United States Department of Agriculture Limited Source/Brand Name Justification

FAR 13.106-1(b)(1) – Simplified Acquisitions

1. Identification of the agency and the contracting activity.

2. Description of supply or service required to meet the agency’s needs.

Water quality automated collection sampling and logging equipment that is compatible with existing network of ISCO equipment that has already been implemented as part of a long-term water quality research project.

3. The rationale or circumstances for limiting competition.

There is currently an extensive network of automated Teledyne ISCO 6712 portable samplers and Teledyne ISCO signature bubblers/flowmeters and data loggers. Expanding or upgrading the network with two new locations using a different manufacturer would not be feasible. Teledyne ISCO 6712 portable samplers and signature bubbler flowmeter systems are needed to maintain telemetry and communications within the watershed and among the sampling locations.

4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

An internet search was conducted for Teledyne ISCO competitors, which yielded limited results.

Four other companies were found, three of them (

) are based outside the United States and the fourth ( ) is based in the United States but most manufacturing is outside the United States. In addition, sources sought notice (12505B24Q0321) to find potential sources of equipment that is compatible with the existing equipment was posted on SAM from August 12, 2024 through August 16, 2024. Two responses were received; however, neither company provided enough information to allow the Government to determine if they would be capable of meeting the requirement.
