Delta Clearwater Remediation Project Phase 2 Construction Contract.

The purpose of this amendment is to provide the sign-in sheet from the site visit held 12/14/2017, provide responses to questions received, provide clarifications, provide the subgrade grading file, provide the topsoil grading file, and to incorporate the following clauses and provisions:

Add Clause 52.203-13 Contractor Code of Business Ethics and Conduct.

Add Clause 52.225-11 Buy American - Construction Materials under Trade Agreements.

DELTA CLEARWATER REMEDIATION PROJECT

Q1: “Will electronic submission of bids be allowed or sealed envelope to the Palmer address only?”

A1: Yes, electronic submissions of bids will be allowed. Please email submissions to ryan.lorimer@wdc.usda.gov.

Q2: “Due to the Holiday season and the necessity to work with multiple topsoil source locations.

We respectfully request a 14 day bid extension, to allow adequate time to source the Topsoil and provide the best pricing to USDA. Of note, the requirement to comply with SHPO and Division of Agriculture for each proposed Topsoiling material site, inherently will require adequate time pre-bid to receive site approvals. As multiple farms will be required and available quantities and trucking durations will vary, which will drastically affect the pricing.”

A2: No extension at this time.

Q3: “Please confirm the repairs to the swale are the six rip rap sections as depicted on Sheet 11 of 27.

A3: See drawings.

Q4: “Would it be acceptable to the USDA that Stage 3 of this project be extended to a second working season? Due to the above average snowfall in the area and the traditionally late thaw, project conditions may require a later than proposed start date.”

A4: Performance time is currently 150 calendar days.

Q5: “Regarding Spec Section 407-Shrub Planting: Would it be acceptable to supplement the required 16,800 Canadian Buffalo Berry shrubs with another Buffalo Berry; i.e.: 10,000 Canadian Buffalo Berry and 6,800 of another Buffalo Berry? Due to the short time period to procure the required quantity of shrubs, our suppliers are finding difficulty locating this quantity with adequate size.”

A5: Construction specification 407-Shrub Planting, section 5-a-(2) is hereby amended to read as follows: “In Section 2, Materials, the plant species shall be 60 percent Shepherdia canadensis (L.) “Soap Berry”, “Canadian Buffalo Berry”, 10 to 20 percent Alnus rubra “Red Alder”, and the remainder Dasiphora fruticosa, “Shrubby Cinquefoil”.

Each shrub shall be a minimum of eight (8) inches in height from the root collar to the top of the plant and shall have well branched root systems. Shrubs shall be free of any dead wood and shall be capable of standing upright without any support when planted.

Q6: “Regarding Topsoiling Bid Item 11-Section 7, Subsection A,3: Will the contractor be required to verify composition of the topsoil at increments of every 2,000 CY for topsoil used on the project as well as the material located off site?”

Q7: “Regarding Topsoiling Bid Item 11-Section 7, Subsection A,4: “In Section 3, Furnishing, Method 2 shall apply.” Please confirm that Method 1 is to be completed and Method 2 will apply only after Method 1 has been exhausted.”

Q8: “The project specification allows for 6hrs from pickup to placement of topsoil on location.

Is this duration above to be extended?

A8: No

Q9: “Topsoil may be hauled from local farms and stockpiled on site?”

A9: See construction specification 26, Topsoiling.

Q10: “Topsoil may be recovered from the edges of the roadway and allowed to be stockpiled, which would allow the coring road work to begin earlier in the project.”

A10: NRCS is unclear what is being asked in this question and therefore has no response at this time.

Q11: “Please confirm that we are not required to have separate people performing the duties of Safety Manager, Quality Control Manager, and Superintendent.”

A11: Please refer to the contract documents and specifications for specific requirements.

Q12: “Please provide a detailed layout of silt fence placement.”

A12: Please refer to drawings and specifications.

Q13: “Is the well still viable and may it be used to provide potable water through a filtered system, in lieu of commercially filled water jugs and water cooler?”

A13: NRCS makes no statement as to whether any well is or is not still viable. See construction specification 96, Field Office, for field office drinking water requirements.

Q14: “In reference to the seeding, fertilizer and mulch section in this project, the applications rates are in question. The seeding rate of 20-30 lbs PLS per acre is typical for drill seeding.

Hydroseeding at those rates would not produce a adequate spread of grass. 44-88 lbs per acre is adequate. The hydroseed application rate of 500 lbs per acre is too low. Manufacture recommends 2000 lbs per acre minimum.”

