FAR SUBPART 13.5 SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS
– BRAND NAME JUSTIFICATION AND APPROVAL

Description of Requirement:
This procurement is to purchase ten 4160 Volts, AY Electrical Cables, that are each 600 feet long, used for providing shore power to homeport and visiting Naval vessels.
Authority: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5.

2. Description of Action:
Commander, Fleet Activities Yokosuka (CFAY) requests ten 600 feet section, 4160 volt electrical cables.
The Government projects award for September 2023 and fiscal year 2023 Operations and Maintenance, Navy funds will be used. The electrical cables will include brand name only Original Equipment Manufacturer (OEM) Adalet PML 415 AB plug end, which accommodates a cable diameter ranging from 1.50” to 3.50”. The cables in will be used to provide shore power, fabricated in accordance with UFC 4- 150-02 of 1 sept 2020 with three (3) conductor, SHD350GC 8kV, non-shielded insulated, PVC jacketed cable in accordance (ICEA) S-66-524. Prior to shipment and delivery, cable tests shall be provided and certified that the cable assemblies were inspected and tested in accordance with NETA ATS and UFC 4- 150-02.
The electrical cable is cross-linked, thermosetting polyethylene insulated wire and cables. It is important that the cable assemblies and plug-ins arrive together for a fully functional, integrated, and secure system by the necessary completion date.

b. Reason for Authority Cited:
FAR 11.104(b) authorizes agencies to write a requirement for brand name with a general description of specifications. The 4150V cable is a standard voltage with a variety of lengths, the brand name only component is commercially available. It has been determined that multiple small businesses (entities) can quote on the cables based on the salient characteristics.
Being able to provide ship-to-shore power is a critical mission function for CFAY. CFAY would not otherwise be able to provide ship-to-shore power to the newly assigned ship without having to reengineer the ship’s electrical receptacles.
5. Efforts to Obtain Competition:
This requirement has a brand name only component. The Contracting Officer will publish the notices required by FAR 5.201. The brand name justification will be posted with the solicitation in accordance with FAR 5.102(a)(6).
6. Actions to Increase Competition:
This procurement will be competed to the maximum extent practicable in accordance with FAR
13.104 Market research confirmed there were multiple sources identified that can provide the cables. The brand name is only applicable to the Adalet PML 415 Ab plug end.
7. Market Research:
A search of the AbilityOne and Unicor website was conducted 18 May 2023, with no results for the 4160 volt cables. Market research showed these cables are sold to the public and meet the commercial definition of 2.101 and FAR part 12. These cables were previously purchased under N0040622C0032, as brand name only, and other similar cables were purchased as brand name only under contract N0040622C0017. Pervious purchase and market research has confirmed that small business can meet the requirements of this acquisition.
8. Actions to Remove Barriers to Future Competition For the reasons set forth in Paragraph 5, Fleet Logistics Center (FLC) Puget Sound Contracting Office has no plans at this time to remove the brand name only component of this requirement. If another potential source emerges, FLC Puget Sound will assess whether competition for future requirements is feasible.
