SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 DESCRIPTION OF WORK

Furnish all labor, equipment and material to accomplish the work under this contract to provide new roofs on five (5) separate buildings located at the Fulton Work Center; new roofs on two (2) buildings located at the Johnsondale Work Center; replacement of two shower enclosures in the men’s bathroom at the Johnsondale Work Center; and repair of interior and exterior water damage to one (1) building located at the Havilah Work Center. Work includes but is not limited to the following:

o Removal of the old roofing material o Replacement of damaged or deteriorated roof deck o Installation of complete new ribbed metal roofing system o Removal and replacement of shower enclosures and associated components o Water damage repair includes replacement of exterior siding, interior sheet rock, and repair of subflooring with new floor covering

The Contractor should refer to the SCHEDULE OF ITEMS and project plans and specifications when making estimates of quantities of work.

C.2 PROJECT LOCATION

The project sites are located on the Sequoia National Forest at the locations listed below on two districts at three work centers.

Five buildings are located at the Fulton Work Center, 9167 Highway 155, in Glenville on the Kern River Ranger District of the Sequoia National Forest. Kern County, CA; Township 25 S., Range 31 E., Section 29.

o From Bakersfield travel north and east approximately 42 miles on Chester Ave to Granite Road to Highway 155 through Glenville. Fulton work center is approximately 2 miles east of Glenville.

Two buildings are located at Johnsondale Work Center, 01 FS Road 22S10A in Johnsondale, on the Western Divide Ranger District of the Sequoia National Forest. Tulare County, CA; Township 22 S., Range 31 E., Section 35.

o From Bakersfield approximately travel 41 miles east on Highway 178 through the Kern Canyon road to Hwy 155 in Lake Isabella. Exit right and follow Hwy 155 to Wofford Heights, then stay straight on Kernville Road to Kernville, then 24 miles on Mountain 99 Highway to Johnsondale.

One building is located at the Havilah Work Center, 7333 Caliente-Bodfish Road in Caliente, on the Kern River Ranger District of the Sequoia National Forest, Kern County, CA approximately 11 miles south of Lake Isabella on County Road 483.

Kern County, CA; Township 28 South, Range 32 East, Section 10 and 11.

o From Bakersfield approximately travel 55 miles east on Highway 178 through the Kern canyon. Exit right on Elizabeth Norris Rd then right on Lake Isabella Blvd. which becomes Bodfish Caliente Rd. The work center is located approx. 11 miles south of Lake Isabella on the Bodfish Caliente Road which continues to State Highway 58 to the South.

C.3 CONTRACT TIME

Estimated start work date is July 15, 2019. The contract time will be 90 days. Contract time includes delays for weather; locating and transporting supplies and materials; and final sites cleanups.

Contractor must begin work within 10 days of the effective date of the Notice to Proceed. See Section F for additional information.

C.4 PROJECT SITE CLEAN UP

Any excess material generated from this project shall be disposed of as described in the contract or off of National Forest Lands and according to all state and local laws that apply. No materials of any kind are to be placed in any government or private trash bins or dumpsters

C.5 PRICE RANGE

The price range for this project is between $100,000 and $250,000.

C.6 SPECIAL CONDITIONS AFFECTING THE WORK

a. Physical Conditions. The indications of physical conditions on the drawings and in the specifications are the result of site investigations and surveys performed by the Government.

b. Weather. Low temperatures at the project sites range from temperatures of less than 20 ºF in

December and January to lows of 65 ºF in July and August. High temperatures range from 45 ºF in December and January to over 90 ºF in July and August Icy conditions on local roads and highways can occur during the fall, winter and spring. Highway curves in shaded areas will remain covered with ice or frost for weeks.

c. Work Hours. Work hours are from 7:00 am to 5:00 pm Monday through Friday. Weekend equipment work is not allowed at any time during the Work. Dogs and pets are not allowed on the project sites at any time.

d. Safety, Emergency Communications and Evacuation. Contractor is responsible for the safety of the Contractor’s employees including Subcontractors employees, Government employees associated with the project, and any visitors to the site both Government and private. The Contractor shall submit a project safety plan to the Contracting Officer for review prior to commencement of Work. The project safety plan shall comply with the appropriate California OSHA and Federal OSHA rules and regulations and must include a medical evacuation and emergency communications plan.

e. Highway Permits. Contractor is responsible for securing any overload or over width limit permits required for the transport of building materials to the project sites. The Contractor is responsible for conducting a thorough reconnaissance of all routes leading to the sites. The Government will not be responsible for any building materials that cannot be transported to the sites.

f. Temporary Site Utilities. Contractor may install temporary site utilities to support work on the project. The installation of temporary utilities is the responsibility of the Contractor and shall be paid for by the Contractor. The Contractor shall provide the Contracting Officer with written certification that all temporary site utilities have been properly disconnected and final utility bills are paid in full. The Contractor may make a temporary hookup to the existing Forest Service water line to provide water for construction and/or temporary housing.

g. Toilets. Contractor may use toilets at the work centers as specified in Section 01010. No shower facilities are available. Contractor shall provide toilet facilities for its employees if the toilet buildings are not utilized.

h. Security. Contractor is responsible for the Contractor’s equipment and building materials supplied to the sites. All equipment not equipped with a key lock system shall be secured in such a manner as to make it inoperable to the average person at the end of each working day.

