STATEMENT OF WORK
CHEMICAL AND BIOLOGICAL WASTE DISPOSAL
NATIONAL CENTERS FOR COASTAL OCEAN SCIENCE
NOAA Beaufort Laboratory
A. INTRODUCTION
NCCOS Beaufort Laboratory is located at 101 Pivers Island Rd, Beaufort, NC 28516, is a research laboratory which is owned and operated by the Department of Commerce, National Oceanic and Atmospheric Administration, National Ocean Service/ National Centers for Coastal Ocean Science. The facility produces mainly formalin and solvent wastes from the fixation of fish and marine mammals utilized to provide mangers with information needed to enhance recreational and commercial fishing and essential fish habitat. Beaufort conducts laboratory and field research on estuarine processes, nearshore and ocean ecosystems’ biological productivity, harmful algae blooms, the dynamics of coastal and reef fishery resources and the effects of human influences on resource productivity.
This statement of work details the scope of this requirement to remove chemical and biological wastes at the NOAA Beaufort Laboratory located in Beaufort, NC. The laboratory is an EPA “Very Small Quantity” Generator of chemical wastes that also generates biological materials from various marine and wildlife research processes and are legally held to uphold state and federal EPA and other environmental code requirements for the disposal of chemical and biological wastes.
NOAA's Environmental, Safety, and Sustainability Office (NESSO) establishes NOAA's policy to ensure compliance with regulatory, internal, and drive toward continuous improvement in Environment, and Sustainability performance. Environmental guidance requires NOAA facilities to conduct business in the most environmentally responsible manner possible, including the generation and disposal of chemical and biological wastes. To limit environmental liability and maximize environmental sustainability, the preferred method of disposal of all NCCOS generated waste is to recycle/reclaim/recover whenever possible. When recycling is not possible, to dispose of chemical and biological materials using fuels blending by cement kilns, and lastly disposed of by a waste to energy process as fuel for beneficial incineration. NO waste is permitted to be disposed of by burial, ground injection, landfill, unauthorized or illegal means, or shipped outside the United States. All wastes removed from the facilities must be handled according to applicable local, state, and federal regulations.
B. OBJECTIVES
NOAA Beaufort Laboratory requires a firm fixed price contract for semi-annual (once every 180 days) hazardous waste removal services to properly and legally dispose of all chemical, biological, and universal wastes generated by the NOAA/NCCOS Beaufort NC Laboratory facility. The entirety of wastes for disposal are identified in the thousands of chemicals specifically listed in the DOT Transportation Regulations 49 CFR Part 172.101 Hazardous Materials Table pages 157-310. For legal purposes of this contract, these chemical wastes are generically identified by official DOT hazard classes or Division as:
Class 1 Explosives; Class 2 Flammable, Non-flammable, and Poison Gases; Class 3. Flammable Liquids;
Class 4. Flammable solids, Spontaneously Combustible, and Dangerous When Wet; Class 5. Oxidizers;
Class 6. Poison, Toxic, and infectious Substances; Class 7. Radioactive; Class 8. Corrosives; Class 9 Miscellaneous Hazardous Materials. Universal wastes including hazardous waste batteries, Mercury-containing equipment, pesticides, and lamps. All specific chemicals for disposal by the generator under this contract are found within these classes and divisions and otherwise are not able to be specifically identified by proper shipping name until generated and requesting a pickup. General information regarding typical chemicals for disposal are identified in Attachment A in this document.
C. SITE VISIT:
Offerors are strongly encouraged to conduct a site visit to review all existing conditions affecting the requirements in this statement of work, and to familiarize themselves with site conditions for purposes of formulating quotes. It is the Contractor’s responsibility to confirm existing conditions and evaluate requirements listed in the Statement of Work herein. Failure to determine existing conditions will not be considered a basis for granting additional compensation.

D. SCOPE
The Contractor shall provide a firm fixed price quotation to furnish all labor, services, vehicles, and associated materials to package and label for transport, manifest, remove from facility and properly, legally dispose of assigned chemical wastes in a timely manner, and provide prompt certificates of destruction for all hazardous wastes – including reporting summary of wastes removed from the NOAA Beaufort NC Laboratory and their disposal/treatment status. The Federal Government shall not provide any labor or components to fulfill the terms of this contract; however, NCCOS reserves the right to audit any and all facilities of the selected Contractor and Subcontractors. Location and approximate chemical/biological waste inventories are included under Attachment A shown below. NOTE: Not limited to only these specific waste streams.
1. Wastes shall be disposed of by the following prioritized list of disposal methods:
Recycling/Reclaiming/Recovery, 2. Fuels Blending, 3. Waste to Energy Process, or 4. other recognized methods of beneficial reuse wherever possible to maintain the highest level of NCCOS commitment to environmental management. Quantities are not to exceed the amounts listed in attachment A.
2. The Contractor shall have a minimum of five (5) years’ experience in hazardous waste pickup, transport, management and disposal with a clean and unblemished environmental record from the applicable US and state EPAs. This contractor shall own and operate a regulatory compliant Transportation, Storage, and Disposal facility (TSDF). Contractors shall submit past performance information, evidence of business experience, current insurance documents, EPA permits, notification of any environmental or safety regulatory deficiencies within the past five years, and appropriate audit letters as part of their quotation.

