OVERVIEW

This solicitation will result in one or more Performance Based, Indefinite Delivery - Indefinite Quantity (IDIQ) Contracts as best meets the needs of the Government. These contracts will have a base period, which runs through March 31, 2020 and four option years, which if exercised could extend contract performance through March 31, 2024. There is no guarantee that any options will be exercised by the Government. Submission of an offer for the basic contract period constitutes an offer to perform in the Option Period(s), if exercised.

Individual task orders will be issued to support specific requirements as identified locally.

The Government reserves the right to adjust the quantity ordered on any task order based on the availability of funds.

AUTHORIZED ORDERING ACTIVITIES: Task orders may only be issued by warranted contracting officers or purchasing agents on behalf of the National Forests and Grasslands in Texas.

SECTION I - GENERAL INFORMATION

SCOPE

The contractor shall provide all materials, labor, equipment, tools, transportation, supervision, expertise, and other incidentals necessary, except as otherwise provided, to successfully provide prescribed fire support on the National Forests and Grasslands in Texas, in accordance with attached and reference specifications. Work includes but is not limited to tasks and subtasks related to prescribe fire operations such as: furnishing, fully equipping, and staffing Type 5 and 6 Wildland Fire Engines; Prescribed Fire Crewmembers (FFT2); and Intermediate Fallers (FAL2).

Services will be performed on a call-when-needed (CWN) basis to assist the Forest Service in meeting objectives of the National Fire Plan in accordance with Public Law 106-291. Engines and vehicles will not be used for initial attack or any other service related to Wildland Fire Suppression.

SITE VISIT

An organized site visit is not scheduled. Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

PERFORMANCE OF SIMILAR WORK BY THE GOVERNMENT

Nothing in this contract restricts the Government from performing any of the work with its own organization and workforce.

CONTRACTOR REPRESENTATIVE

The contractor shall provide a contract representative for the performance of the work. The name of this person and an alternate(s) who shall act for the contractor when the contractor is absent shall be designated in writing to the contracting officer. The contractor representative or alternate shall have full authority to act for the contractor on all contractual matters relating to daily operation of this contract.

ENGLISH SPEAKING REQUIREMENT

Communications between Contractor crew personnel and Government incident personnel is mandatory for safe and effective performance. Contractor’s representative shall be able to proficiently communicate in English, in the language of the crew, and read and communicate the Incident Action Plan, Safety Alerts, etc. All radio communication on Government-assigned frequencies shall be in English. The Contractor Representative designated by the contractor shall have the ability to read, write, and speak English and communicate with crew members.

EQUIPMENT CLEANING – INVASIVE SPECIES OF CONCERN

(a) The contractor shall ensure that any equipment intended for use during contract performance, either mechanical or otherwise, shall be free from invasive species of concern before use on this contract or any subsequent task order.

(i) Prior to commencing work on a project, the contractor shall advise the Forest Service of previous equipment cleaning measures and make equipment available for inspection upon request. Forest Service shall have 2 days, excluding weekends and Federal holidays, to inspect any equipment to ensure it is free of invasive species of concern. Equipment shall be considered clean when a visual inspection does not disclose seeds, soil, vegetative matter, and other debris that could contain or hold seeds of invasive species of concern. After satisfactory inspection or after such 2 day period, the contractor may proceed with work as directed by the Contracting Officer (CO)

(ii) If the contractor desires to clean equipment on National Forest land, such as at the end of a project or prior to moving to or through an area that is free of invasive species of concern, the contractor shall obtain prior approval from CO as to the location for such cleaning and measures, if any, for controlling impacts.

(b) The respective District Offices maintain a current list and maps of areas known by the Forest Service that are infested with invasive species of concern and are available upon request. The parties shall promptly communicate with one another with respect to description or designation of additional locations; discovery of locations of new species or new infestation; and addition of species to the list of invasive species of concern and any potential impact on contract operations.

PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND

IMPROVEMENTS

(a) The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place.

(b) The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site, and (2) on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

(c) The Contractor shall take every precaution necessary to prevent pollution of any stream. All streams shall be kept free of Contractor generated debris. Heavy equipment shall not operate within the streamside management zones as designated by the COR. The COR will designate stream crossings if required.

