NATIONAL MINE HEALTH AND SAFETY ACADEMY

STATEMENT OF WORK

1.0 BACKGROUND

The mission of the Mine Safety and Health Administration (MSHA) is to protect the safety and health of the nation’s miners. The National Mine Health and Safety Academy was constructed on 74 acres in the early 1970s with the intent to provide a self-contained training facility for the Agency and the mining industry. Mining professionals from across the United States and many foreign countries come to the Academy for health and safety training. The Academy complex, which opened in 1976, consists of 9 buildings, seven of which are inter-connected, making up 347,410 square feet and includes classrooms and laboratories accommodating 600 students, a residence hall of 174 lodging rooms, a cafeteria, a library, auditorium, and wellness facilities.

1.1 OBJECTIVES

The objective of this procurement is repair and replace stucco finish along the foundation of G Building at the National Mine Health and Safety Academy.

1.2 SCOPE

The Contractor will provide labor, equipment, materials, supervision, permits, licensure, and any other incidentals to repair and replace stucco finish along the foundation of G Building at the National Mine Health and Safety Academy.

It is expected that the Contractor may need to attend a site visit for the purpose of this contract in order to conduct an overall assessment to determine appropriate steps. Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

1.3 SPECIAL QUALIFICATIONS

The Contractor warrants that he will have obtained all licenses and permits required by law to engage in the activities that are required in connection with the Statement of Work. The Contractor shall conform to all required safety regulations for the Academy, County, State, and the Federal Government. Contractor must engage an installer who is currently experienced in repair and replacement of stucco systems.

1.4 PERIOD OF PERFORMANCE

The period of performance shall be completion within 90 days after Notice to Proceed (NTP).

All work must be scheduled to complete within this timeframe. The Contractor must keep a record of inclement weather delaying work on the project. Any modifications or extensions due to inclement weather will be requested through the Contracting Officer’s Representative (COR) and approved by the Contracting Officer.

1.5 RECOGNIZED HOLIDAYS

The Contractor is not required to perform services on the following holidays:

1.6 HOURS OF OPERATION

The Academy operates between the hours of 8:00 a.m. and 4:00 p.m. Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings.

1.7 PLACE OF PERFORMANCE

The work to be performed under this contract will be at NMH&S Academy, 1301 Airport Road, Beaver, Raleigh County, WV.

1.8 SECURITY REQUIREMENTS

Contractor staffs are required to conform to MSHA's security and privacy requirements as described below.

1.8.1 As a condition of employment with the U.S. Department of Labor (DOL), Mine Safety and Health Administration (MSHA), all employees must complete paperwork for a short e-QIP background investigation as needed.

1.8.2 Identification Badge. Contractor employees visiting Government facilities shall wear an identification badge provided by on-site security. Visiting Contractor employees shall comply with all Government escort rules and requirements. All Contractor employees shall identify themselves as Contractors when their status is not readily apparent and display all identification and visitor badges in plain view above the waist at all times.

1.8.3 Employee Conduct. Contractor employees shall comply with all applicable Government regulations, policies and procedures (e.g., fire, safety, sanitation, environmental protection, security, “off limits” areas, wearing of parts of military uniforms, and possession of weapons) when visiting or working at Government facilities. The Contractor shall ensure contractor employees present a professional appearance at all times and that their conduct shall not reflect discredit on the United States, the Department of Labor or

MSHA.

1.8.4 Removing Employees for Misconduct or Security Reasons. The Government may, at its sole discretion, direct the Contractor to remove any Contractor employee from MSHA facilities for misconduct or security reasons. Removal does not relieve the Contractor of the responsibility to continue providing the services required. The Contracting Officer (CO) will provide the Contractor with a written explanation to support any request to remove an employee.

1.9 SAFETY REQUIREMENTS

The Contractor shall ensure that safety requirements are followed at all times and must adhere to all MSHA, OSHA, EPA, and Academy safety requirements.

1.10 CONTRACTING OFFICER REPRESENTATIVE

The Contracting Officer Representative (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates.

The COR is not authorized to change any of the terms and conditions of the resulting contract.

1.10.1 The Contractor will in the performance of this requirement immediately notify the COR or the MSHA Point of Contact if the time and/or service obligations of this contract cannot be met due to inclement weather, civil disturbances, equipment failure, illness, etc. MSHA recognizes the obligation of the Contractor to provide for the safety and well-being of personnel engaged in providing services under this contract. The Contractor shall notify the MSHA COR or other MSHA designated point of contact no later than 9:00 a.m. on the day the services were scheduled to be provided if any circumstances prevent timely performance.

