STATEMENT OF WORK FOR CONTRACT FOR SERVICE OF Hitachi S-3500VP SCANNING ELECTRON MICROSCOPE and Hitachi H-8000 TRANSMISSION ELECTRON MICROSCOPE SYSTEM Occupational Safety and Health Administration (OSHA)

Email: mccollum.lecia@dol.gov The Salt Lake Technical Center (SLTC) uses the Scanning Electron Microscope (SEM) and the Transmission Electron Microscope (TEM) to support the OSHA mandate to protect workers from exposure to hazardous chemicals and processes.

The SEM is used to analyze and identify small particles and to examine materials and surfaces in support of compliance investigations. This instrument is unique in that it provides high resolution images and chemistry of individual particles and surfaces. It is used in support of compliance sample analysis including asbestos to provide shape, surface and chemical information critical to support analyses in mixed dust exposures. As part of material failure investigations, it is used to analyze fracture surfaces on components to identify modes of failure, such as fatigue which may have contributed to fatal incidents. In-place chemical analysis of residues on surfaces helps identify chemical reactions and explosion characteristics in OSHA investigation of accidents. The SEM is also used to perform general material and particle identification. It is critical that the instrument be properly maintained in order to obtain optimal operating performance and minimal instrument downtime.

The TEM is used to examine and identify ultrafine particulate and nano-size particulate by forming an image from electrons passing through a specimen that must be ultra thin. OSHA is required to identify and characterize individual particles in certain mixed dust exposures in order to determine which Permissible Exposure Levels (PELs) are appropriate, and to support determinations of exposure values for those PELS. Among those dusts are the asbestos minerals, which are extremely complex minerals that require TEM for identification. Even though the OSHA asbestos PEL is based on Phase Contrast Light Microscopy (PCM), it cannot definitively identify asbestos fibers. OSHA has relied on its TEM capabilities to make these identifications for 35 years in meeting the legal obligation of the standard. This has become increasingly important as the nature of worker exposure has shifted from tasks where most of the fibers in the exposure were asbestos to those where they are only a fraction. In addition, the increased manufacture of products from nano-sized materials, such as carbon nanotubes, has caused emerging concerns as to the health effects of these new materials caused by worker exposure. TEM provides OSHA an essential exposure monitoring capability for characterizing these finely divided materials. It is critical that the instrument be properly maintained in order to obtain optimal operating performance and minimal instrument downtime.

The SEM and TEM microscopes are highly sophisticated instruments which require periodic service by a trained service engineer to maintain their optimal performance. The requested maintenance service includes replacement of oils, hoses and seals, and replacement of failed components. The service contract provides priority response for repairs and availability of replacement parts.

2. Services to be Performed

2.1. Emergency Service is that service to be performed where a breakdown has occurred through normal usage of the Equipment and Subscriber has notified the Vendor of that breakdown. The replacement of a consumable item does not constitute Emergency Service. Emergency Service repairs will be performed free-of-charge to the Salt Lake Technical Center

2.2. On-Site Emergency Service Response Time is the length of time within which the Service Engineer should arrive on-site after receipt of the first request by the Salt Lake Technical Center for Emergency Service.

2.3. Preventive Maintenance. The Vendor will provide comprehensive preventive maintenance inspections and service designed to keep the Equipment in a condition ready for ordinary use at intervals based on the contract option selected by mutual agreement with Subscriber. The cost of preventive maintenance inspections and service is included in the cost of this Agreement. Routine replacement of parts shall be as specified below, and other parts will be replaced if deemed necessary in the judgment of the Service Engineer. Preventive maintenance inspections and service may include the following, as determined by the Service Engineer:

Cleaning of the instrument;

Replacement of parts;

Inspection and replacement of vacuum pump oils, seals and filters;

Inspection and replacement of vacuum hoses, air lines and water lines;

Inspection and adjustment, if necessary, of all systems; and

Column alignment and inspection of image.

2.4. Parts. All parts, except consumables will be provided and replaced or repaired free-of-charge if, in the determination of the Service Engineer, such replacement or repair is necessary to keep the Equipment in a condition ready for ordinary use. The Salt Lake Technical Center shall be awarded a 10% discount off the standard selling price for the parts not covered by the Service Agreement.

3. STATEMENT OF WORK

The Vendor will inspect, repair, and maintain the Hitachi S-3500VP Scanning Electron Microscope and the Hitachi H-8000 Transmission Electron Microscope to include the attached photo camera unit on the SEM under the terms of a Service Agreement. The contract will include unlimited service calls and telephone support during the Vendor’s normal business hours. The Vendor will repair or replace any component part of the Equipment at no additional cost to Subscriber, except as specified in a Service Agreement (such as consumables), if said repair or replacement is deemed necessary in the judgment of the Vendor. Labor required to perform such services will be rendered during the hours specified in the Service Option selected by Subscriber as described in the Service Options section of this Agreement. Labor required after such hours will be billed to the Subscriber at the Vendor’s standard overtime rates (less 10% discount) in effect at the time such labor is rendered.

4. DELIVERABLES

The Vendor will provide timely service and parts according to a Service Contract for the purpose of maintaining both the Hitachi S-3500VP Scanning Electron Microscope and the Hitachi H-8000 Transmission Electron Microscope in Operational Condition. The contract will include unlimited service calls and telephone support during the Vendor’s normal business hours. The response shall be within 48 hours.

5. PERIOD OF PERFORMANCE

The term of the Contract shall be for the period of one year No work will be done during authorized government holidays which are as follows:
