NATIONAL MINE HEALTH AND SAFETY ACADEMY
1301 Airport Road, Beaver, WV 25813
STATEMENT OF WORK
FOR REFUSE DISPOSAL SERVICES
1.0 BACKGROUND
The National Mine Health and Safety Academy (NMHSA) is one of the seven federal training academies. The purpose of the NMHSA is to design, develop, and conduct instructional programs that will assist in government, labor, and industry efforts to reduce injuries, illnesses, and fatalities in the mineral industries. The NMHSA is located adjacent to the Raleigh County (West Virginia) Memorial Airport at 1301 Airport Road, Beaver, WV 25813. This requirement is to provide the haulage, disposal and listed containers:
· One (1) leased totally enclosed 35 cubic yard compactor/roll-off sealed container no more than two ( 2 ) years old at the beginning of the contract
· One (1) eight (8) yard cubic yard open container for food items/cafeteria
· One (1) thirty (30) cubic yard open container at Mine Simulation Lab 1.1
OBJECTIVES
The objective of this procurement is providing three (3) waste removal disposal containers, haulage and disposal of Academy refuse.
1.2
SCOPE
The Contractor shall provide the three (3) containers, haulage and disposal of the Academy refuse as outlined in Part 5 of this Statement of Work.
During the course of the base year and each option period, the compactor is to be steam cleaned at the beginning of each quarter (4 times during each contract period). Scheduled dates shall be submitted in writing to the Academy COR at the beginning of each contract period.
1.3
SPECIAL QUALIFICATIONS
The contractor shall, without additional expense to the government, be responsible for obtaining any necessary licenses, and permits, and for complying with any and all applicable Federal, State and Municipal laws, codes and regulations in connection with the prosecution of the work. Contractor shall be similarly responsible for all damages to persons or property that occurs as a result of his fault or negligence. Contractor shall take proper safety and health precautions to protect the work, the workers, the public and the property of others.
The contractor shall guarantee for one (1) year from date of contract to provide complete collection and disposal service per specifications from April 1, 2016 – March 31, 2017.
1.4
PERIOD OF PERFORMANCE
The period of performance shall be one Base Year with four (4) option periods of twelve months each as follows:
Base Year:
April 1, 2016 through March 31, 2017 Option Year I:
April 1, 2017 through March 31, 2018 Option Year II:
April 1, 2018 through March 31, 2019 Option Year III:
April 1, 2019 through March 31, 2020
Option Year IV:
April 1, 2020 through March 31, 2021

