Instructions to Offerors--Commercial Items
(Jan 2017)

Addendum to FAR 52.212-1

INSTRUCTIONS TO OFFERORS:

Offeror is to return the following as part of their quotation package:

Cost Proposal shall include the following:

· SF1449 Completed and Signed

· Completed Bid Schedule

· Completed Experience Questionnaire (Key personnel experience, commercial contract work, work as either a prime or a sub, or past performance of predecessor companies may be submitted in section 5 in lieu of current company government contract experience)

· Completed Contractor Information Section (see below)

· Completed Reps and Certs (unless completed in SAM)

· Completed FAR 52.223-1 Biobased Product certification (see below) The Offerors shall submit their quote to Cookie Washington cwashington@fs.fed.us, Contracting Specialist, by email at sebutler@fs.fed.us, with a courtesy copy to Takele K. Woldu at twoldu@fs.fed.us by the response date and time in block 8 of the SF1449.

52.212-2 Evaluation—Commercial Items. (OCT 2014) (a.)

The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

· PAST PERFORMANCE

· PRICE

(b) Past Performance is considered more important than price;

(c) Options. As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the offeror's final option period price to the offeror's total price (base and four option periods). Thus, the offeror's total price for the purpose of evaluation will include the base year, 1st option period and 2nd option period, 3rd option period, 4th option period, and ½ of the 4th option period price. Offerors are not required to enter a price for the potential six-month extension period.

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

A. Initially offers shall be ranked according to price, including any option prices if applicable. The price evaluation will document for the offers evaluated under the following subparagraph B, the reasonableness of the proposed total evaluated price.

B. Using questionnaires, the contracting officer shall seek relevant performance information on the three (3), lowest priced, offerors based on (1) the past and present efforts provided by the offeror and (2) data independently obtained from other government and commercial sources. Relevant performance includes performances of efforts involving janitorial services. The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in this solicitation, based on the offeror’s demonstrated present and past performance. The assessment process will result in an overall performance confidence assessment of High Confidence, Significant Confidence, Satisfactory Confidence, Unknown Confidence, Little Confidence, or No Confidence, as defined below:

High Confidence: Based on the offeror’s performance record, the government has high confidence the offeror will successfully perform the required effort.

Significant Confidence: Based on the offeror’s performance record, the government has significant confidence the offeror will successfully perform the required effort.

Satisfactory Confidence: Based on the offeror’s performance record, the government has confidence the offeror will successfully perform the required effort.

Unknown Confidence: No performance record is identifiable.

Little Confidence: Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort.

No Confidence: Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.

C. In evaluating past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this RFP.

D. If the lowest priced evaluated offer is judged to have a High Confidence performance assessment, that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.

E. If the lowest priced offeror is not judged to have a High Confidence performance confidence assessment, the next lowest offeror will be evaluated and the process will continue (in order by price) until the 3rd lowest priced technically acceptable has been evaluated.

F. Offerors are cautioned to submit sufficient information and in the format specified. Offerors may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.

THE GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN THE LOW OFFEROR.
