Pre-Bid Site Showing Solicitation – 12FPC322B0004 EWP – Shelby County, Texas
TO: Natasha Kennedy, Contract Specialist, NRCS, Forth Worth, TX
A site showing was held at the Shelby County Courthouse on Thursday, May 12th, at 930AM.
The site showing included a visit to 4 out of 30 of the proposed work sites (SITES 1-01, 2-02, 2- 04, 2-09). The meeting was attended by representatives of 5 prospective bidders.
The following information was reviewed with the contractors at the showing, which covered the Construction Specifications, Drawings, and the Site Visit. Please use this information along with the question and answer section as warranted for the preparation of any needed amendment to this solicitation.
SOLICITATION
Offers are due by 23 May 2022, at 2PM, Central Time. Offers may be modified or withdrawn, in writing, any time prior to bid opening.
Offers must be submitted via email to Natasha Kennedy, Contract Specialist at Natasha.Kennedy@usda.gov. Email submission requirements are listed under the “SUBMISSION OF BIDS BY EMAIL” section of the solicitation.
Offers must include a 20% bid bond with their email bid, and a performance and payment bond will be required to be submitted no later than 10 days after award.
The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government considering only price and the price-related factors. Due to COVID19 restrictions, the public bid opening will be held via teleconference on the date and time of closing.
Offerors must acknowledge receipt of any/all addenda.

DELIVERIES OR PERFORMANCE (SECTION F)
52.211-10: Commencement, Prosecution and Completion of Work: Work shall begin within 10 days of Notice to Proceed. Work must be completed no later than 357 calendar days after Notice to Proceed. This includes final cleanup of the premises.
ADDITONAL INFORMATION: The following conditions must be met for the contractor to run two crews simultaneously:
1. Work between the two crews shall be scheduled such that critical points of inspection are not happening simultaneously between sites. The government inspector shall be given enough time to commute between sites between critical points of inspection.
Critical points include driving pilings, tensioning cables, burying deadman anchors, inspection of rock or bag wall foundations, and any other tasks that could be covered
up. If something installed does not meet the contract specs or drawings, whether a critical point or not, it must be fixed promptly.
2. If both crews experience weather days on the same day, only 1 weather day will be added to the performance period.
3. Crews shall work simultaneously at sites that are closest in proximity to one another.
4. Both crews shall have a competent QC officer, safety officer, superintendent, first aid certified employee, signage, and any other requirements listed in the contract.
52.211-12: Liquidated Damages – Construction: Liquidated damages are $922.00 for each calendar day over the performance period.
52.211-13: Time Extensions: Time Extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction.
ADDITIONAL INFORMATION: Weather at the project site which causes a delay in the completion of the contract was not figured into the performance period. If half of a work day or more is lost due to weather delays on site, an additional day will be added to the performance period at the end of the contract. The full time inspector will keep track of the weather delays as the contract proceeds.
52.236-15: Schedules for Construction Contracts: The Contractor shall, within five days after the work commences on the contract or another period of time determined by the Contracting Officer, prepare and submit to the Contracting Officer for approval three copies of a practicable schedule showing the order in which the Contractor proposes to perform the work, and the dates on which the Contractor contemplates starting and completing the several salient features of the work (including acquiring materials, plant, and equipment). The schedule shall be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completion by any given date during the period. If the Contractor fails to submit a schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.
ADDITIONAL INFORMATION:
Maximum Workweek: The maximum workweek for this contract is 10 hours per day, 6 days per week, Monday through Saturday.
Work Performance on Holidays: The Contractor shall not perform work on the following holidays except in the case of emergency as permitted elsewhere in this contract

The Contractor may be permitted to work the following remaining designated Federal holidays provided that he/she submits a letter of request to the Contracting Officer at least five (5) days in advance of the holiday.

52.219-14 Limitations on Subcontracting (Deviation authorized in December 2018)) requires that the Contractor not pay more than 85% of amount paid by the Government for performance, excluding materials, to subcontractors that are not similarly situated. Any work that a similarly situated entity further subcontracts will count toward the 85% subcontract amount that cannot be exceeded.
52.222-6 Construction Wage Rate requirements is incorporated into the solicitation. The wage determination(s) specify the minimum wage rate and fringe benefits that contractors and subcontractors must be paid under a resultant contract. The wage determinations are listed in attachment 3 of the solicitation and are physically attached to the solicitation.
Please read the wage determination that was attached with the solicitation.
