The Contractor is responsible to provide all labor, materials, tools, equipment, supplies and supervision for the Campus Water Deficiency Correction in accordance with the statement of work (SOW), specifications, and drawings attached hereto.

The Contractor will be responsible to coordinate and schedule work and shall be expected to plan work as outlined in the Statement of work, Drawings and Specifications.

This is a Total Service Disabled Veteran Owned Small Business (SDVOSB) set aside procurement and will be conducted in accordance with Public Law 109-461. All prospective bidders must be registered in SAM (www.sam.gov) under NAICS code 238220, D&B (www.DandB.com) and are verified/visible/certified in VIP VetBiz (www.vetbiz.gov) at the time of offer submissions and before award of this procurement. Offerors must submit their annual Vets-4212 Report.

Magnitude of Construction is between $1,000,000.00 and $5,000,000.00. The North American Classification System Code is 238220 - Business Size is $15M. Completion time is 180 Calendar Days from the Notice to Proceed.

A Pre-Bid Site Visit is scheduled for April 17, 2019 at 10AM EST. Prospective Bidders shall meet in the Engineering Conference Room at the Hudson Valley Healthcare System, Castle Point Campus Route 9D Castle Point, NY 12511 NOTE: NO OTHER SITE VISTS WILL BE ALLOWED. INTERESTED BIDDERS ARE STRONGLY ENCOURAGED TO ATTEND

Scope of Work Construction Services for Project No. 620A4-17-120 Campus Water Distribution Deficiency Corrections

Background:

The Castle Point Facility was constructed in 1922. With the exact configuration of the plumbing system unknown a field investigation was completed in 2015. With entire system fully mapped water pipe that is no longer in use was identified and flagged for removal if noncompliant with current DOH guidelines. This is to minimize the risk of spreading legionella to staff and patients.

Objectives:

Removal of all active hot and cold-water pipe that is classified as a “dead leg” per length and diameter configuration during the 2015 analysis.

Period of Performance:

The period of performance to complete the entire contract is 180 Calendar-days from NTP, with construction to be completed according to the phased schedule below.

Phase I, Submissions: 30 Calendar-days duration, to be completed within 30 Calendar-days of NTP Phase II, Government Review: 30 Calendar-days duration, to be completed within 60 Calendar-days of NTP Phase III, Construction: 120 Calendar-day duration, to be completed within 180 Calendar-days from NTP;

Place of Performance:

The place of performance for this contract is at the VA Hudson Valley Health Care System, Castle Point Campus, Castle Point, New York.

Scope of Task:

The Contractor shall furnish materials, equipment, personnel and supervision to accomplish the work as described in the contract drawings, specifications specified herein for Project 620A4-17-120 Campus Water Distribution Deficiency at Castle Point Campus of the Hudson Valley Health Care System, New York.

Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes including specific regulations related to working at the VA Medical Center.

Contractor shall be responsible to complete the work within the contractual period of performance, and within the work hours as defined in the contract. Contractor shall be responsible to plan and develop activities, phasing and project scheduling per proposed Phasing Plans.

The Bidding Contractors shall inspect the areas of work prior to bidding.

Scope of Work for the Base Bid includes the following description of work, as defined in the contract documents but not be limited to:

· Remove all pipe insulation with standard asbestos glove bag procedures and re-insulate as per specifications. Awardee has option of testing any pipe insulation demolition point location with licensed asbestos inspector and if a determination is made that the location is negative for asbestos then such insulation may be disposed of as standard construction debris. Defined ICRA containment level will still apply regardless of how the insulation is treated. No demolition location can be assumed to be asbestos free without asbestos sampling/testing specific to that location. All insulation construction debris is assumed to be positive for asbestos and handled properly as such per NYS Industrial Code Rule 56 without laboratory testing that proves to the contrary.

· Provide new insulation for all exposed pipe.

· Cut and Cap dead leg piping and Valves and replace as per contract documents.

· Pipes that penetrate thru Masonry walls shall be cut, capped and insulated as close as possible to the Supply pipe (Source). For any risers that go up to a Dead leg, cut and cap piping at the lowest possible point and abandon pipe in wall. Label dead end pipes abandoned inside of wall at each end as “ABANDONED PIPE” and date the pipe “MONTH/YEAR”.

