DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
1.3 STATEMENT OF WORK
Sidewalk Replacement
(a) General: The Contractor shall provide all labor, tools, and materials to replace existing sidewalks and curbs on both sides of McClellan Avenue at Hampton, VA Veterans Affair Center.
(b) Place of Performance: Tasks will be performed at the VA Medical Center, Hampton, VA, 23667.
Work will be around an occupied healthcare facility in operation 24 hours a day.
(c) Scope:
a. Contractor shall at a minimum but not limited to:
1. Lay out and mark all areas of replacement.
2. Demo and remove areas to be replaced to the nearest joint or saw cut. Dispose of all debris off site.
3. Install forms as necessary to retain and support concrete.
4. Roll existing sub grade materials to achieve maximum density.
5. Install full depth entrained concrete to match existing adjacent slabs and curves.
6. Install expansion joint material structures. Install crack control joints where applicable. Concrete surface should be broom with a fine brush in a traverse direction to ensure traction.
7. Install ADA approved detectable warning strips on all required ramps.
8. Apply curing compound and or provide protection against elements necessary to promote curing of new installation.
9. Remove forms and backfill adjacent disturbed areas using onsite materials.
(d) Specific requirements:
a. Work includes the demolition and removal (including saw cutting as necessary) of approximately 1500 LF of existing concrete, and ramps. Saw cut all sidewalk areas parallel to McClellan Ave. that has been identified. Remove material/debris and prepare concrete base with new material. Contractor shall form up and pour the new 4000 psi reinforced concrete ASTM C150/C150M Type I or II with 6 x 6 W2.9 – W2.9 wire mesh in addition to adding fiber mesh to the mix and provide a broom finished surface that matches the texture of the existing sidewalk area and proper slope to match the adjacent elevations.
b. Surrounding sections where the concrete is raised at joints must be milled to provide a smooth and even contour to prevent potential tripping hazards.
c. Contractor shall remove any existing in-place sealant. Sealant shall be cut loose from each joint face independently using a vertical cutting-edge tool. Alternatively, a power-driven concrete saw with diamond or abrasive blade may be used. After cutting the existing sealant free from both joint faces, the sealant shall be removed to the depth required to accommodate any separating and/or depth blocking medium used, and to provide the specified depth for the new sealant material to be installed. The product shall be clean, free of scale or foreign matter, oil or moisture and shall be non-absorbing.
d. On completion of work of this section and after removal of all debris, leave site in clean condition satisfactory to Contracting Officer’s Representative. Clean-up shall include off the Medical Center disposal of all items and materials not required to remain property of the Government as well as all debris and rubbish resulting from demolition operations.
e. Contractor will Perform on one side of McClellan Avenue at a time to ensure pedestrians have access to existing sidewalk.
(e) Execution:
a. Subgrade Preparation: Subgrade preparation for sidewalk shall be made to the required depth and to a width that will permit the installation and bracing of the forms. The subgrade shall be shaped and compacted to a firm, even surface in reasonably close conformity with the grade and section on the Plans. All soft and yielding material shall be removed and replaced with acceptable material, which shall then be compacted as directed. The prepared subgrade shall then be brought to true line and grade with a minimum depth of four inches (4") of mineral aggregate base, unless specified otherwise on the drawings.
b. Expansion Joints – see attached drawing
c. Mixing and Placing Concrete: Concrete shall be mixed in accordance. Immediately before placing the concrete, the subgrade shall be thoroughly wetted, and the forms given a coating of light oil. Where removed and used again, the forms shall be thoroughly cleaned and oiled each time before using.
d. Finishing: The concrete shall be struck-off with a transverse template resting upon the side forms. After the concrete has been struck-off to the required cross-section, it shall be finished with floats, trowels, and straightedges until the surface requirements have been obtained.
e. When the surface of the concrete is free from water and just before the concrete obtains its initial set, it shall be gone over and finished with a float and swept lightly with a broom in order to produce a sandy texture. The longitudinal surface variations shall be not more than one-fourth inch (1/4") under a twelve-foot (12') straightedge, nor more than one-eighth inch (1/8") on a five-foot (5') transverse section. The surface of the concrete shall always be so finished as to drain completely. The edges of the sidewalks and median pavement shall be carefully finished and rounded with an edging tool having a radius of one-half inch (1/2").