Certified payrolls must be submitted weekly through the Inspector or COR. Labor interviews will be conducted with all employees.
52.222-11 Subcontracts (Labor Standards). Requires contractor to flow down certain labor clauses in their subcontracts and ensure that subcontractor employees are also paid not less than the minimum wage rate and fringe benefits stated in the wage determination.
NRCS SUPPLEMENT TO OSHA (SECTION H, Page 16 of 42)
1.1: Written safety program, site specific (i.e., snakes, heat exhaustion, etc.).
1.5: Weekly job-site safety meetings are required.
1.7: First aid training, at least one employee on-site at all times with current certificate.
2.3: Communication and transportation, at least one serviceable stretcher and two blankets on-site at all times.
4.1 : Hard hat areas, include entire job site. Required while operating any heavy equipment, regardless of ROPS.
4.2 : Posting, Signs at least 3x4 feet worded as follows with 6” tall red letters with white background at all job access points:

REQUIRED CONTRACTOR SUBMITTALS
Submittals shall be sent to the Contracting Officer though the Contracting Officer’s Representative prior to construction. Submittals are required after contract award (not with your bid). The following list may not be all-inclusive, it is the contractor’s responsibility to refer to the contract clauses and construction/material specifications for submittal requirements.

• Submittals for all construction materials showing that the material meets the construction and material specifications for that item.
CONSTRUCTION SPECIFICATIONS
There are two types of specifications in this contract: (1) Construction Specifications and (2) Material Specifications. Each of the construction specifications for this project are composed of two parts. The first part is called the “closed” specification and is the NRCS national standard construction specification that begins with the “Scope” and ends with “Measurement and
Payment” or “Payment”. The second part is called the “open” specification and consists of the “Items of work and construction details” that are written specifically for this job, and that serve to modify/clarify the preceding closed specification as needed.
All the construction specifications are listed in the solicitation package. Not all the construction specifications have a corresponding Bid Item. Some of the bid items have subsidiary items of work, which means that those items are required to be accomplished but the payment for those items is included under another construction specification. For example, Construction Specification 5, Pollution Control, is a subsidiary item to the bid items for Rock Riprap, Timber Headwall, and Cement Bag Wall. This means that the submitted bid cost Timber Headwalls, Rock Riprap, and Cement Bag Walls should include costs associated with Spec 5, Pollution Control.
The contractor shall comply with all of the specifications (construction and material). In the interest of time, not all of the specifications were reviewed in detail at this meeting or in the following notes. The following are several main points presented from the specifications.
Construction Specification 1 – Clearing
• Subsidiary to Bid Item for Site Preparation
• Section 8. A written disposal plan is required and shall be submitted to the COR and approved by the CO prior to the start of work.
• Section 8. Burning is authorized if all state county, and local burning laws, ordinances and requirements are met. Other requirements for burning are in the specifications.
• Section 8.a(3): Trees currently standing and uninjured will remain unless interfering with work.
Construction Specification 5 – Pollution Control:
• Subsidiary to Bid Items for Rock Riprap, Timber Headwall, and Sand-Cement Bag Wall.
• Section 8.a.(3): The Contractor’s written plan for pollution control shall be approved prior to the start of construction operations. Written plan shall at a minimum include proposed sequencing of operation to minimize duration and size of disturbed areas.
Construction Specification 7 – Construction Surveys:
• Subsidiary to Bid Items for Site Preparation, Rock Riprap, Timber Headwall, and Sand- Cement Bag Wall.
• Section 5. Construction Surveys: Provide name and qualifications of proposed surveyor(s) in writing before any work requiring surveys.
• Section 5, method 2 shall apply. Contractor to provide surveying as needed to set line and grade for all work, slope staking, final grade staking, and quantity estimates.
• Section 9.a(3): Surveys will proceed from Government-established benchmarks or reference points.
• Section 3, measurements for establishing the location of structures shall be to the nearest 0.1 foot, or as determined in the field by the engineer.
Construction Specification 8 – Mobilization and Demobilization:
• Bid Item 1, payment for documented direct costs, only up to 85 percent, remaining 15 percent held until final payment.
• 4.a.(1)(a): Project staging and storage limited to the existing county street right-of ways and the site locations.
• 4.a.(1)(b): All road surfaces outside of the work limits damaged by the Contractor shall be repaired at the Contractor’s time and expense. .
• 4.a.(1)(d): The Contractor shall provide a minimum of 3-day notice to the appropriate commissioner prior to closing a road. Notification shall be documented in the Inspector’s Job Diary and Contractor Quality Control Report. Sites not authorized for closure are listed on the drawings.
