SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 SCOPE OF CONTRACT

Project Summary:

The Medicine Bow-Routt National Forests and Thunder Basin National Grassland intends to issue a solicitation for the removing of temporary ACROW bridge single reinforced single land truss bridge and install a single span steel beam superstructure with timber running planks and micropile foundation on National Forest System Road (NFSR) 792.1 -0.1 over South Fork Michigan River near Gould in Jackson County, Colorado (latitude 40.501970°, longitude - 106.022007°).

This visit is being conducted prior to solicitation as the site is expected to be inaccessible prior to the actual solicitation and award of the project. This is not a solicitation and in no way commits the Government to award a contract. The Government does not intend to award a contract(s) based solely on this site visit nor does it intend to pay for any costs incurred in response to this announcement. The intent of this notice is to ensure that prospective vendors may see the site and proposed work prior to heavy snowfall and issuing the solicitation.

Michigan River Bridge Project:

The work anticipated but is not limited to traffic control; dewatering and rewatering of the channel; culvert removal; clearing and grubbing; soil erosion and sediment control; installation of a single span steel beam superstructure with timber running planks and micropile foundation; construction of minor channel structures and bank protection. This project will be installing construction waring (traffic control) signs. The road will be closed during construction.

The delivery location for temporary ACROW bridge is located at the Forest Service Yard in Steamboat Spring, Colorado (latitude 40.489571, longitude -106.847317). The contractor will be responsible for the transport and delivery of the existing bridge to the Forest Service Yard.

The work anticipated under any contract resulting from the solicitation will be started as soon as conditions on-the-ground are favorable for the prosecution of the work next spring (estimate early June 2022 starting date).

C.3 MAGNITUDE OF CONSTRUCTION PROJECT

Between $250,000 and $500,000

C.4 PERIOD OF PERFORMANCE

The project contract duration is estimated to have period of performance [POP] of 365 calendar days from the issuance of the Notice to Proceed [NTP].

Contract time includes delays for weather, locating and transporting supplies and materials, and final site cleanup.

Construction shall be completed by September 2023.

C.5 TECHNICAL SPECIFICATIONS

A. Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects. FP-14 U.S. Department of Transportation, “Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects: FP-14 U.S. Customary Units,” hereafter referred to as FP-14, are included by reference and are applicable to this project and are hereby made a part of this solicitation and any resultant contract. The specifications are included by reference and the full specifications are available at the following website:

B. Forest Service Supplemental Specifications [FSSS] Forest Service Supplemental Specifications [FSSS] that augment and/or amend FP-14 is included in this solicitation and resulting contract. Included as Attachment 1. Refer to Section J.

C. Drawings-Plans Project Plans for MICHIGAN RIVER BRIDGE REPLACEMENT sheets 1-17. Includes as Attachment 2. Refer to Section J.

The requirements contained in these listed specifications are hereby made a part of this solicitation and any resultant contract.

Note that the specification list includes the major specifications applicable to this project. Other specifications referred to within these specifications (even though not specifically listed herein) are also fully applicable to this request for proposals and any resultant contract/task order.

A detailed “Work Schedule Plan” and “Traffic Plan” will be required prior to start of work.

C.6 EQUIPMENT AND MATERIALS

All equipment shall be suitable for the purpose intended and shall meet all requirements of the Occupational Safety and Health Act. The Contracting Officer may order the removal or require the replacement of any unsatisfactory equipment.

All vehicles and machinery operating on or from the traveled way or road shoulder shall have flashing lights or rotary beacons operated continuously while work is in progress. All equipment shall be equipped with a standard slow-moving vehicle emblem. Truck headlights shall be on while operated. Backup warning devices shall be required on self-propelled equipment in excess of 8,000 pounds gross vehicular weight. Vehicles and machinery not currently used in maintenance operation shall be parked off the traveled way at the approved location to minimize interference with normal use of the road.

C.6.1 Equipment Cleaning & Weed-Free Certification To prevent the introduction of seeds of noxious weeds onto National Forest land, the Contractor shall ensure all equipment moved onto National Forest land is free of soil, seeds, vegetative matter, or other debris that could contain or hold seeds. Contractor shall employ whatever cleaning methods necessary to ensure compliance with this provision and shall notify the Forest Service prior to moving each piece of equipment onto National Forest land. Upon request of Forest Service, arrangements will be made for Forest Service to inspect each piece of equipment prior to being moved onto National Forest land. If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.