1.11 TYPE OF CONTRACT

The Government anticipates awarding a firm fixed price contract.

PART 3

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.0 GOVERNMENT FURNISHED ITEMS AND SERVICES

Knowledgeable MSHA personnel will be made available to direct the Contractor to the location of the building/area needing repairs/services at NMH&S Academy. The NMH&S Academy will provide access to the facility for the Contractor as required in the performance of the tasks identified in this SOW to include site and building electrical power for power tools. The Government will provide any drawings that may be available for this project.

The Government reserves the right to inspect work at any time during the project.

3.1 CONTRACTOR USE OF PREMISES

The Contractor will be performing this work on the grounds of the National Mine Health and Safety Academy. The grounds have controlled access and as such the Contractor shall comply with Academy security procedures.

The Contractor will be provided a storage / staging area for equipment and materials in an area determined by the COR. The Contractor is responsible for restoring the area to its original condition at the completion of work and repairing any damages incurred to the area as a result of Contractor activities.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4.0 CONTRACTOR FURNISHED ITEMS AND SERVICES

Except for those items, services, or commodities specifically stated in Part 3 as Government furnished, the Contractor must furnish everything needed to perform this contract according to all its terms.

The Contractor is responsible for the removal and disposal of waste that is a result of this project and must comply with all federal, state and local regulations pertaining to the transport and disposal of waste.

The Contractor shall perform the services as set forth in the Statement of Work and in accordance with all applicable laws and regulations. The Contractor warrants that he will have obtained all licenses and permits required by law to engage in the activities that are required in connection with this Statement of Work.

PART 5

REQUIREMENTS AND SPECIFICATIONS

5.0 REQUIREMENTS

All labor, planning, documents, materials, equipment, supervision, incidentals, permits, licensure, and cleanup shall be provided by the Contractor to complete the following tasks. These tasks are not all inclusive of work to be performed but included only as a general idea of what is expected.

5.0.1 Mobilization

· Mobilize personnel and equipment to job site storage/staging area

5.0.2 Complete

· Repair approximately 350 square feet of damaged stucco in preparation for new coating

· Install approximately 950 square feet of cementitious board over existing stucco foundation

· Apply expansion joints, control joints, and corner trim as necessary.

· Apply base coat and smooth finish coat.

5.0.3 Painting and Caulking

· Stucco finish coat will be color of government’s choosing.

· Caulk as needed to prevent water penetration

5.0.4 Cleanup and Disposal of Debris

· Remove and properly dispose of waste products generated during construction.

5.1 SPECIFICATIONS

· ASTM C926-18b: Standard Specification for Application of Portland Cement-Based Plaster will serve as the technical resource for this project.

5.2 WORK SCHEDULE

All work shall be performed during the periods of time established by the U.S. Government’s Contracting Officer’s Representative (COR) so there is no disruption in training that is scheduled at the Academy.

5.3 INSPECTION AND ACCEPTANCE

For this project, the acceptance of all tasks will belong with NMH&S Academy management and the Contracting Officer’s Representative (COR) in accordance with the contract. The selected Contractor must ensure it has adequate resources for making all repairs.

Once project tasks have been completed, the Contractor will provide a Project Completion Report and final certified payroll to the Contracting Officer’s Representative (COR) requesting, in writing, a final inspection. The COR will make an inspection within 10 days of receipt of request. The approval of this final inspection documentation by the COR will acknowledge acceptance of all project deliverables and that the Contractor has met all assigned tasks.

Any discrepancies involving completion of tasks or disagreement between NMH&S Academy management or the COR and the chosen Contractor will be referred to both organizations’ Contracting offices for review and discussion.

5.4 STOP WORK

All work shall be performed in a safe and professional manner. If work is not performed safely and professionally, the COR shall have the authority to stop work immediately. This does not in any way affect the U.S. Government’s right to terminate the contract for default or convenience in accordance with the applicable provisions of the contract.

5.5 WARRANTY

Unless specified otherwise, in writing and agreed upon by all parties, all products, labor, and service must be warranted by the Contractor for a period not less than one (1) year from the official date of final Contractor payment.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights-

(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.

(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

(a) Definitions. As used in this clause-

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(a) Definitions. As used in this clause-

Commercially available off-the-shelf (COTS) item- (1) Means any item of supply (including construction material) that is-

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

Construction material means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

Cost of components means-

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

Domestic construction material means-

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if-

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

Foreign construction material means a construction material other than a domestic construction material.

United States means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference. (1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that-

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute. (1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including-

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute or Balance of Payments Program.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:
