STATEMENT OF WORK

REPAIR TRANSFORMER PAD

USP ATWATER – PROJECT 6D6L

1. SPECIFICATIONS:

A. INTRODUCTION

The Federal Bureau of Prisons, United States Penitentiary (USP) Atwater intends to award to a responsible entity for the provision of skilled service to repair a transformer pad at USP Atwater, located at #1 Federal Way, Atwater California, 95301.

B. SCOPE OF WORK

1. Currently USP Atwater has a large pad‐mounted transformer that has tilted and moved out of a level plane due to squirrels digging burrows beneath the pad. This is placing stress on the underground conduit that contains high voltage power lines.

2. Method of Performance:

a. The contractor shall provide all necessary labor, equipment and materials to lift the transformer and repair any damaged conduit, then backfill the damaged subgrade soil and repair or replace the concrete pad that supports the transformer.

b. The contractor shall provide their on‐site workers with all necessary safety equipment to include, proper personal protective equipment, fall protection equipment, and any “job‐site specific” safety equipment deemed necessary to safely complete the project described in this statement of work.

c. The contractor shall provide the COR with SDS (Safety Data Sheets) on all chemically engineered products that may be used during the course of the project prior to being used. In the event a particular product(s) is not approved by the institution Safety Manager or Contracting Officer due to security or safety concerns, it shall be the responsibility of the contractor to locate and procure alternate acceptable product(s) at no additional cost to the Government.

3. All work shall be completed, secured and sealed per manufacture’s recommendations and accepted by the institution’s COR prior to closure of the project.

C. QUALITY ASSURANCE/INSTALLATION REQUIREMENTS

1. All installers/technicians shall be qualified and/or certified by the manufacturer to install the material being installed.

2. All seismic zone requirements, environmental compliance, life safety, NFPA, ADA‐ABA, and federal, state and local codes and regulations will be considered during all phases of this project.

3. Services and materials provided will be consistent with current industry standards and Underwriters Laboratories (UL) and relevant building codes.

D. TESTING AND ACCEPTANCE

1. Upon work completion, the contractor shall:

A. Perform a minimum to 100% functional performance test.

B. Make all necessary adjustments and verify that all wire lugs, components and features operate properly as designed by the manufacturer.

C. Ensure all materials used meet or exceed manufacturer specifications to the satisfaction of the COR before release of contractor liability is granted.

2. The contractor will be responsible to ensure that the premises are kept clean and free from accumulation of waste materials and rubbish at all times. The contractor will remove all debris, scrap, and rubbish from the work area daily. Surplus materials and all equipment shall be promptly removed from the site upon completion of the work. The contractor shall be responsible for removing all debris and waste materials from the job site at USP Atwater upon conclusion and acceptance of the project. These items must be disposed of in accordance with all federal, state and local laws.

E. CONTRACTOR RESPONSIBILITIES

1. Contractor shall be responsible for acquiring and maintaining any necessary permits.

2. Contractor shall supply all heavy equipment to perform the repair including but not limited to cranes, etc.

3. All contractor provided field technicians assigned to do the prescribed work shall be certified. Proof of certifications must be provided by the contractor to the COR prior to project start.

4. Upon assembly, the contractor shall use all new fasteners, seals/sealant that meet, and/or exceed the manufacturer’s specifications.

5. Contractor shall comply with all applicable federal, state, and local safety standards providing their on‐ site field technicians with all necessary safety equipment to include, proper personal protective equipment, fall protection equipment, and any “job‐site specific” safety equipment deemed necessary to safely complete the project described in this statement of work.

6. The contractor shall comply with all applicable federal, state, and local laws for the safe transportation, storage, use, documentation, and disposal of all chemicals that may be used on the job. Likewise, all used chemicals, chemically hazardous debris (to include used rags), must be safely collected in approved receptacles and removed by the contractor in accordance with the aforementioned regulatory entities.

7. The contractor shall provide Safety Data Sheets (SDS) on all hazardous/flammable chemical products that would be required, or recommended, or used to complete the project. If the institution Safety

Manager deems any of the products are inappropriate for use within the institution it shall be the contractor’s responsibility to find an alternative material/chemical to use.

F. USP ATWATER RESPONSIBILITIES

1. Utilities: USP Atwater will provide minimal electricity service (120V), for battery chargers, small hand tools and restroom services.

2. USP Atwater shall ensure all energy sources needing to be secured to prevent personal injury and/or property damage will be locked‐out and tagged‐out with the appropriate safety measures.

3. USP Atwater shall provide staff member escorts who can allow authorized access to all areas requested by the contractor as needed.

4. The COR shall be the general point of contact between the contractor and USP Atwater.

5. The institution’s Safety Manager shall randomly monitor the project. If at any time the Safety Manager deems a potential hazard, the situation must be resolved immediately.

G. MATERIAL DELIVERY AND HANDLING

The USP’s normal hours of operation are Monday thru Friday. 7:00 a.m. to 3:30 p.m., excluding federal holidays.

All work must be scheduled within this time frame. Any work that is required outside of this schedule must be preapproved by the COR and/or Contracting Officer prior to the beginning of any work.

1. All construction materials and contractor equipment needed to perform the work that will require temporary on‐site storage will be coordinated with the COR.

2. All construction related deliveries which are directly shipped to the institution on behalf of the contractor can be received at the institutions’ Receiving Warehouse between the hours of 7:00AM – 2:00 PM, Monday – Friday, excluding federal holidays. At no point will a USP Atwater staff member sign for, or allow a drop shipment of project related materials or equipment to enter the institution if the contractor, or his representative, is not present to inspect, verify and accept the delivery. Under no circumstance will USP Atwater, or its staff, be responsible for the acceptance of any project related deliveries.

