B.3 STATEMENT OF WORK

Statement of Work:

Hyperchlorination of Water Distribution System

Description: This project involves the disinfection of the hot and cold water distribution system in the Community Living Center (CLC), New Clinical Additional (NCA) and Main Hospital

(Building 1) by hyperchlorination. Work includes testing for total chlorine, free chlorine and pH to determine disinfection efficacy.

Performance Period: 60 days from award

Purpose: To comply with VA Policy and ASHRAE, NIOSH and other relevant industry standards on the prevention of the spread of Legionella Disease.

Scope: The Contractor shall provide all materials, tools, equipment, labor and supervision required to perform the following work:

1.0 Background: The VA Medical Center in Wilkes-Barre, PA requires the services to hyperchlorinate, test and flush its water distribution system (both hot and cold). The work must be performed in three phases to limit impacts to operation of the facility and to ensure complete disinfection of the entire distribution system. All work shall be in compliance with AWWA C651-99 Disinfecting Water Mains. All testing shall be performed by a licensed and certified testing lab in accordance with all requirements of the Pennsylvania Department of Environmental Protection (PADEP) and United States

Environmental Protection Agency (EPA). The Contractor shall employ a minimum, Water Treatment System Operator certified in biocide treatment or a Licensed

Professional Engineer with a minimum of 7-years of experience in drinking water treatment system design and operation to be the Onsite Project Manager. The Contractor shall also employ and have available onsite sufficient qualified personnel to perform the work in a timely and expeditious manner.

2.0 Submittals: Prior to commencing any work, the Contractor shall provide the Contract

Officer Representative (COR) with the following:

1. Copies of all licenses, resumes and/or certifications for the Project Manager, Water

Treatment System Operator, Engineer, Testing Technician(s) and, Testing Lab(s).

2. A detailed Work Plan describing phasing and the proposed protocol for conducting the hyperchlorination including points of injection, injection rates, equipment used, testing points, testing methods, testing equipment and flushing procedures.

3. Safety Data Sheets (SDS)s for Sodium Hypochlorite (NaClO) and any other chemicals to be used and documentation that the materials are certified for use in drinking water systems.

4. Procedures for testing of free chlorine, total chlorine and pH including specifications for testing equipment and certification that equipment meets EPA approved methods for testing of drinking water.

3.0 Description of Facility Water Distribution System: The Wilkes-Barre VA Medical

Center purchases its potable water from Pennsylvania American Water. Water enters the

VA Facility through a single main metering pit. Water then enters a loop main that encircles the facility and provides water for distribution to the facility including, but not limited to: a 400,000 gallon elevated storage tank; the main Medical Center (Bldg. 1); the

Community Living Center (CLC); the New Clinical Addition (NCA); various administrative outbuildings; fire hydrants; and, yard spigots.

Water is supplied to the areas used for clinical operations at three points: the main boiler plant which serves Bldg. 1; the CLC Mechanical Room which serves the CLC; and, the

NCA Mechanical Room which serves the NCA. At each of these locations, water is filtered through a bank of 10μ bag filters prior to distribution to the points of use. In

Building 1, water leaving the filters is pumped up to the 8,000 gallon day tank on the

13th Floor for gravity storage prior to distribution to the points of use. In the CLC and

NCA, water leaving the filters goes directly to the points of use. Each of these three distribution systems provide hot and cold water, are isolated from each other and have no cross connections.

All hot water for the Medical Center is “on-demand” using steam heat exchangers and is distributed through a recirculating distribution system.

(Note: The following information is provided to assist the Contractor in developing a Work

Plan to perform the hyperchlorination.)

4.0 Proposed Procedure: Contractor shall visit site prior to commencement of hyperchlorination and determine the locations for injection of NaClO. Contractor shall install injection ports, valve and other appurtenances as necessary to allow for attachment of chemical injection pumps. Actual work performance dates/times shall be coordinated with VA staff. These dates/times shall include nights and weekends as required by VA staff. It is anticipated that the work will occur over three separate weekends within a 2-month timeframe. Each weekend, one of the distribution systems servicing the clinical areas will be treated (CLC, NCA or Bldg. 1). The Contractor shall locate two points of injection for the sodium hypochlorite (NaClO)—one for the cold-water distribution system and one for the hot-water distribution system. The Contractor shall then inject a sufficient amount of NaClO to create a free chlorine residual of 5.0 mg/l (ppm) at the furthest point of the hot and cold distribution system. The Contractor may work onsite prior to testing to locate and prepares the injection points.

The Contractor shall verify chlorine residuals by using a calibrated colorimeter testing apparatus such as a HACH DR820 or similar approved unit. The chlorine test unit shall utilize an EPA approved method to measure Free Chlorine and Total Chlorine in the range of 0 to 10 mg/l (ppm). The Contractor shall also measure pH using a calibrated portable pH Meter such as a HACH HQ40d or similar approved unit.

The VA will have a minimum of 4 staff member available to assist the Contractor in accessing sinks and showers throughout the distribution system being tested. VA staff will assist the Contractor in running the faucets and showers and providing access to all areas as required. However, the Contractor shall supply sufficient personnel and testing equipment to ensure all areas have an elevated chlorine residual within 2-hours of starting the treatment. This will require running all faucets and sinks and taking representative samples to ensure a sufficient residual is present.

From the moment testing begins until it ends, no water will be used for potable purposes in the area being treated. Upon verification of sufficient residual in both the cold and hot distribution systems, the chlorine injection shall stop and the injection equipment shall be removed from the system. Throughout testing, the use of cold water shall be allowed for the flushing of toilets only. However, no hot water shall be used for a period of 24-hours. At the end of the 24-hours, the Contractor shall return and, with the assistance of

VA Staff, flush the entire distribution system (hot and cold) until sufficient testing indicates that the water has returned to background residual levels. Once the system has been flushed, the Contractor shall have a Certified Testing Lab and Technician test the water at six locations (total 18) on the distribution system that was just treated (3 cold-water and 3 hot-water) and have the samples tested for Total Coliform, Legionella (large volume test (1000 ml) for all serogroups of L. Pneumophila), Bac-T, TSS, TDS and inorganics.

Up to 35% of the sinks and showers on each floor shall be tested to assure proper chlorine residual. The Contractor shall record all chlorine and pH measurements noting time and location and provide that information to the VA in the form of an Excel

Spreadsheet along with the original results of all of the laboratory tests prior to final payment.

The inventory of sinks and showers in Appendix A and B are estimates and should be used as a general reference, the numbers are subject to change. Field verification shall be conducted by the Contractor at the time of hyperchlorination.

RECORDS MANAGEMENT OBLIGATIONS

A. Applicability

This clause applies to all Contractors whose employees create, work with, or otherwise handle Federal records, as defined in Section B, regardless of the medium in which the record exists.

B. Definitions

“Federal Record” as defined in 44 U.S.C. § 3301, includes all recorded information, regardless of form or characteristics, made or received by a Federal agency under Federal law or in connection with the transaction of public business and preserved or appropriate for preservation by that agency or its legitimate successor as evidence of the organization, functions, policies, decisions, procedures, operations, or other activities of the United States Government or because of the informational value of data in them.

The term Federal record:

1. includes [Agency] records.

2. does not include personal materials.

3. applies to records created, received, or maintained by Contractors pursuant to their [Agency] contract.

4. may include deliverables and documentation associated with deliverables.

C. Requirements

The following standard Items relate to records generated in executing this contract and should be included in a typical contract where records could possibly be created, maintained or dispositioned:

1. Contractor shall comply with all applicable records management laws and regulations, as well as

National Archives and Records Administration (NARA) records policies, including but not limited to the

Federal Records Act (44 U.S.C. chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII

Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.

2. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C.

chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the

Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.

3. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the

Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.

4. [FACILITY] and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of [FACILITY] or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18

U.S.C. 2701.

In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to [FACILITY]. The agency must report promptly to NARA in accordance with

36 CFR 1230.

5. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government’s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to [FACILITY] control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4).

6. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The

Contractor (and any sub-contractor) is required to abide by Government and [FACILITY] guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.

7. The Contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with [FACILITY] policy.

8. The Contractor shall not create or maintain any records containing any non-public [FACILITY] information that are not specifically tied to or authorized by the contract.

9. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.

10. The [FACILITY] owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which [FACILITY] shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by

FAR 52.227-11 through FAR 52.227-20.

11. Training. All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take VHA-provided records management training, Talent Management

System (TMS) Item #3873736, Records Management for Records Officers and Liaisons. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.

[Note: To the extent an agency requires contractors to complete records management training, the agency must provide the training to the contractor.]

D. Flowdown of requirements to Subcontractors

1. The Contractor shall incorporate the substance of this clause, its terms and requirements including this paragraph, in all subcontracts under this [contract vehicle], and require written subcontractor acknowledgment of same.

2. Violation by a subcontractor of any provision set forth in this clause will be attributed to the

Contractor.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. C.3 VAAR 852.215-70 SERVICE-DISABLED VETERAN-OWNED AND

VETERAN-OWNED SMALL BUSINESS EVALUATION FACTORS (OCT 2019)

(a) In an effort to achieve socioeconomic small business goals, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business status and their proposed use of eligible service-disabled veteran-owned small businesses (SDVOSBs) and veteran-owned small businesses (VOSBs) as subcontractors.

(b) Eligible service-disabled veteran-owned small businesses offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the

Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor.

To receive credit, an offeror must be registered and verified in the Vendor Information Pages

(VIP) database.

(c) Non-Veteran offerors proposing to use SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. C.5 VAAR 852.219-75 SUBCONTRACTING COMMITMENTS MONITORING

AND COMPLIANCE (JUL 2018)

(a) This solicitation includes the clause: 852.215-70 Service-disabled veteran-owned and veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.

(b) The Contractor is advised that in performing contract administration functions, the

Contracting Officer may use the services of a support contractor(s) to assist in assessing

Contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an

“Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor compliance with the subcontracting commitments.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT

REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a

Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National

Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting

Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.

A. Failure to follow the instructions below may result in elimination from award consideration or a non-responsive determination.

2) All quotes shall include one (1) separate electronic copy of each of the Section listed below. The

Sections must be clearly identified as described below (either as the title of the document or on the actual document).

3) No price information shall be included in the technical section. If pricing information is found in the technical section, the quote will automatically be considered non-responsive and not evaluated.

4) The font of text shall be no larger than 12 pt and no smaller than 10 pt.

5) All page number requirements will be strictly followed. Any extra pages will be extracted from the document starting at the last page and working backwards until the page limit is achieved.

B. Section I Administrative/Regulatory. Page limit: None. Please be advised that this Section is not sent for technical evaluation.

C. Section II Technical Page limit: 10 pages including any coversheets and table of contents. Brochures are not included in the page limit.

Vendors shall provide a narrative (including any descriptive literature and/or certifications) which demonstrates the offeror’s ability to meet the technical credentials, capability, and specifications as stated in the Statement of Work (SOW). The narrative shall not exceed ten (10) pages and address the following requirements:

1) Provide detailed narrative which fully describes the process the vendor proposes to use to perform the services as described in the SOW. This narrative shall include information regarding subcontractors proposed. Subcontractor’s DUNS and SBA size information must be included. A copy and paste of the SOW into the technical portion of the quote is not an acceptable response to the Government’s request and may result in an “Non-Responsive” determination.

2) Provide a copy or description of all certifications/experience required to perform the services in accordance with the SOW. The certifications/experience should distinguish if the information provided is for the prime or the subcontractor. Failure to provide this information or clearly identify what information is for the prime/subcontractor may result in a “Non-Responsive” determination.

D. Section III Redacted Technical. Redacted copy of Section II. Page limit: 10 pages including any coversheets or table of contents.

The redacted copy is the document that will be sent to the technical evaluators. The redaction should eliminate the vendor’s name, any names of individuals working for the company, email addresses or any other identifying data. The purpose of the redaction is an attempt to hold an unbiased evaluation. The vendor is responsible for redaction of this section and the Government will not apply further redactions to this section. This section will be reviewed prior to submission to the technical evaluators and, if it is determined that it contains vendor information (DUNS, CAGE, Phone Numbers, Names, etc) the vendor may be considered non-responsive and no longer considered for award.