· Any salvageable “ABANDONED PIPE” will be removed by the Awardee and recycled as scrap metal for monetary gain of the Awardee only. All salvageable “ABANDONED PIPE” must be readily accessible with no additional demolition required or inconvenience posed to the facility. No contractual promise regarding the quantity of such material is made to the contractor and final determination of what is salvageable and/or must be removed is left solely to the discretion of the COR and CO.

· Remove all sinks and fixtures that are on dead leg branches. If the sink was on a dead leg and the pipe was abandoned inside the wall, demo pipe back to wall and cap. Restore conditions on wall where sink was removed to match existing conditions.

· Only remediate dead legs designated as type A on the drawing set Master Schedules. Dead legs designated as type B or type C on the Master Schedules are for reference only and are not to be remediated. They are to be ignored for purposes of this project.

· Dead legs designated as type A and requiring architectural demolition will not be fully remediated but rather mitigated as best as possible without performing full architectural demolition. Dead legs that require architectural demolition but only to remove pipe from a wall penetration will be remediated. The wall penetration will be repaired to match existing conditions if visible to the public or appropriately fire stopped otherwise.

· ICRA III containment barriers and negative air are required at each remediation point. If asbestos sampling is conducted and a determination made that insulation is non-asbestos the ICRA level drops to category II but only for building 7,8, 9, 13 and 44. The main complex of the hospital will be handled as ICRA category III in all circumstances regardless of the determination of insulation material to be positive or negative for asbestos.

· Work is to be done off hours for buildings 15H, 15E, 16, 17, 18, 20 and 21. All work once started is to be completed within the off hours shift allotted and the area cleaned up completely prior to next working day hospital activity.

· Provide Firestop at all penetrations as per VA specs.

· Selective demolition of Gypsum walls and hung ceilings required for access to the dead legs. Patch and paint all affected areas to original condition after dead leg removal. Contractor to coordinate removal and disposal of all material and waste into designated dumpster.

(a) Bidding materials consisting of Invitation for Bids, drawings, specifications and contract forms will be available on http://www.fedbizopps.gov in electronic format only by searching for solicitation number 36C24219B0025_1 All interested parties (subs & primes) should register at http://www.fedbizopps.gov as an “Interested Vendor” so that others will know of our interest in participating in this procurement. A Bidder’s mailing list WILL NOT BE prepared by the Contract Specialist. SOLICITATION AMENDMENTS: Amendments to the solicitation will be posted at http://www.fedbizopps.gov. Paper copies of the amendments will NOT be individually mailed. By registering to “Receive Notification”, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Bidders are reminded that they are responsible for obtaining and acknowledging all amendments to this solicitation prior to the time for receipt of bids.

(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

(c) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.

(d) If the bid is between $30,000 - $150,000. The bidder to whom award is made will be required to furnish a Payment Bond, Standard Form 25A or alternative payment protection which conforms to the requirements set forth in FAR Clause 52.228-13, Alternative Payment Protections, as noted in the General Conditions of this Specification. Copies of the Standard Form of Payment Bond may be obtained upon application to the Issuing Office.

BASE BID: This work shall correct the water deficiency identified at the Castle Point Campus, Hudson Valley Healthcare System.

A. ITEM I, GENERAL CONSTRUCTION: The Contractor shall furnish materials, equipment, personnel and supervision to accomplish the work as described in the contract drawings, specifications specified herein for Project 620A4-17-120 Campus Water Distribution Deficiency at Castle Point Campus of the Hudson Valley Health Care System, New York. Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes including specific regulations related to working at the VA Medical Center. Contractor shall be responsible to complete the work within the contractual period of performance, and within the work hours as defined in the contract. (2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. (4) Estimated starting and completion dates of the subcontract; and

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

2.5 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be percent of the bid price or , whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

3.2 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)

(a) Definitions. As used in this provision— "Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

"Federal contracts and grants with total value greater than $10,000,000" means—

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
