(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR12.6 and 13. Streamlined Procedures for Evaluation and Solicitation for Commercial Items and FAR 13. Simplified Acquisition Procedures for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; packages are requested, and a written pre-solicitation will not be issued.

(ii) This solicitation is being issued as a Request for Quote (RFQ). The Request for Quote will be submitted through beta.sam.gov on RFQ reference number 36C24220Q0203.

(iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-03

(iv) This procurement is being issued as a unrestricted open market. The North American Industry Classification System (NAICS) code is 511120, Periodical Publishers, with a small business size standard of 1000 Employees.

(v) The Contractor shall provide pricing to provide Journal Subscriptions Services as described in the Statement of Work included herein. See Attached table (It is not mandatory to use this table specifically, but it is encouraged. The contract specialist will need to distinguish between the varying costs of the procurement in order to make a determination on price reasonableness.)

Point of Care databases are online clinical reference tools used by healthcare professionals in treating and diagnosing patients’ healthcare issues. These databases may contain e-journals, e-books, or be made up of proprietary information resources. These resources are accessible via the Internet.

A. Scope of Work:

The Contractor shall be responsible for the management, labor and equipment necessary to provide access to

(1) serial publication subscriptions (both in print and online),

(2) point of care database subscriptions, and

(3) related subscription requirements to keep track of subscriptions which are likely renewal titles year to year once the subscription exists.

Related subscription requirements include paying publishers, handling claims for non-receipt, processing changes in subscriptions status (renewals, new and cancelled subscriptions), facilitating the activation of online access, and submission of required reports and other service problems.

Approximately 90% of subscriptions placed by the Customers will be renewal subscriptions.

All online subscriptions are to be made available to the Primary facility James. J. Peters VA Medical Center, 130 W. Kingsbridge Rd., Bronx, NY 10468 as well as its out-patient clinics and Vet Center listed below. All print subscriptions are to be shipped to the Primary facility: James J. Peters VA Medical Center.

Vendor is required to notify customer of titles which cease or merge during contract years.

Claims for customer should be made within 48 business hours of request when sent via emailed to vendor. However, if the vendor provides access to their website for claiming purposes the VA employee staff may enter claims as needed if wanting not to email Vendor Customer Service.

C. Period of Performance

The period of performance shall commence on the effective date of award during first quarter of the fiscal year. With approximately 30-day lead time, the contractor needs advanced time to place and compete the subscription orders to the varied publishers (indicated by the title list attached at the end of this statement of work). Subscriptions are to start with January of new calendar year and run through end of calendar year unless the publisher has bi-monthly publication which starts in Feb. or of a similar nature. Without this advanced work requirement, the VA may not receive timely access to the required subscriptions. All publishers require advanced payment or a PO before granting access to the VA customers. Therefore, the VA contract period of performance can begin in the first quarter of the fiscal year to ensure the calendar year subscriptions are provided to the VA without waste.

PPO: Dec. 06, 2019 – Dec. 05, 2020 Plus 4 option years to renew with same vendor at the 6% increase as was forecasted for 2020 and observed in 2019 and has been since 2012 (ref – Library Journal April 2019 article). However, the customer through the Contract Specialist maintains the right to add or delete titles as needed to the journal list each year as the situation unfolds using the contract modification vehicle. As is known to be the case, sometimes National VA picks up titles or removes titles that they currently subscribe to. Or the case where the local institution either no longer finds a need for a title or a new subject arises that was not being covered before.

Vendor is required to notify customer of titles which cease or merge during contract years.

Claims for customer should be made within 48 business hours of request.

Print journals should arrive in good condition or replacement copy requested when the fault of environmental elements.

Invoice will be processed at the start of subscription period for the majority of the titles which is the month of January.

H. Other Related Services (Not Included in the Scope of Work)

Any services not expressly stated in this statement of work are not authorized. Services such as inspection, Original Equipment Manufacturer (OEM) required maintenance, or other maintenance and repair vital to the continued functioning of the systems may be added only after written modification from the contracting officer. No other person, including the COR or any other VA personnel are authorized to request additional work be performed by the contractor. Any additional services performed that are not authorized by the contracting officer will be considered inclusive.

(vii) Awardee shall coordinate with the Contracting Officer’s Representative (COR) prior to performance.

(viii) The provision at FAR 52.212-1, Instructions to Offerors-Commercial Items (MARCH 2016), applies to this acquisition. All offers must reference:

1) solicitation number for this requirement as 36C24220Q0203

2) Name, address and telephone number of offeror

3) Description of services to be performed in accordance with the Statement of Work. Terms of any express warranty

4) Price. Price should be for all services detailed in section “v” of this document. The pricing must be broken down in a manner that allows for price reasonableness to be determined. Failure to provide complete pricing will result in contractors package being determined to be incomplete.

7) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation.

Offers that fail to furnish required representation or information or reject the terms and conditions of the solicitation will be excluded from consideration.

(ix) The provision at FAR 52.212-2, Evaluation—Commercial Items (OCTOBER 2014), applied to this acquisition.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation represents the lowest price technically acceptable and providing appropriate past performance. The following factors shall be used to evaluate offers:

Complete the Price/Cost Schedule contained in the RFQ for all items listed for the Base Year and all Option Years.

Past Performance:

Provide a minimum of three (3) references and include the contract number, dates of performance, point of contact and telephone number for each. Also:

Please provide evidence of previous contract with the Federal Government regarding Library Subscription of Journals.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Failure to provide the information requested in the evaluation criteria may result in being found non-responsive.

This requirement includes options executed under FAR 52.217-8. The government will evaluate prices for the option under FAR 52.217-8 by using the last year’s option prices to calculate the price for six months of efforts and adding that amount to the base and other option years to arrive at the total.

(xv) This is an open-market total small business set-aside combined synopsis/solicitation for Journal Subscription Services at the James J. Peters, Bronx VAMC and listed CBOC & VET Clinics as defined herein. The government intends to award a contract as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows:

"The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition."

"The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:"

The Quoter shall list exception(s) and rationale for the exception(s). Quotes received without this statement will be assumed to infer that terms and conditions are acceptable without modification, deletion or addition.

Submission shall be received not later than 11:59PM EST, Monday January 29, 2020. The government shall only accept electronic submissions via email, please send all quotations to Natalie.Acevedo@va.gov. Late submissions shall be treated in accordance with the solicitation provision at FAR 52.212-1(f). RFI’s will not be accepted after Tuesday January 24, 2020 @ 12:00 PM EST.