• 4.a.(2)(b): All disturbed areas shall be bladed or smoothed to blend the area with the surrounding land surface.
• 4.a.(2)(d): Original fences shall be restored to equal or better than pre-construction conditions.
Construction Specification 9 – Traffic Control
• Subsidiary to Bid Item 1 – Mobilization and Demobilization
• Section 7.a(1): Where roads are to remain open, the Contractor must provide a traffic control system and route traffic through the construction area without excessive delay.
• Section 7.a(2): The contractor shall furnish, install, and maintain all barricades, warning signs, and traffic control devices necessary to control traffic and public safety.
• Section 7.a(3): The Contractor's written plan for traffic control shall be approved prior to the start of construction operations. Written plan shall at a minimum include the area(s) or extents proposed for use at each site, duration of road closures, temporary barricades and signage, and coordination with local officials.
• Section 7.a(4): Construction of multiple sites in close vicinity shall not prohibit landowner access between sties.
Construction Specification 11 – Removal of Water:
• Subsidiary to Bid Items for Site Preparation.
• Section 8.a(2): The Contractor's plan for dewatering the sites shall be approved prior to the start of construction operations on any site requiring dewatering. The plan shall at a minimum include the duration and size of necessary diversions, and contingency plans (i.e., pumping) to continue work and protect the incomplete structure.
Construction Specification 13 – Piling:
• Subsidiary to the bid items for Timber Headwalls.
• Section 14.a(1)(b)(V): Used steel pipe or tubing shall have an outside diameter of 10.75-inch, minimum wall thickness of 0.365-inch, and weigh a minimum or 40 pounds per foot. Used steel pipe shall also be free of excessive rust pits and other flaws that would reduce the strength or durability of the piles as determined by the engineer. Used steel pipe shall be approved by the engineer prior to incorporating into the work.
• Section 14.a(1)(c): Holes required for the installation of bolts, screws, or other items necessary to construct the headwall shall be drilled or cut. All cuts shall be minimum required for installation.
• Section 14.a(1)(e): No geologic site investigations have been done. In the event of encountering rock or rock like material, a hole shall be drilled to the specified depth; after the piling is placed, the hole shall then be backfilled with an approved sand –cement mix as approved by the engineer. A commercially available sackcrete mix may be approved.
Construction Specification 61 – Rock Riprap:
• Bid Item 2, by ton for Sites 1-01, 1-02, 1-03, 1-04, 1-05, 1-06, 1-07, 1-08, 1-09, 1-10, 1-11, 1-12, 2-02, 2-03, 2-04, 2-05, 2-06, 2-07, 2-08, 2-09, 2-10, 2-11, 2-12, 2-13, 2-14, 2-15, 3-
02, 3-03, 3-04, 3-05, 3-06, 4-01, 4-02, 4-03, 4-04, 4-05, 4-06, 4-07, 4-12.
• Section 8.a(2): Rock for use as riprap shall comply with the requirement of Material Specification 523, Rock Type 2.
• Section 8.a(3): The Contractor provide written notice of proposed source of rock material to the contracting officer at least five (5) working days before delivery.
• Section 8.a(4): Rock size requirements are shown on the construction drawings.
Prior to delivery of rock to the construction site, the Contractor shall provide a certified gradation analysis from the rock quarry and other evidence satisfactory to the Engineer showing that the rock to be supplied complies with the specified gradation(s).
• The contractor shall also show that the rock to be supplied meets Material Specification
523, Rock Type 2, by submitting documentation showing bulk specific gravity, absorption, and soundness testing results.
• Quantities for rock riprap are noted on the site drawings. ANY overages of tons of rock delivered to a site must be approved by the NRCS engineer prior to delivery of such overage. The NRCS inspector will note approval of quantities in the daily diary maintained for the work. NRCS will pay on tons of rock approved by NRCS for delivery and installation.
Construction Specification 83 – Timber Fabrication and Installation
• Bid Items for Timber Headwalls (3-21)
• Section 7.a(2): Timber material used for the walls shall be surface dried, treated, southern pine, SPIB Grade No. 2 or stronger, and a nominal thickness of 3”. They shall be CCA pressure treated meeting the requirements of AWPA t1 at the retention rate of
0.6 PCF.
• Section 7.a(7): Walers: Used channel iron shall be approved by the engineer prior to installation.
• Section 7.a(9): Cables shall be new, ¾” diameter steel cables with a minimum breaking strength of 52,000 lbs. force and a minimum modulus of elasticity of 20,000,000 psi.
