EVALUATION FACTORS, ATTACMENT 1
VICTIM COORDINIATOR SERVICES
for the BUREAU OF INDIAN EDUCATION (BIE), Haskell Indian Nations University
11/09/2018
EVALUATION FACTORS
1.1 Evaluation Factors for Award
The government will evaluate the Offeror’s quote to determine if the service offerings satisfy the specific requirements under this solicitation, based on the evaluation factors defined in this section. To result in an award, the Offeror’s quote must demonstrate the ability to satisfy all technical requirements as set forth in Victim Coordinator Services Statement of Work and must conform to all required terms and conditions of this contract.
The government may award a contract based on the initial quote without discussions or negotiations with Offerors, in accordance with FAR 52.215-1. Therefore, it is important that each quote be fully compliant, without exception to any requirement, clause, or provision. Offerors should submit initial quotes which respond most favorably to the solicitation’s requirements.
FAR 52.252-1 Solicitation Provisions Incorporated by Reference (Feb 1998)
This solicitation incorporates one or provisions by reference, with the same force and effect as if they were given in full text. Upon request, the CO will make their full text available. Also, the full text of a clause may be accessed electronically at https://www.acquisition.gov/far.
5.2 Evaluation Type
The award will be made to the Offeror that presents the overall best value to the government using a Best Value with Tradeoffs evaluation process.
The government anticipates awarding a contract to the Offeror whose quote represents the best value, price and other factors considered. All evaluation factors other than price, when combined, are considered significantly more important than price.
(a) The relative importance of the evaluation factors is as follows:
Factor
Weight
Technical
45%
Past Performance
35%
Price
20%
(b) The government intends to evaluate quotes and may award a contract without discussions. However, the government reserves the right to conduct discussions if determined by the CO to be necessary. Therefore, each initial offer should contain the Offeror’s best quote from both a price and a technical standpoint.
(c) Quotes received in response to this solicitation will be evaluated pursuant to the Federal Acquisition Regulation (FAR), in accordance with FAR 52.215-1, and in accordance with the evaluation criteria set forth herein. The government intends to make one award to the responsible Offeror whose quote, conforming to the solicitation, is determined most advantageous to the government, all technical and price factors considered.
(d) Options. The Government will evaluate offers for award purposes by adding the total price for all years to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
The Government will make an award to the responsible Offeror whose quote is determined to represent the best value to the Government, Price and other factors considered. The Government reserves the right to make an award to other than the lowest priced Offeror or to the Offeror with a higher technical score, if the Government determines that to do so would result in the best value to the Government. The Government will use a tradeoff analysis to determine best value.
1.3 Price Evaluation Criteria
An Offeror’s quote is presumed to represent its best efforts to respond to the solicitation. Any inconsistency, whether real or apparent, between promised performance and cost should be explained in the quote.
Any significant inconsistency, if unexplained, raises a fundamental issue of the Offeror’s understanding of the nature and scope of the work required and of its financial ability to perform the contract, and may be grounds for rejection of the quote.
The Price Quote will be used by the Government to evaluate and determine whether proposed prices are reasonable. For this reason, the data must be logically displayed and adequately supported in such a manner as to show a clear relationship to the appropriate price element.
The Price Quote shall provide a comprehensive discussion of all proposed prices. The Offeror shall structure the price discussion and the tabulation of all prices/costs.
Pricing used to formulate a resulting contract shall remain valid for the duration of the contract.
The Price Quote should contain the Offeror’s best terms from a cost or price and technical standpoint. Discussions will be conducted with only those Offerors within the competitive range, if established.
1.4 Technical Evaluation Criteria
The government will review the responses to this solicitation to ensure that contractors have addressed the requirements outlined in Victim Coordinator Services Statement of Work of this solicitation and are sufficient in detail and clarity to allow the government to determine whether the proposed services, technical approach, and agency-specific solutions are acceptable, or if the government desires to enable BIE Special Education Office to identify items for discussions.
The technical evaluation criteria will serve as the standard against which all technical quotes will be evaluated and will serve to identify the significant discussion items that Offerors should address in their quotes. The government will evaluate the Offeror’s technical quote based upon the following factor:
1) Technical
The above factors has three sub-factors. To achieve an acceptable rating, the Offeror’s Technical Quote must achieve a satisfactory or above rating on all sub-factors.
The evaluations will be based on the factors and sub-factors listed in descending order of importance for each and what the quote should provide to meet the minimum technical acceptability rating.
The government will evaluate each of the Offeror’s technical quotes to determine if the service offerings satisfy the specific requirements. The factor and sub-factors are presented below.
5.4.1 Factor 1: Technical
5.4.1.1 Factor 1a: Technical Approach: The Technical Approach shall be in as much detail as the offeror considers necessary to fully explain the quoted technical approach. The technical quote should reflect a clear understanding of the nature of the work to be performed. The quote shall assess the offeror’s understanding of the Bureau of Indian Education’s goals for the project and an understanding of the SOW. If the Offeror simply restates the requirements in Victim Coordinator Services Statement of Work of this solicitation, the Offeror’s quote will be removed from consideration for award. The quote should include, but not be limited to the following:
-Knowledge and understanding of the requirements outlined in the SOW.
