B.2 PRICE/COST SCHEDULE

The Contractor shall provide all labor, personnel, equipment, tools, materials, supervision and other items and services necessary to provide water sampling services. Vendor will respond and be onsite ready to deliver services at the requested service time. The purpose of this contract is to procure Laboratory Analysis of water samples for AAMI compliance with water quality in accordance with VHA Directive 1116(2) dated March 03, 2016, Reference guidance in current 2017 AAMI TIR 34.

The period of Performance for the Base Year and Four Option Years shall be 12 months. The Performance Period for the Base Year will be effective upon award of services.

B.3 PERFORMANCE WORK STATEMENT

1. Scope of Work

a. The scope of this work is to procure services to include all labor, equipment, tools, supervision, testing supplies and materials, and other items to completely provide sampling, testing, analyzation, and reporting services to meet AAMI TIR34.1: 2014/(R)2017 guidelines for utility and critical water system performance. The contractor will provide sampling services onsite within the requested timeframe. Contractor is responsible for preparing and shipping samples to an appropriate and certified laboratory for water quality testing purposes. The Contractor shall provide reports to the Contracting Officer’s Representative (COR) detailing the results of the water sampling and testing. The goal of this contract is to procure laboratory analysis of utility and critical water testing samples to prove facility compliance with Table 1, below:

NOTE 1: This is the quality of water that might come from the tap but might need some form of treatment to achieve these specifications.

NOTE 2: If this is the final rinse prior to sterilization of a critical device.

NOTE 3: If hardness is greater than 150 mg/L, a water softener is recommended unless used for washing and the cleaning chemistry is capable of handling higher levels of hardness.

NOTE 4: For boiler-treated steam, most boilers are treated to maintain a pH of 7.5 or 8.5. Any treatment of water that goes into boilers should be in accordance with the sterilizer and boiler manufacturers’ written IFU.

b. The contractor shall furnish all sample collection bottles and return shipping labels, all transportation costs, and resources necessary to perform the scope of this work.

c. Containers must be sterile, appropriate for the analysis, properly preserved, and ready for prompt transportation to the laboratory under strict chain of custody procedures.

d. Contractor shall perform sample collections.

e. The testing laboratory processing the water samples for AAMI water quality compliance shall be certified by the Centers for Disease Control and Prevention (CDC) with water quality Isolation Techniques Evaluation (ELITE) program as proficient at performing the cultures. The testing laboratory must have environmental microbiology accreditation by a nationally recognized accrediting body, such as EMLAP, NELAP, etc., and experience with completing bacterial testing for no less than 5 years. The sampling contractor must be certified by the Environmental Protection Agency or the North Carolina Department of Environmental Quality to perform environmental sampling to include heterotrophic bacterial testing, for no less than 5 years’ experience.

f. Per AAMI TIR34.1: 2014/(R)2017, Annex D.3.2, water samples shall be collected after running taps or outlets for at least 60 seconds, collected aseptically in a sterile, endotoxin-free, non-polypropylene container. At least 100 mL to 300 mL of water shall be collected. Sample taps shall be wiped with alcohol and allowed to evaporate prior to running water and collecting the sample. The sample shall be held at 4°C (39.2°F) until delivered to the testing laboratory. Sample must be maintained by the lab for 30 calendar days and must release to the COR if requested.

g. Analysis of heterotrophic plate counts shall be through the membrane-filtration method, the spread-plate method, or the pour-plate method, as outlined in AAMI TIR34.1: 2014/(R)2017, Annex D.3.3.2, Annex D.3.3.3, or Annex D.3.3.4, respectively. Requirements for handling, shipping, and testing to be completed per AAMI TIR34.1: 2014/(R)2017, Annex D.

2. Location of Work

a. The location where test samples are to be taken shall occur at the Sterile Processing Service department, located in the basement of Building 47 at 1100 Tunnel Road, Asheville, NC, 28803. The samples shall be shipped by the contractor to an appropriate testing laboratory (or laboratories) to complete the testing required per AAMI TIR34.1: 2014/(R)2017 and this scope of work.

b. For the base year of the contract, bacterial heterotrophic plate count testing shall occur weekly for Reprocessing Area, Storage Tank, and Downstream of Water Treatment Process locations to provide a weekly update and baseline on the status of bacterial growth in the RO system, per Table 2.

4. Testing Days

a. Testing shall occur during normal business hours (8AM – 4:30PM).

b. Testing shall occur between the 10th and 15th business day of the month.

c. The contractor shall notify the Contracting Officer’s Representative (COR) prior to travelling to the site to ensure that testing can be completed on the requested date. The COR may request to move the testing date due to mission requirements and rescheduling shall result in no additional cost to the government to reschedule.

5. Reporting

a. Reports shall be provided via email to the COR. Reports shall be provided before the last business day in the testing month.

b. Contractor shall notify the COR immediately if any of the samples collected are above the ranges per Table 1 (above) of AAMI TIR34.1: 2014/(R)2017.

c. Contractor reports shall include a signed copy of the chain of custody, identification of the sampling locations (including pictures), testing laboratory certification(s), testing methods completed, testing method standard, testing equipment certifications, and other applicable data to show compliance with AAMI TIR34.1: 2014/(R)2017 testing requirements.

d. Reports shall provide recommendations for remediation of deficient testing parameters.

