SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 SCOPE OF CONTRACT

The intent of this contract is to secure forestry-related services for performing hazardous fuels reduction treatments on 2 existing mixed-chaparral shrub dominated fuelbreaks totaling approximately 212 acres on the Trabuco Ranger District along Main Divide and South Main Divide Road, as well as, bordering the community of Rancho Capistrano to the north and east, in western Riverside County and eastern Orange County. Treatments performed by contractor will include hand cutting of shrubs with chainsaws, hand piling existing dead and down wood debris and contractor generated cut material, and covering piles with paper. Three additional OPTIONAL units (1c thru e) totaling 60 acres may be awarded dependent on future funding levels.

Contractor Responsibility: The Contractor shall provide everything--including, but not limited to, all equipment, supplies, transportation, labor, and supervision--necessary to complete the project, except for that which the contract clearly states is to be furnished by the Government.

C.2 Project Location & Description

Location: Cleveland National Forest, Trabuco Ranger District.

Description: The project areas are generally identifiable by changes in vegetation, roads, flagging, or through geographical information systems (GIS) data. The boundaries can be adjacent units, or other natural or manmade features that clearly define the boundary as noted on the project area maps. In most cases the interior and exterior boundaries of the project areas will be flagged with blue flagging or otherwise described below or by Contracting Officer’s Representative (from now on COR). If there is any discrepancy on the boundaries of individual work areas within units the COR must be contacted as soon as possible and no more work must take place until the discrepancy is resolved.

The project is located in portions of Sections 15, 16, 22, 23, 25, 26, 36 within Township 6 South, Range 5 West. San Bernardino Baseline and Meridian, eastern Orange and western Riverside counties. There are 5 units adjacent to Main Divide and South Main Divide Road as well as the community of Rancho Capistrano located off the Ortega HWY (74) South Main Divide Road.

These units are defined by road systems, flagging (blue) and fence lines.

The 5 units, including optional units; are approximately 271 acres, located within and adjacent to the communities of Rancho Capistrano and along South Main Divide Road. Approximate elevation is 2200 to 3600 ft. The terrain is rough and broken with a variety of slopes with scattered rock outcroppings. Units are dominated by mixed-chaparral shrub types that include Ceanothus, Manzanita, Scrub Oak, Mountain Mahogany, Buckwheat, and other various species in lower amounts. Shrub height is generally less than 8ft.

Exclusions (non-work areas): Control areas, if present; and limitations on work performed will be noted in C.5 and delineated on the ground by a specific color flagging on the boundaries. If alternate colors are used to distinguish between control areas, colors will be known to contractor prior to commencement of work.

Accessibility: Units sites can be accessed from either I-15 or I-5, and onto HWY 74 to Main Divide and South Main Divide Rd.

Any prospective contractor desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing from the Contracting Officer soon enough to allow a reply to reach all prospective contractors before the solicitation closing date. Oral explanations or instructions given before the award of a contract will not be binding.

C.3 Maps Maps showing the general vicinity and/or specific work areas are included in Section J. Maps are general in nature and are not to be considered as definitively identifying locations.

C.4 Estimated Start Date & Contract Time Start: 11/1/2019 Period of Performance: 60 Calendar Days. See also Section F.

C.5 Restrictions on Work

Work may be performed at any time during the period of the contract, except as outlined here.

Nothing in this part shall be construed to take away any of the Government's rights under the Suspension of Work Clause (52.242-14). Restrictions are as follows:

1. In accordance with the fire plan, if included in Section J.

2. When the Contracting Officer (or designated representative) determines that adverse weather has made access too dangerous or that continued vehicular travel would cause unacceptable road damage.

3. In addition to operational restrictions listed in the fire plan #6 under EV, chainsaw operations will not be permitted when forecasted red-flag warnings coincide with operational periods. Hand-piling and covering of piles may continue.

4. Restriction on work hours are as follows: Monday through Saturday 7 AM to 7 PM.

No work may be performed on Sundays and federal holidays without prior authorization from the COR. When authorization is granted, work may commence between 10 AM and 5 PM.

5. All food and trash shall be removed from the site and properly disposed of daily.

6. A limited operating period (LOP) prohibiting mechanized operations, including use of chainsaws; is in place from April 1st to September 1st of any given year to limit impacts to neotropical and migratory nesting birds. The COR will consult with a Forest Service biologist prior to authorizing work within the LOP to determine if breeding season chronology has changed due to site specific and climatic conditions during that year.

7. In addition to Section H, Archaeological and Historic Sites; all project related work shall cease immediately upon discovery of unknown cultural resources. COR shall be notified immediately and affected area(s) shall be flagged for avoidance until a Forest Service Archaeologists can determine relevance of discovery.

8. Approximately 3 known Control Areas exist within units which will require the removal of cut material up to 100 feet before piling. These areas will be made known to contractor at award. Control Areas will be designated in pink and black checkered flagging. Flagging will not be removed by contractor nor their employees.

9. Cutting and removal of tree form oaks, i.e. coastal and canyon live oaks, is prohibited.

10. In Riparian Conservation Areas (RCA) perennial streams will have a 328-foot wide buffer and intermittent streams will have a 100-foot buffer. In these RCA buffers:

a. There would be no cutting or taking of riparian species, i.e. willow, maple.

11. Slash piles will be placed at least 50 feet outside intermittent stream channel, springs, seeps, lakes, and ponds; and 25 feet outside ephemeral drainages.

12. Vegetation at unit boundaries adjacent to roads shall be left intact, approximately 3 feet in width to deter off road vehicular travel.

13. Sensitive plants and invasive weed locations will be designated with Orange and black poke-a-dot flagging for avoidance by contractors operations.

14. Refueling of chainsaws would not occur within 25 feet of any body of water or stream channel

15. Manzanita species would not be cut by contractor’s activities. Piles shall not be placed within 15 feet of retained shrubs

C.6 Licenses and Insurance The contractor shall obtain the insurance and licenses listed here; (see also Section L, Notices to Offerors and Respondents).

MSPA Card (Form WH510): This contract [] does [ ] does not require the contractor to be registered with the US Department of Labor as a Farm Labor Contractor. The Contractor shall provide a current Form WH510 or legible copy.

Note: Only required if contractors intend to house, transport, or drive a migrant or seasonal agricultural worker.

C.7 Camping and Housing Camping is not permitted in US Forest Service campgrounds. Contractor [ ] will [] will not be permitted to camp elsewhere on US Forest Service land. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit. (See also Section H, Camping Permit Compliance)

C.8 Technical Requirements C.8-1 Definitions Conifer – Typically an evergreen tree, which usually has a single well-defined trunk and/or attains a height greater than 20 feet (i.e. pine, spruce, and fir species)

Control Area (Cultural and/or Threatened and Endangered (T&E) Sites) - Areas delineated by pink and black checkered flagging for the purpose of protecting resources of concern. Locations where special protection is required to preserve and protect cultural values and species of plants or animals listed on the T&E list.

Crown Ratio – The portion of the total vertical tree height that is occupied by the vertical length of the tree crown.

Damaged/Diseased Tree – Any tree with one or more of the following:

1. Broken or dead top, regardless of cause.

2. Vertical orientation of bole is lost.

3. Visible disruption of roots.

4. Dead or dying limbs/foliage within the upper three-fourths of the live crown

DBH – Diameter of trees measured at breast height (4.5 feet above ground, upslope side of tree).

Diameter - Other vegetation (not trees) is measured 1 foot above ground

Drip Line – Distance (radius) from the edge of live canopy to the trunk of the tree.

Dominant/Co-dominant Tree – Trees generally of good vigor due to being the larger trees in the stand and their crowns receiving full sunlight from above and on much of the sides.

Excess Tree – A tree that is left, but should have been cut to meet spacing or trees-per-acre requirements.

Existing Down Woody Material – All logs, stems, limbs and tops of trees and brush, which are dead and lying on the ground prior to Contractor beginning operations.

Hardwood - A broad-leaved tree, which usually has a single well-defined trunk and/or attains a height greater than 20 feet, i.e. sycamore and oak species. Sprouting hardwood species may be in the form of multi-stemmed clumps.

Hazard Tree – A dead or live tree, which is unstable or shows signs of defect which may lead to failure AND poses a threat to improvements, personnel, or contractor’s operations.

Jackpot - Concentration of slash or natural fuels, heavier than the surrounding areas.

Ladder Fuels - Fuels that provide vertical continuity between the ground and the tree crowns thus are creating a pathway for surface fire to move into the overstory tree crowns.

