SECTION C

DESCRIPTION/STATEMENT OF WORK/SPECIFICATIONS

Scope of Contract General Description Men and women’s bathroom/shower conversion from communal shower to individual privacy stalls.

There are 6 shower heads in the men’s and 3 in the women’s. The concrete floor in the shower area will need to be replaced and floated with new concrete to assure drainage for the replacement shower units.

Installation of new tile on the floors and walls. New linoleum on the floors where water damage has occurred. Two urinals in the men’s restroom will need to be separated with a privy wall/partition.

Replacement of 7 toilets with low flow flush toilets. Light exhaust fans in each of the men’s and women’s bathroom that will be rewired to accommodate separate fixtures for the new LED lighting and the exhaust fan.

Contractor Responsibilities The contractor will be responsible for work in compliance with contract terms, specifications, and provisions. This includes furnishing all labor, materials, equipment, supervision, disposal of materials off site, and incidentals to complete work.

Project Location The project is located on the Bass Lake Ranger District of the Sierra National Forest. From Fresno, CA.

proceed north on State Highway 41 approximately 45 miles thru the community of Oakhurst, CA continue on highway 41 approximately 3 miles to the Forest Service Station - Batterson Work Center on the left.

Price Range The Government's estimate is:

Contractor must begin work within 10 days of the effective date of the Notice to Proceed. See Section F for additional information.

Pre-Bid Conference or Tours

Pre-bid tour is not scheduled. Bidders may request to schedule a site visit by contacting Sandra Tarvin by Telephone (559) 297-0706, ext. 4845 at the Supervisor's Office, Sierra National Forest, 1600 Tollhouse Road, Clovis, CA 93611, between the hours of 7 am and 4 pm, Monday through Friday, except legal holidays or by email starvin@fs.fed.us.

Restrictions on Work Work shall be performed Monday through Friday from 0730 to 1700.

Worker's Compensation Insurance The Contractor shall provide evidence of Worker's Compensation Insurance or a written explanation as to why the Contractor is exempt from the requirement. NOTE: The Contractor working alone is not required to carry the insurance.

Camping and Housing Contractor may use a self-contained travel trailer or recreational vehicle to camp on National Forest System lands near the project sites subject to the approval of the Contracting Officer. All waste material must be transported off-site to a station equipped to handle such waste. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit.

TECHNICAL SPECIFICATIONS

The men’s bathroom and shower area

There are two urinals that need to be removed, and two new urinals will be installed according to the IPC. Valves for urinals will be replaced. A divider will be mounted to separate the two urinals. Paneling on wall that the urinals are attached to will be replaced in kind. Sheetrock to be repaired and painted. There are 5 existing toilets that are to be replaced with low flow units.

All waste will be removed.

The shower area is approximately 12’ by 10’. This is a communal shower. There is tile on the floor and on the walls. The tile on the walls is 6 ½’ high. There are six shower units. Three on the east wall and three on the west wall. The shower heads are approximately 3’ apart. There are two floor drains. There are two light/exhaust fan fixtures. All tile is to be removed. The concrete floor of the shower area is to be removed and a new floor to be poured to accommodate six individual shower units. All concrete work will follow the IBC. The shower pans will be constructed to direct water to the new drains. The two drain lines are to be removed and six new drain lines added and tied into existing sewer system. Walls are to be constructed to separate shower units with 2x4 construction and cement board on both sides. Three walls attached to the east and three attached to the west. The walls are to stem out 3’ from the east and west walls and be 6 ½’ high to divide the shower units. These stem walls will be anchored to the floor and to walls. A step will be constructed between stem walls to complete the sides for the shower pans.

All walls will be taped and sealed and prepped for tile. 2” tile will be used on the floor and 6” tile will be used on the walls. All tile will be grouted and sealed. Wall tile will have a bullnose finish where needed. A tile soap dish will be placed in each shower unit. All shower diverters and fixtures will be removed and replaced with new. A shower rod and curtain will be placed in each shower unit. Light/exhaust fan fixtures will be removed and replaced with new LED light/exhaust fan fixtures. Rewiring and relocation of light/exhaust fan fixtures will be required to establish proper light coverage. All Electrical work will follow the NEC. All waste will be removed.