Miscellaneous Waste
In addition to the above bulk waste streams, the laboratories generate miscellaneous waste on a smaller and less frequent basis which the contractor shall dispose of on an “as needed basis” at the same time as the above bulk waste streams under this contract. The entirety of these miscellaneous wastes are found in DOT 49CFR Part 172.101 Hazardous Materials Table, but are too numerous to list individually.

F. CONTRACT REQUIREMENTS/TASKS
The Contractor shall provide all services necessary for the manifesting, bulking, packing, labeling, transport and final disposal of chemical, biological, universal, sharps, and medical wastes generated by the NCCOS Beaufort laboratory on a semi-annual basis.
Requirement includes providing prompt certificates of destruction for all hazardous wastes, including the annual reporting summary of wastes removed from each facility and their disposal/treatment status for facility documentation. The Contractor shall provide removal and disposal semi-annual (once every 180 days) within the contract period of performance at the Beaufort Lab. All procedures involved with the disposal shall be in accordance with applicable local, state and federal policies, laws and regulations. Contractor shall transport and dispose of wastes in bulk or as lab packs filled observing all DOT 49 CFR Transportation regulations, and according to hazard class and compatibility. The Contractor shall provide properly trained and certified or licensed employees who have at least 5 years of experience providing in hazardous waste collection and disposal methods. The Contractor shall include all personnel, equipment, labor, transportation, placarding, packaging, manifesting, temporary permits, analysis (if needed) and compilation and submission of all documentation including but not limited to properly prepared shipping documents, land bans, invoices, and a container inventory listing each container any consolidation information, information on where each container shipped, and the ultimate information on destruction (location, date, method, etc.). Total quantities listed on DOT manifests must accurately reflect proper compatibility and quantity of chemicals in a drum. All quantities are to be listed by weight. For customary EPA reporting purposes, the Contractor shall list individual hazardous waste quantities shipped as weight of the waste only (total weight less weight of the drum).
Accurate portable scales for weighing waste containers are to be provided on each transport vehicle used by Contractor.
Final disposal of bulk solvent waste streams shall be solvent reclamation by distillation or fuels blending by an approved cement kiln. Final disposal of lab packs and other hazardous and nonhazardous wastes are to be consolidated and disposed of at approved facilities by the following order of priority: reclaimed, recycled, or recovered wherever possible, fuels blending at cement kilns, or fuel for waste to energy incinerators. Wastes shall be neutralized and then fuels blended or used in a waste to energy incineration process when either of the preferred disposal methods is not possible. Wastes are not permitted to be disposed of by: landfill, deep well injection methods, or at facilities outside the United States mainland. Wastes from the NOAA Beaufort Lab shall be sent only to disposal facilities that are in full compliance with federal, state, and local regulations.
Contractor shall work with the facility to recommend improvements in waste management and destruction technology that allows the NOAA Beaufort Lab to maintain the highest level of environmental management.
Any and all permits, licenses or related fees are the responsibility of the Contractor.
Prior to disposal, the Contractor shall be notified via telephone or email by the laboratory Environmental Health and Safety (EH&S) contact to negotiate a pickup date, followed by an email of the waste inventory to be removed. NOAA labs may add additional items for pickup until 48 hours prior to any pickup or at the time of pickup if additional items fall into an approved waste stream container. Prior to removal of any waste from the NOAA Beaufort Lab facility, copies of the current annual vehicle inspection and commercial driver’s license with HAZMAT endorsement for the driver must be provided to the local onsite EH&S coordinator. This is mandatory for any vehicle used to remove wastes from the facility. Transport of waste from a facility will not be permitted until full compliance is met.