f. The surface of sidewalks shall be divided into blocks by use of a grooving tool. Grooves shall be so placed as to cause expansion joints to be placed at a groove line. The grooves shall be spaced approximately five feet (5') apart, and the blocks shall be rectangular unless otherwise ordered by the Engineer. The grooves shall be cut to a depth of not less than one-half inch (1/2") and not more than one inch (1"). The edges of the grooves shall be edged with an edging tool having a radius of one-fourth inch (1/4"). Grooves shall be placed in median pavement in line with corresponding joints in adjoining construction or as directed by the COR.
g. The edges of the concrete at expansion joints shall be rounded with an edging tool having a radius of one-fourth inch (1/4"). All marks caused by the edging shall be removed with a wetted brush or float. The top and ends of expansion joint material shall be cleaned of all concrete, and the expansion joint material shall be so trimmed as to be slightly below the surface of the concrete.
h. Truncated DomeTactile- Warning Strip - Detectable warning strip must cover the entire width of the ramp opening, excluding the wings. All domes must be aligned in the direction of travel. one corner of the leading edge of the detectable warning may be more than 5 feet from the back of the curb. When located along a curb return, the leading edge of the detectable warning may be defined by the chord drawn between the leading edges of the ramp opening.
(f) Protection and Curing
a. Protect exposed surfaces of concrete from premature drying, wash by rain or running water, wind, mechanical damage, and excessive hot or cold temperatures.
b. Curing Methods: Cure concrete with curing compound using wet method with sheets.
c. Formed Concrete Curing: Wet the tops and exposed portions of formed concrete and keep moist until forms are removed.
d. If forms are removed before 14 days after concrete is cast, install sheet curing materials as specified above.
e. Concrete Flatwork Curing: Install sheet materials according to the manufacturer's instructions. When manufacturer's instructions deviate from specifications, submit proposed resolution for Contracting Officer's Representative consideration.
f. The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which is not to be removed and which does not unreasonably interfere with the work required under this contract.
The Contractor shall only remove trees when specifically authorized to do so and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workmen, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by the Contracting Officer.
g. The Contractor shall protect from damage all existing improvements and utilities at or near the work site and on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.
(g) Period of Performance: Contractor shall commence work under this contract promptly after
Notice to Proceed (NTP), execute the work diligently, and achieve final completion and acceptance including final cleanup of the premises within four (4) consecutive weeks.
(h) NORMAL OPERATING HOURS-
Normal work hours are 8A.M. to 4:30P.M (negotiable) eastern standard time (EST), Monday through Friday, excluding Federal Holidays and weekends. Contractors must obtain written permission from the COR at least 4 working days prior to work on Saturdays, Sundays, or Federal holidays. The following federal holidays are observed:

3.3 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY
SITE OF THE WORK (MAY 2014)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate
Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the
Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

3.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—
CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition
Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph
(b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

(a) Definitions. As used in this provision—
Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain
Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for
Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

5.2 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF
WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 days after Notice to proceed. The time stated for completion shall include final cleanup of the premises.

5.3 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM
REREPRESENTATION (JUL 2013)
(a) Definitions. As used in this clause—
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to
Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause.
Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the
Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts—

5.4 52.225-9 BUY AMERICAN—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. As used in this clause—
"Commercially available off-the-shelf (COTS) item"—
(1) Means any item of supply (including construction material) that is—
(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
"Component" means any article, material, or supply incorporated directly into construction material.
"Construction material" means an article, material, or supply brought to the construction site by the
Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.
"Cost of components" means—
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the end product (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but…