The women’s bathroom and shower area

There are two existing toilets that are to be replaced with low flow units.

The shower area is approximately 12’ by 5’. This is a communal shower. There is tile on the floor and on the walls. The tile on the walls is 6 ½’ high. There are three shower units. Located on the west wall. The shower heads are approximately 3’ apart. There are two floor drains.

52.246-12 Inspection of Construction (AUG 1996)

Inspections

Government inspections are for the purpose of satisfying the Government that the supplies and/or services are acceptable and do not relieve the Contractor of the responsibility for maintaining quality control. The Contracting Officer's Representative or designated inspector will conduct all inspections.

52.242-14 Suspension of Work (APR 1984)

FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 60 days after the effective date of the notice to proceed. The time stated for completion shall include final cleanup of the premises.

Work Timing Delays due to normal adverse weather, weekends, and holidays have been included in the calculation of contract time.

Winter Shutdown When winter weather sets in and the continuation of work is impractical, the Contracting Officer may authorize a total suspension until such time as work can proceed. During the period of total suspension, the calendar days elapsed will not be charged against the contract time specified.

SECTION G--CONTRACT ADMINISTRATION DATA

GOVERNMENT-FURNISHED PROPERTY

The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.

Invoices Payment will be made from the contractor’s invoice. All invoices are to be submitted via the electronic Invoice Processing Platform (IPP). This is a mandatory requirement initiated by the U.S. Department of Treasury; you can find more information at this website https://www.ipp.gov/index.htm . There is no pre-award registration.

After award of a contract, please make sure that your company registers promptly at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish your account. PRIOR to starting the IPP enrollment process, please verify that the point of contact’s (POC’s) email address is up-to-date in your company’s System for Award Management (SAM) account at www.sam.gov and that any recent updates have been allowed time to process resulting in an “Active” status on the SAM account. The one-time enrollment in IPP means a series of emails will be sent to the SAM POC. If you have questions on the IPP enrollment process, the help desk phone number is 1-866-973-3131.

Invoices in IPP are now the official record of payment. The payment certification per FAR 52.232-5 and a breakdown of billing, based on the pricing schedule, must be included as attachments to the IPP invoice. (See next page for invoice certification language.) The contractor must also be up-to-date on certified payrolls for the invoiced timeframe, Far 52.222-8. For assistance with creating invoices and attachments in IPP, the help desk phone number is 1-866-973-3131.

The Contractor shall submit payrolls weekly for each week in which any contract work is performed.

The copies shall be sent to the COR. Payrolls submitted shall set out accurately and completely all of the information listed on the form WH-347 (available for download at www.dol.gov, including the certification verbatim from the WH-347. Forms from other State or County governments are not compliant.

Invoices that do not meet these requirements will be rejected.

Payment for Materials Off Site In accordance with Clause 52.232-5, progress payments may include payment for materials stored off site. Contractor shall provide a copy of the paid invoice; provide evidence that the material will be included in the finished project; and identify the location where the materials are stored, so that the government may make visual inspection if the Contracting Officer deems it necessary. The Contractor shall be liable for loss, damage, or destruction of the materials until such time as the materials are physically in the possession and control of the government. The Contractor will not be held liable to the extent that the Contracting Officer determines that the loss, damage, or destruction occurred through the fault or negligence of the government or its agents.

Incidental Items The intent of the contract is to provide for the completion of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment of items shown.

Preconstruction Conference This required conference will be scheduled by the COR.

Section H

SECTION H--SPECIAL CONTRACT REQUIREMENTS

Emergencies Fire Plan

Area of Responsibility for Fire. Unless otherwise noted elsewhere in the contract, the following define the limits of a contractor's area of responsibility for fire under the terms of the Fire Plan (Section J):

Superintendence by Contractor In addition to Clause 52.236-6, the following applies: The name and the specific authorities of the foreman or superintendent must be designated in writing to the Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run. The Contractor shall have a person on-site that is fully conversant in the English language.

