This acquisition is conducted under the authority of 41 United
States Code (U.S.C.) 253(c)(1) as set forth in Federal Acquisition Regulation (FAR) 6.302- 1.
This acquisition is conducted under the authority of section 4202 of the Clinger-Cohen Act of 1996.
This acquisition is conducted under the authority of the Services
Acquisition Reform Act of 2003 (41 U.S.C. 428a).

This is to procure Smarter Forms Software License that enables Form Design Automation. Smarter Forms utilizes proprietary patent-pending technology to convert a PDF form into Smarter Forms Electronic Form automatically. This saves valuable design time by automatic PDF import features such as importing federal forms that instantly converts “paper” SF federal forms into dynamic eForm. STP Software Systems, Inc. is the sole source for the SmarterForms software.
6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.
FBO notice will be publicized.
7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.
The replacement of the manufacturer product with a different solution would result in significant investment costs associated in the investment of time and resources in the development applications that requires the use of SmarterForms for digitalization of Federal Forms. This will result in significant disruptions and lost in of four months to redevelop digital forms.
8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.
Market research done on various technical products, and finally a recommendation to purchase the product was based on several evaluation criteria (see HRSA ECM Technical Recommendations Document):

Six (6) different software products were evaluated based on the above criteria, and based on the Business Requirements and evaluation process, the recommendation is to use SmarterForms proprietary software technology to electronically converts Federal PDF forms to digital formats and implement workflow. With SmarterForms solution, HRSA will be able to scale and deliver hundreds of standardized forms within time and cost constraints.
9. Any other facts supporting the use of other than full and open competition.
SmarterForms was the product previously tested/piloted at HRSA as a complimentary product that worked in tandem with SharePoint, in particular with the digitalization of forms and saving the forms contents into SharePoint.