All hand tools, ladders and other equipment shall be secured at the end of each working day.

On Fridays all construction debris, trash, and refuse shall be properly stored in dumpsters or trash bins or removed from the sites.

i. Protection of Resources. Contractor shall thoroughly clean all equipment prior to delivery to the project sites to remove weeds, mud, grease and oil buildup from the tires, wheels, tracks, engines and engine compartments, and other surfaces. Spills of petroleum products and other hazardous substances shall be reported, contained, and removed in accordance with all applicable rules, regulations and laws. Contractor shall submit a project spill response plan at the pre-work meeting for review by the Contracting Officer.

j. Fire Restrictions. The Havilah, Kernville, and Pinehurst Work Centers and Buck Rock Lookout are operational centers for fire support during fire operations. The contractor may be required to stop work with no additional cost to the government if the Work Center(s) is/are required to operate during a large fire operation. The Contractor shall then resume work after fire operations have stopped.

k. The roofing projects are located at existing fully operational Work Centers used by many Forest Service employees. The Contractor shall keep his equipment and work areas confined to the areas shown on the attached location map and drawings. At no time shall the Contractor prevent fire personnel or other employees from accessing the work site to gather materials or supplies, or to perform their assigned work. Contractor’s vehicles shall be kept out of the way of the parking lot traffic flow to allow Forest Service employees access to all utilities. The Contractor may not enter or have access to any of the other buildings located at the Work Centers not related to this project. No children or pets of any kind will be allowed to hang around the Fulton, Johnsondale, or Havilah work centers.

C.7 PRE-BID CONFERENCE OR TOURS

Site Visit is schedule for June 18 2019, 9:00 a.m. at the Contractors are advised to visit the site on their own and make the necessary site investigations prior to submitting proposals.

NOTE: Any prospective bidder desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing soon enough to allow a reply to reach all prospective bidders before submission of their bids. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. (See Section L, 52.236-27, SITE VISIT.)

NONE

Worker's Compensation Insurance The Contractor shall provide evidence of Worker's Compensation Insurance or a written explanation as to why the Contractor is exempt from the requirement. NOTE: The Contractor working alone is not required to carry the insurance.

Camping and Housing (see also Section H, Camping Permit Compliance) Camping is not permitted in US Forest Service campgrounds. Contractor [ ] will [x] will not be permitted to camp elsewhere on US Forest Service land. Camping on Forest Service land is not a right;

permission may be revoked for failure to comply with the terms of the permit.

52.242-14 Suspension of Work (APR 1984)

The Contractor shall be required to (a) commence work under this contract within _10___ calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than _21__after the effective date of the notice to proceed. The time stated for completion shall include final cleanup of the premises.

Work Timing Delays due to normal adverse weather, weekends, and holidays have been included in the calculation of contract time.

Winter Shutdown When winter weather sets in and the continuation of work is impractical, the Contracting Officer may authorize a total suspension until such time as work can proceed. During the period of total suspension, the calendar days elapsed will not be charged against the contract time specified.

SECTION G—CONTRACT ADMINISTRATION DATA

GOVERNMENT-FURNISHED PROPERTY

Invoices

Payment will be made from the contractor’s invoice. All invoices are to be submitted via the electronic Invoice Processing Platform (IPP). This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm. There is no pre-award registration.

After award of a contract, please make sure that your company registers promptly at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish your account. The one-time enrollment in IPP means a series of emails will be sent to the point of contact (POC) established in your System for Award Management (SAM) account at www.sam.gov. So, please verify that the POC’s email address is up to date in your company’s SAM account prior to starting the IPP enrollment process. If you have questions on the IPP enrollment process, the help desk phone number is 1-866-973-3131.

Invoices shall be accompanied by the signed contractor certification, using the exact wording in the clauses, FAR 52.232-5, and be up-to-date on certified payrolls for the invoiced timeframe, FAR 52.222-

8. (See next page for invoice certification language.) Invoices that do not meet these requirements will be rejected.

The contractor shall submit payrolls weekly for each week in which any contract work is performed.

The copies shall be sent to the COR. Payrolls submitted shall set out accurately and completely all of the information listed on the form WH-347 (available for download at www.dol.gov., including the certification verbatim from the WH-347. Forms from other State or County governments are not compliant. Invoices that do not meet these requirements will be rejected. A Contract Release is required with the final invoice, or the invoice may be rejected.

PAYMENT FOR MATERIALS OFF-SITE

In accordance with Clause 52.232-5, progress payments may include payment for materials stored off site. Contractor shall provide a copy of the paid invoice; provide evidence that the material will be included in the finished project; and identify the location where the materials are stored, so that the government may make visual inspection if the Contracting Officer deems it necessary. The Contractor shall be liable for loss, damage, or destruction of the materials until such time as the materials are physically in the possession and control of the government. The Contractor will not be held liable to the extent that the Contracting Officer determines that the loss, damage, or destruction occurred through the fault or negligence of the government or its agents.