(d) Improvements such as fences, gates, property boundaries, corner monuments and trees that are marked or identified with paint, signs, tags, and/or blazes shall be protected by the contractor.

(e) Trees that are located adjacent to roads, fire lines, fences, private property, right-of-ways, or other structures and are designated for treatment shall be severed and felled so as not to damage, lean on, clog or otherwise obstruct existing structures or facilities.

(f) The contractor will notify the COR immediately of any damaged structures and repair damages that have resulted from the contractor’s operations.

(g) Lead off and wing ditch structures that have been constructed for system roads shall be protected.

TASK ORDER PERFORMANCE TIME

All task orders issued will include contract delivery or performance schedule in terms of specific calendar dates or contract time for completion. To facilitate timely inspections, the contractor shall inform the Government of the proposed operation schedule. The contractor shall notify the Government of schedule changes.

All work shall be performed during the time period of one-half hour after sunrise to one-half hour before sunset, Monday through Friday, unless time changes are approved by the COR or Inspector.

DOCUMENTATION

The contractor is required to maintain a Quality Control Plan and Safety Plan acceptable to the Government throughout the life of this contract.

INSPECTION AND TESTING

The contractor shall make available to the Government any records, materials, and other evidence regarding inspection, testing, and quality control for any work performed under this contract for examination, audit, or reproduction. This requirement also applies to any subcontracts under this contract. The Contractor shall notify subcontractors appropriately and insert this requirement in all subcontracts under this contract.

SECTION II – PERFORMANCE WORK STATEMENT TASKS AND CRITICAL SUBTASKS

Engine and personnel will be used for prescribed fire operations, to include but not limited to, ignition, holding and mopping up. Personnel must possess current National Wildfire Coordination Group (NWCG) qualifications for any job they perform on prescribed fires. Required Personal Protective Equipment (PPE) will be worn for job/task being performed. If administrative or weather conditions prevent the prescribed fire operations from being conducted, other prescribed fire project work (such as line preparation, etc.) may be substituted by the ordering unit. The contractor shall be required to complete one or all of the following tasks:

Work Environment: The work is performed in a forest and range environment in flat to steep terrain where surfaces may be extremely uneven, rocky, covered with thick tangled vegetation, etc. Temperatures are frequently extreme, both from the weather and from the fire. Smoke and dust conditions are often severe. The hazardous nature of the work requires that protective clothing be worn. The engines may be used on narrow, unimproved roads, off roads, rangeland and timbered areas and may be driven where there is brush growing on road shoulders.

Ignition: At the discretion of the Burn Boss or Ignition Specialist, personnel shall be utilized for ignitions along control lines and/or within the burn unit. Ignition will primarily be accomplished by use of hand held drip torches and/or fusee. Specifications for ignition are located in the approved Prescribed Fire Burn Plan. Personnel conducting ignitions are under the guidance of either the Burn Boss or Ignition Specialist.

Holding: Engines/personnel shall be used for holding which consist of patrolling and preventing prescribed fire from spreading outside the unit boundaries. In addition, any spot fires or slop-overs that have occurred would also be patrolled. Holding would be accomplished by Contractor Personnel: utilizing engines to spray water/foam, using hand tools and by patrolling. Holding personnel are frequently exposed to high concentrations of smoke and fire byproducts. Personnel with breathing difficulties should be made aware of possible effects created by the smoke.

Holding personnel work under the guidance of the Burn Boss, Ignition Specialist or Holding Specialist.

Mop-Up: Contractor engine/personnel would also be used for mop-up. Mop-up consists of the use of water, foam, dirt, hand tools and chainsaws too ensure that the fire is out within a specific distance around the parameter.

Chainsaws may be used for feeling and/or bucking of burning or hazardous trees and shrubs near the fire parameter.

Falling consist of cutting standing trees down. Bucking consist of cutting trees already on the ground into smaller, more manageable pieces. The specified distance to be mopped up is stated within the approved prescribed fire burn plan. Mop-up personnel are under the guidance of the Burn Boss or Holding Specialist.

