1.0 BACKGROUND

The United States Border Patrol (USBP) requires geophysical surveying and mapping services to perform cone penetration testing (CPT) (or acceptable substitute), deploy a variety of geophysical surveying technologies, drill up to twenty-five (25) uncased twenty-four-inch (24”) diameter boreholes up to one-hundred-feet (100’) deep, drill up to two lined forty-two-inch (42”) diameter boreholes up to one-hundred-feet (100’) deep, and provide earth-moving equipment to manage the drilling spoils and aid with geophysical surveying. The work will be completed at specific locations as directed by DHS personnel within the Naco, AZ Port of Entry area.

2.0 SCOPE

2.1 Cone Penetration Testing (CPT)

The Contractor shall perform ten (10) CPTs to a depth of one-hundred (100’) feet at specific locations as indicated by USBP/CBP representative. The contractor shall deploy magnetometer based sensors, electrical resistivity sensors or a probe based camera at the direction of USBP/CBP representative to record data as a function of depth. All recorded data along with locations of each test to sub-centimeter accuracy GPS coordinates shall be delivered at completion of project. If the geology is not suited to CPT, another exploratory geophysical technique may be proposed such as traditional geotechnical borings with sampling/data logging.

2.2 Optional Tasks

2.2.1 Optional Task 1: Uncased Borehole Drilling

The Contractor shall drill five (5) boreholes to a depth of up to one-hundred (100’) feet at specific locations as indicated by USBP/CBP representative. Each borehole will be completed by drilling a twenty-four (24) inch diameter borehole within industry best practices for standard deviation from vertical.

The Contractor shall drill five (5) boreholes to a depth of up to one-hundred (100’) feet at specific locations as indicated by USBP/CBP representative. 2.2.3 Optional Task 3: Uncased Borehole Drilling

The Contractor shall drill five (5) boreholes to a depth of up to one-hundred (100’) feet at specific locations as indicated by USBP/CBP representative. Each borehole will be completed by drilling a twenty-four (24) inch diameter borehole within industry best practices for standard deviation from vertical.

2.2.4 Optional Task 4: Uncased Borehole Drilling

The Contractor shall drill five (5) boreholes to a depth of up to one-hundred (100’) feet at specific locations as indicated by USBP/CBP representative. Each borehole will be completed by drilling a twenty-four (24) inch diameter borehole within industry best practices for standard deviation from vertical.

2.2.5 Optional Task 5: Uncased Borehole Drilling

The Contractor shall drill five (5) boreholes to a depth of up to one-hundred (100’) feet at specific locations as indicated by USBP/CBP representative. Each borehole will be completed by drilling a twenty-four (24) inch diameter borehole within industry best practices for standard deviation from vertical.

2.2.6 Optional Task 6: Lined Large Borehole Drilling

The Contractor shall drill one (1) lined borehole of forty-two inch (42”) diameter up to a depth of one-hundred (100’) feet. The borehole will be lined with thirty-six inch (36”) diameter corrugated pipe, or other approved material. The corrugated pipe will be secured at the surface so as to render the casing self-supporting above the bottom of the borehole.

2.2.7 Optional Task 7: Lined Large Borehole Drilling

The Contractor shall drill one (1) lined borehole of forty-two inch (42”) diameter up to a depth of one-hundred (100’) feet. The borehole will be lined with thirty-six inch (36”) diameter corrugated pipe, or other approved material. The corrugated pipe will be secured at the surface so as to render the casing self-supporting above the bottom of the borehole.

2.2.8 Optional Task 8: Technology Deployment Services

The Contractor shall provide up to six (6) days of technology deployment and provide the analyzed data output to the on-site Government representative to inform the placement, sequence, and depth of the boreholes. The type of technology deployed shall be by direction of the USBP. The Government may supply the technology (hardware, software, supplies), however the Contractor shall be responsible for providing the sensor subject matter experts and technicians necessary for the technology deployment and data analysis/interpretation.

2.2.9 Optional Task 9: Change Management Contingency

Due to the highly unpredictable nature of this work, the Contractor shall establish a change management contingency of up to 10% of the total project costs. This will allow the Contractor to be agile and quickly adapt to urgent needs of the project as needs arise or priorities change. Use of the change management contingency funds will be at the written direction of the CO or COR.

2.3 Mobilization and Demobilization

The Contractor shall figure up to one mobilization and demobilization costs per separate equipment type, although this Scope of Work may require short relocations of equipment during the work (up to approximately 1.5 miles).

2.4 Surface Marking of Underground Utilities

Surface marking of any underground utilities must be in place prior to the start of work.

2.5 Spoils

All spoils shall be graded within the work area and not removed.

3.0 Applicable Documents

3.1 This Statement of Work

4.0 Specific Tasks

The Contractor, in completing these tasks, shall follow the requirements of this SOW, and where not specifically defined, comply with government regulations and industry standards.

4.1 General Requirements

4.1.1 General Information

4.1.1.1 No utilities will be provided by the Government.

4.1.1.2 The Contractor’s material/product selection, installation means and methods shall only be completed by qualified personnel.

4.1.1.3 Damage to property owned by others and caused by the Contractor shall be repaired by the Contractor and shall be returned to its original condition.

4.1.2 Contractor shall:

4.1.2.1 Follow all Federal, State, and Local codes during the completion of this project. Refer to Section

3.0 Applicable Documents.

4.1.2.2 Survey areas with the Contracting Officer’s Representative (COR) or authorized Facility Point of Contact (POC) to verify final location of all work prior to work commencing.

4.1.2.3 Protect and safeguard the site from all damage. Any corrective action to repair damaged areas shall be the responsibility of the Contractor.

4.1.2.4 Provide all temporary sanitary facilities, such as, hand wash and portable toilets.

4.1.2.5 Provide environmental protection measures as necessary to prevent polluting discharges of any type, or to be a source of nuisance or interference to operations or other Government personnel in the proximity of the work.

4.1.2.6 Be fully responsible for securing and payment of any necessary State or local permit or other form of approval documentation. In the event that no such permit or documentation is required, the Contractor shall attest to that fact in writing.

4.1.2.7 Workers shall be aware of, and consent to, either being under constant physical escort or video surveillance by closed circuit cameras at all times.

4.1.2.8 Be responsible for all temporary services and/or other accommodations, as well as, all direct and indirect management effort and expenses required to execute this project.

4.1.2.9 Obtain prior approval from the COR/POC prior to commencing with any on-site work.

4.1.2.10 Provide trucks for proper disposal of all construction debris and spoils. Truck waiting locations on site shall be coordinated with the COR/POC prior to arriving on site.

Contractor shall be responsible for the proper disposal of waste/debris associated with this project.

4.1.2.11 Be responsible to secure its equipment and materials stored on site.

4.2 Delivery and Inspection Instructions

4.2.1 The Government:

4.2.1.1 Reserves the right to refuse equipment not meeting the aforementioned requirements

4.2.2 The Contractor shall:

4.2.2.1 Be responsible for the delivery, offloading and mobilization of all equipment to be used for this project.

4.2.2.2 Be responsible for conducting a physical check of the equipment, jointly with the COR/POC, to determine that all mechanical and safety inspections have been performed on each piece of equipment and proof of those inspections are up to date.

4.2.2.3 Document all discrepancies and shall be responsible for either repair or replacement of any equipment that does not have, or cannot prove, up-to-date safety and mechanical inspections.

5.1 Deliverable Submittals

All submittals shall be provided through a Material Approval Submittal (or Contractor format) process and submitted to the Contracting Officer’s Representative (COR) in a Portable Document Format (PDF) file format. Unless noted otherwise, all deliverables shall be in electronic format and provided no less than fifteen (15) calendar days prior to the proposed drilling.

5.1.1 Additional Deliverable Requirements

5.1.1.1 Submittal information shall relate specifically to the requirements, and components required for the work and activities described in Section 4 of this SOW for the project. If the contract provides for the submission of shop drawings, samples, lists and descriptive data for approval, it is important that these be transmitted as early as possible in order to allow time for review and approval. In order to expedite the review for approval, the Contractor shall ensure that the submittals are clearly marked to properly identify the specific items proposed.

5.1.1.2 General statements relating to the methods of work to be completed and material manufacturer’s generic or booklet type information will be returned without review.

5.1.1.3 The Contractor shall allow the Government seven (7) calendar days (after receipt of submittal information) for review and action relative to submittals.

5.1.1.4 Submittal information returned to the Contractor shall be corrected and resubmitted to the Government within five (5) calendar days of Contractor receipt of returned submittal.

5.1.1.5 Failure, on the part of the Contractor, to provide acceptable submittal information within the time frames defined herein shall not be cause for a contract time extension.

5.2 Types of Deliverable

5.2.1 Schedule of Values (SOV)

The Contractor shall submit within five (5) calendar days after NTP issuance the SOV that will provide sufficient breakdown of all unit costs related to individual tasks listed in this SOW. This SOV shall be submitted with each payment request.

5.2.2 Safety, Health and Accident Prevention Plan

The Contractor shall prepare and submit a Task Specific Accident Prevention Plan and Task Specific Safety Plan. This plan shall be submitted within five (5) calendar days after NTP issuance. This plan shall be provided for information only.

5.2.3 Progress Reports/Daily Reports

The Contractor shall prepare reports and shall transmit the reports to the COR/POC via email by 4:00 pm (Local Time) each Friday, or prior to the weekly progress meeting if one is held.

5.2.4 Post – Construction Submittals

5.2.4.1 Contractor shall provide one (1) set of as-built drawings in hard copy format and one (1) set in electronic (PDF) format. Each drill hole shall be labeled on a scale map showing the GPS coordinates, known depth.

5.2.4.2 The Contractor shall provide one electronic PDF copy of all the following that apply, but not limited to: waste/debris disposal documents associated with the tasks of this SOW within fifteen

(15) calendar days after construction is complete.

5.2.4.3 All post-construction submittals shall be provided to the Contractor and approved by the Government before final Government acceptance of completion of the tasks in this SOW.

Electronic copies must be delivered on CD or DVD; USB Flash Drive (Thumb Drive) is not acceptable.

6.0 Government Furnished Equipment and Property

• The Government will provide Geographic Technology Reports to the Contactor.

• The Government will provide technology devices.

7.0 Place of Performance

All work will be within a two mile radius of the Naco Port of Entry in Naco, Arizona.

8.0 Period of Performance

The performance period will be approximately twelve (12) months.

9.0 Security

9.1 Security Requirements

The work to be performed under this SOW is categorized as unclassified. The Contractor shall be responsible for its employees following all the laws of the United States or other governing bodies affecting operations at all sites. This shall include regulations imposed by the CBP.

9.1.1 Security – Work Clearance

9.1.1.1 All Contractor personnel shall be subject to the security provisions and requirements of the facility. Work on the site may incur time constraints associated with security compliance activities, i.e., personnel and vehicle inspections, etc. The Contractor shall ensure that security compliance activities are properly factored into the work schedule and cost proposals. The Contractor shall coordinate with security officials at the facility regarding all applicable security/safety requirements.

9.1.1.2 All personnel entering in or working on federal property will be screened and checked for criminal history and proper immigration status. Personnel who do not meet the minimum standards will not be allowed on the job site. The following items determine whether a person has met the minimum standards as it relates to the criminal history requirement:

• Felony conviction

• Immigration violation (unless exonerated by a judge)

• Active warrant (anywhere)

9.1.1.3 If an individual does not clear vetting, the Government cannot disclose (for privacy reasons) the specific results of the vetting process.

9.1.1.4 The Contractor shall submit the following information to the applicable CBP Sector/Station Security Manager for each employee (including subcontractor personnel) having access to the site, no less than ten (10) working days prior to work start:

• Individual's full name

• Date of birth (DOB)

• Place of birth (POB)

• Driver's Licenses Number and State

• SSN or Alien Registration Number

• On a case-by-case basis, the Contractor may be asked to furnish photocopies of the driver license or state identification card and the social security number or alien registration number in order to help verify and/or resolve conflicting information resulting from the security screening process.

9.1.1.5 Should any Contractor employee, Subcontractor employee, or any other person working on behalf of the Contractor (through further investigation) be found unfit to work on a CBP site, that person shall be removed from the site and barred from returning to the project site.

9.1.1.6 Contractor shall provide the required information showing proof of personnel security screening within ten (10) calendar days of receiving the notice of contract award. The personnel information shall be included in a protected Word attachment to an email. A separate email with the password for the Word document shall be sent after the initial email.

9.1.1.7 The Contractor shall submit all required information for access and security clearances required by CBP.

9.2 Physical Security

The Contractor shall be responsible for safeguarding all Government equipment, information, and property provided for Contractor use. At the close of each workday, Government facilities, equipment, and materials under Contractor control shall be secured.

10.0 Hours of Operation

This site is accessible at all times between 7:00 am to 5:00 pm (local time), Monday thru Friday. The Contractor will not be required to work on the weekends or Federal Holidays, but may do so with approval from the Contracting Officer.

11.0 General Information

11.1 Safety and Environmental

• The Contractor shall conduct work and maintain the work site in such a manner as to not be the cause of any adverse environmental issues to the surrounding environment, CBP, or personnel in or around the immediate area.

• The Contractor shall comply with all OSHA requirements. The Contractor shall provide a Site Safety and Health Officer (SSHO) and be on-site at all times when work is being performed.

• The Contractor shall be required to wear personal protective equipment (PPE) such as hard hats, safety glasses, reflective vests, safety shoes and long pants within the work perimeter at all times. All equipment operators shall be licensed and/or certified to operate equipment and have all the necessary safety training.

• All Contractor accidents, involving injuries or property damage that occur during the performance of this contract shall be reported to the COR/POC within four (4) hours of the Contractor being aware of the occurrence.

11.2 Other/Meetings

• Other - In the event that the necessary materials or methods of installation are not defined by direction or documents provided for this project, the Contractor shall utilize industry standards for any such material or installation method.

• Meetings – The Contractor shall be required to attend the following meetings.

o The Contractor shall attend a job walk-through prior to commencement of any activities.

This meeting will consist of a one-half (1/2 day) meeting at the project site. The designated Contractor Project Superintendent/ Manager, as well as key Subcontractors and trades, are required to attend this meeting.

o Prior to project completion, the Contractor shall conduct a preliminary punch list walk-through on the works and forward the punch list to the COR/POC for review (pre-final inspection) o The Contractor shall conduct a final punch list walk-thru at the completion of the project (final inspection). The final walk-thru shall be attended by the Contractor’s key personnel, site staff, and the COR/POC.

11.3 Special Considerations

• All work to be performed with the least amount of interruption to on-going operations.

Contractor must be aware that interruption of CBP and USBP operations, while necessary, shall be kept to a minimum, and scheduled and coordinated through Border Patrol and CBP personnel ahead of time. This includes any kind of constraint or disruption to BPS activities.

• It is possible that there could be an interruption in the work due to unplanned emergencies and events beyond the control of the Government due to the nature of the facility and Border Patrol operations.

• Contractor shall complete final cleaning of all affected areas by the work. Cleaning shall be to the extent there is no remaining evidence that demolition or construction took place.

11.4 Points of Contact

Notwithstanding the Contractor’s responsibility for management during performance, the administration of this contract will require coordination between CBP, USBP and the Contractor.

The Contracting Officer (CO) will appoint the COR to assure orderly performance of the tasks and provide technical direction. The COR/POC is:

12.0 Questions or Concerns

All technical questions and concerns shall be directed to the COR/POC. All contractual questions shall be directed to the CO/Contract Specialist.

The types of actions within the purview of the COR/POC authority:

• Assure that the Contractor performs the technical requirements of the contract

• Assure that the Contractor perform inspections necessary in connection with performance of the contract

• Maintain both written and oral communications with the Contractor concerning the aspects of the contract within his/her purview

• Issue interpretations of technical requirements

• Monitor the Contractor’s performance under the contract and notify the Contractor and CO of any deficiencies observed

• Coordinate Government-Furnished Property or Data availability and provide for site entry of Contractor personnel (if required)

The COR/POC is not empowered to make any commitments or changes which affect the contract price, delivery or other items and conditions. Any such proposed changes shall be brought to the immediate attention of the CO for action. The acceptance of any changes by the Contractor without specific approval and written consent of the CO shall be at the Contractor’s risk.

13.0 Travel

All travel performed for this effort will be in accordance with Federal Travel Regulations (FTR) and will be reimbursed at actual cost. All travel must be approved by the Contracting Officer (CO) prior to performance.
