STATEMENT OF WORK
DESIGN AND INSTALL FLOOR AND DISHWASHER IN KITCHEN
This project consists of the Professional Design for the development of construction documents and Construction Services for the replacement of the kitchen floor including the dishwasher are. The dishwasher will have to be replaced with a rental for the duration of the floor replacement phase of this project.
The A/E Services required are for site survey and investigation, construction drawings, specifications, and construction period services. This work shall involve preparing the site location for a temporary portable dishwasher, 300 – 500 dishes per hour and preparing it for the connections needed for water and power. The A/E will need to design the replacement of tile and water proof the remainder of the main kitchen wet bed floor. As-build drawing will be provided for the existing location. The A/E will work with VA Project Management Staff to develop the necessary working drawings, phasing plans and specifications for full and complete construction of this project. Completed construction plans shall be stamped by a professional engineer licensed in the State of Pennsylvania.
All designs must, at a minimum, be in accordance with all applicable Federal, State and Local codes as well as the Department of Veterans Affairs (VA) publications (Master Construction Specifications, Space Criteria, Construction Standards, etc.). The floor replacement is to be installed in several phases to maintain the day to day operation of the kitchen. The following are proposed five phases, The contractor/ A/E shall investigate and modify as required and approved by the VA engineer and kitchen service:
Phase I Portable Dishwasher Set-up.
Provide labor and material necessary to upgrade floor Building #2 main Kitchen located on ground floor. As follows:
1. Provide and Install rental temporary portable dishwasher 300-500 dishes trailer. Place the building 2 loading Dock first bay next to kitchen door to the loading Dock.
2. Pipe the temporary rental dishwasher from ¾” hot and cold pipe located in trash room located in the loading dock (25 ft.).
3. Provide power for temporary rental dishwasher from EEK panel located in the kitchen approximately 150 FT from the loading dock. 220/480 Volt is available.
4. Connect temporary rental dishwasher to 4” drain line below the loading dock existing 4” drain. Approximately 150 FT.
5. Start up and test the rental dishwasher and demonstrate operation to kitchen staff. Provide emergency repair service for renal duration.
6. Provide and install ICRA wall and vacuum machine for floor demolition.
7. Disconnect, plumbing, electrical power from existing dishwasher, remove, protect and store dishwasher for future use.
8. Remove, protect and store dishwasher conveyer for future use.
9. Demolish/ remove floor tile, wet set concrete approximately 4” deep to, 1200 SQ FT.
10. Remove all floor drains total (4) in dishwasher room.
11. Install new water proof wet bed approximately 3”- 4” in lieu of the broken bed. Install new floor drains total (4) to match existing. Slope the wet bed floor to drain per plumbing code. Install dishwasher floor sink per the plumbing code.
12. Install new tile and base to match existing tile same color and thickness, Approximately 1200 SQ.FT.
13. Remove clogged drain pipes under the floor drains located outside the computer room in the subbasement Approximately 240 linear Feet of cast iron 4” drain pipe. Provide straight run for hot and cold water to the dishwasher to prevent tripping hazard.
14. After completion of the dishwasher room floor and concrete cure, bring and install the original stored dishwasher. Connect electricity, plumbing, test and start up. Install and Power the conveyer. Demonstrate to VA staff.
15. Disconnect and remove (electrical, plumbing, drains) the temporary dishwasher trailer. Restore the plumbing in the trash room and temporary used drain
16. Qualified mechanical contractors with similar experience in health care projects will be considered.
17. All work shall be performed during normal work hours 7:00 AM to 4:00 PM. All water shut downs will be performed during premium time 8:00 PM to midnight or on weekends. The contractor shall consider two shut downs. One for disconnecting and one for reconnecting.
18. Job duration is 30 calendar days.
Phase II (13500 SF) Prep, Pot wash and HAC:
1. Coordinate all work with Plumbing foreman at 215-823-4127, for working in area, lock out tag out, starting and stopping kitchen equipment.
2. Build complete ICRA fire rated wall, sealed with negative pressure to the surroundings. Use the electrical room exist for working in this phase.