Leave or Residual Tree – Typically a dominant or co-dominant tree, but can be in the Intermediate or suppressed range; which is free from Damage/Disease, or a tree less than the desired DBH specified in the C.8-2, and is left uncut (or should have been left uncut) by the Contractor to meet desired spacing or trees per acre requirements. Any live tree greater than 8 inches DBH are automatically considered to be Leave Trees.

Mobilization - The act of delivering all ordered personnel and equipment to the project area. The price for mobilization shall be included in the proposed unit prices.

Percent Cover – Portion of the project area beneath the drip line of vegetation to be cut or left untreated. Percent cover will be specified in C.8-2.

Reserved Trees or Reserved Areas - Individual species of trees or certain areas within a treatment unit that the contract or COR designates are reserved from treatment.

Riparian Conservation Area Buffer - A 100 to 328 horizontal foot area extending upslope on each side of a stream channel.

Shrub (or brush) - Vegetation consisting of woody perennial plant smaller than a tree, usually having permanent single or multiple stems originating at or near the ground level not normally reaching 20 feet in height (i.e. Ceanothus, manzanita, mountain mahogany, sagebrush, etc.)

Slash – Any cut vegetation or existing naturally (dead and down) woody debris. This includes stems, limbs, down logs, and brush that existed from previous activities or was generated by the contractor during current activities. Typically less than 10 inches in diameter. Limbs less than 1 inch in diameter and 2 feet in length are not defined as slash and may be left scattered on the forest floor.

Snag – A dead or living tree that has 10 percent or less live crown.

Superior Vigor Trees – Trees which exhibit healthy, dark green needle color. Needle length is longer, and reaches further back on branches. Needle length on inferior vigor trees is shorter and often tufted nearer branch tips. Recent height growth is also greater on Superior Vigor Trees. May not always be the largest/tallest tree.

Supervisor (foreman) - A working (English speaking) supervisor, who is knowledgeable and experienced in the required work and supervision, shall be provided for each crew and is required to stay with the crew while work is in progress. If crew is non-English speaking, the supervisor must be bilingual in English and the language of the crew members.

Suppressed/Intermediate Tree – Trees generally of poor vigor due to being overtopped or crowded by larger trees. The crowns of these trees usually receive little or no direct sunlight.

Undesirable Vegetation – Conifer trees less than 8.0 inches DBH with one or more of the following attributes:

1. Damaged/Diseased Trees.

2. Trees with Suppressed and/or Intermediate crown position classification.

3. Excess trees not selected as Leave Trees.

C.8-2 Specifications C.8-2.1 Chaparral Fuelbreak Construction (cut, pile, cover)

C.8-2.1.1 Thinning of Shrubs and Small Trees w/ Chainsaw - Remove 70 percent of live shrubs and all dead shrubs from treatment units. Leave untreated islands, generally no greater than 0.25 acre in size, in an irregular pattern and shape distributed randomly throughout the unit. Islands, as well as unit boundaries, should have a wavy form or outline to provide a natural appearance. Avoid treating individuals of oaks, bigberry manzanita, and spiny redberry. Shrubs and small trees shall be severed below a 4 inch height. Residual tree shall be pruned to 6 feet in height or 50% of the live crown, whichever is less.

C.8-2.1.2 Pile Location - Piles shall be at least 15 feet from shrub islands, the drip line of residual oak trees and the project boundary unless approved by the COR. Slash shall not be piled or placed on logs, rocks, or stumps, in roadways, swales, or drainage ditches, on springs or seeps, or within 50 feet of stream channels, lakes, or ponds as shown on the contract area map and/or observed on the ground. Piles may not be created within 100 feet of improvements, i.e. utility lines, gates, or outbuildings and residences.

C.8-2.1.3 Pile Construction - All piles shall be constructed by laying cut stems, and all other slash, including existing down woody material up to 10 inch diameter in the pile, in a vertical arrangement, so as to be triangular in shape, resembling a teepee. Slash shall be bucked to 4 foot lengths to facilitate tight piles.

C.8-2.1.4 Pile Size – Unless approved otherwise by the COR in writing, maximum pile size shall be 10 feet in diameter by 6 feet in height, and minimum pile size shall be 5 feet in diameter by 3 feet in height at the time of final inspection.

C.8-2.1.5 Pile Covering - All constructed piles shall receive one – (1) 4 foot wide by 6 foot long sheet, or multiples sheets to cover 60 percent of the surface area, which is greater; of Kraft paper at the 2/3rd depth of the pile. Contractor shall pile additional material (top third) on top of the Kraft paper to prevent paper from moving off the pile by environmental conditions. On hillsides, paper shall be shifted to downhill side of pile to allow for ease of ignition.

C.8-3 Contractor-Furnished Equipment Unless otherwise specified herein, the Contractor shall provide all labor, transportation, materials, and equipment necessary to perform the work as described herein.

The Forest Service anticipates the use of chainsaws to complete the tasks stated under C.8-2.1

C.8-4 Government-Furnished Property See Section G.

C.8-5 Public Safety A safety plan will be discussed with Contractor upon award and may vary on complexity and proximity to high use areas.

Project areas are located along paved roads, near residential areas, near popular recreation areas, and along power line roads with live wires. Therefore, warning signs, flaggers, and/or other safety precautions, dependent on operations, shall be employed by the contractor to ensure public and employee safety. Warning signs must meet standards set forth in the California Manual on Uniform Traffic Control Devices.

C.8-6 Salvage Rights No salvage rights exist under this contract.

C.8-7 Road Maintenance Road maintenance is not required. All roads shall remain open, unobstructed, and free of trees and/or slash at all times during the Contractors’ operations. Any damage caused by contractors’ activities to gates, drainage structures or deleterious road bed re-shaping shall be repaired at the contractors’ expense and under the direction of the Contracting Officer.

E.2 Specific Inspection Procedures

The sample plots will be located throughout each unit, so as to obtain a representative sample of the work. Each item will be inspected separately. Determinations of the acceptability of the work performed will be based on these inspections, which will be considered conclusive, except as otherwise provided in the contract.

Plot centers will be marked at each plot with brightly colored flagging and examined. The following criteria are inclusive of all items up for award; only applicable criteria for each item will be measured, but all is shown to inform contractor. As numbering varies Item to Item, General headings found under C.8-2 Specific Tasks are listed below and can be referenced back to each Item.

E.3 Acceptance Work on this contract will be deemed acceptable when the governments’ inspection plots equal a quality equal to or higher than that specified for that task, as shown in the Quality Assurance Plan (QAP). Each item and each task must meet or exceed its Acceptable Quality Level for full payment on the item. If one or more tasks are below their Acceptable Quality Level, payment will be made at the lowest rate (rate most favorable to the Government).

E.4 Government Inspections Government inspections are for the purpose of satisfying the Government that the services are acceptable and do not relieve the Contractor of the responsibility for maintaining quality control.

The Contracting Officer's Representative or designated inspector will conduct all inspections.

The Contractor (or designated representative) is encouraged to be present to observe inspections.

Summary results will be made available on request.

Compliance Inspections. Visual compliance inspections will be made on a periodic basis. Such inspections are not final and do not constitute acceptance by the Government.

Final Inspections. Final (formal) inspections for payment will be made on completed sub-items only. Contractor shall request final inspections in writing and give the Forest Service at least two working days advanced notice. Inspections will be completed within four working days after the notice is received If the work is not ready for inspection at the time specified by the Contractor, the cost associated with the inspection attempt may be charged to the Contractor.

Disputed Inspection.

The Contractor may request reinspection without rework if the results are unacceptable.

Reinspection must be requested in writing within 48 hours after receiving written notice of the inspection results. Reinspection will be accomplished within five working days after receipt of the contractor's written request.

The same sampling and inspection procedures will be used, but new samples will be taken. The inspection pattern will be shifted so that new samples will not overlap previously inspected samples. Results will be rounded to the nearest whole percent.

If reinspection results are within five percentage points of the first inspection, the original inspection result will be used in determining acceptability and payment. If reinspection results are greater than five percentage points above or below the first inspection, the reinspection results will be used.

If the reinspection results are within five percentage points of the first inspection, the Contractor shall pay the actual costs of the reinspection.

Reinspection after Rework. Where rework after a failed inspection may improve the inspection results, the Contractor may rework the area and request (in writing) a second inspection. The Government will charge to the Contractor the cost of this additional inspection. Reinspection will be accomplished within five working days after the notice is received. The results of the second inspection will be final, and no further rework will be permitted. Areas not ready for reinspection at the time specified by the Contractor will not be reinspected, and the results of the first inspection will be final.