-Understanding of general and local conditions which can affect the SOW.
-Demonstrated ability of contractor to provide the services required by the SOW.
5.4.1.2 Factor 1b: Resume: The contractor shall demonstrate corporate knowledge and experience by submitting a resume for individual it submits as key personnel (Reference Victim Coordinator Services Statement of Work). The offeror shall explain why this individual is essential to the offeror’s performance. The Government will look more favorably on personnel with direct experience supporting Bureau of Indian Education entities.
5.4.1.3 Factor 1c: Experience: The offeror shall describe the relevance of the past performance it is providing under Factor 2: Past Performance. Specifically, the contractor shall demonstrate its knowledge of BIE, as well as the schools and tribal entities it supports. The offeror shall describe the relevant experience working with Native American populations.
5.5 Past Performance Evaluation Criteria
The Offeror shall exhibit recent (within the past three years) and relevant Past Performance on contracts similar in nature and operational complexity to the subject requirement. Relevancy of Past Performance for any Offeror or team partner is defined as similar in scope, size, and operational complexity to the work for which they are proposed to perform. The Government will evaluate Past Performance for a quality rating based upon the Past Performance of the Offeror and proposed subcontractors expected to perform major or critical aspects of the requirement. The Government may consider recent and relevant Past Performance on contracts not submitted by the Offeror. An individual Past Performance reference shall not exceed two pages.
The Past Performance volume shall identify and describe relevant Past Performance information in fulfilling Government and/or commercial contracts still in progress or completed within the past three years that have at least one year of performance history. The Offeror shall submit three examples of Past Performance for the prime Offeror. The Offeror shall indicate whether it performed as a prime and/or major subcontractor and indicate its role for each questionnaire submitted. Irrespective of limitations, all contracts active within the past five years that have been terminated for default, received show cause or cure notices, had a defective pricing or fraud action initiated by the Government, or have had products accepted on a non-conforming basis must be reported.
The evaluation of Past Performance information will take into account Past Performance information regarding predecessor companies, Key Personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the acquisition.
The Offeror shall furnish the following information for each Past Performance reference.
i. Company/Division name
ii. Product/Service
iii. Contracting Agency/Customer
iv. Contract Number
v. Contract Dollar Value
vi. Period of Performance
vii. Verified, up-to-date name, address, telephone number of the relevant CO
viii. Project summary
In the case where Offerors do not have any relevant Past Performance and/or experience related to the scope of the work defined in the SOW, they shall provide an explanation in its Past Performance volume. If an Offeror does not have any projects whose Past Performance is recent and relevant to the solicitation, the Government will assign a rating of Neutral, which is neither favorable nor unfavorable.
The Government may use multiple sources of Past Performance data, including the Offeror’s Past Performance references, Government and/or commercial databases (e.g. PPIRS, FAPIIS, etc.), and Government interviews with past and current clients.
1.6 Evaluation Ratings for Technical

Rating
Definition
Outstanding (O)
The quote has exceptional merit and reflects an excellent approach which should clearly result in the superior attainment of requirements and objectives. The proposed approach includes numerous substantial advantages, and almost no disadvantages, and can be expected to result in outstanding performance. The solutions proposed are exceptionally clear and precise, fully supported, and demonstrate an outstanding understanding of the requirements.
Very Good (VG)
The quote demonstrates a sound approach which should result in a more than satisfactory attainment of requirements and objectives. This approach includes substantial advantages, and few relatively minor disadvantages, which collectively can be expected to result in better than satisfactory performance. The solutions proposed are clear and precise, supported, and demonstrate a clear understanding of the requirements.
Satisfactory (S)
The quote demonstrates an approach which should result in acceptable attainment of requirements and objectives. The approach has both advantages and disadvantages, however; the disadvantages do not outweigh the advantages and the approach can be expected to result in satisfactory performance. The solutions for the most part clear, precise, and supported, and demonstrate a general understanding of all the requirements.
Marginal (M)
The quote demonstrates an approach which should result in minimal attainment of requirements and objectives, and may pose a risk that the Offeror might fail to perform satisfactorily without significant Government oversight or participation. Any advantages that may exist in the approach are outweighed by existing disadvantages. The solutions proposed lack clarity and precision, or are unsupported.
Unacceptable (U)

Award will be made to the single, responsible offeror whose quote is most advantageous to the Government.
1.9 Discussions/Award without Discussions
The Government intends to make award without discussions. The Offeror’s initial quote should contain the Offeror’s best terms from a pricing and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. Failure to comply with instructions may result in an offer being determined as nonresponsive.
As stated above the Government reserves the right to make an award without discussions, except for clarifications as described herein. Any exceptions or deviations by the offeror to the terms and conditions stated in this RFQ for inclusion in the resulting award may make the offer unacceptable for award without discussions. If an offeror proposes exceptions to any of the terms and conditions as stated herein or of the requirements, the Government may make an award, without discussions, to another offeror that did not take exception to the terms and conditions.
Clarifications are limited exchanges with offerors that may occur when award without discussions is contemplated. If award will be made without conducting discussions, offerors may be given the opportunity to clarify certain aspects of their submission or to resolve minor or clerical errors.
