Contracting Office Address Wilmington, DE Description This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 in conjunction with Part 13 of Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This Solicitation is issued as a Request for Quote (RFQ), and the solicitation number is 36C244-21-Q-0987.

This notice incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2020-05 effective March 30, 2020, and the Veterans Affairs Acquisition Regulations (VAAR). The complete text of any of the clauses and provisions may be accessed in full text at http://farsite.hill.af.mil.

This Solicitation is unrestricted. The NAICS Code is 811310 – Commercial and Industrial Machinery and Equipment (except automotive and electronic) repair and maintenance and the business size standard is $8 million.

The VISN4 Contracting Office is seeking to purchase services for Generator PM and Load Bank Testing located at the Veterans Affairs Medical Center in Philadelphia, PA. The Statement of Work (SOW) is enclosed.

Service Contract Act Wage Determination No. 2015-4233, Revision No. 17, dated 12/21/2020, applies to this acquisition and will be incorporated into the resulting contract. A copy of the Wage Determination is included with this solicitation as Attachment 1.

This is a new procurement. It does not replace an existing contract. No prior contract information exists.

Complete instructions for submitting a response to this solicitation and applicable provisions and clauses are enclosed. All offerors are advised to pay careful attention to the quote submission instructions as there are very specific instructions as what is required to be provided.

The applicable line item/CLIN are enclosed.

The delivery/task order period of performance (POP) will begin as described in the Statement of Work.

Any award resulting from this solicitation will be issued on a Standard Form 1449.

NOTE: To receive an award resulting from this solicitation, offerors MUST be registered in the System for Award Management (SAM) database IAW FAR 52.212-(k). Registration may be done online at: www.acquisition.gov or www.sam.gov.

Statement of Work A. Purpose:

1. Provide Annual Load Bank Testing services on Emergency Generators for the Philadelphia Corporal Michael J Crescenz Veterans Affair Medical Center (CMCMC) .

B. Locations:

1. Main Hospital Buildings 3, and 30 3900 Woodland Avenue Philadelphia, PA 19104 Description: Provides inpatient and outpatient services for veterans in areas: Emergency Department, Operating Rooms, Intensive Care Unit, Step down Units, Inpatient Units, Outpatient Clinics, Mental Health Services (inpatient/outpatient services), Food delivery, Education, Research, Utility Building, and Parking Garages.

2. Community Living Center 3461 Civic Center Blvd Building 30 Philadelphia, PA 19104 Description: Houses full-time residents in a nursing home setting and administration functions.

3. Dialysis Community Clinic 4129 Chestnut Street Philadelphia, PA 19104 Description: Leases facility for outpatient dialysis.

C. Objectives

1. The CMCMC Healthcare System requires load bank testing services to be performed on emergency generators to comply with NFPA and The Joint Commission (TJC) requirements

2. Perform annual load bank testing and certification in accordance with the standards of the National Fire Protection Association (NFPA) on all emergency generators listed.

3. The contractor shall provide all labor, supplies, transportation, and equipment necessary to perform load bank testing services on emergency generators for the areas defined in this contract.

D. Performance Requirements

1. Perform annual load bank testing and certification in accordance with the standards of the National Fire Protection Association (NFPA) on all emergency generators listed.

2. Provide Manufacture’s recommended maintenance on all generators and equipment prior to load bank testing.

E. Required Contractor Reporting:

1. A full detailed testing report shall be generated; the contractor shall provide the Contracting Officer Representative (COR) with three (3) hard copies at the conclusion of all performance requirements.

2. Reporting Defects: The contactor shall immediately notify the Contracting Officer or COR by way of a separate report, the discovery of any defects or repairs required to the emergency generators. If there is a need for work to be performed beyond the scope of this contract, the contractor shall provide a written cost estimate for any work or materials at no additional cost to the Government. The contractor shall not perform any work or make any purchases beyond the scope without approval from the Contracting Officer.

3. All hard copies of testing reports shall be provided to the COR, or designated representative prior to the Government’s final acceptance.

