SOLE SOURCE JUSTIFICATION

FOR SIMPLIFIED ACQUISITIONS

From: C731 To: Cognizant Code 02 Acquisition Branch

Subj: SOLE SOURCE JUSTIFICATION

1. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES, ESTIMATED

VALUE, AND DELIVERY REQUIREMENTS

NSWCCD has a requirement to procure custom Transducers (called Pingers) which are used for safe operation of submarines on acoustic trial ranges. Eight custom 1172A Transducers are required. The estimated dollar value for each custom Transducer is $16,117.

The delivery requirement is no later than 30 June 2021 in order to support submarine acoustic trials. The recommended sole source vendor is Gavial.

2. SUPPORTING DOCUMENTATION FOR SOLE SOURCE BASED ON

CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE

ACQUISITION

This purchase order is for custom Transducers (called Pingers) for use on U.S. Navy Submarines. Only the transducers produced by this vendor have been utilized for this application.

Gavial’s transducers are compatible with existing equipment and approved Tempalts.

Gavial owns all design information, manufacturing know-how and critical equipment required to deliver all legacy ITC Transducer models, as well as future ITC transducer models (see Market Survey section below).

QA reliability impacts and technical risk for this effort would greatly increase if another vendor’s transducer design was used. A new vendor would have to be introduced to and learn the unique US Navy requirements, then prove they could do it, all adding to the risk involved.

Therefore, in accordance with FAR 13.106-1(b)(1)(i), the circumstances of this contract action deem only one source to be reasonably available.

3. MARKET SURVEY

ITC, maker of the Navy’s legacy transducer models, went bankrupt 2016. Before Gavial bought ITC, and restored their operations in 2017, the Navy could not meet its procurement requirements for acoustic trials transducers because there were no viable commercial options. The last time the Navy purchased the acoustic trials transducers was in 2009, before ITC went bankrupt. As a consequence, inventory levels are low and are impacting the ability to support submarine schedules.

4. ADDITIONAL FACTS

In 2009 when the Navy last bought the transducers, the price was $15,000 each (for quantity greater than 30).

5. CUSTOMER SIGNATURE:

I certify that the statements and information provided above, are complete and correct to the best of my knowledge. I understand that the processing of this sole source justification precludes the use of full and open competition.
