SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 SCOPE OF CONTRACT

Description of Work:

The intent of this contract is to secure forestry-related services for performing hazardous fuels reduction treatments on approximately 119 acres of moderately-dense to open Jeffrey pine forested lands within the Laguna Mountain Recreation Area and on 84 acres of mixed chaparral shrub lands adjacent to the community of Carveacre. Both project areas are located on the Descanso Ranger District of the Cleveland National Forest in southeastern San Diego County, CA. Treatments will include one or more of the following activities: cutting of small diameter live and dead trees with chainsaws, cutting of live and dead shrubs with chainsaws; pruning limbs of residual conifer trees with chainsaw; applying a borax compound to freshly cut coniferous stumps; piling by hand all contractor generated cut material and existing dead and down woody debris; and covering piles with paper. Additionally in the Carveacre project area a subsequent foliar application of herbicide on cut plants will be made during a second entry in the Spring when cut shrubs have begun to sprout. One optional forested unit, 94 acres in size, within the Mount Laguna Recreation Area may be awarded at a future date dependent on price and availability of funding.

Contractor Responsibility: The Contractor shall provide everything--including, but not limited to, all equipment, supplies, transportation, labor, and supervision--necessary to complete the project, except for that which the contract clearly states is to be furnished by the Government.

C.2 Project Location & Description

Location: The projects are located on the Cleveland National Forest, Descanso Ranger District.

Description: The project areas are generally identifiable by changes in vegetation, roads, flagging, or through geographical information systems (GIS) data. The boundaries can be adjacent timber stands or project units, recent harvest units, or other natural or manmade features that clearly define the boundary as noted on the project area maps. In most cases the interior and exterior boundaries of the project areas will be flagged with Florescent Blue flagging or otherwise described below or by Contracting Officer’s Representative (from now on COR). If there is any discrepancy on the boundaries of individual work areas within units the COR must be contacted as soon as possible and no more work must take place until the discrepancy is resolved.

Item 1 1a - Unit 65 of the Mount Laguna Community Defense and Healthy Forest Restoration Project is located west of Sunrise Hwy. Unit 65 is approximately 119 acres, located within the Mount Laguna Recreation Area.

Legal Land Description: Township 15 South, Range 5 East, Sections 2, 11, and 12.

Approximate elevation ranges from 5,520’ to 5,200’. The terrain is gentle to rough and broken with a variety of slopes and scattered rock outcroppings. A majority of the unit has timber over story consisting of mixed conifer and oak species. Understory consists of mixed-chaparral shrubs that include Ceanothus, Manzanita, Scrub Oak, Mountain Mahogany, and Buckwheat.

Shrub height is generally less than 8ft.

1b (optional) – Option item 1b is located within unit 65 of the Mount Laguna Community Defense and Healthy Forest Restoration Project and adjacent to Item 1. Unit 65 is located west of Sunrise Hwy. Unit is approximately 94 acres, located within the Mount Laguna Recreation Area.

Access - From the city of San Diego, travel Interstate 8 East, exit Sunrise Hwy., turn left heading North on Sunrise Highway then a left turn on Los Huecos Rd. West of Sunrise highway. The unit can be accessed by Los Huecos Rd., and by various roads within local cabin tracts. These access locations have no locked gates and will not require a Forest Service key. Contracting Officers Representative (COR) or designated inspector will work with contractor to establish other possible access routes. Optional item 1b is accessed directly off Sunrise Highway.

Item 2- The units in item 2 are approximately 84 acres, located within and adjacent to the community of Carveacre. Township 16 South, Range 3 East. Section(s) 19, 20, 28, 29 and 30.

Approximate elevation 2200-3600 ft. The terrain is rough and broken with a variety of slopes with scattered rock outcroppings. Unit is dominated by mixed-chaparral shrub types that include Ceanothus, Manzanita, Scrub Oak, Mountain Mahogany, Buckwheat, and mixed Chaparral.

Shrub height is generally less than 8ft.

Item 2 Access - From the Alpine area off of Interstate 8 navigate to Japatul Valley Rd., continue on Japatul Valley Rd. to Carveacre Rd. The community of Carveacre and all units within project are accessed by Carveacre Rd. Contracting Officers Representative (COR) or designated inspector will work with contractor to establish other possible access routes.

Exclusions (non-work areas): Control areas, if present; and limitations on work performed will be noted in C.5 and delineated on the ground by flagging on the boundaries. If alternate colors are used to distinguish between control areas, colors will be known to contractor prior to commencement of work.

Accessibility: Access routes are identified above and shown on the project area maps. The project areas can and will be accessed from established highways and Forest system roads. Work vehicles and equipment will be parked on Forest Service land unless prior arrangements have been made by the Contracting Officer. In most cases project areas will be accessible by 2WD;

however, some terrain may necessitate the use of a four-wheel drive, high-clearance vehicle

Any prospective contractor desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing from the Contracting Officer soon enough to allow a reply to reach all prospective contractors before the solicitation closing date. Oral explanations or instructions given before the award of a contract will not be binding.

C.3 Maps

Maps showing the general vicinity and/or specific work areas are included in Section J. Maps are general in nature and are not to be considered as definitively identifying locations.

C.5 Restrictions on Work

Work may be performed at any time during the period of the contract, except as outlined here.

Nothing in this part shall be construed to take away any of the Government's rights under the Suspension of Work Clause (52.242-14). Restrictions are as follows:

Restrictions Applicable to all items:

1. In accordance with the fire plan, if included in Section J.

2. When the Contracting Officer (or designated representative) determines that adverse weather has made access too dangerous or that continued vehicular travel would cause unacceptable road damage.

3. Regardless of the Forecasted Project Activity Level, when a Forecasted Red Flag Warning is present over the contract area as predicted by NOAA, COR may shut down all mechanical operations, including the use of chainsaws.

4. Restriction on work hours are as follows: Monday through Saturday 7 AM to 7 PM.

No work may be performed on Sundays and federal holidays without prior authorization from the COR. When authorization is granted, work may commence between 10 AM and

5 PM.

5. In addition to Section H, Archaeological and Historic Sites; all project related work shall cease immediately upon discovery of unknown cultural resources. COR shall be notified immediately and affected area(s) shall be flagged for avoidance until a Forest Service Archaeologists can determine relevance of discovery.

5. No live oak trees may be intentionally cut unless deemed hazardous to contractors operations and approved by COR prior to removal.

6. Within RCA’s as designated on the map (perennial streams buffer = 328 feet;

Intermittent stream buffer = 100 feet), no cutting or removal of riparian plant species will be allowed. Treatments will be completely avoided within the identified inner stream gorge (from channel bottom to top of stream bank).

7. All food and trash shall be removed from the site and properly disposed of daily.

8. Known sensitive plant and invasive weed populations exist along roads and within treatment units. Locations will be delineated for avoidance with orange and black polka dot flagging and/or “Do Not Cut” flagging.

9. Retain all wood rat nests within the unit where they do not threaten treatment efficacy.

Restrictions Specific to Item 2:

11. Item 2, herbicide application is estimated to start on March 1, 2020 but may be shifted by up to 30 calendar days each way to coincide with cut shrub sprouting.

12. Prior to herbicide application a spill response plan must be approved by the COR and spill kit provided on-site during the life of the treatment.

13. Herbicide spray equipment shall not be washed or rinsed within 150 feet of any body of water or stream channel. All herbicide containers, including rinse water would be disposed of in a manner that would not cause contamination of waters.

14. No herbicide treatments may occur within twice the distance of the dripline on any oak tree nor within 100 feet of any sensitive plant occurrence.

15. Control areas will exist for herbicide avoidance, Contractor will buffer known sensitive species populations, delineated in orange and black polka dot flagging during cutting treatment; by an additional 10 feet during herbicide application. It is contractors’ responsibility to know locations prior to commencement of applications. A map showing sensitive plant populations, which can be viewed in conjunction with AvenzaPDF may be provided to contractor upon request.

C.6 Licenses and Insurance The contractor shall obtain the insurance and licenses listed here; (see also Section L, Notices to Offerors and Respondents).

MSPA Card (Form WH510): This contract [X] does [ ] does not require the contractor to be registered with the US Department of Labor as a Farm Labor Contractor. The Contractor shall provide a current Form WH510 or legible copy.

C.7 Camping and Housing Camping is not permitted in US Forest Service campgrounds. Contractor [ ] will [X] will not be permitted to camp elsewhere on US Forest Service land. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit. (See also Section H, Camping Permit Compliance)

C.8 Technical Requirements

C.8-1 Definitions

Conifer – Typically an evergreen tree, which usually has a single well-defined trunk and/or attains a height greater than 20 feet (i.e. pine, incense cedar, and fir species)

Control Area (Cultural, invasive weeds, sensitive plants, and/or Threatened and

Endangered (T&E) plant and animal populations) - Areas delineated by flagging, other than the color Blue or Yellow, for the purpose of protecting resources of concern. Locations where special protection is required to preserve and protect cultural values or species of plants and animals listed on the T&E list.

Crown Ratio – The portion of the total vertical tree height that is occupied by the vertical length of the tree crown.

Damaged/Diseased Tree – Any tree with one or more of the following:

1. Broken or dead top, regardless of cause.

2. Vertical orientation of bole is lost.

3. Visible disruption of roots.

4. Dead or dying limbs/foliage within the upper three-fourths of the live crown

DBH – Diameter of trees measured at breast height (4.5 feet above ground, upslope side of tree).

Diameter - Other vegetation (not trees) is measured 1 foot above ground

Drip Line – Distance (radius) from the edge of live canopy to the trunk of the tree.

Dominant/Co-dominant Tree – Trees generally of good vigor due to being the larger trees in the stand and their crowns receiving full sunlight from above and on much of the sides.

Excess Tree – A tree that is left, but should have been cut to meet spacing or trees-per-acre requirements. Applies to conifer species or shrubs.

Existing Down Woody Material – All logs, stems, limbs and tops of trees and brush, which are dead and lying on the ground prior to Contractor beginning operations.

Hardwood - A broad-leaved tree, which usually has a single well-defined trunk and/or attains a height greater than 20 feet, i.e. sycamore and oak species. Sprouting hardwood species may be in the form of multi-stemmed clumps.

Hazard Tree – A dead or live tree, which is unstable or shows signs of defect which may lead to failure AND poses a threat to improvements, personnel, or contractor’s operations.

Jackpot - Concentration of slash or natural fuels, heavier than the surrounding areas.

Ladder Fuels - Fuels that provide vertical continuity between the ground and the tree crowns thus are creating a pathway for surface fire to move into the overstory tree crowns.

Leave or Residual Tree – Typically a dominant or co-dominant tree, but can be in the Intermediate or suppressed range; which is free from Damage/Disease, or a tree less than the desired DBH specified in the C.8-2, and is left uncut (or should have been left uncut) by the Contractor to meet desired spacing or trees per acre requirements. Any live conifer tree greater than 10 inches DBH and all oaks greater 6 inches DBH than are automatically considered to be Leave Trees.

Mobilization - The act of delivering all ordered personnel and equipment to the project area. The price for mobilization shall be included in the proposed unit prices.

Percent Cover – Portion of the project area beneath the drip line of vegetation to be cut or left untreated. Percent cover will be specified in C.8-2.

Reserved Trees or Reserved Areas - Individual species of trees or certain areas within a treatment unit that the contract or COR designates are reserved from treatment.

Riparian Conservation Area Buffer - A 100 to 328 horizontal foot area extending upslope on each side of a stream channel.

Shrub (or brush) - Vegetation consisting of woody perennial plant smaller than a tree, usually having permanent single or multiple stems originating at or near the ground level not normally reaching 20 feet in height (i.e. Ceanothus, manzanita, mountain mahogany, sagebrush, etc.).

Slash – Any cut vegetation or existing naturally (dead and down) woody debris. This includes stems, limbs, down logs, and brush that existed from previous activities or was generated by the contractor during current activities. Typically less than 12 inches in diameter. Limbs less than 1 inch in diameter and 2 feet in length are not defined as slash and may be left scattered on the forest floor.

Snag – A dead or living tree that has 10 percent or less live crown.

Superior Vigor Trees – Trees which exhibit healthy, dark green needle color. Needle length is longer, and reaches further back on branches. Needle length on inferior vigor trees is shorter and often tufted nearer branch tips. Recent height growth is also greater on Superior Vigor Trees. May not always be the largest/tallest tree.

Supervisor (foreman) - A working (English speaking) supervisor, who is knowledgeable and experienced in the required work and supervision, shall be provided for each crew and is required to stay with the crew while work is in progress. If crew is non-English speaking, the supervisor must be bilingual in English and the language of the crew members.

Suppressed/Intermediate Tree – Trees generally of poor vigor due to being overtopped or crowded by larger trees. The crowns of these trees usually receive little or no direct sunlight.

Undesirable Vegetation – Conifer trees less than 10.0 inches DBH with one or more of the following attributes:

1. Damaged/Diseased Trees.

2. Trees with Suppressed and/or Intermediate crown position classification.

3. Excess trees not selected as Leave Trees.

C.8-2 Specifications

C.8-2.1 Hand Thin w/ Chainsaws, Prune, and Hand Pile (Item 1)

C.8-2.1.1 Thinning Conifers w/ Chainsaws - All live and dead coniferous trees less than or equal to 10.0” DBH are evaluated for cut or leave status. The result of thinning effort is all conifers trees less than 10” DBH, which were not selected as Leave Trees, are cut down. Trees are cut below the lowest live limb and completely severed from the stump.

Leave Trees are un-damaged by Contractor’s operations, except for minor bark scraping, which does not expose the cambium.