F. Specific Technical Requirements

1. Load Bank Testing for generators defined under this contract.

2. Test Standards: In accordance with NFPA 110, all emergency generators shall be tested using supplemental loads of 50% of nameplate rating for 30 minutes, followed by 75% of name plate rating for 60 minutes for a total of 1 ½ continuous hours.

4. VA Support during Contact Performance :

a. VA personnel will provide the contractor with access to the appropriate emergency generators for testing for the length of the project.

b. A staging and operation area will be provided to the contractor that will be near the emergency generator to be tested. Exact location will be provided by the COR upon commencement of work.

G. Medical Surveillance

1. For Tuberculosis - Review of all contract worker Tuberculosis (TB) screening requirements and options (reference VHA Directive 2011-036 Safety and Health during Construction). Contractor is required to annual certify all Contractors working on VAPHS have documented screening for latent Tuberculosis within the last 12 months and every 12 months thereafter while working in this medical center. If screening for latent Tuberculosis is positive, clearance from a physician is required prior to working at VAPHS. The Contractor shall also be notified that anyone failing to meet these requirements is not permitted to work onsite and/or may be removed at any time without notice until these requirements are met. 2. For Influenza - Per VHA Directive 1192, all Contractors working at VAPHS are required to show documentation of annual seasonal Influenza vaccination. Provide evidence to COR.

H. Security and Privacy Requirements

1. The COR is responsible for ensuring that all Contractors comply with physical security policies. COR will ensure Contractor obtains required security badge. A compliant ID badge must be worn by Contractors at all times while on VA premises.

2. Contractor may not have access to the VA network or any VA sensitive information under this contract.

3. All Contractors must receive Privacy training annually using one of the following methods:

4. Complete “VA Privacy Training for Personnel without Access to VA Computer Systems or Direct Access to or Use to VA Sensitive Information” training by using VA’s TMS system (https://www.tms.va.gov/). Contractors may use the TMS Managed Self Enrollment method to complete the training in Talent Management System (TMS).

5. Complete the hard copy version of “VA Privacy Training for Personnel without Access to VA Computer Systems or Direct Access to or Use to VA Sensitive Information”. Signed training documents must be submitted to the COR.

6. Training must be completed prior to the performance of the contract and annually thereafter. Proof of training completion must be verified and tracked by the COR.

I. Safety

1. The Contractor shall adhere to all OSHA, EPA, NFPA Life Safety Codes, and all other regulatory requirements.

2. In performance of this contract, the Contractor shall follow CMCMC safety policies and standards for safe work practices and take such safety precautions as the Safety Officer or designee may determine to be reasonably necessary to protect the lives and health of occupants of the building. Contractor is responsible for the supervision of all the employees while on government property.

3. CMCMC is a non-smoking facility.

4. Prior to the commencement of the contract, the contractor shall submit to the COR, the Material Safety Data Sheets (MSDS) for all potentially hazardous materials (lubricants, cleaners, working fluids, etc.) to be used in the facility in performance of the contract. The contractor shall maintain a copy of all MSDS at the chemical storage site in a location accessible to CMCMC personnel to assure compliance with all laws and requirements regarding the “Right to Know” law.

5. The contractor is responsible to identify, provide and maintain all personal protective equipment required to perform the duties outlined in the contract. In addition, the Contractor is responsible for identifying and providing all applicable safety programs (i.e. lockout/tag out, confined space entry, universal precautions, etc.) required performing the work. Training on required safety programs and the proper use of PPE’s shall be provided, and documentation maintained by the contractor.

J. Interference in Performance Requirements:

1. The following provisions shall be adhered to by contractor personnel throughout the duration of this contract:

2. Contractor may be required to interrupt their work at any time so as not to interfere with the normal functioning of the facility; e.g. utility services, servicing of fire protection systems, and the passage of facility patients/personnel, etc.

3. In the event of an emergency, contractor services may be stopped and rescheduled at no additional cost to the government.

4. Contractor personnel shall inform the COR of the need to gain access to secured areas. If access is required to secure areas, prearranged scheduling will be made by the COR.