Wildfire Declaration: In the event that a prescribed fire becomes uncontrolled and is declared a wildfire, the contractor shall be retained for up to one operational period at the awarded hourly/daily rate (see section G. Project Payments). If one operational period is exceeded after the wildfire declaration, the Government at its discretion may retain the resource and utilize the Vendor’s I-BPA for that particular piece of equipment, provided the vendor has a valid IBP-A under the Southern Area Water Handling Agreement.

Engine Requirements: Engine Types are classified as follows.

Engines shall be staffed as follows:

Contractor shall furnish wildland fire engines consisting of a minimum crew of:

1 each- Single Resource Boss Engine (ENGB) - All Types

2 each- Firefighter (FFT2 minimum) - Type 5

2 each- Firefighter (FFT2 minimum) - Type 6

Basic Engine Equipment Requirements:

A. Contractor engines/vehicles shall have external identification with business name clearly posted on the driver’s side door.

B. Equipment (vehicle, tank, pump, accessories and engine inventory) shall meet all standards established by specification or incorporated by reference and must be maintained in good repair by the contractor.

C. Engines shall be equipped with a single rapid shut-off valve that permits the attachment of 1 1/2” hose.

D. The engine shall be equipped with a live reel with a minimum of 200 feet of hard rubber hose or a basket containing a minimum of 200 feet of cotton/synthetic lined hose and be configured for immediate deployment from 0-200 feet. Hose shall be connected to the water supply. The hose shall not be less than 1” NPSH diameter with a combination nozzle. The 200 feet of hose specified here is in addition to the hose specified in the NWCG Fireline Handbook (Mar. 2004) under “Components” .

E. Engine shall have automatic foam proportioning capabilities.

Tank Requirements:

A. The water tank must be equipped with partitions that reduce the shifting of the water load

B. The tank shall be attached to the chassis frame or to a structurally sound flat bed in such a way to withstand pitch, roll and yaw of the load during on and off road operation without damaging the tank or other chassis components.

Pump Requirements:

A. The pump may be an auxiliary powered pump or a take-off power pump. If the pump is a gear type, a bypass or pressure relief valve shall be provided. The pump shall meet minimum capabilities for the type Engine as designed in the NWCG Fireline Handbook.

B. The pump, as mounted, shall be capable of drafting water from a water source located 10 feet vertical distance below the pump head through the required suction hose.

C. All engines will have pump and roll capabilities.

Accessories:

The following accessories are required if an auxiliary engine operates the pump.

1. Sufficient extra spark plugs to replace spark plugs in any engine auxiliary pump engines.

2. Wrench, adjustable, 10”.

3. Wrench, spark plug, unless the adjustable 10” wrench is suitable for use on the spark plug(s).

4. Pliers, slip joint, 6”.

5. 2 Quarts of oil, crankcase, if engine is the type that requires it.

6. Screwdriver, flat blade, 4 assorted.

7. Screwdriver, Phillips, 4 assorted.

8. Starter rope, if engine can be pull started.

9. Grease gun, if the pump requires periodic greasing.

Minimum Inventory:

Each engine shall have extra copies of compartment inventories as stated in the Interagency Standards for Fire and Fire Aviation Operations (Appendix R). Inventories quantities will change between engine types, i.e. length of 1” hose on a T-3 (800) vs. T-6 (300)

Programmable Radios:

Contractors shall one field programmable radio, with programming cables, per engine to facilitate the communications between overhead personnel and engine personnel. The radio must be capable of broadcasting a minimum of 1.5 watts. Radios can be analog or digital and capable of working in narrow band mode, modified radios are not acceptable. Digital radios may be required.

Frequencies will be installed by the hiring agency at the project location and removed after completion of the project or demob.

Contractors shall comply with all National Telecommunications and Information Administration (NTIA) rules and regulations on all federal agency projects and with all Federal Communication Commission (FCC) rules and regulations on all state agency incidents.

Vehicle Licensing Requirements:

A. All vehicles offered and used under this contract must be licensed and legally operable on all roads.

B. Operators of any motor vehicle having a GVRW of more than 26,001 pound must meet all Federal and

State Commercial Driver’s License (CDL) requirements for the state in which the operator is licensed.

C. Vehicle shall be equipped as follows

1. All vehicles shall be in sound mechanical condition with sufficient horsepower and mainframe configurations to ensure successful performance on roads and highways and in terrain described in 1.2.

2. All vehicles shall have operational 4-wheel/or multiple axle drive capability.

3. Tires shall have load ratings in accordance with GVWR. All tires must have sound side walls, body and tread. A minimum of 3/32” tread depth, all 4-wheel drive vehicles will have all season or mud and snow tread tires on each wheel.

4. 1 full size securely mounted spare tire with a minimum 3/32” tread.

5. 1 set of highway reflectors (3).

6. 1 Fire extinguisher, 4-B or C securely mounted and accessible.

7. Wheel Chocks (in compliance with SAE J348 standards).

8. An audible reverse warning device which can be clearly herd above the surrounding noise in the vicinity of the vehicle.

9. The manufactures Gross Vehicle Weight Rating (GVWR) or Gross Axle Weight Rating (GAWR) per axle shall not be exceeded when the vehicle is fully loaded and equipped. The GVWR plate or sticker should be on the driver’s side door post, driver’s door or in the glove compartment.

Personnel Requirements:

A. All personnel performing work under this contract shall carry a picture identification and qualification card for the effective year of the contract.

B. Contractor is responsible for documenting and tracking of NWCG training requirements, qualifications and work capacity physical testing.

C. English speaking verbal requirements: all crew and personnel must be able to communicate fluently in English for safe and effective performance.

D. All personnel must the work capacity test at the arduous level. This work requires strenuous physical exertion for extended periods of time. Employees may be tasked with hiking, climbing, chopping, throwing, lifting and frequently carrying 40+ pounds of gear over rough and un-even terrain.

Personal Protective Equipment (PPE):

The contractor is responsible for ensuring that all personnel arrive at the project sites with the proper PPE. PPE must be well maintained and used at all times.

A. Boots, leather 8” minimum height with lug type sole (no steel toe).

B. Hard Hat, plastic, class-B ANZI Z89.1 1986, OSHA approved, NFPA Standard 1997/98.

C. Glove, heavy duty leather.

D. Eye protection, ANZI Z87.

E. Hearing protection required.

F. Headlamp, with extra batteries and hard hat attachment.

G. Canteen or bottled water, minimum 2 quart.

H. Fire Shelter, National Fire Protection Association (NFPA) approved.

I. Nomex shirts (2), pants (2).

Intermediate Faller (FAL2):

The contractor shall provide a certified sawyer equipped with all materials, labor, equipment, tools, transportation, supervision, expertise, and other incidentals necessary to successfully perform chainsaw operations in support of prescribed fire. Personnel shall meet or exceed NWCG and Forest Service qualifications for Intermediate Faller (FAL2). You can find the requirements for the FAL2 positions beginning on page 78:

Saw Use: All personnel involved in chainsaw operations will wear required PPE serviceable chainsaw chaps to protect the legs from the thigh to below the knees. Chainsaws may be used in felling trees, clearing firelines, during mop-up and for clearing escape routes.

Training/Qualifications:

A. Personnel Qualifications:

The following are minimum requirement, for purposes of this contract, 4 positions are recognized- Single Resource Boss-Engine (ENGB), FFT1, FFT2 and Faller (FALA). Advanced Fire Fighter/Squad boss (FFT1) is included because it offers the required progression from FFT2 towards ENGB.

B. Training and Experience:

1. For each individual, the contractor shall supply certification showing the individual has met all the training and experience requirements as shown in exhibit A for the position they are performing when assigned. Current Red Cards, completed Position Task Books (PTBs), and/or copies of individual training certificates may be used to verify training and experience certification.

2. The Government reserves the right to reject any personnel who are not in full compliance with the specifications. Further if any member of the engine crew does not demonstrate an ability to perform the task as listed in the PTB for their position, that deficient performance may be cause for immediate release from the project.

3. The Engine Boss (ENGB) shall meet the training and experience requirements for Single Resource Boss-

Engine listed in exhibit A and the performance task in PMS 311-13 (PTB) for ENGB. Engine crew persons shall meet the above training requirements for Firefighter 1 or 2 listed in exhibit A and the performance task in PMS 311-15 (PTB) for FFFT2. The contractor shall maintain a complete set of records that validate the employee has met the above training and experience requirements and shall maintain Position Task Books for each employee who is certified after January 1, 1994, in one or more of the positions listed for this agreement.

4. In addition to the training requirements for ENGB, FFT1, and FFT2 positions listed in in Exhibit A, the contractor shall insure that all returning certified employees receive annually, “Standards for Survival” and “Using your Fire Shelter” (Video NFES#1568, 2001edition and booklet: “Your Fire Shelter” NFES 1570) (AND OR THE MOST CURRENT) refresher courses and training. The contractor shall maintain records that validate the employee have received this additional annual training.

5. Upon request the contractor shall provide complete records that document each employee’s training and qualifications for approval prior to adding any individual to the contract. Contractor employees who, as of 12/31/1993, completed the required training specified in Exhibit A for one or more positions listed for this contract, and have documentation to validate such training, and meet the experience required to maintain currency specified in Exhibit A, and have documentation to validate such experience for the position(s), can be considered qualified. The contractor shall maintain a complete set of records that validate employee completed the entire Exhibit A required training as of 12/31/93, and records that validate they meet the currency requirements listed in Exhibit A.

*NOTICE: Contractor employees who, as of 12/31/96, completed the required training and experience requirements as specified in PMS 310-1 October 1993 and who provide documentation to validate such training experience for the position(s), can be considered qualified. The contractor shall maintain a complete set of records that validate that the employee completed all of the required training per PMS 310-1 dated October 1993 required as of 12/31/96, and the employee meets the experience requirements listed.

Dispatching (Ordering)

A. Resources nearest to the project area (closest force) will be given first consideration to project orders.

B. Upon receiving an ordering call, the contractor has one hour to confirm availability.

Definitions:

Contractor- Person or firm with which the government enters into this contract for the accomplishment of any portion(s) of any work or service to be provided in this contract.

Subcontractor- Persons or firms with whom the contractor enters into a contract for the accomplishment of any portion(s) of any work or service to be provided in this contract.

Agency Cooperator- Tax based entities available through Cooperative Agreement to assist the government.

Contracting Officer- Government agent/employee responsible for the negotiation and award of contracts and agreements.

COR- Contracting Officers Representative. Government agent/employee responsible for assisting in the administration of this agreement.

Crewmember- Basic wildland firefighter used to control and extinguish wildland fire and works as a member of an engine crew assignment.

Government- the United States Forest Service.

IPT- Iron Pipe Thread

Lateral- A length of hose attached to a trunk line at an angle away from parallel to the tree trunk.

NH- National Hose Thread

Normal Wear and Tear- For the purpose of this contract, the term “normal wear and tear” shall include but not limited to:

A. Hose that burst due to excessive pressure (PSI), old age, or deterioration of material use.

B. Brush scratches on the body of a vehicle.

C. Puncture, tears, or destruction of tires and/or sidewalls due to rocks or sticks common to the working environment.

D. Wear on the paint on the inner and outer surfaces of the vehicle, top, sides, rails, gates and tailgate.

Includes chips from flying rocks and minor bumps and dents on both the sheet metal and the bumpers.

E. Clogged air and oil filters from dust

F. Damage to the power train.

NWCG- National Wildfire Coordinating Group. The interagency group responsible for wildland fire policy and coordination.

On Shift- Includes a- the time the contractor is actually working. b- Time under the direction and control of the government, including ordered standby.

On Order - Time when the contractor arrives at the incident, until released.

Ordered Standby- Time when a resource is held in a specific location fully outfitted and ready for assignment.

Operational Period- Equal to one shift. An operational period is considered to be 10 hours for project work.

Property:

A. Accountable Property: Items with a purchase price of $5000.00 or more; items the government considers sensitive (cameras, chainsaws, radios). This property is generally tagged with an agency identification number.

B. Durable Property: Durable properties are those non-accountable items that have a useful life expectancy greater than one project (tents, tools). This property may be marked with paint or etching.

C. Consumable Goods: Consumable goods are items normally expected to be consumed on the project (batteries, aspirin, and oils). This property is not marked.

D. Upon completion of assignment at a project all accountable and durable property (if provided) shall be returned to the government. The cost of consumable goods (batteries etc.) will be deducted from pay invoices.

Extent of Liability for Each Order:

Through joint review of planning, programming and budget documents, a mutually agreed upon work schedule will be developed for the orderly and timely accomplishment of the work in accordance with management requirements.

The constraints of time and money must be recognized and integrated into work schedules.

Immediate projects as well as, subsequent projects, will be secure by a Task Order (TO). The TO will set forth detailed requirements of the work and will provide for the payment of a mutually satisfactory fee based on the pre-approved rates and conditions of the contract.

Liability of the contractor: The contractor will comply with all federal, state and local laws, ordinances standards, regulations and obtain all necessary permits, inspections and approvals with respect to work contemplated herein. It is further understood and agreed that the contractor assumes all responsibility of the safety of his or hers employees, plant and materials.

Risk: The contractor shall assume all risk in connection with the execution of this contract, shall waive any claim against the United States of America (USA) for damages arising out of the performance of the work specified, and shall protect the USA from any claim which may result from damages or injury to property or persons in connection with the performance of this contract.

Progress reports: The contractor within 15 days of the issuance of a Task Order under this contract shall prepare and submit to the contracting officer, for approval, a feasible schedule showing the order in which the contractor proposes to do the work, the date on which he will start the different task involved and the contemplated dates for completing these task.

Contracting Officer’s Technical Representative(s) or COR(s) for this contract will be established at task order issuance.

PROJECT PAYMENTS

Important Terms:

On shift – Included: a) time the Contractor is actually working, and b) time under the direction and control of the Government, including ordered standby.

On Order – Time beginning when the Contractor arrives at the Project until released.

Basis of payment – The project daily rate in the schedule shall be based on a ten-hour shift. All shifts greater than ten hours will be calculated using daily rate plus the hourly rate times the actual number of hours worked in excess of 10.

Rates of payment – Rate of payment for equipment hired with operator(s) includes all operator(s) expenses.

Payment for equipment and operator (s) furnished will be at the rates specified, except as provided in the non-compliance clauses, incidental briefing and unacceptable performance clauses of this contract.

For each calendar day the resource is on shift the Government shall pay as follows:

A. Less than five (5) hours; one-half the daily rate.

B. Five (5) to Ten (10) hours; the daily rate.

C. Greater than ten (10) hours; the daily rate plus the hourly rate times the actual number of hours worked in excess of 10.

Mobilization/Demobilization (MOB/DEMOB)

Mobilization and demobilization fees are not authorized for this contract. These costs are considered incidental and are to be incorporated in the unit price as bid on the schedule of items.

Non-Compliance:

Payment will not accumulate during any operational period when equipment is in a non-compliant status. The daily rate will be reduced by 1/8th for each hour or portion thereof when the equipment is in a non-compliant status.

Periods of noncompliance will be accumulated for the day and rounded up to the next full hour to determine the amount to be deducted from the Daily Rate (for that day). If the equipment is non-compliant for part of a shift but becomes compliant during the same shift the Government has the option to return the equipment to work or release it for the remainder of the shift. If released, the equipment will be considered in non-pay status from the time of non-compliance until the beginning of the next shift. If the government returns the equipment to work during that same shift, all time worked in that shift shall count towards the daily rate.

The following exception applies: Short Crew: At any time a Contractor is short one crewperson of a three-person crew, (Type 5) the Government may use the equipment or refuse to use it. If the Government places the short crew/equipment on shift a 20% deduction in the daily rate will be made. If during a shift any one crewperson on a three-person engine becomes sick, injured, or is otherwise unable to work no deductions shall be made for that shift.

No payment will be made for equipment when less than the NWVG minimum crew compliment is met.

Incidental Items

No additional payment will be made for costs associated with shift briefings, checkout, preparation/maintenance, and invoice reconciliation. These costs are considered incidental and are to be incorporated in the unit price as bid on the schedule of items.

Unacceptable Performance

The Government shall incur no obligation for payment for 1) unauthorized withdrawal of equipment, or 2) unacceptable performance or behavior.

