3. Description of Supplies or Services:
The estimated value of the proposed action is $ $72,262.84
The VA Pittsburgh Healthcare System requires the purchase of eight (8) Howard Hi-Care E Base Carts, customized to fit our needs with a consent signature pad, pullout keyboard and scanner.
These carts have been approved and are the standard for use throughout the VAPHS.

4. Authority:
ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
5. Rational/explanation to support cited authority:
The VA Pittsburgh Healthcare System is seeking replacement of existing Howeard Medical HI-Care E Standard base carts for the Same Day Surgery Service. Replacement is required with the same, as the units are standard throughout the VAPHS. The current units have proven to be unreliable and are not working most of the time. They are in a state of disrepair. With the existing units not working, nursing staff is forced to leave a patient’s side to chart, presenting a huge patient safety issue. The Howard Medical HI-Care E Standard Base carts are required to maintain consistency across the VAPHS and to allow nursing staff to continue to use the same carts across the facility. These carts have proven to reduce failures in the emergency contingency operations by requiring accurate tracking and charting of healthcare documentation. They have provided the VAPHS with the ability to ensure traceability so that, should an unanticipated incident occur, proof can be provided that the healthcare facility acted according to safe, legal and ethical practices, protecting the hospital from potential liability in the case of litigation.
6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