K. Contractor Responsibilities:

1. The contractor shall be responsible for the actions of all individuals provided to work for the VA under this contract. In the event that damages arise for work performed by contractor provided personnel, the contractor shall be responsible for all resources necessary to remedy the incident.

2. The Contractor shall be responsible for ensuring all provided personnel are properly licensed to operate a motor vehicle if operating a motor vehicle on VA property is required.

L. Performance Schedule:

1. The contractor shall complete all performance requirements within 30 days of the contract award.

M. Working Hours:

1. All work shall be performed Monday through Friday (except Federal Holidays), 7:00 AM Eastern – 3:30 PM Eastern.

N. Reporting

1. The Contractor shall immediately notify the Contracting Officer or COR in writing in a separate report from the load bank testing of the existence of any defects in, or repairs required to the generators and shall furnish a written estimate of the cost to make the necessary repairs.

2. Contractor to provide report to COR within 10 days of the load back completion.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

(End of Clause) C.4 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes FAR 52.219-6 Notice of Total Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

C.5 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.212-1 Instructions to Offerors -- Commercial Items (OCT 2018) applies to this acquisition.

Addenda to 52.212-1:

I. Quote Submission Instructions:

A. Failure to follow the instructions below may result in elimination from award consideration or a non-responsive determination.

1) Quotes shall be sent electronically via e-mail.

2) All quotes shall include one (1) separate electronic copy of each of the Section listed below. The Sections must be clearly identified as described below (either as the title of the document or on the actual document).

3) No price information shall be included in the technical section. If pricing information is found in the technical section, the quote will automatically be considered non-responsive and not evaluated.

4) The font of text shall be no larger than 12 pt and no smaller than 10 pt.

5) All page number requirements will be strictly followed. Any extra pages will be extracted from the document starting at the last page and working backwards until the page limit is achieved.

B. Section I Administrative/Regulatory. Page limit: None. Please be advised that this Section is not sent for technical evaluation.

1. Completed certifications and representations located at FAR 52.212-3, or an indication that said certifications and representations are current and located in the SAM database.

C. Section II Technical Page limit: 10 pages including any coversheets and table of contents. Brochures are not included in the page limit.

Vendors shall provide a narrative (including any descriptive literature and/or certifications) which demonstrates the offeror’s ability to meet the technical credentials, capability, and specifications as stated in the Statement of Work (SOW). The narrative shall not exceed ten (10) pages and address the following requirements:

1)Provide detailed narrative which fully describes the process the vendor proposes to use to perform the services as described in the SOW. This narrative shall include information regarding subcontractors proposed and a detailed description of how the offeror plans to adhere to the requirements of 13 CFR § 125.6. Subcontractor’s DUNS and SBA size information must be included. A copy and paste of the SOW into the technical portion of the quote is not an acceptable response to the Government’s request and may result in an “Non-Responsive” determination.
2)Provide a copy or description of all certifications/experience required to perform the services in accordance with the SOW. The certifications/experience should distinguish if the information provided is for the prime or the subcontractor. Failure to provide this information or clearly identify what information is for the prime/subcontractor may result in a “Non-Responsive” determination.

D. Section III Redacted Technical. Redacted copy of Section II. Page limit: 10 pages including any coversheets or table of contents.

The redacted copy is the document that will be sent to the technical evaluators. The redaction should eliminate the vendor’s name, any names of individuals working for the company, email addresses or any other identifying data. The purpose of the redaction is an attempt to hold an unbiased evaluation. The vendor is responsible for redaction of this section and the Government will not apply further redactions to this section. This section will be reviewed prior to submission to the technical evaluators and, if it is determined that it contains vendor information (DUNS, CAGE, Phone Numbers, Names, etc) the vendor may be considered non-responsive and no longer considered for award.

E. Section IV Price. No page limit.

II. Evaluation of Quotations of Offers IAW FAR 13.106-2(b)(3) The Government intends to issue a single purchase order in response to this solicitation.

A Comparative Evaluation of quotes will be performed in accordance with FAR 13.106-2(b)(3).

E.1 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019) The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items.

(a) Definitions. As used in this provision— Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