Remain Overnight Allowance (RON)

The Government will make a determination whether the RON is allowable. When the project check-in is 50 miles or greater from the Contractor’s point of origin, or if travel time to reach the project exceeds 10 hours in a 15-hour day, the RON may be allowed. Also, when the Government determines the cost of commuting (i.e., the difference in mob/demob fees) would exceed RON, the Government may either provide a campsite or pay a flat rate of $70.00 per person, per night.

Campsite- campsites will be provided by the government if available. If no camp sites are available the RON will be paid.

Deductions

The Contractor shall furnish all services, supervision, equipment, supplies, transportation, and trained personnel necessary to meet these specifications. To insure continued safe, efficient service at the project, the Government may issue accountable and durable property and consumable goods. The cost of all consumable goods will be deducted from payment to the Contractor. Upon completion of assignment at the project all accountable and durable property shall be returned to the Government.

Invoicing Process

Shift Tickets – The Emergency Equipment Shift Ticket (OF-297) will be used to record hours worked. Upon completion of each operational period the Contractor’s shift tickets must be approved by an appropriate Government official. Shift tickets shall contain the following:

1. Name of Contractor and Mailing Address

2. Contractor’s Tax Identification Number

3. Task Order Number

4. Date of Service

5. Description of the Services Performed, Quantity and Unit Price

6. Approval of Government official – Both the Government and the Contractor will retain two (2) each original copies of the Emergency Equipment Shift Tickets. When submitting an invoice to the Government, the Contractor shall submit an original shift ticket copy for each operational period worked.

7. The name, title, phone number, and mailing address of a person to notify in the event of a defective invoice.

Invoices submitted without all the elements of a proper invoice will be returned and will result in delayed payments.

The Contractor is responsible for submission of the invoices. The "Submit Invoice-to" address for USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). This platform is managed by the U.S. Department of Treasury and additional information is available at this website https://www.ipp.gov/index.htm.

Rest and Recuperation (R&R) does not apply to this contract.

PERFORMANCE EVALUATIONS

The contractor’s performance shall be documented on the Fire Crew Performance Rating Form (ICS-224) or other comparable form, which shall be completed at the project. A copy of the evaluation will be placed in the project documentation folder and a copy will be forwarded to the Contracting Officer issuing the delivery order.

QUALITY ASSURANCE SURVEILLANCE PLAN

This Quality Assurance Surveillance Plan (QASP) was developed pursuant to the requirements of the Performance Work Statement (PWS). This plan sets forth procedures and guidelines that will be used in evaluating the technical performance of the contractor.

A. PURPOSE OF THE QASP

The QASP is intended to accomplish the following:

Define the roles and responsibilities of participating government officials and the contractor;

Identify the types of work to be performed and the inspections to be performed to validate adequacy;

Describe the evaluation methods that will be employed by the government in assessing the contractor’s inspection program and performance to the quality/performance standards required for each task;

Provide copies of the contractor’s inspection records and Government quality assurance monitoring forms that will be used by the government in documenting and evaluating the contractor’s performance;

Describe the process of performance documentation.

The contractor is responsible for performing inspection services pursuant to the inspection clause and for providing and maintaining the inspection forms, approved by the government, to perform the contractor’s inspection services.

The contractor has represented themselves, to be responsible for meeting the prescribed quality/performance standards in the statement of work.

B. ROLES AND RESPONSIBILITIES OF GOVERNMENT OFFICIALS

The following government officials will participate in assessing the quality of the contractor’s performance. Their roles and responsibilities are described as follows:

The Contracting Officer’s Representatives (COR) will be responsible for monitoring, assessing, recording, and reporting on the technical performance of the contractor on the schedule of inspections submitted by the contractor and approved by the government. The COR/Inspector, if the latter is assigned to the project, will either witness the contractor’s performance of the inspections performed by the contractor or will evaluate the contractor’s inspection results as to documented findings relative to meeting the standards for each task/subtask within the statement of work. The COR will have primary responsibility for completing quality assurance monitoring forms which will be used to document the inspection and evaluation of the contractor’s work performance.

The Contracting Officer (CO) will have overall responsibility for overseeing the contractor’s performance.
