1.1 SOLICITATION TERMS

Quoters will be required to submit the attached Form 10 solicitation document with their quotes input. All information requested by the individual line must be provided for your quote to be considered to be responsive. This includes the requirement to state the acutal brand product you are quoting on your reponse.

At this time, funding for any awards made is not currently available until approved fiscal year 2024 are provided. Any award sent prior to these funds being available will be subject to the terms of FAR Clause 52.232.18, Availability of Funds.

EVALUATION FACTORS AND OTHER AWARD INFORMATION AND INSTRUCTIONS:

All offerors must be registered in SAM at http://www.sam.gov. Each offer is required per 52.212-3 to complete their representation and certifications via the Online Representation and Certification Applications (SAM) at http://www/ sam.gov. All responsible sources are encouraged to submit a written offer which will be considered for award. The solicitation will be available on or after November 17, 2023 with a due date of December 05, 2023, and no later than 9:00 a.m., Pacific Standard Time. Awards will be made based upon price and price-related factors to the lowest priced

15BDUB24Q00000007 Page 6 of 14 technically acceptable offerors. Past Performance (i.e., the offeror’s performance record on previous contracts) will be considered.

CHANGES TO SPECIFICATIONS WILL LIKELY CAUSE YOUR OFFER TO BE CONSIDERED

NON-REPONSIVE.

Offerors must be registered in SAM to receive award (see www.sam.gov for more information). The registration must be current and valid. Quoters shall include their Unique Entity ID (UEI) number in Block 17a of the Standard Form 1449, in accordance with far 52-212.1(j). The contracting officer will verify registration in the SAM database prior to award by entering the potential awardee's UEI number into the database. Additionally, the offeror must not be included on the Excluded Parties Listing.

DELIVERY: Receiving hours are MONDAY - FRIDAY; 6:30 A.M. - 12:30 P.M. excluding Federal Holidays. Deliveries are on a first come, first served basis. PLEASE CONTACT THE WAREHOUSE TO SCHEDULE DELIVERY. Warehouse contact is Mrs. Marshall at 925-833-7500 Ext. 361.

52.232-18 Availability of Funds (Apr 1984)

Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract and does not contain the clause at 52.215-2, Audit and Records-- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

PRODUCT MUST BE 6 MONTHS OR YOUNGER UPON DELIVERY WITH THE DATE CLEARLY ON THE LABEL, (NO STAMPED OR WRITTEN DATES ALLOWED).