Security Contractor is responsible for the Contractor’s equipment and materials supplied to the site. All equipment not equipped with a key lock system shall be secured in such a manner as to make it inoperable to the average person at the end of each working day. All hand tools and other equipment shall be secured at the end of each working day. On Fridays all construction debris, trash, and refuse shall be properly stored in dumpsters or trash bins or removed from the site.

Physical Conditions The indications of physical conditions on the drawings and in the specifications are the result of site investigations and surveys performed by the Government.

Weather Average low temperatures at the project sites range from temperatures of less than 30 ºF in December and January to lows of 50 ºF in July and August. Average high temperatures range from 60 ºF in December and January to over 100 ºF in July and August. The annual precipitation at the project sites varies from less than 4 inches per year including snow fall in the valley to several feet of snow in the mountains. Winter snow storms and freezing temperatures will occur during the winter months that result in a winter project shutdown at higher elevations. Icy conditions on local roads and highways can occur during the fall, winter and spring. Highway curves in shaded areas will remain covered with ice or frost for weeks.

Safety, Emergency Communications and Evacuation Contractor is responsible for the safety of the Contractor’s employees including Subcontractors employees, Government employees associated with the project, and any visitors to the site both Government and private. The Contractor shall submit a project safety plan to the Contracting Officer for review prior to commencement of Work. The project safety plan shall comply with the appropriate California OSHA and Federal OSHA rules and regulations and must include a medical evacuation and emergency communications plan.

Highway Permits Contractor is responsible for securing any overload or over width limit permits required for the transport of materials or equipment to the project site. The Contractor is responsible for conducting a thorough reconnaissance of all routes leading to the site.

Loss, Damage or Destruction Equipment Furnished with Operator. The Government shall not be liable for loss, damage, or destruction of equipment furnished under this contract except for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.

Other. Even though this contract may provide for performing services at the direction of Government personnel, the contract is not for personal services, and neither the Contractor nor his or her personnel are Government employees. The Government assumes no liability for injury occurring to Contractor personnel or to third parties, or for loss, damage, or destruction involving third parties' property as a result of the Contractor's operation. Except that the Government is liable for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) acting within the scope of their employment.

Toilets No toilet or shower facilities are available on site. Contractor shall provide toilet facilities for its employees.

Protection of Resources Contractor shall thoroughly clean all equipment prior to delivery to the project site to remove weeds, mud, grease and oil buildup from the tires, wheels, tracks, engines and engine compartments, and other surfaces.

Spills of petroleum products and other hazardous substances shall be reported, contained, and removed in accordance with all applicable rules, regulations and laws. Contractor shall submit a project spill response plan at the pre-work meeting for review by the Contracting Officer

Archaeological and Historic Sites Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC 433)--will be identified for the contractor before work commences.

Spill Plan If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare and implement a Spill Prevention and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer. The Contractor under the direction of the Contracting Officer, or in the absence of said officer, acting independently, shall immediately take action to contain and clean up, without expense to the Government, all petroleum products spills on or in the vicinity of the project which are caused by the Contractor's employees directly or indirectly as a result of contract operations. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and clean up of petroleum products spills caused by Contractor's employees or resulting from contract operations. The Contractor shall immediately report all petroleum products spills to the Contracting Officer.

Equipment Cleaning On National Forest Service project, all construction equipment shall be cleaned prior to entering Forest Service Land to prevent introduction of invasive plant and animal species. The following will be required at all project sites:

a. All equipment and machinery except passenger vehicles such as trucks, vans, pickups, and cars used for transport of personnel, shall be cleaned prior to entering Forest Service (FS) land. If equipment is moved from FS land, used on a project elsewhere and returned to FS land, cleaning is also required before returning to FS land. This includes wheels, tires, tracks, buckets, stabilizers, undercarriages and bumpers. All washing must take place off of FS land or in designated wash areas where rinse water is collected and disposed of in either a sanitary sewer, a landfill, or other facility authorized to accept such rinse water. Depending on the nature of the debris, the equipment may be cleaned using mechanical methods (brushing, scraping, prying), compressed air, high-pressure water, or steam. Visual inspection of the equipment shall not show plant material, seeds, dirt clods, or other such debris.