3. Remove kitchen equipment, store equipment in area designated by VA, protect equipment, and Remove floor wet bed approximately 3” in some areas, cove remove base. Control all dust to maintain the daily operation of kitchen.
4. Remove all floor drains, drains from equipment below floor in subbasement, replace all cast iron and galvanized piping.
5. Install new drains and new piping for equipment in this phase.
6. Submit cuts for tile to match new tile area around the steamers, submit cuts for drains and water proof system to VA engineer.
7. Install new tile, wet bed, water proof system MAPEI similar or equal to existing.
8. Reinstall equipment; reconnect piping, power, utilities. Test and restart equipment.
9. This phase work duration is 21 days.
10. All work shall be performed after the kitchen closes, 8:00 PM to 5:00 AM.
11. Work in accordance with SK-1 Phase III and phase IV Tray Make up:
The contractor shall consider Phase II and Phase III as two completely separate phases. The area was divided to two phases to maintain the operation in the kitchen.
1. Coordinate all work with Plumbing foreman at 215-823-4127, for working in area, lock out tag out, starting and stopping kitchen equipment.
2. Build complete ICRA fire rated wall, sealed with negative pressure to the surroundings. Use the electrical room exist for working in this phase.
3. Remove kitchen equipment, store equipment in area designated by VA, protect equipment, and Remove floor wet bed approximately 3” in some areas, cove remove base. Control all dust to maintain the daily operation of kitchen.
4. Remove all floor drains, drains from equipment below floor in subbasement, replace all cast iron and galvanized piping.
5. Install new drains and new piping for equipment in this phase.
6. Submit cuts for tile to match new tile area around the steamers, submit cuts for drains and water proof system to VA engineer.
7. Install new tile, wet bed, water proof system MAPEI similar or equal to existing.
8. Reinstall equipment; reconnect piping, power, utilities. Test and restart equipment.
9. This phase work duration is 30 days.
10. All work shall be performed after the kitchen closes, 8:00 PM to 5:00 AM.
11. Work in accordance with SK-1 Phase V Corridors CB2-16 and CB2-15
12. Build complete ICRA fire rated wall, sealed with negative pressure to the surroundings. Use the electrical room exist for working in this phase.
13. Remove kitchen equipment, store equipment in area designated by VA, protect equipment, and Remove floor wet bed approximately 3” in some areas, cove remove base. Control all dust to maintain the daily operation of kitchen.
14. Remove all floor drains, Install new drains.
15. Submit cuts for tile to match new tile area around the steamers, submit cuts for drains and water proof system to VA engineer.
16. Install new tile, wet bed, water proof system MAPEI similar or equal to existing.
17. Reinstall equipment; reconnect piping, power, utilities. Test and restart equipment.
18. This phase work duration is 3 days.
19. All work shall be performed after the kitchen closes, 8:00 PM to 5:00 AM.
20. Work in accordance with SK-1.
21. The contractor shall maintain access in this area all time during kitchen operation. The contractor has option to divide the Corridor or finish it in one night.
Phase VI Corridor CB2-17
22. Coordinate all work with Plumbing foreman at 215-823-4127, for working in area, lock out tag out, starting and stopping kitchen equipment.
23. Build complete ICRA fire rated wall, sealed with negative pressure to the surroundings. Use the electrical room exist for working in this phase.
24. Remove kitchen equipment, store equipment in area designated by VA, protect equipment, and Remove floor wet bed approximately 3” in some areas, cove remove base. Control all dust to maintain the daily operation of kitchen.
25. Remove all floor drains.
26. Install new drains in this phase.
27. Submit cuts for tile to match new tile area around the steamers, submit cuts for drains and water proof system to VA engineer.
28. Install new tile, wet bed, water proof system MAPEI similar or equal to existing.
29. Reinstall equipment; reconnect piping, power, utilities. Test and restart equipment.
30. This phase work duration is 3 days.
31. All work shall be performed after the kitchen closes, 8:00 PM to 5:00 AM.
32. Work in accordance with SK-1
33. The contractor shall maintain access in this area in this phase during kitchen operation. The contractor has the option of dividing the corridor or finishing it in one day.