INCIDENTAL ITEMS

The intent of the contract is to provide for the completion of the project described in the contract.

Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with https://www.ipp.gov/index.htm https://www.ipp.gov/vendors/enrollment-vendors.htm http://www.sam.gov/ http://www.dol.gov/ drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. This required conference will be scheduled by the COR. (See also Section I, Clause 52.236-26.)

PAYMENT CERTIFICATION

I hereby certify, to the best of my knowledge and belief, that—

(1) The amounts requested are only for performance in accordance with the specifications, terms, and conditions of the contract;

(2) All payments due to subcontractors and suppliers from previous payments received under the contract have been made, and timely payments will be made from the proceeds of the payment covered by this certification, in accordance with subcontract agreements and the requirements of Chapter 39 of Title 31, United States Code;

(3) This request for progress payments does not include any amounts which the prime contractor intends to withhold or retain from a subcontractor or supplier in accordance with the terms and conditions of the subcontract; and

Contractor may use at no cost the electrical at the District Office.

Superintendence by Contractor In addition to Clause 52.236-6, the following applies: The name and the specific authorities of the foreman or superintendent must be designated in writing to the Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run.

The Contractor shall have a person on-site that is fully conversant in the English language.

Loss, Damage or Destruction Equipment Furnished with Operator. The Government shall not be liable for loss, damage, or destruction of equipment furnished under this contract except for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.

Other. Even though this contract may provide for performing services at the direction of Government personnel, the contract is not for personal services, and neither the Contractor nor his or her personnel are Government employees. The Government assumes no liability for injury occurring to Contractor personnel or to third parties, or for loss, damage, or destruction involving third parties' property as a result of the Contractor's operation. Except that the Government is liable for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) acting within the scope of their employment.

Camping Permit Compliance Contractor shall comply with all terms and conditions of any camping permit issued to allow use of premises. Any non-compliance will result in suspension of work until compliance is achieved.

Archaeological and Historic Sites Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC 433)--will be identified for the contractor before work commences.

Spill Plan If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare and implement a Spill Prevention and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer. The Contractor under the direction of the Contracting Officer, or in the absence of said officer, acting independently, shall immediately take action to contain and clean up, without expense to the Government, all petroleum products spills on or in the vicinity of the project which are caused by the Contractor's employees directly or indirectly as a result of contract operations. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and clean up of petroleum products spills caused by Contractor's employees or resulting from contract operations. The Contractor shall immediately report all petroleum products spills to the Contracting Officer.

Equipment Cleaning All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.

Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer at least five days in advance of moving equipment in so that arrangements can be made for inspection.

If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.

SECTION M--EVALUATION FACTORS FOR AWARD

AWARD DETERMINATION

Award will be made using the Simplified Acquisition Procedures in accordance with FAR Part 13. Award will be made to the offeror whose acceptable offer provides the best value to the government, considering price and the non-price factors. Non-price evaluation factors include past performance, capability of offeror.

EVALUATION FACTORS

Acceptability of the Offer The Government will determine the acceptability of each offer on a pass or fail basis. An offer is acceptable when it manifests the offeror's assent, without exception, to the terms and conditions of the RFQ, including attachments. If an offeror takes an exception to any of the terms and conditions of the RFQ, then the Government will consider its offer to be unacceptable.

Capability of the Offeror The Government will assess the capability of each offeror on the basis of the following criteria: (1) Understanding of the Government's requirements, (2) Organizational Experience, and (3) Organizational Past Performance. The Government will not assess capability on a pass/fail basis, but will use its assessments of capability as a basis for comparing offerors to determine best value.

(1) Understanding of the Government's Requirements. The Government will evaluate each offeror's relative understanding of the Government's requirements on the basis of its written submittals addressing the following subfactors:

a) Any information that indicates the extent to which the site for this project was visited.

b) The results concluded from the site visit.

c) The resources (personnel and equipment) which are planned for use on the project, and how realistic that plan is given concurrent obligations. Discuss any subcontractors and their background and capability.

d) Site-specific safety plan.

e) Plan of work to include the major tasks and timelines.

f) Where applicable, estimated production rates.

(2) Organizational Experience. Experience is the opportunity to learn by doing. The Government will evaluate each offeror's organizational experience on the basis of its breadth, its depth, and its relevance to the work that will be required under the prospective contract. The Government will not evaluate an offeror's organizational experience on the basis of the personal experience of the offeror's key personnel. However, the Government will consider the extent to which the offeror's key personnel have worked together in the past.

(3) Organizational Past Performance. Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with Federal, state, and local laws and regulations. The

Government will contact some of each offeror's customers to ask whether or not: (1) the offeror was capable, efficient, and effective; (2) the offeror's performance conformed to the terms and conditions of its contract (specifications); (3) work was finished within the contract time; (4) the offeror was reasonable and cooperative during performance; and (5) the offeror was committed to customer satisfaction. In evaluating past performance, the Government will contact some of the references provided by the offeror and other sources of information, including, but not limited to: Federal, state, and local government agencies, better business bureaus, published media, and electronic data bases.