A14: The seeding rate and mulch rate stand as specified in construction specification 6, Seeding, Sprigging, and Mulching. We are aware these are lower than normal application rates. These rates have been specifically established to accomplish the goals of this project.

Q15: “We have reached out to our sign manufacturers regarding the requested signage. Would it be acceptable to the USDA to match the current DOT standard for aluminum sign blanks of 5052 H38 with a maximum thickness of 1/8”? The manufacturers are no longer using 6061-T6.”

A15: NRCS will allow either 6061-T6 stock as specified or 5052 H38 stock of 1/8 inch thickness for Bid Item 15, Signs.

Q16: “After visiting the Site we have some questions about the extent and expectation of the project dewatering. It was brought up that the basin could be full of water depending on precipitation. Assuming the basin holds 400,000 CYD’s, this would be around 80,000,000 gallons of turbid water. Obviously the SWPPP implications and site constraints would make discharging or diverting this a huge challenge that is left contingent to the contractor. The dewatering specifications would seem to eliminate any method practical to remain in the 8- 10,000,000 price range outlined. Could some more clarification of the expectations of dewatering be outlined?”

A16: The anticipated price range for this project is $5-$10 million. NRCS computations indicate that when completely full the basin will hold approximately 46,000,000 gallons of water. NRCS expects the contractor to develop a dewatering plan that employs reasonable measures for dewatering the site.

Q17: Is hydroseeding to occur before or after placement of Woody Debris?

A17: Hydroseeding is to occur prior to placement of Woody Debris.

Q18: Will contractor be held responsible for success of planted materials?

A18: The contractor must install all planted materials in conformance with the specifications and contract requirements. At final checkout when NRCS approves the completion of work on the project the contractor will be relieved of responsibility for success of the planted materials.

Q19: Are records available from past flow events at the project site?

A19: At the site showing NRCS indicated we would check our files and publish any available records from past flow events. Upon review of existing records we have found that we have very little documentation on past flow events and what limited information we do have would not be helpful in determining likelihood of flow events during construction. Contractors are encouraged to utilize other sources of information in regards to the likelihood of a flow event at the project site and the scale or duration of such an event.

Q20: “We were wondering if per diem would apply to this job.”

A20: Please refer to wage determination WD AK170001.

21) The Salcha-Delta Soil and Water Conservation District maintains a list of farmers that are willing to consider having berms removed from their farms. Bidders can contact the SWCD at either 907-687-9924 which is Bryce Wrigley cell phone or 907-895-6279 which is the main business phone number for the SWCD and will be answered by Violeta. Bidders will note that construction specification 26 requires that berms obtained for topsoil be free of noxious weeds.

Bidders are welcome to inquire with the SWCD as to staff availability to assist with weed identification and verifying specific berm rows are free of noxious weeds.

22) At the site showing it was discussed that NRCS intends to issue two separate notices-to-proceed (NTP) for this project. The initial NTP will be to allow the contractor to mobilize equipment and supplies to the project site and to set up the Field Office required in Bid Item 2.

The second NTP will be issued once the weather conditions are suitable for actual construction work to commence at the project site. It is when this second NTP is issued that the 150 calendar day performance time commences.

23) At the site showing NRCS indicated we would post a copy of the subgrade grading file and the topsoil grading file to be available to prospective bidders. It was asked if we would also post a file for original ground. We will not be posting the original ground survey data at this time.

Initial estimated quantities have been computed by NRCS and are available on the bid schedule.

NRCS will update the original ground survey immediately prior to commencement of construction at the site and this updated survey will be provided to the contractor at that time.

24) Attendees at the site showing were informed that a water well existed at some point in the past on the Anders lot (shown as Lot 8 just south of the Alaska Highway and immediately to the east of 1408 road). The local SWCD controls access and use of this lot and they have agreed that the contractor may utilize this well to obtain water specifically for this remediation project on the condition that the lot not be damaged by use and any minimal damage done by normal use be repaired at the completion of the work. Neither the SWCD nor NRCS makes any guarantee that the well still exists, is in usable condition, has a pump currently installed, has power available in the vicinity to operate a well pump, or any other detail regarding the well. It is incumbent upon the contractor to verify all specifics if they desire to pursue use of this possible water source including obtaining a temporary water use authorization or other approval from State of Alaska- DNR and any other legal requirements necessary.
