This is a combined synopsis/solicitation for commercial goods and commercial services prepared in accordance with the format in FAR subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation will not be issued. The solicitation number is 12405B24Q0288 and is issued as a request for quotation (RFQ). This solicitation document incorporates those provisions and clauses in effect through Federal Acquisition Circular 2024-05. This will be a small business set-aside. The NAICS code is 334516, Analytical Equipment Manufacturing with a small business size standard of 1,000 employees.

The USDA, ARS, in Charleston, SC has a new requirement for a medium-sized sterilizer/autoclave unit, to include:

• Medium-sized sterilizer/autoclave unit (Steris AMSCO 630LS, for example)

• Electric Steam Generator

• Descaling unit

• Auto Flush kit

• Installation of all components to include making all air, steam, water & drain utility connections from building termination to the equipment, per manufacturer’s specifications, by a licensed and certified installer (preferably by a manufacturer certified technician) so as not to void any manufacturer’s warranties.

• A site visit is scheduled for July 15th at 11 am ET.

DELIVERY DUE DATE: The Government requires delivery and install on or before 150 ARO, however, each offeror shall include their proposed delivery schedule as part of their quotation.

Please ensure all email correspondence includes the solicitation number in the subject line. Emails without the RFQ number in the subject line may not be seen, read, and /or reviewed and therefore disqualified from consideration.

The government anticipates award of a firm fixed priced contract resulting from this solicitation to the responsible offeror whose offer conforms to the specifications that will be the most advantageous to the government in accordance with FAR 13.106-2.

Responses shall include a quote on company letterhead, to include vendor’s SAM.gov UEI number, technical specifications, descriptive material, product country of origin, unit price per item, capabilities of the offeror’s equipment, total price to include shipping, and valid for at least 60 days after receipt of quote. Offerors shall identity where the offered item meets or does not meet each of the Government's functional and performance minimum specifications listed herein.

REJECTION OF QUOTATION: Failure to demonstrate compliance will be cause to reject the quote without further discussions. All responsible sources may submit an offer and will be considered.

The following clauses and provisions apply to this acquisition. 52.212-1 Instructions to Offerors— Commercial Products and Commercial Services.; 52.212-3 Offeror Representations and Certifications— Commercial Products and Commercial Services.; 52.212-4 Contract Terms and Conditions—Commercial Products and Commercial Services.; 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders—Commercial Products and Commercial Services.

FAR 52.212-2, Evaluation-Commercial Products and Commercial Services, the significant evaluation factors, in the relative order of importance, are (i) technical capability of the item offered to meet the Government requirement including delivery date; (ii) price; and (iii) past performance, based on F.O.B.

Destination. Award will be made based on overall BEST VALUE to the Government.

AGAR Clauses 452.204-70 Modification for Contract Closeout

As prescribed in USDA’s Contracting Desk Book 404.804 and 413.302-5, and 416.102, insert the following clause:

MODIFICATION FOR CONTRACT CLOSEOUT (DEVIATION JUNE 2024)

“Upon contract closeout for contracts utilizing anything other than cost reimbursement:

(a) If unliquidated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) Upon contract closeout for contracts utilizing SAP: if unliquidated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a “Contractor Release of Claims” be completed by the contractor, although not required for contracts and orders using SAP.) If the bilateral modification and/or Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

STATEMENT OF WORK

MEDIUM AUTOCLAVE STERILIZER

USDA, Agricultural Research Service (ARS), US Vegetable Laboratory 2700 Savannah Highway

Charleston, SC 29414

GENERAL REQUIREMENTS

The Vendor shall provide all material, labor, travel, and equipment to fulfill the requirements of this statement of work. For this project, the Vendor shall provide a complete and functional medium Sterilizer/Autoclave for project use. Vendor is responsible for accurate distances for ordering cables, panels, breakers, and lines.

Last known observation: Water and power available in area.

B. WORKING HOURS

All work shall be performed during normal working hours of this facility, 7:00am to 4:00pm, Monday through Friday, except Government holidays. Work performed outside the normal working hour shall be scheduled in advance.

C. DETAILED REQUIREMENTS

1. The goal of this project is to provide a complete medium-sized sterilizer/autoclave unit

2. 460-480 vac – 3Ph generator system

3. 72kw - 75kw output

4. Single door/ auto-locking

5. Chamber size: roughly 26" x 37.5" x 66"

6. Steam supplied/ house fed (50-80 psi)

7. Sensors, valves, plumbing materials, brackets, mounts, screws etc., and installation

8. Training and sanitizing/cleaning kits

9. 2 sets of staff training to be provided

10. Unit leveled, installed, piped for water, drain and exhaust

11. Provide all proper gauge electrical cables, panels, conduits connections, breakers, disconnects, and tie-ins.

CI. SECURITY

Vendor shall sign in all employees working on the job site. Due to Covid-19 protocol, temperature checks and masks shall be used while in the facility.

E. FINAL INSPECTION

LPOC and Vendor will perform a final walkthrough.

F. Cleanup:

The headhouse area shall be kept clean and free of debris at all times. Restore areas disturbed as nearly as possible to the original appearance and condition. Upon completion of the project, and prior to final inspection, the Vendor shall remove from the premises all unused material, trash, packaging, and debris resulting from the work to the satisfaction of the LPOC.

G. Final Payment/Contract Closeout:

The following documents are REQUIRED PRIOR TO FINAL PAYMENT (other documents may also be required):

1. Invoice sent to the CO

2. Warranties

3. Manuals

H. Installation Plan:

Submit a comprehensive plan, describing the proposed sequence, methods, and equipment for the completion of this project.

1. Installation Schedule:

Vendor shall coordinate assembly and installation with Local Point of Contact (LPOC). All disturbances or disruptions of service as a part of work for this building shall be coordinated with the LPOC to prevent jeopardizing on-going research.

2. Quality Control:

The work performed under this contract shall be subject to continuous audit by the LPOC. Quality control is the exclusive responsibility of the Vendor.

3. Protection of Work and Property/Safety Requirements:

a. The Vendor shall protect the work, the site, and all existing property and structures within the limits of the project activities or that may be affected thereby until acceptance of the work. Any damage to property shall be repaired at the Vendor's expense to pre-damaged condition to the satisfaction of the COR.

b. Safety and health matters, as they relate to the work, are the exclusive responsibility of the Vendor. The Vendor shall furnish, erect, and maintain barricades, warning lights, signs, guards, or take other precautions as may be required by law or local authorities of the protection and security.

c. Open depressions and excavations occurring as part of this work shall be adequately barricaded or fenced to prevent vehicle or pedestrian traffic into the work area.

e. The Contract Documents may not represent all surface conditions at the site and adjoining areas.

f. Government will not furnish any labor or equipment to unload or move materials or supplies.

4. Disposal of Removed Materials and Debris:

a. Dispose of materials, waste, trash, and debris in a safe, acceptable manner, in accordance with applicable laws and ordinances and as prescribed by authorities having jurisdiction.

b. Burying of trash and debris on the site will not be permitted. Burning of trash and debris at the site will not be permitted.

c. Remove trash and debris from the site at frequent intervals so that their presence will not delay the progress of the work or cause hazardous conditions for workers and the public.

d. Removed materials, trash, and debris shall become the property of the Vendor and shall be removed from the project site and be disposed of in a legal manner. Location of disposal site and length of haul shall be the Contractor's responsibility.

e. The Vendor should make every effort to recycle as much of the project debris as possible.

ci. Comply with hauling and disposal regulations of authorities having jurisdiction, per federal, state and local requirements.

6.0 Temporary Facilities:

a. Temporary utilities (water and electricity) may be furnished to the Contractor by the Government, if so requested. The Vendor shall maintain and protect all such utilities during the course of the project and shall repair or replace any items damaged through its own negligence.

6.1 Cleanup:

The project site shall be kept clean and free of debris at all times. Restore areas disturbed as nearly as possible to the original appearance and condition. Upon completion of the project, and prior to final inspection, the Vendor shall remove from the premises all unused material, trash, and debris resulting from the work to the satisfaction of the LPOC or COR.

6.3 PROJECT SCHEDULE: The Contract time for this project is 150 calendar days from the notice to proceed. NTP will be issued at the mandatory project kick-off conference.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(2) While not required, the Contractor may include in its subcontracts for commercial items a minimal number of additional clauses necessary to satisfy its contractual obligations.

Alternate I (Feb 2000). As prescribed in 12.301(b)(4)(i), delete paragraph (d) from the basic clause, redesignate paragraph (e) as paragraph (d), and revise the reference to "paragraphs (a), (b), (c), or (d) of this clause" in the redesignated paragraph (d) to read "paragraphs (a), (b), and (c) of this clause".

Alternate II. (Feb 2024) As prescribed in 12.301(b)(4)(ii), substitute the following paragraphs (d)(1) and (e)(1) for paragraphs (d)(1) and (e)(1) of the basic clause as follows:

(d)(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8 G of the Inspector General Act of 1978 (5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—

(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and

(ii) Interview any officer or employee regarding such transactions.