34. Qualified contracting with kitchen, plumbing and tile work experience will be considered.
35. Total job duration is 150 calendar days.
36. The contractor shall match existing tile, color, size and grout color.
1. Design Build Solicitation This project will be solicited as a firm fixed price best value contract. The solicitation will be conducted as a two phase design build in accordance with FAR 36.3. The A/E and construction contractor team shall be required to submit information in two phases.
A. Under Phase I of the solicitation the contractor Design-Build Team shall be required to submit detailed information on the following as explained later in the solicitation:
a) Technical approach
b) Specialized experience and technical competence
c) Capability to perform
d) Past performance The factors are of equal weight of importance, and an overall rating shall be assigned.
The following information/documentation is required as part of the offeror’s Phase I proposal:
SUBMISSION REQUIREMENTS for Phase I: Interested firms having the capabilities to perform this work shall submit one (1) hard copy along with one (1) electronic (CD) copy. Submissions by electronic means are NOT permitted. All questions are to be sent to the attention of Cheryl.Roberts2@va.gov . Additionally, the submission shall include an insert detailing the following information:
1. Dun & Bradstreet Number
2. Tax ID Number
3. The e-mail address and phone number of the Primary Point of Contact
4. A printed copy of the firm’s VetBiz Registry
5. Certification of OSHA and EPA violations
6. EMR Rating
7. Contractor shall provide detailed information for each of the following factors that the Government will evaluate. Information shall be presented in a manner that highlights your firm’s capabilities in meeting the specific areas that are listed under each evaluation factor. Detailed information of Phase I:
a) Technical Approach – provide design and construction approach; roles and responsibilities; quality control policies and standards; scheduling methodology; and considerations for fast tracking.
b) Specialized Experience and Technical Competence to include general renovations; number and duties of proposed staff; addressing function, responsibilities and authorities of key personnel designing and constructing to salt shed requirements.
c) Past Performance of at least three but no more than five projects similar in size and scope.
This information will then be evaluated and the Government shall select the three most highly qualified offerors. The Contracting Officer will then issue a Request For Proposal to the three most highly qualified offerors to provide the information per Phase II of the solicitation.
B. Under Phase II of the solicitation the contractor Design-Build Team shall be required to submit the following as detailed later in the solicitation:
a) Schematic Design Concept/Proposed Technical Solution
b) Construction Management
c) Management Capability
d) Pricing (Will be a separate package) The non-price factors a) and b) are equal in importance, and when combined are significantly more important than c) price.
The following information/documentation is required as part of the offeror’s Phase II proposal:
SUBMISSION REQUIREMENTS for Phase II: The three most highly qualified offerors shall submit one (1) hard copy along with one (1) electronic (CD) copy. Submissions by electronic means are NOT permitted. All questions are to be sent to the attention of Cheryl.Roberts2@va.gov . Additionally, the submission must include an insert detailing the following information:
a) Schematic Design Concept/Proposed Technical Solution
b) Construction Management
c) Schedule
d) Pricing with a detail price breakdown by division (Will be a separate package)
e) Bond guarantee executed on Standard Form SF 24 in an amount not less than 20 percent of the proposed price but shall not exceed $500,000. Failure to furnish the required guarantee on the proper form (SF 24), shall require rejection of a proposal as unacceptable except those listed in FAR 28.101-4, and may be cause for rejection.
This information will then be evaluated and the offeror evaluated as representing the best value to the Government shall be awarded the contract.
2. Phase I Rating Guidance:
There are four (4) non-priced evaluation factors for Phase I. There are three (3) technical and one past performance. Each factor will receive a rating with an overall total rating established for Phase I.
Phase I Evaluation Factors The factors are of equal weight of importance
1) Technical Approach:
This factor evaluates how the individual offeror will approach the design and construction of this project. The offeror shall provide detailed information addressing the organization and the roles and responsibilities of the various sub-contractors for both the design and construction. Offeror shall also provide adequate detail on the offeror’s policy with regard to Quality Control (QC) and how the offeror intends to achieve this standard on the project. The offeror is to provide the scheduling methodology and demonstrate an understanding of its limitation and success. The offeror shall also include considerations of “Fast Track” construction whereby preliminary site construction activities can begin prior to the completion of the accepted 100% design documents
2) Specialized Experience and Technical Competence:
This factor evaluates the experience of the construction firm and design team in completing projects requiring skills similar to those anticipated for this contract. This includes preparing the site for a new structure, carpentry, metal work, and electrical services for the area to allow for the construction of a new canopy. This factor also evaluates offeror’s number of personnel and the duties of proposed technical staff to determine if offeror has the ability to manage project within the area of consideration without significant difficulty. Offeror should adequately address functions, responsibilities and authorities for performing such duties as overall project management, site superintendence, quality control, safety, administration and in-house trade capabilities. Offeror shall provide a minimum of three (3) project examples of the type that best represents the proposed Corporal Michael J. Crescenz VA Medical Center replace salt shed project.
3) Capability to Perform:
This factor evaluates the ability of the Construction firm to perform given their current projected workload and the availability of their key personnel, to accomplish the project in the required time.
4) Past Performance The Past Performance proposal evaluation will consider such things as an offeror's business practices, quality, customer relationship, and ability to successfully perform as proposed and other considerations considering currency, relevancy, sources, context, and trends. Past Performance includes current on-going (present) performance.
To conduct the performance risk assessment, the Government may use data provided by the offeror, and data obtained from other sources. An offeror with no Past Performance may receive a rating based on the evaluation of its predecessor companies, key personnel, and/or subcontractors, provided an Exhibit #3 has been executed and included in the proposal for proposed subcontractors and/or potential key personnel not employed by the contractor. These ratings may have the same weight as the ratings of the proposing company. If such information is not applicable (i.e., the offeror does not have a predecessor company, key personnel or subcontractors with relevant experience), the offeror shall be evaluated as "Neutral”. However, the proposal of an offeror with no relevant Past Performance history, while rated ”Neutral” in Past Performance, may not represent the most advantageous proposal to the Government. For the purpose of this solicitation, currency is performance occurring within the last five years through the solicitation release date. Within this period, performance occurring later in the period may have greater significance than work occurring earlier in the period. For example, performance information for work occurring during 2015 may have greater importance than performance information for work occurring during 2010. In assessing relevancy, the Government may evaluate an offeror's references for similarity of the construction methods to the scope of this solicitation, (multi-discipline or specialized area), scope/type of contracts/projects, cost magnitude of projects as it relates to price. Performance on managing multiple multi-disciplined projects at one time may also be considered.
3. Phase II Rating Guidance:
There are three (3) non-priced evaluation factors and one (1) price evaluation factor for Phase II of the solicitation.
Phase II Evaluation Factors The following factors are equal in importance, and when combined are significantly more important than price.
1) Schematic Design Concept/Proposed Technical Solution:
This factor evaluates the offers schematic design based on functional layout and efficiency in design.
2) Construction Management:
This factor evaluates the individual experience of the persons that are to be assigned to this project and the coordination of the efforts of all personnel to comply with the requirement. This includes the quality control plan and safety plan/certifications.
3) Scheduling:
This factor evaluates the proposed project schedule, including bar chart meeting or exceeding the performance period identified in the Scope of Work.
4) Price Evaluation:
The Contracting Officer shall determine price as fair and reasonable per FAR 15.404-1(b)(2)(i). The Contracting Officer may consider value analysis of relative worth of a product or approach as a benefit for the Government in conjunction with price analysis.

EVALUATION CRITERIA FOR AWARD
This section of the solicitation outlines the competitive source selection process which will result in one (1) award to an eligible Service Disabled Veteran Owned Small Business (SDVOSB) concern. The selection process is structured based on a two phase Design-Build selection process in accordance with FAR Subpart 36.3. In addition, the evaluation incorporates the procedures in FAR Subpart 15.1 utilizing a “Best Value” source selection process with the option of a trade-off strategy for all non-cost/non-price evaluation factors. The Government intends to award, without discussions to the offeror deemed responsible in accordance with the Federal Acquisition Regulation (FAR) Subpart 9.1 and FAR 52.215-1. The offeror’s proposal must conform to the solicitation requirements and be judged to represent a “Best Value” to the Government. The “Best Value” is the most advantageous offer, design concepts, proposed technical solutions, key personnel, construction management and price considered and consistent with the Government's stated importance of evaluation criteria. THE GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN THE LOW PRICED OFFERORS. This may result in award being made to a higher-rated, higher-priced offeror where the Contracting Officer determines that an offeror's proposal offers a “Best Value” that outweighs the price difference. To arrive at a best value decision, an integrated assessment between all non-cost/non-price evaluation factors and price will be conducted.
Phase one 1 of the selection process includes the receipt of offers from all interested firms eligible to receive an award set-aside exclusively for Service Disabled Veteran Owned Small Business(SDVOSB) concerns. NO PRICING INFORMATION SHALL BE SUBMITTED DURING THIS PHASE 1 PROCESS. The Phase 1 evaluation will consist of a review and evaluation of each offer against the Phase 1 evaluation factors. Thereafter, proposals shall be rated and the three (3) most highly rated offers shall be selected to participate in the Phase 2 of this process. All offers not selected to participate in Phase 2 shall be notified that no further consideration of their proposal will be given.
The Phase 2 evaluation process will exist amongst the three (3) most highly rated offers selected from Phase 1. The Phase 2 proposals shall be submitted in two parts: Volume 1-Technical Proposal and Volume 2-Price Proposal. The Phase 2 evaluation process will consist of an in depth review of an offeror’s technical approach, as well as an examination of the offeror’s response to each evaluation criteria as compared to the solicitation requirements. In the final selection, proposals will be rated based on an offeror’s demonstration of technical understanding by the thoroughness, soundness, comprehensiveness and price reasonableness of its technical approach.
PHASE 1 EVALUATION FACTORS
Offerors shall be evaluated according to the following evaluation factors for Phase 1:
i. Technical approach to performing the work as outlined in the Scope of Work.
ii. Specialized experience of the A/E in designing similarly scoped projects.
iii. Experience of contractor team in performing canopy construction projects.
Phase 1-The Phase 1 evaluation will result in the selection of the three (3) most highly rated offers for participation and proposal submission in the Phase 2 process. During the Phase 1 evaluation process only technical evaluation factors will be considered. No consideration of pricing will occur during this phase. The evaluation factors under consideration for Phase 1 are listed below, and will be evaluated as Excellent, Good, Satisfactory, Marginal and Unsatisfactory.
Factor 1: Technical Approach a.) Offerors shall provide a written narrative approach proposed to accomplish the statement of work. Discussion of the technical approach shall contain explanations of proposed approaches to performing and accomplishing the work.
b.) Include as part of the narrative a statement of any problems anticipated in accomplishing the work and an evaluation of the various methods considered for resolving the problems/difficulties c.) Include a proposed project plan which outlines the work to be accomplished to include a start/completion schedule.
d.) Offeror shall include the extent of anticipated subcontracting together with a list of work to be subcontracted.
Factor 2: Specialized Experience and Technical Competence Offeror shall describe their specialized experience and technical competence in working in a hospital or medical center environment. Information provided under this section shall include the specialized experience and technical competence of key personnel proposed for this project to include both Design and Construction Period services. Offerors shall also describe the resources that will be applied to this project and describe the unique capability they offer to the VA. Offer shall describe the areas of work that will be subcontracted to specialty contractors.
Factor 3: Capability to Perform:
Demonstrates in detail their current projected workload and the availability of their key personnel that shall ensure all contractual requirements will be completed on time.
