About this file

This document is the General Conditions for Construction form (HUD-5370) issued by the U.S. Department of Housing and Urban Development for use by Public Housing Agencies in construction contracts exceeding $100,000. The form establishes mandatory contractual terms and conditions for construction and development work performed under public housing programs, including those funded through Annual Contributions Contracts between the PHA and HUD. The conditions address comprehensive project requirements spanning preconstruction conferences, construction progress schedules, site investigations, material and workmanship standards, permits and codes compliance, health and safety protocols, utility services, protection of existing infrastructure, temporary facilities, environmental compliance, and energy efficiency standards. Contractors must complete all work within specified calendar days from the effective contract date or as established in the notice to proceed, with work commensurate with at least 12 percent of total contract value to be performed directly by the prime contractor organization.

The contract establishes detailed payment terms with progress payments made approximately every 30 days for work meeting established quality standards, subject to 10 percent retainage until completion and acceptance—which may be waived upon satisfactory performance determination at 50 percent completion. The document incorporates extensive federal requirements including Davis-Bacon prevailing wage standards applicable to contracts exceeding $2,000, Section 3 Housing and Urban Development Act compliance for directing employment to low-income persons, Equal Employment Opportunity requirements, and procurement preferences for small businesses, minority firms, and women's business enterprises. Additional mandatory inclusions encompass workers' compensation insurance, commercial general liability coverage, builder's risk insurance, environmental compliance under the Clean Air and Water Acts, and specialized provisions addressing differing site conditions, changes and modifications, suspension of work, disputes resolution, default procedures, and warranty obligations. The contractor bears full responsibility for all labor, materials, equipment, and transportation, while the PHA provides utility services at prevailing rates and maintains inspector presence for quality assurance without relieving the contractor of performance obligations.
