About this file

This document is a justification for other than full and open competition for a limited/sole source contract award. The Department of State Office of Acquisition Management awarded contract 19GE5023P0022 to an unknown vendor on February 21, 2023 for an unknown amount to purchase a replacement chiller unit. The failed chiller unit cooled the chancery of the US Embassy in Tbilisi, Georgia. An expedited sole source award was necessary as the current chiller plant could not provide enough cooling for normal embassy operations, and a facility shutdown was possible if not replaced before the summer season. Market research found the awarded price to be fair and reasonable.

Text version

enough cooling for normal embassy operations- which will result in a possible facility shut do\Vll.

Tbilisi is an Embassy of 750 employees, hosting several regional programs that have moved to Georgia as a result of the Russian war of aggression in Ukraine. This is a critical moment for diplomacy in this part of the world. We cannot risk having to shut dovm operations in the building ifwe are unable to provide a suitable internal environment.

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

This manufacturer has the ability to meet the maximum number of technical specifications within the shortest lead time among all other options explored. Post and OBO has thoroughly searched the market looking for the best options to meet the requirements of this urgent situation.

All other options explored are not technically acceptable and require a much longer lead time.

In order to eliminate the risk of an Embassy shutdown, a new chiller must be delivered to post by the end of June. The selected manufacturer has a current lead time of 19 weeks, but only if ordered immediately. If this order is made by the last week of February, the chiller would be delivered the last week of June. All manufacturers contacted confirmed that chiller delivery lead times increase as the cooling season approaches. The manufacturer stated that delaying the order even to mid-March would result in an even longer delivery, as our order would be put on a waiting list. The time needed to compete this PR could potentially add 8 additional weeks of lead time combining for an additional 4 months of possible delays. Shorting the procurement process is critical to initiating the replacement efforts prior to the beginning of cooling season. The chiller plant at post is currently well below 50% of needed capacity and will never be able to provide enough cooling for post during the summertime. Typical swnrner temperatures in Tbilisi can reach above 100 degrees Fahrenheit and these extreme temperatures would force operations to shut down if this equipment is not replaced before the summer season.

In summary, either order immediately or the Embassy will not be able to cool the Chancellery.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

Post and OBO SME's have gone to great lengths to perform very complete and in-depth market research to include the co1lection of three price offers from different vendors. Many different options have been researched with several manufacturers, however, just three of them can provide a chiller within our time frame. Daikin is the only offer that meets the technical requirements and can also get the chiller to post before summertime.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Market research found the price to be in agreement with current market prices. When considering availability, the satisfaction of technical requirements, and pricing, Daikin's offer is determined to be fair and reasonable.

Post and OBO have gone to great lengths to get multiple comparable bids. They show that Daikin's bid is well within the competitive range and fair and reasonable. Market survey was completed towards every direction, such as local market, European market, and United States market,_ however, no better offer than Daikin' s have been proposed.

9. Any other facts supporting the use of other than full and open competition.

This chiller replacement is urgent to meet the cooling requirements of the approaching summer season. Post is in jeopardy of not having enough cooling c_apacity for normal embassy operations if this does not get done in an expedited fashion. Cooling season starts in early June.

Entering cooling season without a new chiller would force a shutdown of the Embassy. In addition to that, post is already running Emergency backup chiller and even with that, post is barely able to maintain cooling in the winter when cooling load is very low.

Additionally_, the Daikin vendor has been the only one to confirm their active SAMs registration which gives a preference for expedited procurement process. Daikin is the only vendor who can meet technical requirements to install chiller on existing Utility plant location among those vendors who meet equipment production lead time requirement. Although Trane's offer looks good on paper, this vendor is offering a chiller that will not fit physically in the utility plant and would require an major expansion project of post's infrastructure to accommodate something there's no time to do. Daikin's offer is the only one that meets the requirements.

10. A listing of sources-, if any, that expressed, in writing, an interest in the scheduling claims services contract.

None.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Include a statement that this J&A for other than full and open competition will be published on beta.SAM.gov in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.)

Post and OBO have recommitted every effort to ensure that aged and failing equipment will be replaced before the situation requires us to remove fair and open competition.
