Center for Verification and Evaluation (CVE) The Vets First Contracting Program within the Department of Veterans Affairs (VA) was created under Public Law, P.L. 109-461. This contracting program was created for Veteran-Owned Small Businesses and expanded the Service-Disabled Veteran contracting program for VA procurements. The Public Law was implemented in two regulations published in the Federal Register:

38 CFR Parts 802, 804, 808, 809, 810, 813, 815, 817, 819, 828, and 852 Supporting Veteran-Owned and Service-Disabled Veteran-Owned Small Businesses were amended on December 8, 2009, to implement changes to the VA Acquisition Regulation. This regulation defines the acquisition rules for the program with VA.
In order to qualify for participation in the VA Veterans First Contracting Program, eligible SDVOSB and VOSB owners must first be verified in CVE through the Vendor Information Pages (VIP) https://www.vip.vetbiz.gov/
What are the Limitations on Subcontracting?
Generally—a special obligation in return for a special opportunity
| The Limitations on Subcontracting restrict the amount of work a small business can subcontract out for performance, effectively ensuring the small business benefits from the developmental opportunity associated with winning a Federal contract. |
| If a small business (or a team of small businesses) wins a contract in part because of its small business status, it incurs a concomitant obligation to do a majority of the work itself (or through other similarly situated firms). |
| If an other than small business were permitted to use a small business as a front to win an award in a small business set-aside, this would effectively eliminate the restricted competition and pit small firms against large. The competition would not be materially different from full-and-open, and the public policy purpose behind having a set-aside authority would be lost. |
The term "other-than-small" business refers to any entity that is not classified as a small business. This includes large businesses, state and local governments, and non-profit organizations. In most cases, it also includes public utilities, educational institutions, and foreign-owned firms. However, there may be certain instances where a public utility, educational institution, or foreign-owned firm could be considered a small business. When in doubt, you should contact your local SBA office with a size protest or investigation

What are the Limitations on Subcontracting?

| For services contracts (except construction). Of contract’s costs for personnel, at least 50% will be incurred with prime contractor’s employees. |
| For supplies contracts. Of costs for manufacturing the supplies (excluding costs of materials), at least 50% will be performed by prime contractor. Non-manufacturers not covered by this rule; separate rule applies. |
| For construction contracts. Of cost of contract (excluding costs of materials), prime contractor will perform the percentage below with its own employees. |

ASMPP Background Authorized under the 2010 Small Business Jobs Act and the 2013 NDAA
Rather than creating programs for separate constituencies – SDVOB, WOSB, HUBZones - SBA created a single, all-inclusive Mentor-Protégé Program modeled on its 8(a) program.
The All Small Mentor-Protégé Program’s (ASMPP) aim is two-fold: develop strong Protégé firms through Mentor-provided business development assistance; and enhance the ability of Protégé firms to successfully compete for government contracts.
