The following revisions are hereby incorporated into RFP No. 15JPSS18R00000001.
1. Incorporate the questions and answers received in response to this solicitation. See Attachment (4).
2. Incorporate DOL Wage Determination No. 2015-4281, Revision No. 8 for the Washington, DC
Metropolitan Area. See Attachment (5).
3. Under Section C.4, entitled “Transcription Requests”, is hereby deleted in its entirety and replaced with the following:
The average length of a transcript resulting from one immigration hearing is approximately 100 pages. The average hearing is 2.6 hours in length; some may be considerably longer. Most of the transcription requests require a 5-day or 20-day transcription turnaround time (TAT). The following is an estimate of the total volume of audio EOIR expects to produce on a weekly basis for which transcription will be required:
(a) 1000 hours of audio* per week with a 5-day TAT and;
(b) 500-750 hours of audio* per week with a 20-day TAT
*most audio contains simultaneous interpretation
Note: This total volume of audio per week requiring transcription is an estimate only; it is not a minimum or maximum workload commitment or guarantee by the Government, in no way binds the
Government, and no successful awardee is guaranteed this volume, in whole or in part.
4. Section H.6(a) is hereby deleted in its entirety and replaced with the following:
(a) The work to be performed under this contract may involve access to classified information [National
Security Information (NSI)] and will involve access to unclassified information. All references to
“contract(or) personnel” and “contract employee” in this clause include all individuals that will perform under this contract, including individuals employed by the Contractor, team member, subcontractor, consultant, and/or independent contractor.
5. Section H.6.1.1(a) is hereby deleted in its entirety and replaced with the following:
(a) The Contractor shall possess or be capable of obtaining a DISCO Defense Industrial Security
Clearance Facility Code and a Top Secret Facility Clearance to fully perform this contract. As directed by the COR and SPM, the Contractor shall submit the information necessary to allow the Government to prepare and obtain for the Contractor a "Department of Defense Contract Security Classification
Specification" (DD Form 254) for this contract. Where such clearance is required, the Contractor agrees to provide information and access to Contractor facilities as may be required by Government investigators.
6. Under Section I.2, the table entitled “Clauses Incorporated by Reference”, is hereby deleted in its entirety and replaced with the following:

7. Incorporate FAR 52.222-49, “Service Contract Labor Standards – Place of Performance Unknown” under Section I by full text as follows:
Service Contract Labor Standards -- Place of Performance Unknown (May 2014)
(a) This contract is subject to the Service Contract Labor Standards statute, and the place of performance was unknown when the solicitation was issued. In addition to places or areas identified in wage determinations, if any, attached to the solicitation, wage determinations have also been requested for the following: Washington, DC Metropolitan Area. The Contracting Officer will request wage determinations for additional places or areas of performance if asked to do so in writing by 10:00 ET on
January 16, 2018.
(b) Offerors who intend to perform in a place or area of performance for which a wage determination has not been attached or requested may nevertheless submit bids or proposals. However, a wage determination shall be requested and incorporated in the resultant contract retroactive to the date of contract award, and there shall be no adjustment in the contract price.
8. Under Section L.4.1.3(a) is deleted in its entirety and replaced with the following:
(a) The Offeror shall complete the Pricing Table shown in Attachment (1). The Pricing Table shall be a separate document from the Business Proposal and shall be submitted in MS Excel format. All formulas shall remain present in the spreadsheet for verification. Submission of hard-numbered, file-protected or otherwise unworkable Excel documents; or, submission of pdf. files will be deemed non-responsive and may preclude Offeror’s proposal from further consideration. This table contains unit prices for every defined deliverable. The Offeror shall include unit prices for the base year and all option periods.
9. Under Section L.9, entitled, “Solicitation Provisions Incorporated by Reference”, FAR 52.222-46, Evaluation of Compensation for Professional Employees is deleted in its entirety.
10. Under Section M.2.1(1), entitled “Management” is hereby deleted in its entirety and replaced with the following:
(1) Management. The Government will assess each offeror’s understanding of the proposed contract and ability to manage the contract in an efficient and effective manner. The evaluation will take into account the offeror's management structure and processes, key personnel qualifications, and resources. The Government will evaluate whether the offeror possesses or is capable of obtaining the required facility clearance. The Government will evaluate the proposed equipment that the offeror proposes to utilize to perform and the offeror’s plan to maintain the equipment. The Government will evaluate the offeror’s phase-in strategy.
The Government will evaluate the offeror's ability to direct, monitor, and control multiple assignments under the contract. The Government will assess the offeror’s Quality
Control Plan.
11. The proposal due date is extended to 10:00am ET on January 23, 2018.
12. All other terms and conditions remain unchanged and in full force and effect.
