USBP Checkpoint 15C Canopy

Statement of Work

January 17, 2016

1. BACKGROUND:

The Casa Grande Station tactical checkpoint located on Federal Route 15, Mile Post 30

(15C) is currently unshaded. This work site exposes employees to long hours of outside sun and weather element exposure and poses significant health and safety concerns.

This requirement will include the purchase, delivery, assembly and installation of an overhead canopy at the Casa Grande Federal Route 15, (15C) Checkpoint.

2. SCOPE:

The Contractor, as an independent contractor and not as an agent of the Government, shall, in accordance with the terms and conditions more particularly set forth below, furnish all services, materials, supplies, labor, equipment, transportation, and travel needed to completely install a canopy at Checkpoint 15C.

2.1 The project involves turnkey installation of a new 80’W x 80’L x 30’H, 22 oz.

solid PVC laminated flame retardant (meets National Fire Protection (NFP)

701) vinyl fabric, white in color.

2.2 The shade structure will include removable, full-length side panels. The installed canopy shall be anchored in a manner that permits the structure and its anchoring system to be 100% readily removable (leaving no visible footprint).

2.3 The base system to anchor and secure the erected shade structure must have the ability to be built on dirt and/or gravel only. An easily removable soil anchoring system (engineered to meet load bearing standards) must be utilized to meet conditions established by the Tohono O’odham Nation

Approving Tribal Resolution (E.g. spiral wedge anchor). The anchoring system must not be concrete footings or a concrete foundation.

2.4 The installed and anchored structure must be rated at a minimum 100 MPH wind load and 10 PSF snow load.

2.5 The installed structure must contain suitable lightning protection.

2.6 There is sloping terrain on the west and east sides of the canopy site. Leg extensions (approximately 24” long) may be required for proper installation. If grading is needed supplier shall coordinate with the government COR/PoC.

2.7 Lighting shall be 10 each, high bay LED lighting fixtures with a minimum of

13,000 lumens per fixture light output. Supplier will provide and install all necessary electrical work, wiring, conduit, breaker panels and any other necessary equipment within the structure. Connection from the main service panel to the canopy breaker panel will be the responsibility of the

Government. Total canopy lighting should have a minimum output of 130,000 lumens.

2.8 Contractor will be responsible for all permits required to deliver and install the canopy including marking of underground utility locations (aka Blue Staking).

2.9 Traffic control during installation will be the responsibility of the Government.

Installation shall take place during daylight hours, no night work will be allowed.

3. APPLICABLE DOCUMENTS:

3.1 Commercial standards shall be used wherever practicable.

3.2 The contractor shall read and adhere to the Tohono O'odham Nation Legislative

Council Resolution, TERO Requirements, and the Bureau of Indian Affairs (BIA)

Department of Transportation (DOT) Encroachment Permit as stated in Section 10.2 and 10.3.

4. SPECIFIC TASKS:

The contractor shall complete the following tasks as required to comply with this SOW.

4.1 Program Management.

The contractor shall exercise technical direction and control of the, engineering, manufacturing, and test effort required to deliver and install the canopy. This requirement includes the necessary management support tasks related to transportation, production, configuration control, risk management, testing, quality assurance, and data management required to carry out that task and comply with this

SOW.

4.2 Testing.

The contractor shall test and functionality certify the installed canopy prior to delivery of the final product to the government.

4.3 Delivery.

The contractor shall deliver and install the Canopy outlined in Section 5.1.

4.4 Documentation.

The contractor shall be responsible for issuing existing documents as requested by

CBP. (See section 5.3)

4.5 Warranty.

The contractor shall be responsible to provide documentation or certificates of commercial warranties provided with the installed canopy and/or any applicable components (such as vinyl fabric, lighting fixtures, etcetera).

5. DELIVERABLES AND DELIVERY SCHEDULE:

5.1 Canopy.

The contractor shall deliver and install a complete canopy as outlined in the table below.

5.3 Data.

As referenced in section 4.3 above the contractor shall provide copies of the documents listed below. One copy of the data shall be delivered in paper form and one copy in electronic form. The electronic form shall be in MS Word format or Adobe Acrobat. The documents are deliverables under the contract and shall be delivered to the COR no later than thirty days after contract award:

6. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION:

The Government will be responsible for connecting power from the electrical service panel to the electrical panel on the canopy. The Government does not otherwise anticipate providing any GFE or GFI.

7. PLACE OF PERFORMANCE:

The place of performance shall be Federal Route 15 Mile Marker 30, GPS coordinates

N 32°33'03.2" / W-111°55'45.1"

8. PERIOD OF PERFORMANCE:

Period of performance will be three months from the time of award.

9. SECURITY:

9.1 The contractor shall submit the names of all individual employees to Program

Point of Contact (or appointee) for USBP to conduct a background check and approve employee eligibility to work on a United States Border Patrol project.

9.2 Once individuals are approved/vetted, only those contracted employees will be authorized to work on the project.

9.3 There are no specific security classification level requirements associated with this procurement action. Information is deemed unclassified.

10. SPECIAL CONSIDERATIONS:

10.1 Changes to the SOW

No changes to this SOW or cost increases shall be incurred without written prior approval of the Contracting Officer as coordinated by the COR. Any changes or cost increases will not take effect until the Contracting Officer executes a written modification.

10.2. Tribal Employment Rights Office (TERO) Compliance Plan

The Tohono O’odham Nation imposes a TERO Compliance Plan to the contractor for all business on the TON.

10.2.1 TERO Fee (Total contract x .5%) not included.

10.2.2 A TAX of 2% or 5% depending on the requirements met by the contractor.

10.3 Tribal Resolution 16-408 Key Requirements

Amending resolution of the Tohono O’odham Nation (TON) Legislative Council No. 16-

395 identifies key requirements for CBP and authorized contractors.

10.3.1 The contractor shall attend the TERO contract class in Sells, Arizona before beginning work.

10.3.2 If there are any additional installation of buildings, infrastructure that is not readily removable, utilities, etc. not covered in this SOW, the contractor must request and get approval from the TON Legislative Council prior to installation.

10.3.3 Contractors must consult and coordinate through the COR and the Tucson

Sector Tribal Liaison (TCATL) with the TON’s Department of Public Safety (TODPS) to the maximum extent possible, and work with the TODPS Director to provide public information and address its concerns. Contractor should first coordinate all TODPS interactions with Government COR/BCL.

10.3.4 All work to install the canopy must be performed during daylight hours due to the environmental CATEX.

10.3.5 The contractor shall submit the names of all individual employees for a background check (by USBP) to determine eligibility to work on a United States Border

Patrol project.

10.3.6 The contractor shall store equipment, perform all necessary work and build the proposed canopy all within the footprint described in the BIA DOT Encroachment

Permit.

10.3.7 The contractor shall read and adhere to the Tohono O'odham Nation Legislative

Council Resolution, TERO Requirements, and the BIA DOT Encroachment Permit.

10.3.8 The contractor and its employees shall have in his or her possession at all times the TERO hiring haul slips issued to each employee by Tohono O'odham Nation-Public

10.4 Travel

Travel is not required to support the tasks identified in this SOW.