RECOGNIZED HOLIDAYS
The Contractor is not required to perform services on the following holidays:
New Year’s Day
Labor Day
Martin Luther King Jr.’s Birthday
Columbus Day
President’s Day
Veteran’s Day
Memorial Day
Thanksgiving Day
Independence Day
Christmas Day
The contractor may be required to respond to emergency callouts during these holidays.
1.6
HOURS OF OPERATION
During regular scheduling, the collection and haulage of the containers to the landfill shall be completed between 6:00am – 5:00 pm Monday - Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings.
1.7
PLACE OF PERFORMANCE
The work to be performed under this contract will be at NMH&S Academy, 1301 Airport Road, Beaver, WV.
1.8
SECURITY REQUIREMENTS
Contractor staffs are required to conform to MSHA's security and privacy requirements as described below.
1.8.1 Identification Badge. Contractor employees visiting Government facilities shall wear an identification badge provided by on-site security. Visiting Contractor employees shall comply with all Government escort rules and requirements. All Contractor employees shall identify themselves as Contractors when their status is not readily apparent and display all identification and visitor badges in plain view above the waist at all times.
1.8.2 Employee Conduct. Contractor employees shall comply with all applicable Government regulations, policies and procedures (e.g., fire, safety, sanitation, environmental protection, security, “off limits” areas, wearing of parts of military uniforms, and possession of weapons) when visiting or working at Government facilities. The Contractor shall ensure contractor employees present a professional appearance at all times and that their conduct shall not reflect discredit on the United States, the Department of Labor or MSHA.
1.8.3 Removing Employees for Misconduct or Security Reasons. The Government may, at its sole discretion, direct the Contractor to remove any Contractor employee from MSHA facilities for misconduct or security reasons. Removal does not relieve the Contractor of the responsibility to continue providing the services required under any Task Order awarded under this Task Order. The Contracting Officer (CO) will provide the Contractor with a written explanation to support any request to remove an employee.
1.8.4 Privacy: Portions of information disclosed during the performance of this task are protected by the provisions of the Privacy Act of 1974; therefore, all personnel assigned to this Contract are required to take proper precautions to protect the information from disclosure.
1.8.5 Commitment to Protect Sensitive Information: The Contractor shall not release, publish, or disclose sensitive information to unauthorized personnel, and shall protect such information in accordance with provisions of the following laws and any other pertinent laws and regulations governing the confidentiality of sensitive information: 18 U.S.C. 641 (Criminal Code: Public Money, Property or Records).
1.9
CONTRACTING OFFICER REPRESENTATIVE
The Contracting Officer Representative (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract.
1.9.1 The Contractor will in the performance of this requirement immediately notify the COR or the MSHA Point of Contact if the time and/or service obligations of this contract cannot be met due to inclement weather, civil disturbances, equipment failure, illness, etc. MSHA recognizes the obligation of the Contractor to provide for the safety and well being of personnel engaged in providing services under this contract. The Contractor shall notify the MSHA COR or other MSHA designated point of contact no later than 9:00 a.m. on the day the services were scheduled to be provided if any circumstances prevent timely performance.
1.10
CONTRACTOR TRAVEL
All travel costs shall be paid by the Contractor and included within the cost for the services.
1.11
TYPE OF CONTRACT
The Government anticipates awarding a Firm-Fixed Price contract.

PART 3
GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

GOVERNMENT FURNISHED ITEMS AND SERVICES
The government shall furnish the area for the leased, sealed container to rest and all electrical service to operate hydraulic equipment.

CONTRACTOR FURNISHED ITEMS AND SERVICES
The contractor shall furnish all labor, materials, equipment, supervision, license, insurance, supplies, repairs and plans to haul a leased sealed 35 cubic yard compactor/roll-off sealed container , the 8 cubic yard and the 30 cubic yard containers to the landfill as listed in Part 5 of this Statement of Work.
The contractor shall furnish the collection vehicle as well as backup collection vehicle to transport sealed roll-off container and the two (2) other containers to an approved sanitary landfill.
The contractor shall assume full responsibility for compliance with all Federal, State, County and City laws, rules and regulations governing removal and disposal of waste materials.
The contractor agrees that any debris or waste removal under this contract shall not be salvaged, personally disposed of, reclaimed, reused, or resold in any manner whatsoever, and that such refuse or waste removal from the National Mine Health and Safety Academy shall not be fed swine.
PART 5
TASKS
5.0
TASKS
During the course of the base year and each option period, collection shall be made from the main 35 cubic yard compactor, the loading area behind the cafeteria, the area behind the Mine Simulation Lab and other areas designated by the Contracting Officer’s representative (COR) at the Academy.
5.1 The contractor shall provide all services, materials, supplies, planning, supervision, repairs and labor for the 35 cubic yard leased, sealed compactor/roll-off container, the eight (8) cubic yard container and the thirty (30) yard container. All service shall be provided by the same contractor.
5.2 The COR will notify the contractor when the 35 cubic yard compactor and the 30 cubic yard container reaches storage capacity. Contractor shall respond within twenty-four (24) hours and haul and dispose of refuse at an approved sanitary landfill.
5.3 The eight (8) cubic yard shall be emptied on Monday, Wednesday and Friday of each week, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings.
5.4 The contractor is responsible for the refuse between loading into the compactor hopper and disposal at the landfill.
5.5 All disposal service shall be performed during periods of time established by mutual consent of the contractor and the COR.
5.6
STOP WORK
All work shall be performed in a safe and professional manner. If work is not performed safely and professionally, the CO shall have the authority to stop work immediately. This does not in any way affect the U.S. Government’s right to terminate the contract for default or convenience in accordance with the applicable provisions of the contract.
