Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36E776-20-AP-0074

1. Contracting Activity: Department of Veterans Affairs, Program Contracting Activity Central (PCAC) in support of VA Nebraska-Western Iowa Health Care system (NWIHS) located at 4101 Woolworth Avenue; Omaha, NE 68105. Purchase Request #636-20-1-1337-0107.

2. Brief Description of Supplies/Services required and the intended use/Estimated Amount:

This is an individual J&A for approval of a Brand Name Justification in accordance with FAR 13.106- 1(b) soliciting competition; soliciting from a single source (including brand name), where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.

In an effort to maintain standardization of duress systems within the medical centers, VA NWIHS requires the delivery and installation of the LYNX-WLS3 Wireless duress system for the ambulatory surgery departments at the new Ambulatory Care Center that operates throughout the VA NWIHS.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The requiring activity currently uses the Lynx duress system throughout the entire healthcare system. The Lynx duress system is a proprietary network-based emergency notification system that will not work with other emergency systems. The Lynx system uses an extensive catalog of input and output devices that maximizes situational awareness for security, management, and the general population of the facility. The Lynx Duress system is peripheral to the current Lynx system and seamlessly integrates with the existing system using the existing computers, alarms, and software.

This is an extension of a current system and must be identical to integrate properly as a different system cannot integrate with the LYNX-WLS-3 wireless.

4. Description of market research conducted and results or statement why it was not conducted:

In accordance with FAR Part 10, market research has been conducted for this acquisition. Market research was conducted by the facility by reviewing other similar equipment and by contacting vendors. Review of these products is based on actual VA and DoD experience using competing duress alarm systems. Based on these market research efforts, the Government’s technical experts have determined that only the Lynx equipment can meet the VA’s needs.

The Contract Specialist conducted additional market research that is documented in the contract file and determined there are multiple Service-Disabled Veteran-Owed Small Business (SDVOSB) concerns authorized and capable of providing the Lynx duress system as required. Further, the CS called the manufacturer to determine if a third-party duress system can be integrated into a current system and was informed that, “3rd party systems cannot integrate with the LYNX-WLS-3 wireless.”

The only system capable of meeting the VA’s needs is the LYNX-WLS3 Wireless duress system.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
