ADDITIONAL INFORMATION
Be sure to read and review all of the attachments and to complete any and all additional documentation required as part of your quote submission. Of critical importance is to review the Statement of Work (SOW) as it contains the technical requirements.
Vendors are to submit their quote in accordance with FAR 52.212-1. The applicable FAR/AGAR clauses and provisions are included in the attachments. Vendors responding to this announcement shall submit their quote along with all other requested and required documentation (such as completed FAR/AGAR clauses and provisions) that are to be included as part of all vendor’s responses.
Failure to demonstrate compliance with all instructions may constitute sufficient cause to reject a quote without further discussions. All responsible sources may submit a quote which will be put into considered for award. Quotes should include any and all fees, charges, and/or surcharges.
This will be a tax-exempt purchase. The Government anticipates making one Firm-Fixed Price award.
*Domestic Products (USA Made): To be considered a domestic product, the product must be manufactured within the United States AND meet the domestic content test. For 2023, the cost of its components mined, produced, or manufactured in the United States must exceed 60 percent of the cost of ALL its components to meet the domestic content test. For 2024 – 2028, the percentage will be 65 percent. For 2029 onward, the percentage will be 75 percent. See FAR 25.101(a)(2) for more details.
The United States means the 50 States, the District of Columbia, and outlying areas.
**Nondomestic Products (Foreign Made): To be considered a nondomestic product, the product must be manufactured outside the United States OR not meet the domestic content test. For 2023, if the cost of its components mined, produced, or manufactured outside of the United States exceeds 40 percent of the cost of ALL its components the product fails the domestic content test.
For 2024 - 2028, the percentage will be 35 percent. For 2029 onward, the percentage will be 25 percent. See FAR 25.101(a)(2) for more details.
Any location outside of the United States means a location other than the 50 States, the District of Columbia, and outlying areas.
The country of assembly is NOT the country of manufacture. Products assembled in the USA do NOT qualify as domestic products (USA Made) unless the cost of its components mined, produced, or manufactured in the United States exceeds the applicable percentage.
As the Buy American Act applies, a statement or certification from the manufacturer as to the manufacturing street address or country of origin for the quoted product is preferred.

The domestic content test has been waived for commercially available off-the-shelf (COTS) items, except a product that consists wholly or predominantly of iron or steel or a combination of both (excluding COTS fasteners). See FAR 25.001(c)(1), FAR 25.100(a)(5), and FAR 25.101(a)(2)(ii) for more details.
Trade agreements do NOT apply to solicitations set aside for small businesses and/or have a total value under $183,000.00. See FAR 25.1101(c)(1), FAR 25.401(a)(1), and FAR 25.402 for more details.
The FAR/AGAR clauses and provisions constitute the terms and conditions for submitting a quote in response to the solicitation as well as the terms and conditions of the anticipated award.
The FAR/AGAR provisions apply to the solicitation and submission of quotes. The FAR/AGAR clauses apply to the solicitation and submission of quotes as well as to the resulting award. The FAR/AGAR clauses will be included as part of the resulting award. Please review ALL of the FAR/AGAR clauses and provisions included below. The FAR clauses 52.212-4 and 52.212-5 as well as the FAR provisions FAR 52.212-1 and FAR 52.212-2 are applicable to this solicitation.
The clauses listed under FAR 52.212-5(a) are applicable to all solicitations. The clauses marked with an X under FAR 52.212-5(b) and (c) are applicable to this solicitation. The evaluation criteria of FAR 52.212-2 is outlined in a following paragraph.
It is strongly advised that a completed copy of the FAR provision FAR 52.212-3 be included with the submission of all quotes (especially if the applicable NAICS or a NAICS with the same or lower small business threshold is not included in a vendor’s SAM registration). A copy of FAR 52.212-3 is provided in the attachments.
Pursuant to FAR 52.212-2, the criteria for evaluation and basis for award will be Lowest Price, Technically Acceptable (LPTA). Technical acceptable is define as meeting ALL of the technical requirements identified on the Statement of Work and reiterated in the solicitation description.
The Government intends to make one Firm-Fixed Price award based on the lowest price technically acceptable (LPTA) quote received. "LPTA" means the best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price. The lowest priced quote will be evaluated first; if NOT found technically acceptable, the next lowest priced quote will be evaluated, and so on until a technically acceptable quote is identified. The Government will NOT review higher priced quotes if the lowest (or a lower) priced quote is determined to be technically acceptable.
For solicitations where quotes are received for domestic and nondomestic products, the quoted prices will be compared after increasing the quoted price(s) for all nondomestic products by 20% for quotes from large business vendors and/or 30% for quotes from small business vendors. See FAR 25.106 for more details and FAR 25.504-1 for examples.

NO calls with questions will be accepted. No questions will be answered after this date unless determined to be in the best interest of the Government. Answers to questions cannot be provided as a vendor asks them to insure no vendor is given an unfair advantage. The answers to all questions asked will be posted in an amendment to the solicitation on SAM.gov after the aforementioned quote submission deadline for questions has passed.

Verbal quotes made by phone call, quotes submitted by USPS mail, quotes submitted in the body of an email, OR quotes submitted ONLY on company letterhead WITHOUT a completed copy of the above form may NOT be accepted. Failure to meet the quote submission requirements may result in the quote being deemed unresponsive and NOT being put into consideration for award. Please ensure your quote will be current and that the price quoted will NOT expire for a minimum of 30 days or until September 30, 2023.
Be absolutely certain to include the solicitation title and/or number in the email subject, body, and/or in the name(s) of the attachments. Failure to do so may result in the quote being deemed unresponsive and NOT being put into consideration for award.
Only quotes submitted in response to the posted solicitation can be put into consideration for award. Any quotes that were provided or obtained by someone during the market research phase (such as in response to a sources sought) CANNOT be put into consideration for award.
To be eligible to be put into consideration for award, all vendors who respond to a posted solicitation must have a current and active registration in the System for Award Management (SAM) at the time they submit their quote. NO EXCEPTIONS. Vendors who are not currently registered in SAM or whose SAM registration is inactive when they submit a quote will be disqualified and NOT put into consideration for award. A current and active SAM registration is also necessary for modifications to be made to any existing awards, orders to be placed against any existing contracts, and for payments to be made for products delivered or services rendered on prior awards. It is critical to maintain a current and active SAM registration. Be certain you have a current and active SAM registration before submitting a quote in response to a solicitation.
If you are NOT currently registered in SAM or your account has become inactive, please register or reactivate your account and make sure it has become active prior to submitting a quote. Use of the Data Universal Numbering System (or DUNS) number as a vendor’s entity identifier ended on April 4, 2022. A Unique Entity Identifier (UEI) number is now required in order to register in SAM. Vendors must also include their UEI# on ALL quotes. Vendors should also include their SAM status as well as the business size and socio-economic status(es) for the applicable NAICS on their quote.
For solicitations set aside 100% for small business concerns, in order for a quote to qualify and be put into consideration for award the vendor must qualify as a small business concern for the

NAICS specified as being applicable to the solicitation. This means the vendor must be under the specified NACIS small business threshold either with fewer employees than the threshold OR income earned from business completed under the NAICS being lower than the threshold. Simply being registered in SAM as a small business concern for any NAICS is NOT sufficient to qualify as a small business for a specific solicitation. A vendor must qualify as a small business for the specific NAICS applicable to the solicitation. Vendors can be registered in SAM as small business concerns for some, but not all of the NAICS applicable to their business. Vendors can also be registered in SAM for some, but NOT all of the NAICS they qualify as a small business concern for. If a vendor does NOT qualify as a small business concern for the specified NAICS, despite being registered as a small business concern for other NAICS, then their quote will be disqualified and NOT put into consideration for award. For solicitations set aside 100% for small business concerns, be certain you qualify as a small business concern for the specified NAICS code before preparing and submitting a quote in response to a posted solicitation. If your SAM registration does not contain a certification for the NAICS specified in the solicitation, please update your SAM account to include the NAICS.

The submission and payment of invoices on the resulting award will be made through the Invoice Processing Platform (IPP). Vendors must be currently registered or register in IPP in order to be able to submit and receive payment on invoices for the resulting award. Invoices that are submitted by any means other than through IPP will be rejected. Payment terms will be NET 30 from the date an invoice submitted in IPP is approved. Approval of an invoice submitted in IPP will not be made until all products are delivered and/or services are rendered. An invoice submitted before product deliver and/or service completion will be rejected. An invoice may be rejected if the products delivered are damaged, items are missing, or the product(s) do not meet the requirements stipulated in the award. An invoice may also be rejected if services have yet to be rendered, the services rendered were deemed unsatisfactory, or the services provided do not meet the requirements stipulated in the award. Rejected invoices may be resubmitted in IPP for approval after any issues with the product or service have been resolved. Vendors must be certain all products have been delivered and all services rendered with no issues noted before submitting an invoice in IPP. All invoices for an award should be submitted in IPP within a year of the final delivery or completion date.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Statement of Work Differential Scanning Calorimeter (DSC)
Scope:
Delivery, installation, and familiarization of a fully automated differential scanning calorimeter (DSC) for analyzing changes in heat flow, temperature and reaction time associated with melting, freezing and other phase transitions in fats, oils, and their products. The instrument will be capable of analyzing glass transition, melting point, polymorphic transitions, crystallization, freezing point, oxidation and curing reactions and specific heat.
A DSC measures heat flow by scanning two pans under identical conditions. One of the pans is empty (the reference pan) and the other pan contains the sample.