6. Emergency Testing

a. Contractor shall also provide twelve (12) additional tests per Table 8, per year.

b. Contractor shall test within five (5) business days of the official request via email.

c. Additional tests may be requested through a contract modification at the testing rate provided for the original twelve (12) tests.

B.4 SPECIAL CONTRACT REQUIREMENTS

a. The services specified in Section B. - Schedule of Services may be changed by written modification to this contract. The modification shall be prepared by the Contracting Officer (CO) and, prior to becoming effective, shall be signed by both parties.

b. The Government reserves the right to refuse acceptance of the contractor’s employees, if personal or professional conduct jeopardizes patient care. Breaches of conduct include intoxication or debilitation resulting from drug use, theft, patient abuse, dereliction or negligence in performing directed tasks, or other conduct resulting in formal complaints by patient. Standards for conduct shall mirror those prescribed by current federal personnel regulations. The Contracting Officer and Contracting Officer’s Representative (COR) shall deal with issues raised concerning contract personnel’s conduct. The final arbiter on questions of acceptability is the Contracting Officer.

c. The Contracting Officer shall resolve complaints concerning the contractor employee relations with the Government employees or patients. The Contracting Officer is the final authority on validating complaints. In the event that the contractor employee is involved and named in a validated patient complaint, the Government reserves the right to refuse acceptance of the services of such personnel. This does not preclude refusal in the event of incidents involving physical or verbal abuse. In the event the contractor employee effects any such change at the direction of any person other than the Contracting Officer without authority, no adjustment shall be made in the contract price to cover an increase in costs incurred as a result thereof.

d. Contractor shall, in writing, keep the Contracting Officer informed of any unusual circumstances in conjunction with the contract.

1. PERSONNEL:

Personnel Replacement: Any personnel the contractor offers as substitutes shall meet the security requirements and qualifications as outlined in the Performance Work Statement (PWS).

2. WORK HOURS:

1. Normal hours of service are Monday through Friday 8am to 4:30pm.

1. Federal Holidays: The 10 holidays observed by the Federal Government are:

New Year’s Day Martin Luther King’s Birthday President’s Day Memorial Day Independence Day Labor Day Columbus Day Veterans Day Thanksgiving Christmas Any other day specifically declared by the President of the United States to be a federal holiday.

When one of the holidays falls on Sunday, the following Monday shall be observed as a Federal Holiday. When a holiday falls on a Saturday, the preceding Friday shall be observed as a Federal Holiday.

Off Duty hours: Hours other than those described in 2(a).

3. MANAGEMENT AND SUPERVISION:

a. The Contractor shall be responsible for supervising the daily services provided by the contractor’s staff.

b. The VAMC will provide to the contractor policies, procedures and processes necessary to allow cooperative functioning between the agency and VAMC. Updates and refreshers will be provided to the contractor upon request and when policy procedures or process changes.

c. The Contractor shall complete checks to ensure that employees do not have a record of criminal offenses or substantiated incidents of patient abuse before being submitted; and, if required to perform their duties, employees are properly licensed and insured to operate motor vehicles.

4. RECORD KEEPING:

a. Contractor’s employee(s) shall report to the COR, upon arrival at the VA Medical Center. VAMC personnel shall brief Contractor employee(s) on VAMC policies and procedures on the first scheduled duty day. Contractor shall abide by VA Handbook 6300.1 located: http://www.va.gov/vapubs/viewPublication.asp?Pub_ID=475&FType=2

b. Documentation of services performed shall be reviewed prior to certifying payment. Contractor shall be present at the VAMC and shall be actually performing the required services as specified in the task order in order to receive reimbursement. The VAMC shall pay for services actually performed and in strict accordance with B.2, Schedule of Supplies/Services above. Contract monitoring and record keeping procedures shall be sufficient to ensure proper payment and allow audit verification that services were provided.

5. NO SMOKING POLICY:

Under VHA Directive 1085, all VHA health care facilities (including CBOCs and HCCs) will be smoke-free for patients, visitors, contractors, volunteers, and vendors effective October 1, 2019.The policy applies to cigarettes, cigars, pipes, or any other combustion of tobacco, including but not limited to electronic or e-cigarettes, vape pens or e-cigars.

6. IDENTIFICATION, PARKING, AND VA REGULATIONS:

a. Parking shall be provided in any open employee parking spots. Access shall be through the Employee Entrance, at the rear of the main building, Building 47.

b. The Contractor must log into the logbook and apply a Contractor sticker badge upon entering the facility.

7. CONTRACT ADMINISTRATION DATA:

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements of this contract. The Contractor shall communicate with the Contracting Officer and or Contraction Officer Representative on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitments or issue changes that shall affect price, quantity or quality of performance of this contract. All contract administration functions will be retained by the Department of Veterans Affairs.

8. CONTRACTING OFFICER'S REPRESENTATIVE (COR):

The COR for this contract and/or individual task orders shall be Lonnie Mangus.

9. BILLING:

Invoice requirements and supporting documentation: Supporting documentation and invoice must be submitted no later than 30 days of the end of each month services were provided. Invoices to be submitted at https://www.fsc.va.gov/einvoice.asp. Subsequent changes or corrections shall be submitted by separate invoice.

In addition to information required for submission of a “proper” invoice in accordance with FAR 52.212-4 (g), all invoices must include:

· Contract Number and Purchase/Task Order Number

· Dates of Service

· CLIN Numbers with quantity

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 days of the contract expiring.

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days of the contract expiring; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