• Section 7.a(11): Cables shall be installed with tension as approved by the engineer.
Construction Specification 94 – Contractor Quality Control:
• Subsidiary to bid items for Rock Riprap, Timber headwall, and Sand-Cement Bag Wall.
• Section 10.a(1): The use of such words as “as approved by the Engineer or Contracting
Officer” and words of like imports in the specifications or construction drawings which refer to approval by the Contracting Officer are considered to be a part of the
Government’s Quality Assurance Program and do not relieve the Contractor in any part of the Contractor’s Quality Control Responsibilities as specified.
• Section 10.a(4): The Contractor’s quality control system shall be provided in writing to the Contracting Officer, approved and operational before commencement of work.
• Section 10.a(5): Method 1 shall apply with the exception that the identification of the quality control personnel and their duties and authorities shall be submitted to the contracting officer in writing within 10 calendar days after notice of award.
Construction Specification 95 – Geotextile:
• Subsidiary to bid items for Rock Riprap, Timber Headwall, and Sand-Cement Bag Wall
• Section 2: Geotextile shall conform to the requirements of Material Specification 592 and this specification.
• Section 7.a(2): Geotextile shall be Class I non-woven fabric.
Construction Specification 420 – Site Preparation:
• Section 6: Road surfacing material (gravel, asphalt, and oil sand) shall be stockpiled separate from other excavated materials. Stockpiled road surfacing material shall be placed after all other earthfill and earth backfill has been placed, including any additional fill materials if provided by the county. The stockpiled road surface materials shall be placed as a final surface.
Construction Specification 432 – Sand-Cement Bag Riprap
• Section 2, Materials and Section 7.c: Bags shall be a thickness of approx. 4 inches and consist of Type I or Type II Portland Cement. Bags are normally 80 lb bags.
• Section 7.d: Bags shall be sprayed with water every 20 inches in height with clean water.
• Section 7.g: Concrete bags are limited to commercially available premixed cement bags specified by the manufacturer for erosion control. Bags shall consist of biodegradable “scrim” material.
• Section 7.h and drawing notes: Dowels used to anchor the foundation course shall be
#4 (1/2”) rebar and shall extend 12” into undisturbed earth or 8” into hard rock (with grout). Remaining dowels shall be #3 rebar, 10” in length. Two dowels shall be placed per bag and extend through the bags below. The joints between the rows of bags shall be staggered. The top outermost bag shall have four #3 rebar dowel extending through the bag below.
DRAWINGS
• Drawings include a cover sheet, and 55 sheets individually numbered. These sheets include site vicinity maps, plan and section views for each site, a general headwall detail page at the end, and associated construction notes. The last page of the drawing includes important details for the construction of the timber headwalls.
• Many sites have culverts to be replaced. Culverts to be replaced are shaded darker on the drawings. The county will provide culverts and may deliver them to each site during construction
CHANGES OR CORRECTIONS
None.
QUESTIONS AND ANSWERS
1. Q: Are the superintendent, QC, Surveyor, and Safety personnel allowed to be the same person?
A: Yes. They are allowed to be the same person as long as they have the necessary qualifications/certificates.
2. Q: Do the pilings have to be completely filled with concrete?
A: No. The concrete caps only need to be a minimum of 4” deep from the top of the piling.
The last page of the drawing set has all of the details about timber head walls
3. Q: What does the NRCS estimate the job to cost?
A: The NRCS estimate is not available to the contractor, but it falls within $1,000,000 and $5,000,000
4. Q: Where can we take any woody debris or old, removed culverts from the site?
A: Construction Specification 1 – Clearing, Section 6 Disposal: “All materials cleared from the designated areas shall be disposed of at locations shown on the drawings or in a manner specified in section 8. The contractor is responsible for complying with all local rules and regulations and the payment of any and all fees that may result from the disposal at locations away from the construction location”. The commissioners may have areas designated for debris, but they are not obligated to provide the contractor access to these areas.
5. Q: Do the commissioners want the culverts back?
A: Only if they’re in good enough shape to reuse.
6. Q: Can the road be closed on site 1-01?
A: Sites to remain open are labeled as such in the site specific notes on each plan map. Site SH1-01, the landowner that lives down the road from the culvert crossing has another way out, but the commissioner asked that the contractor gives the county enough notice to let the landowner know that the contractor will be closing the road. The commissioner said that 2 or 3 days is enough notice.
7. Q: Where can the contractor store equipment and/or materials?
A: Construction Specification 8 – Mobilization and Demobilization, Section 4.a(1)(a) – “The Contractor may utilize the existing city/county street right-of-way at the site locations for project staging and storage. The Contractor shall not block driveways or other access points to the roadway and shall not utilize right-of-way areas beyond those closed for the work.”
Additionally, the commissioners have agreed to allow storage of material at their county barns. Coordinate with the inspector, COR, and the commissioners beforehand.
8. Q: Is the contractor allowed to create a bypass channel to de-water?
A: Construction Specification 11 – Removal of Water, Section 3 Dewatering the Construction Site – “Foundations, cutoff trenches, and all other parts of the construction site shall be dewatered and kept free of standing water and muddy conditions as necessary for the proper execution of the work. The contractor shall furnish, install, operate, and maintain all drains, sumps, pumps, casings, well points, and all other equipment required to properly dewater the site as specified. Dewatering systems that cause a loss of soil fines from the foundation areas will not be permitted.
The contractor shall furnish the contracting officer, in writing, a proposed plan for dewatering before commencing with any construction activity for which dewatering may be required, unless waived in section 8 of this specification. Acceptance of this plan or the waiving of the plan requirement will not relieve the contractor of the responsibilities for completing the specified work.”
Construction Specification 11 – Removal of Water, Section 5 Erosion and Pollution Control – “Removal of water from the construction site, including the borrow areas, shall be accomplished so that erosion and the transporting of sediment and other pollutants are minimized. Dewatering activities shall be accomplished in a manner that the water table water quality is not altered. Pollution control activities shall not conflict with the requirements of Construction Specification 5, Pollution Control, if it is a part of this contract.”
9. Q: Where are the benchmarks?
A: The benchmarks are typically in the base of trees near the site. The locations are marked on the drawings, and are described on each drawing page.
10. Q: What is expected of the contractor in terms of dust control?
A:Dust control has not typically been necessary on EWP sites in the past. If dust control measures need to be taken, reference Construction Specification 5 – Pollution Control, Section 5, Air Pollution
11. Q: Are there any example sites we can visit from previous EWP contracts in order to understand what is expected for the construction of timber headwalls and sand cement bag walls?
A: Yes.

12. Q: While working on a different site, is the contractor allowed to send an operator to a rock site with a trackhoe to begin excavating and placing rock?
A: Yes. As long as the equipment operator has the correct appointments as a superintendent, safety officer, quality control, and surveyor, and has a first aid certification through a state approved organization. Also they would need to give the inspector notice that the rock foundation is prepared for inspection prior to placing rock.
13. Q: What is required for traffic control? Do the workers need to be certified?
A: Construction Specification 9 – Traffic Control, Section 4 – Street Closures, Detours, and Barricades – “The contractor shall comply with the requirements of all applicable responsible units of government for closure of any street, road, or highway. The contractor shall provide the required barriers, guards, lights, signs, temporary bridges, and flaggers together with informing the public of any detours and construction hazards by the most suitable means available, such as local newspapers or radio stations. The contractor is also responsible for compliance with additional public safety requirements that may arise during construction. The contractor shall furnish, install, and, upon completion of the work, promptly remove all signs, warning devices, and other materials used in the performance of this work.
Unless otherwise specified, the contractor shall notify, in writing, the fire chief, police chief, county sheriff, state patrol, schools that operate school buses, or any other government official as may be appropriate no less than 7 days before closing, partly closing, or reopening any street, road, or highway.
Unless otherwise specified, the contractor shall furnish to the engineer a written plan showing the proposed method of signing, barricading for traffic control, and safety for street detours and closures.
All temporary detours will be maintained to ensure use of public rights-of-way is provided in a safe manner. This may include dust control, grading, and graveling as required in section 7 of this specification.”
Construction Specification 9 – Traffic Control, Section(s) 7.a.2&3 – “(2) As a part of this item the Contractor shall furnish, install and maintain all barricades, warning signs, traffic control devices, etc. necessary to control traffic and provide for public safety. The Contractor's traffic control system shall comply with the requirements of the Texas Manual on Uniform Traffic Control Devices for Streets and Highways, as well as the requirements of Shelby County, Texas.
(3) The Contractor's written plan for traffic control shall be approved prior to the start of construction operations. Written plan shall at a minimum include the area(s) or extents proposed for use at each site, duration of road closures, temporary barricades and signage, and coordination with local officials.”
Additionally, the traffic control personnel do not need to be certified.