b. Contractor shall notify the designated Forest Service contact at least 2 working days prior to moving each piece of equipment on to National Forest land or the project area immediately adjacent to FS land, unless otherwise agreed by the CO. Notification will include vehicle washing information. Upon request of Forest Service, Arrangement will be made for Forest Service to inspect each piece of equipment prior to it being placed in service. Work on Forest Service land may not commence until documentation of cleaning has been obtained unless otherwise agreed by the CO.

c. Any equipment, tools, or vehicles that have been staged off established roads or created ground disturbance within areas that the Forest Service has identified as containing invasive plant species, shall be cleaned to remove dirt and vegetation that could contain weed seed or root fragments before leaving the site of infestation. Depending on the nature of the debris, the equipment shall be cleaned using mechanical methods (brushing, scraping, prying), or compressed air.

d. Contractor shall certify in writing compliance with the terms of provision prior to each start-up of operations. The Forest Service may direct equipment operator to remove any equipment from Forest Service land if certification of compliance has not been obtained.

e. Any new infestations of invasive species, identified by the Contractor or Forest Service, on National Forest land in the work area or on the access route shall be promptly reported to the other party.

Project Site Cleanup

Project site cleanup includes the removal and proper disposal of all construction trash, debris, and residue off of National Forest Land.

Contractor shall have hazardous spill clean-up kit available at all sites and shall be available during construction equipment operation. All spills of petroleum products including leak spots from parked vehicles shall be removed and properly disposed according to all Local, State, and Federal rules, regulations, and laws governing such disposal.

SECTION M--EVALUATION FACTORS FOR AWARD

AWARD DETERMINATION

Award will be made using the Simplified Acquisition Procedures in accordance with FAR Part 13.

Award will be made to the offeror whose acceptable offer provides the best value to the government, considering price and the non-price factors. Non-price evaluation factors include past performance, capability of offeror.

EVALUATION FACTORS

Acceptability of the Offer The Government will determine the acceptability of each offer on a pass or fail basis. An offer is acceptable when it manifests the offeror's assent, without exception, to the terms and conditions of the RFP, including attachments. If an offeror takes an exception to any of the terms and conditions of the RFQ, then the Government will consider its offer to be unacceptable.

Capability of the Offeror The Government will assess the capability of each offeror on the basis of the following criteria which are of approximately equal value: (1) Understanding of the Government's requirements, (2) Organizational Experience, and (3) Organizational Past Performance. The Government will not assess capability on a pass/fail basis, but will use its assessments of capability as a basis for comparing offerors to determine best value.

(1) Understanding of the Government's Requirements. The Government will evaluate each offeror's relative understanding of the Government's requirements on the basis of its written submittals addressing the following subfactors:

a) Any information that indicates the extent to which the site for this project was visited.

b) The results concluded from the site visit.

c) The resources (personnel and equipment) which are planned for use on the project, and how realistic that plan is given concurrent obligations.

d) Site-specific safety plan.

e) Plan of work.

f) Where applicable, estimated production rates.

(2) Organizational Experience. Experience is the opportunity to learn by doing. The Government will evaluate each offeror's organizational experience on the basis of its breadth, its depth, and its relevance to the work that will be required under the prospective contract. The Government will not evaluate an offeror's organizational experience on the basis of the personal experience of the offeror's key personnel.

However, the Government will consider the extent to which the offeror's key personnel have worked together in the past. The Government will evaluate the organizational experience of the offeror's proposed key subcontractors.

(3) Organizational Past Performance. Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with Federal, state, and local laws and regulations. The Government will contact some of each offeror's customers to ask whether or not that: (1) that the offeror was capable, efficient, and effective; (2) the offeror's performance conformed to the terms and conditions of its contract (specifications); (3) finished within the contract time; (4) the offeror was reasonable and cooperative during performance; and (5) the offeror was committed to customer satisfaction.