If operating in areas known to contain noxious weeds, the contractor shall ensure that prior to moving from one on-forest location to another part of the project area, all off-road equipment is free of soil, seeds, vegetative matter, or other debris that could contain or hold seeds.

Contractor shall certify in writing to the Contracting Officer that off-road equipment is free of noxious weeds prior to each start-up of operations and for subsequent moves of equipment to other project areas. Measures taken to ensure that off-road equipment is free of noxious weeds will be identified. “Off-road equipment” includes all equipment operating off paved roadways. A Current list of noxious weeks of concern to Forest Service is available at the Forest Supervisor’s office. Contractor shall employ whatever cleaning methods are necessary to ensure that off-road equipment is free of noxious weeds. Equipment shall be considered free of soil, seeds, and other such debris when a visual inspection does not disclose such material.

Disassembly of equipment components or specialized inspection tools is not required.

Contractor shall notify Forest Service at least 24 hours prior to beginning of work in area designated as a noxious weed area, unless otherwise approved by CO. Notification shall include the location of the equipment’s most recent operations. If the prior location of the off-road equipment cannot be identified, Forest Service may assume that it was infested with noxious weed seeds. Upon request by the Contracting Officer, the Contractor must make arrangement for inspection of each piece of off-road equipment prior to it being placed into service. If

Contractor desires to clean off-road equipment on National Forest land, such as at the end of a project or prior to moving to a new unit that is free from noxious weeds, Contractor and Contracting Officer shall agree on methods of cleaning, locations for the cleaning, and control of off-site impacts, if any. New infestations of noxious weeds within the project area or on the haul route, shall be promptly reported by the Contractor or Forest Service.

All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.

Contractor shall clean all vehicles and equipment before entry into the District unless Forest Service waives the cleaning requirement in writing. Thereafter, all vehicles and equipment that leave the district must be cleaned prior to their reentry unless waived by the Forest Service. All cleaning of vehicles or equipment shall be done at sites agreed to by Forest Service and the Contractor. Forest Service shall inspect all equipment prior to entry, as appropriate and determined necessary. Cleaning shall include the removal of soil by steam cleaning or use of high-pressure water spray.

Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer at least five days in advance of moving equipment in so that arrangements can be made for inspection.

All heavy equipment shall be cleaned and thoroughly inspected prior to mobilization to the work site. Once on site all equipment shall be inspected daily and all visible oil, grease, and hydraulic fluid will be removed. Needed repairs will be implemented immediately before resuming work.

C.6.2 Storage.

The contractor’s material and equipment storage site shall be determined at the pre-construction meeting. The area shall be kept clean and free of litter.

The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer. The Government is not responsible for loss of or damage to materials or supplies stored on-site during performance of this contract.

C.6.3 Loss, Damage, or Destruction.

Equipment Furnished with Operator. The Government shall not be liable for loss, damage, or

Solicitation No: 1240LT22R0056 Page 11 of 56 destruction of equipment furnished under this contract except for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.

Other. Even though this contract may provide for performing services at the direction of Government personnel, the contract is not for personal services, and neither the Contractor nor his or her personnel are Government employees. The Government assumes no liability for injury occurring to Contractor personnel or to third parties, or for loss, damage, or destruction involving third parties' property as a result of the Contractor's operation. Except that the Government is liable for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) acting within the scope of their employment.

C.7 LANDSCAPE PRESERVATION

The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements.

A. The Contractor shall confine operations to within clearing limits or other areas designated in contract

B. documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Material which falls outside of these limits shall be retrieved, disposed of, or incorporated in the work as directed by the Contracting Officer, and damage to vegetation or structures outside the clearing limits shall repaired as directed by the Contracting Officer.

C. Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems and impoundments (lakes, reservoirs, etc.)

D. Pollutants such as fuels, lubricants, bitumen, raw sewage, and other harmful materials shall not be discharged into or near rivers, streams, and impoundments or into natural or manmade channels leading thereto. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

E. Mechanized equipment shall not be operated in live streams without written approval by the Contracting Officer.

F. Prevention of Oil Spills – If the Contractor maintains storage facilities for oil or oil products on project Area, appropriate preventive measures shall be taken to ensure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual States.