Delays due to normal adverse weather, weekends, and holidays have been included in the calculation of contract time. The Government reserves the right to set the priority of items or subitems. Contractor shall complete all work on one subitem before proceeding to another.

Winter Shutdown When winter weather sets in and the continuation of work is impractical, the Contracting Officer may authorize a total suspension until such time as work can proceed. During the period of total suspension, the calendar days elapsed will not be charged against the contract time.

SECTION G--CONTRACT ADMINISTRATION DATA

Pre-work Pre-work conference. Before work begins on service contracts, a pre-work conference is normally held to discuss the contract--especially the specifications, labor provisions, plan of work, and selected standard clauses. The pre-work meeting should be attended by an officer of the firm or someone designated in writing to act on behalf of the firm. The pre-work meeting may be waived at the discretion of the Contracting Officer.

Notice to Proceed.

A. [X] No work may begin on this contract until the Contracting Officer has issued a Notice to Proceed.

B. [ ] Work on this contract may proceed and contract time will begin upon receipt of the awarded contract. Any adjustments to the anticipated completion date will be noted in the award letter.

Measurement Methods of Measurement.

Remeasurement. Unless otherwise indicated by this contract, the contractor may request remeasurement of any quantities in Part B, when the units are acres or any linear measurement.

The request must be made in writing and must be made within 10 calendar days of completing work on the unit in question. If remeasurement indicates a variance of five percent or less from the stated quantity, the Contractor shall pay for the actual cost of remeasurement and no adjustment will be made in the quantity as stated in Part B. If remeasurement indicates a variance more than five percent from the stated quantity, payment will be based on the remeasured quantity, and the Contractor will not be liable for the costs of remeasurement. All remeasurements will be done by the Government. Remeasurement of acreage will be done with two people using a hand compass and ground measurement or by means of a Global Positioning System. This clause is not applicable to quantities listed as estimated quantities.

Payment Payments and Deductions. Payment will be made for fully acceptable work at the prices bid in the schedule of items. In the event of extended non-work periods because of adverse weather, the Contracting Officer may authorize progress payments for partially completed sub-items on a case-by- case basis. In accordance with the inspection clause, payment may be made for less than fully acceptable work at a reduced price. Other exceptions are noted below:

A. [X] Payment will be made in full if inspection results are 90 percent or higher. No payment will be made if inspection results are less than 90 percent.

B. [ ] Payment will be made in full if inspection results are 90 percent or higher. If inspection results are below 90 percent, a deduction will be made equal to 2 percent for every 1 percent below 90. For example, if inspection results are 87 percent, the bid price would be reduced by 6 percent. No payment will be made if results are less than 80 percent.

Contract Release. The following supplements the Payments clause in Section I:

Before final payment will be made the Contractor shall sign a release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically exempted from the operation of the release. A release may also be required of the assignee if the Contractor's claim to amounts payable under this contract has been assigned under the Assignment of Claims Act of 1940 (31 U.S.C. 3727 and 41 U.S.C. 15).

Payment will be made from the contractor’s invoice. All invoices are to be submitted via the electronic Invoice Processing Platform (IPP). SECTION H—SPECIAL CONTRACT REQUIREMENTS

Emergencies Fire Plan

Area of Responsibility for Fire. Unless otherwise noted elsewhere in the contract, the following define the limits of a contractor's area of responsibility for fire under the terms of the Fire Plan (Section J):

Superintendence by Contractor The name and the specific authorities of the foreman or superintendent must be designated in writing to the Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run. The Contractor shall have a person on-site that is fully conversant in the English language.

Camping Permit Compliance Contractor shall comply with all terms and conditions of any camping permit issued to allow use of premises. Any non-compliance will result in suspension of work until compliance is achieved.

Archaeological and Historic Sites Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC 433)--will be identified for the contractor before work commences.

Spill Plan If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare and implement a Spill Prevention and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer. The Contractor under the direction of the Contracting Officer, or in the absence of said officer, acting independently, shall immediately take action to contain and clean up, without expense to the Government, all petroleum products spills on or in the vicinity of the project which are caused by the Contractor's employees directly or indirectly as a result of contract operations. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and clean-up of petroleum products spills caused by Contractor's employees or resulting from contract operations. The Contractor shall immediately report all petroleum products spills to the Contracting Officer.

Equipment Cleaning All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.

Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer at least five days in advance of moving equipment in so that arrangements can be made for inspection.

If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.