3. The contractor shall be responsible for providing their own means of loading and unloading contractor materials and equipment. At no time shall contractor materials or equipment being staged for institution entry or exit be allowed to block, impede or otherwise hinder the typical operations of the receiving dock area.

4. The contractor will be permitted to use the shipping and receiving area to load and unload project related materials and equipment during the aforementioned hours of operation. During such evolutions, a USP Atwater staff member must be present to monitor the process. At no time shall the contractor be permitted to stage project related materials or equipment at the receiving area beyond 2:00PM each workday without prior approval from the COR. At no time shall project materials or equipment be staged on the receiving dock without approval by the COR.

H. STORAGE OF MATERIALS, EQUIPMENT, AND TOOLS

1. All construction materials and equipment shall be stored in a designated area mutually agreed upon between the COR and the contractor. The contractor shall provide a securable, single point access storage container, such as a job or gang box that will be left in the agreed upon storage area for the duration of the project. Size of the storage container will be determined by the contractor and the COR. The container will be secured using a double padlock protocol with one padlock being contractor provided and the other being USP Atwater provided. If necessary, a heavy duty chain may be used to facilitate the double lock requirement. All materials and equipment stored within the container will be maintained in a safe and orderly fashion. Items cannot be stored at a height that would create a safety hazard.

2. All contractor ladders that may be needed for the job, and cannot be stored in an authorized storage container, shall be stored and secured in the immediate work site area. Such ladders will be secured to an agreed upon stationary fixture with a contractor provided padlock and chain.

3. The contractor shall be required to adhere to the BOP’s tool inventory program as it pertains to contractor tools and equipment entering and exiting the institution. If an authorized on site storage container should be used by the contractor to store their job tools and equipment for the duration of the project, the contractor will be required to use a daily inventory check sheet to account for all items in the container. A USP Atwater facilities staff representative will be present to oversee and verify the inventory process. The container will be inventoried and verified at the end of every work shift prior to locking the container shut.

I. SECURITY CLEARANCE / CONTRACTOR BADGES

1. The contractor shall be responsible to comply with Homeland Security Presidential Directive (HSPD) #12 advising the primary contractor that he is responsible to obtain and review for accuracy all required security clearance documents submitted to the BOP on behalf of their employees and any sub‐ contractors who will be entering USP Atwater as a secure federal facility. The Government will not accept security clearance packages from sub‐contractors.

2. The contractor shall provide the COR with all the necessary security clearance documents on all contractor employed field technicians accessing the institution and be security cleared for badging within 30 days of on‐site work starting. In the event a contractor field technician cannot pass the security clearance process, it will be the contractor’s responsibility to provide another certified worker candidate. By law USP Atwater cannot, and will not, release any information to the contractor concerning the nature of why his field technician was not able to pass the security clearance process.

3. Active contractor security clearances and associated institution access badges will be in effect for the actual time required to complete the project, but not to exceed the short term, low risk security clearance criteria of 6 months.

4. All contractors assigned to work on the project that will be entering secure confines of USP Atwater will be issued and required to wear a picture ID/contractor badge provided by the institution. For security reasons, the badge will be worn in a visible manner as directed by the COR.

J. SAFETY AND PERSONAL PROTECTIVE EQUIPMENT

1. All contracted field technicians working within the designated job site shall have and wear applicable

Personal Protective Equipment (PPE) as prescribed by Occupational Safety & Health Administration

(OSHA) regulations and industry standards. It is the responsibility of the contractor to provide such equipment.

2. USP Atwater shall ensure all energy sources and/or energy management systems needing to be secured to prevent personal injury and/or property damage will be locked‐out and tagged‐out with the appropriate locking devises. Locking of identified isolation points will be comprised of a minimum two lock process, one lock provided by the institution and the other provided by the contractor. All lock‐ out/tag‐out measures to be implemented, and/or removed, shall require verbal authorization and physical verification by the contracted field technician, the COR, and institution Safety Manager prior to doing so.

K. OTHER CONSIDERATIONS

1. Contractors will not be allowed to bring any mobile electronic devises, i.e. (phones, computer equipment, cameras, 2 way pagers, etc…) into the institution. USP Atwater’s facilities department has a digital camera that will be used to photo document project work. Upon approval by the Warden, the contractor may request copies of detailed project photos taken.

2. Lost time due to security restrictions/considerations:

A. Contractors should plan for a minimal amount of time accrued for security considerations, i.e., check‐in screening, delays due to inmate movements, institution lock‐down, institution emergencies, etc. In the event of an institution emergency, the contractor may be instructed to suspend all work, secure and stow all tools, equipment, and materials, and be escorted out of the institution. Work will be suspended until the institution emergency passes.

3. Any deviations from this statement of work will be considered a change order request and must be authorized through the institution’s Contracting Officer prior to the implementation of the requested change.

4. It is the contractor’s responsibility to repair and/or replace any equipment or property of the Government damaged by the contractor during the transformer pad repair process. Damage initiated by the contractor will be corrected and restored to previous condition at no cost to the Government.

5. In accordance with the Bureau of Prisons Acquisition Regulation (BPAP) 37.103 (e):

A. This service is a contractual arrangement and not a personnel appointment.

B. Payment is based on an end product or accomplishment of a specific result.

C. The service does not constitute an employer/employee relationship.

D. The contractor will not be subject to Government supervision, except for security related matters. However, contractor performance shall be monitored.