G. If the total oil or oil products storage exceeds 1320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare a Spill Prevention Control and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112) including certification by a registered professional engineer.

C.8 SPECIAL CONDITIONS OR RESTRICTIONS AFFECTING THE WORK

C.8.1 Local Disposal Site Excess or unsuitable material excavated can be disposed at locations identified by the COR in the field.

C.8.2 Existing Physical Conditions The indications of physical conditions on the drawings and in the specifications are the result of site investigations and surveys performed by the Government. It is the Contractor’s responsibility to verify all dimensions and conditions related to this project/contract before proceeding with the work. All dimensions must be verified and/or determined in the field.

Protect all improvements including existing culverts, signs, and roadway from damage during construction.

C.8.3 Weather.

Low temperatures at the project sites range from temperatures of less than 5 ºF in December and January to lows of 45 ºF in July and August. High temperatures range from 25 ºF in December and January to over 70 ºF in July and August. The annual precipitation at the project sites varies from less than 12 inches per year including snow fall in the valley to several feet of snow in the mountains. Winter snowstorms and freezing temperatures will occur during the winter months that result in a winter project shutdown at higher elevations. Icy conditions on local roads and highways can occur during the fall, winter, and spring. Highway curves in shaded areas will remain covered with ice or frost for weeks. The project location may have a winter shutdown.

Adverse Weather. When the Contracting Officer or Contracting Officer’s Representative [COR] determines that adverse weather has made access too dangerous or that continued vehicular travel would cause unacceptable damage.

Weather conditions suitable for road access are normally expected from June through October. Snow, sometimes heavy, is normal throughout the winter, with periods of rain during warmer weather.

C.8.4 Hours of Operation / Work Hour Limits.

Construction activity / contractor’s hours of operation shall be limited to Sunrise to Sunset No work will be allowed on federal holidays without written approval by the COR and CO. Dogs and pets are not allowed on the project site at any time.

C.8.5 Permits, Notifications, and Approvals.

The Contractor shall apply for and obtain all required permits and approvals from state or local authorities having jurisdiction over the work to be performed under this Statement of Work and associated task order award.

Highway Permits. Contractor is responsible for securing any overload or over width limit permits required for the transport of materials or equipment to the project site. The Contractor is responsible for conducting a thorough reconnaissance of all routes leading to the site.

Burning Permits. Contractor is subject to all rules and regulations governing the onsite burning of slash and other debris. Contractor shall obtain a burning permit from the jurisdiction having control over burning.

C.8.6 Archaeological or Historical Sites Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC 433) --will be identified for the contractor before work commences.

C.8.7 Project Site Clean-up Project site cleanup includes the removal and proper disposal of all construction trash, debris, and residue off of National Forest Land.

All spills of petroleum products including leak spots from parked vehicles shall be removed and properly disposed according to all Local, State, and Federal rules, regulations, and laws governing such disposal.

During the work, the Contractor is required to furnish dumpsters or other trash receptacles and to empty such containers either as they become full or weekly, whichever is more frequent. The Contractor shall not place materials of any kind into private or Government trash bins or dumpsters.

All non-salvageable items and trash shall be hauled off the grounds and disposed of in accordance with applicable state and local regulations. Items shall be transported in tarp-covered and closed vehicles.

C.8.8 Other / General.

Water. TBD.

Toilets. No toilet or shower facilities are available on site. Contractor shall provide toilet facilities for its employees.

Camping. Camping is not permitted in US Forest Service campgrounds. Contractor may be permitted to camp elsewhere on US Forest Service land. Contractor must request a permit from the Ranger District Office. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit.

Contractor may use a self-contained travel trailer or recreational vehicle to camp on National

Forest System lands near the project sites subject to the approval of the Contracting Officer. All waste material must be transported off-site to a station equipped to handle such waste.

Site Security. Contractor is responsible for the Contractor's equipment and materials supplied to the site. All equipment not equipped with a key lock system shall be secured in such a manner as to make it inoperable to the average person at the end of each working day. All hand tools and other equipment shall be secured at the end of each working day. On Fridays all construction debris, trash, and refuse shall be properly stored in dumpsters or trash bins or removed from the site.