C.8-2.1.2 Stump Height – Resulting stumps of all cut trees live or dead shall be less than 6 inches when measured from the uphill side.

C.8-2.1.3 Leave Tree Spacing - Spacing may vary by up to 25 percent but will average 25

ft. from bole to bole. Spacing shall result in leaving a healthy, vigorous understory of seedling, sapling, and pole sized trees. Live oak trees greater than 6 inches DBH count as leave trees and should be reflected when meeting leave tree spacing requirements. Live oak trees less than 6 inches in DBH may be ignored.

These trees should generally cover the entire acre, but are not arranged in a grid-like fashion. Trees occur individually or in small clumps (3 to 5 trees), depending on the existing forest arrangement.

C.8-2.1.4 Cut and Leave Tree Selection - Generally, the Contractor will select Leave Trees, which are of superior size (height over DBH) and vigor from the remaining intermediate and suppressed trees, choose superior vigor trees as Leave Trees, regardless of spacing. The crowns of Leave Trees generally do not touch one another.

The following protocol should be used in identifying trees to be cut in an area:

1. Cut all dead trees under 10 inches in DBH regardless of species and location.

2. Cut all live conifer trees less than 10 inches in DBH located within 10 feet of the dripline of large healthy oak trees with a DBH over 6 inches.

3. Cut all live conifer trees less than 10 inches in DBH when located under the crown of a residual conifer tree greater than 10 inches in DBH (fuel ladder) or within 1.5 times the length of the dripline of large old conifer trees greater than 24 inches in DBH.

4. After ensuring 1-3 are met, thin the remaining acres to the Leave Tree Spacing guidelines shown above retaining the following species in order of preference:

Oak, Pine, Fir, and Cedar. At no time may a live oak tree be cut.

C.8-2.1.5 Leave Tree Pruning – Remove live and dead limbs to within 1 inch of the bole on all residual conifer trees to a height of 6 feet or 1/3rd the total tree height for trees 12 feet or less in height. Do not prune Oaks.

C.8-2.1.6 Borax Compound Stump Application – Cellu-treat™ (or Sporax ™) shall be evenly applied to all live and recently dead conifer stumps within four hours of cutting the tree. A non-toxic die must be used to aid in inspection when using either substance in a liquid form. Manufacturers recommended mixing and safety guidelines shall be adhered

to. Usage will be reported to COR at end of contract prior to submitting invoice for final payment.

C.8-2.1.7 Thinning of Shrubs w/ Chainsaw – Remove all shrubs from within 10 feet of the dripline of all leave trees; both conifer and hardwood. Within large patches of shrubs (>2 acres) remove all shrubs within 25 feet of the dripline from the forest edge. Favor leaving islands of bigberry manzanita. Shrubs shall be severed below a 4 inch height.

C.8-2.1.8 Pile Location –

1. Piles shall not be created within 100 feet of any cabin, outbuilding, or improvement, i.e. utility lines.

2. Piles shall not be closer than 15 feet to boles of Leave Trees or within 10 feet from the dripline; whichever is further.

3. Piles shall be at least 15 feet from retained snags, project perimeter, shrub islands, and any down log exceeding 12 inches diameter at the large end, unless approved by the COR.

4. Slash shall not be piled or placed on logs, rocks, or stumps, in roadways, swales, or drainage ditches, on springs or seeps, or within 30 feet of stream channels, lakes, ponds or meadows as shown on the contract area map and/or observed on the ground.

C.8-2.1.9 Pile Construction - All piles shall be constructed by laying limbs, stems, cut boles, and all other slash, including existing down woody material up to 12 inch diameter in the pile, in a vertical arrangement, so as to be triangular in shape. Slash shall be bucked to 4 foot lengths and limbed to facilitate tight piles.

C.8-2.1.10 Pile Size – Unless approved otherwise by the COR in writing, maximum pile size shall be 10 feet in diameter by 6 feet in height, and minimum pile size shall be 5 feet in diameter by 4 feet in height at the time of final inspection.

C.8-2.1.11 Pile Covering - All constructed piles shall receive one – (1) 4 foot wide by 6 foot long sheet, or multiples sheets to cover 60 percent of the surface area, whichever is greater; of Kraft paper at the 2/3rd depth of the pile. Contractor shall pile additional material (top third) on top of the Kraft paper to prevent paper from moving off the pile by environmental conditions. On hillsides, paper shall be shifted to downhill side of pile to allow for ease of ignition.

