hazards. Contractor shall encourage personnel in the performance of their duties to report fire, safety hazards and unsafe conditions to their supervisor. The Contractor and their subcontractors shall comply with U.S Department of Veterans Affairs Safety regulations and laws.

Project activities governed by U.S Department of Veterans Affairs, the Contractor shall comply with safety and health requirements as established OSHA Title 29 Code of Federal Regulations (CFR) Part 1926, The Joint Commission (TJC) and National Fire Protection Association (NFPA) standards identify requirements for safe construction practices.

Environmental Protection Agency (EPA) regulations address safety requirements related to specific environmental issues (e.g., asbestos, lead, etc.). The Federal Acquisition Regulation (FAR) and Veterans Affairs Acquisition Regulation (VAAR) address contractor safety and Department of Veterans Affairs (VA) oversight requirements.

C.3 Construction Safety Training. The project superintendent/foreman or alternate shall have completed OSHA 30 hour Construction Safety course and on-site general and sub-contractor’s construction workers shall have completed the OSHA 10 hour Construction Safety training, and other relevant competency training. The Contractor shall comply with all provisions of section 01 35 26 SAFETY REQUIREMENTS.

D. Environmental Protection

D.1 In order to present and provide for abatement and control of any environmental pollution arising from the activities in the performance of this contract, the Contractor shall comply with all applicable pollution control and abatement policies, and all applicable provisions of the U.S Department of Veterans Affairs U.S. Government regulations/laws. Further, the Contractor shall comply with all provisions of 1.9 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS above.

D.2 Environmental protection action required by this section shall consist of furnishing all labor, materials, and equipment and performing all work required for the abatement and prevention of pollution during and as the result of construction operations under this contract. For the purpose of this specification, environmental

01 00 00 -22 pollution is defined as the presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances; detrimentally impact on biological species and/or their habitat; or degrade the aesthetic and recreational value of the area.

D.3 The Contractor shall not pollute storm or sewer lines; or swales with fuels, oils, bitumen, calcium chloride, acid, construction wastes;

or other harmful materials. It is the responsibility of the Contractor to investigate and comply with all applicable U.S. Government laws concerning pollution of river and streams. All work under this contract shall be performed in such a manner that objectionable conditions shall not be created in streams through or adjacent to the project areas.

D.4 Waste material is defined as any material for which no use or reuse is intended and which is to be discarded. Disposal of hazardous waste, containers or components thereof, shall be in a hazardous waste disposal site only and no other location shall be utilized for such disposal. Only hazardous waste sites which are permitted by the US Environmental Protection Agency (EPA), and/or U.S Department of Veterans Affairs shall be utilized for such disposal actions.

Contractor shall coordinate with CAVHCS environmental office for disposal/storage activities.

E. Safety

E.1 Personnel Safety. The Contractor shall immediately correct all safety deficiencies upon notification of such deficiencies by the Contracting Officer /contracting officer representative and shall notify the Contracting Officer or contracting officer representative of the corrective action taken. Contractor will provide safety violations correction in writing within 24 hour period and will follow up with corrective measure report within 72 hours. The Contractor shall be responsible for the safety of their workers and all visitors at each work site; and shall ensure that all personnel are wearing appropriate safety gear at all times (i.e. safety glasses, helmet, harness, gloves, and safety shoes). The Contractor shall comply with all provisions of section 01 35 26 SAFETY REQUIREMENTS.

F.2 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials.

F Responsibilities of Contractor

F.1 Damage to Persons or Property. The Contractor shall be responsible for all damages to persons or properties at the worksite that occur as a result of the Contractor's own fault or negligence. The Contract shall take proper safety and health precautions to protect the work sites, the workers, the public, and the property of others.

F.2 Responsibility for Work Performed. The Contractor shall be responsible for all work performed until final completion and acceptance of the entire project, except for any completed unit of work which may have been accepted in writing under the contract.

F.3 Repair. The Contractor shall repair any damage to the existing grounds, facilities, or property incurred during the course of construction to its original pre-existing conditions.