Factor 4: Previous Experience/Past Performance Offerors shall describe a minimum of three (3) and a maximum of five (5) completed Design/Build projects within the past 5 years, where the work occurred in a hospital or medical office setting. The projects listed under this factor shall be similar in scope and complexity as the subject project (Construct Canopy). Information listed under this factor must be completed projects. Projects listed under this factor that are not completed will seriously affect the rating of the offer. Phase 2- The Phase II proposals shall be submitted in two parts: Volume 1-Technical Proposal and Volume 2-Price Proposal. Evaluators will initially be provided only the technical proposal of the offerors selected for participation in Phase 2. Following completion of the technical evaluation, the SSEB will be provided pricing information for further consideration. An integrated assessment of design concept/proposed technical solution, construction management, key personnel, capability to perform and price will be conducted, and the results ranked. A trade-off may occur, if the Contracting Officer determines that an offeror's proposal offers a “Best Value” that outweighs a higher price.
The “Best Value” is the most advantageous offer, design concept/proposed technical solutions, construction management, key personnel, capability to perform and price considered and consistent with the Government's stated importance of evaluation criteria. The evaluation factors under consideration for Phase 2 are listed below, and will be evaluated as Excellent, Good, Satisfactory, Marginal and Unsatisfactory.

(a) Bidding materials consisting of drawings, specifications and contract forms may be obtained by qualified General (Prime) Contractors interested in submitting bids direct to the Department of Veterans Affairs from www.FBO.GOV
(b) Subcontractors, material firms and others interested in preparing sub-bids may obtain a list of Prime Contractors from www.FBO.GOV via the Interested Vendors Section.
(c) A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.
(d) If the contract will exceed $100,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification.
DESCRIPTION OF WORK:
Contractor shall completely prepare site for building operations, including demolition and removal of existing materials, and furnish labor and materials and perform work for “Design and Install Floor and Dishwasher in Kitchen”. The Contractor acknowledges that it has taken steps reasonably necessary to ascertain the nature and location of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost; any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government. The Contractor agrees to be responsible for the correct classification of workers.
Magnitude of Construction: $250,000 to $500,000
CONTRACTOR RESPONSIBILITY:
Safety or Environmental Violations and Experience Modification Rate “All Bidders/Offerors shall submit the following information pertaining to their past Safety and Environmental record. The information shall contain, at a minimum, a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years.
All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the bidder’s/offeror’s insurance company and be furnished on the insurance carrier’s letterhead.
Self insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.
A Determination of Responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines above may result in a determination of “Non-Responsibility” for the bidder/offeror. Failure to submit this information may result in a determination of “Non-Responsive” for the bidder/offeror. NOTE: Any information received by the Government that would cause for a negative Determination of Responsibility may make the bidder/offeror ineligible for award.
This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors. “ Contractor shall be required to complete all contract work and schedule a final inspection within the specified contract performance period. Should the Contractor fail to complete the contract work (including scheduling of the final inspection), and it is determined by the Government to be a Contractor-caused delay, the Contractor shall be in default status. If the Government determines it to be in the best interest of the Government to allow the Contractor to continue to perform contract work, the Contractor shall provide equitable consideration in the form of Liquidated Damages from the first day of inexcusable delay through final acceptance by the Government. These damages are associated with the additional time granted for completion and acceptance of contract work. Such agreement shall not be deemed a waiver of the Government’s right to terminate this contract in the event the Contractor fails to complete the contract work (including scheduling of the final inspection) on or before the completion date.
TRAINING: Effective July 31, 2005, all employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course. The General Contractor’s competent person shall have completed the 30-hour OSHA certified construction safety course. Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. Failure to present the proper training documentation will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.
It is the responsibility of the Contractor to provide TB training annually and a PPD test annually for any employees providing services at the Corporal Michael J. Crescenz VA Medical Center, Philadelphia, PA. The government reserves the right to review the contractor's records. Failure to present the proper training documentation upon the Contracting Officer’s request will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.
Privacy and Confidentiality: Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information. Information maybe overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as, but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized by this agreement or its attached documents in accordance with the contracted services. Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breeches of the privacy and confidential should be reported immediately to the Contracting Officer, Contracting Officer’s Representative (COR) or the Facility Privacy Officer.