C.8-2.2 Chaparral Fuelbreak Construction (Item 2)

C.8-2.2.1 Thinning of Shrubs w/ Chainsaw - Remove 70 percent of live shrubs and all dead shrubs from treatment units. Leave untreated islands, generally no greater than 0.25 acre in size, in an irregular pattern distributed throughout the unit. Islands, as well as unit boundaries, should have a wavy form or outline to provide a natural appearance. Avoid treating individuals of oaks, bigberry manzanita, and Spiny Redberry. Shrubs shall be severed below a 4 inch height.

C.8-2.2.2 Pile Location –

1. Piles shall be at least 15 feet from shrub islands, the drip line of residual oak trees and the project boundary unless approved by the COR.

2. Slash shall not be piled or placed on logs, rocks, or stumps, in roadways, swales, or drainage ditches, on springs or seeps, or within 50 feet of stream channels, lakes, or ponds as shown on the contract area map and/or observed on the ground.

3. Piles shall not be created within 100 feet of improvements, i.e. utility lines.

C.8-2.2.6 Herbicide Application Herbicide application would commence during a second entry into the unit in mid to late spring months in 2020. Application will target sprouting shrubs initially cut in item 2.

The following elements shall be adhered to during application:

1. All herbicide application would adhere to all applicable Federal laws and laws of the State of California and San Diego County. The contractor must be operating under a California Qualified Applicator license or certificate and be registered with the Department of Agriculture in San Diego County. The contractor is responsible for reporting herbicide application to the county as required by State regulation.

2. Work crews would be supervised to ensure that specific safety practices are followed.

These practices include the use of appropriate protective clothing. Clean water and soap would be available for emergency washing.

3. The contractor will supply all herbicide mixtures and spraying equipment as part of the cost of the crew. The triclopyr solution will be mixed for a low volume foliar application. With an average of 1-2lbs active ingredient (1/2 gallons of Garlon 3a (or equivalent) being sprayed per acre, the total herbicide required will be approximately 50 gallons.

4. The herbicide would be mixed to label specification with a modified seed oil (MSO) surfactant and marker dye.

5. The herbicide formulation for all plants will consist of a solution of Triclopyr TEA (example Garlon 3a) and a vegetable or methylated seed oil surfactant (ex. MSO) and a registered dye. No diesel or other petrochemical based surfactants may be used.

The formulation used must have final approval by the COR and will be mixed to label specifications for foliar application.

6. Herbicides would be applied to shrubs previously cut and currently sprouting using hand sprayers or backpack sprayers, potentially with daubing attachments. No aerial application of herbicides would occur.

7. No foliar spray activities would be allowed if wind velocity is expected to exceed five miles per hour.

8. No herbicide treatments would be allowed when rain is occurring or likely to take place within 48 hours.

9. Herbicides would not be applied directly to surface waters. Treatments would be timed to minimize the potential for introduction of herbicide to surface waters. When a target species occurs adjacent to surface waters care would be taken to prevent herbicide drift to surface waters, including trimming and folding of plants away from waters.

C.8-2.2.4 Herbicide Reporting Requirements - The contractor must report to the Forest Service the total amount of herbicide applied and chemical formulation and location applied detailed for each day. These totals can be presented in one summary report at the end of treatment and prior to submitting of final invoice.

C.8-3 Contractor-Furnished Equipment Unless otherwise specified herein, the Contractor shall provide all labor, transportation, materials, and equipment necessary to perform the work as described herein.

The Forest Service anticipates the use of at least 1 seven man handcrew with chainsaws to complete the tasks stated under C.8-2.

C.8-4 Government-Furnished Property See Section G.

C.8-5 Public Safety

A safety plan will be discussed with Contractor upon award and may vary on complexity and proximity to high use areas. At a minimum, contractor shall post “Tree Work Ahead” signs, or other similar precautionary signage; at all entry points into or adjacent to the unit when tree felling is occurring in proximity to multi-use trails along boundaries or that intersect the unit. Temporary trail closures may be warranted and will be discussed with contractor prior to operations.

Project areas are located along paved roads, near residential areas, near popular recreation areas, and along power line roads with live wires. Therefore, warning signs, flaggers, and/or other safety precautions, dependent on operations, shall be employed by the contractor to ensure public and employee safety. Warning signs must meet standards set forth in the California Manual on Uniform Traffic Control Devices.

C.8-6 Salvage Rights No salvage rights exist under this contract.

C.8-7 Road Maintenance Road maintenance is not required. All roads and multi-use trails shall remain open, unobstructed, and free of trees and/or slash at all times during the Contractors’ operations. Any damage caused by contractors’ activities to gates, drainage structures, multi-use trails, or deleterious road bed re-shaping shall be repaired at the contractors’ expense and under the direction of the Contracting Officer.