Protection of Resources. Contractor shall thoroughly clean all equipment prior to delivery to the project site to remove weeds, mud, grease and oil buildup from the tires, wheels, tracks, engines and engine compartments, and other surfaces. Spills of petroleum products and other hazardous substances shall be reported, contained, and removed in accordance with all applicable rules, regulations, and laws. Contractor shall submit a project spill response plan at the pre-work meeting for review by the Contracting Officer.

Protection of Existing Improvements. Contractor shall repair any roads damaged by their operations in accordance with FAR 52.236-9, and at the direction of the Contracting Officer.

Safety, Emergency Communications and Evacuation. Contractor is responsible for the safety of the Contractor's employees including Subcontractors employees, Government employees associated with the project, and any visitors to the site both Government and private. The Contractor shall submit a project safety plan to the Contracting Officer for review prior to commencement of Work. The project safety plan shall comply with the appropriate California OSHA and Federal OSHA rules and regulations and must include a medical evacuation and emergency communications plan.

All shipments of materials, equipment and/or supplies shall be addressed to the Contractor and not to the Government.

The contract number is a unique identifier to purposely and permanently represent an awarded project. The Government issued contract number is to be referenced on all official communication starting upon notice of award.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H.1 CLAUSES

452.228-71 INSURANCE COVERAGE (NOV 1996)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance.

Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

452.236-72 USE OF PREMISES (NOV 1996)

(a) Before any camp, quarry, borrow pit, storage, detour, or bypass site, other than shown on the drawings, is opened or operated on USDA land or lands administered by the USDA, the Contractor shall obtain written permission from the Contracting Officer. A camp is interpreted to include a campsite or trailer parking area of any employee working on the project for the Contractor.

(b) Unless excepted elsewhere in the contract, the Contractor shall (i) provide and maintain sanitation facilities for the work force at the site and (ii) dispose of solid waste in accordance with applicable Federal, State and local regulations.

452.236-73 ARCHAEOLOGICAL OR HISTORIC SITES (FEB 1988)

If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

452.237-74 KEY PERSONNEL (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: Project Foreman, or On-Site Supervisor

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

H.2 OTHER REQUIREMENTS

CONTROL OF EROSION, SEDIMENTATION, AND POLLUTION

(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other

(c) Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.

(a) Definitions. As used in this clause-

Commercially available off-the-shelf (COTS) item-

(1) Means any item of supply (including construction material) that is-

(i) A commercial product (as defined in paragraph (1) of the definition of “commercial product” at Federal Acquisition Regulation (FAR) 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace;

and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

"Construction material" means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work.

The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

Cost of components means-

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

Domestic construction material means-

(1) For construction material that does not consist wholly or predominantly of iron or steel or a combination of both-

(i) An unmanufactured construction material mined or produced in the United States;

or

(ii) A construction material manufactured in the United States, if-

(A) The cost of its components mined, produced, or manufactured in the United States exceeds 55 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic. Components of unknown origin are treated as foreign; or

(B) The construction material is a COTS item; or

(2) For construction material that consists wholly or predominantly of iron or steel or a combination of both, a construction material manufactured in the United States if the cost of foreign iron and steel constitutes less than 5 percent of the cost of all components used in such construction material. The cost of foreign iron and steel includes but is not limited to the cost of foreign iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the construction material and a good faith estimate of the cost of all foreign iron or steel components excluding COTS fasteners. Iron or steel components of unknown origin are treated as foreign. If the construction material contains multiple components, the cost of all the materials used in such construction material is calculated in accordance with the definition of "cost of components".

Fastener means a hardware device that mechanically joins or affixes two or more objects together. Examples of fasteners are nuts, bolts, pins, rivets, nails, clips, and screws.

Foreign construction material means a construction material other than a domestic construction material.

Foreign iron and steel means iron or steel products not produced in the United States.

Produced in the United States means that all manufacturing processes of the iron or steel must take place in the United States, from the initial melting stage through the application of coatings, except metallurgical processes involving refinement of steel additives. The origin of the elements of the iron or steel is not relevant to the determination of whether it is domestic or foreign.