Contractor shall provide DOT-approved drums in good condition for shipping and the bulking or lab packing of wastes as needed. All activities shall be performed according to OSHA, EPA, RCRA, DOT, and all other applicable Federal, State, and local regulations. The Laboratories shall not furnish any equipment or personnel in performance of the Contractor’s responsibilities under this proposal and subsequent contract.
Additionally, NCCOS does not warrant that waste holding containers are suitable for transport in accordance with DOT regulations; the Contractor will determine the need for container repacking or overpack based on the site visit.
When performing pickup at the NOAA Beaufort Lab, the submission of the following shall apply:
• Final signed manifests/or shipping papers.
• Land disposal notifications
• Packing lists
• Detailed original signed Certificates of Destruction (COD) from final disposal site on Company letterhead (see COD requirements below)
• Copies of Contractor invoice and signed original CODs from the ultimate disposal facility must be submitted electronically to the local EH&S contact person. The CODs must be received from the final disposal facility in a timely manner
• Copies of all the above papers shall be submitted electronically to the Contracting Officer along with the original invoice
Although every effort is made here, to clarify items generated as reasonably accurate, some variations are possible, from time to time based on DOT 49 CFR Part 172.101 Hazardous Materials Table and the EPA/RCRA standards.
Summary of Specific Requirements/Tasks:
• The Contractor shall provide Hazardous Waste Removal and Disposal semi-annually (once every 180 days).
• Contractor shall transport and dispose of wastes in bulk or as lab packs filled observing all DOT 49 CFR Transportation regulations, and according to hazard class and compatibility
• The services shall include all personnel, equipment, labor, transportation, placarding, packaging, manifesting, temporary permits, analysis (if needed) and compilation and submission of all documentation including but not limited to properly prepared shipping documents, land bans, invoices, and a container inventory listing each container any consolidation information, information on where each container shipped, and the ultimate information on destruction (location, date, method, etc.).
• Original copies of signed manifests from the designated disposal facility shall be mailed by the designated facility and received by the Generator within the required 30-day EPA time limit
• Certificates of Final Destruction (COD) or Recycling (COR) are required for each manifested waste pickup.
• A written statement indicating that wastes are being handled in accordance with all local, state, and federal regulations and will be properly disposed of is appreciated, but does not meet the requirement of a COD or COR.
• An annual report shall be submitted to each laboratory contact detailing wastes disposed of at each pickup for the calendar year, final disposal process, disposal facility, and date of final destruction.
These reports are expected by January 31 of each year so the data can be used to meet EPA Biennial Report requirements.
G. DELIVERABLES:
The Contractor shall furnish as part of their quotation information that demonstrates that Contractor is appropriately: licensed, permitted, and insured for the transport and temporary storage of hazardous waste involved in this contract and a list of intended temporary and final disposal sites for each category of waste.
In the case of subcontracting work (Fuels Blending, Recycling, etc.), the primary Contractor shall provide proof of licensing, permits, insurance, and list of intended final disposal sites of all Subcontractors before contract execution. NCCOS reserves the right of refusal of any disposal site(s) or to request alternate disposal site(s).
Only sites approved by the NCCOS and NOAA Environmental Compliance Officers will be allowed. Use of a disposal facility that is not on the Contractor’s list provided at bid time, or the use of unapproved disposal methods shall be cause for contract termination and forfeiture of payment(s) from NCCOS. A written request submitted to NCCOS (attention Ron Gagnon, with copy to the Contracting Officer) shall be required for NOAA to approve a new temporary storage or final disposal site. No changes may be made to this contract without written approval of the Contracting Officer.
Original copies of signed manifests from the designated disposal facility shall be mailed by the designated facility and received by the Generator within the required 30-day EPA time limit. If original manifest copies are required to be supplied to Generator and ship to states, the Contractor must mail by certified return receipt requested with the original return receipt returned to the Generator for their audit records.
Certificates of Final Destruction (COD) or Recycling (COR) are required for each manifested waste pickup.
The certificates must specify the Generator facility, original manifest number, container identification number, contents, date of destruction, location of destruction facility, and method(s) of destruction/recycling.
Certificates must be received by the Generator within 120 days of removal from an NCCOS Lab or within 30 days of waste destruction. Also, a written statement indicating that wastes are being handled in accordance with all local, state, and federal regulations and will be properly disposed of is appreciated, but does not meet the requirement of a COD or COR. An annual report shall be submitted laboratory contact detailing wastes disposed of at each pickup for the calendar year, final disposal process, disposal facility, and date of final destruction. In addition, any investigative work encountered on the part of NCCOS to procure these documents, may be invoiced to the Contractor.
A digital written report to meet EPA biennial reporting requirements is required. In addition to requirements for EPA biennial reporting, written reports minimally shall summarize in table format the amount and type of wastes removed during the calendar year, waste manifest numbers, the extent of conformance with recycling/reuse/reclamation disposal objectives for the facility.
Summary of Deliverables
The offeror’s quotation shall include the following:
• Contractors shall submit past performance information, evidence of business experience, current insurance documents, EPA permits, notification of environmental or safety regulatory deficiencies within the past five years, and appropriate audit letters with bid package.
• Proof that the contractor is appropriately: licensed, permitted, and insured for the transport and temporary storage of hazardous waste involved in this contract and a list of intended temporary and final disposal sites for each category of waste.
• In case of subcontracting work, the primary Contractor shall provide proof of licensing, permits, insurance, and list of intended final disposal sites of all Subcontractors before contract execution.
• A sample annual report for EPA biennial reporting requirements, adjusted to locality.
• A completed pricing sheet
H. SECURITY REQUIREMENTS
The contractor will not access, store, process or transmit any government privileged information. The contractor will not have access to any non-public government systems or networks.

J. PLACE OF PERFORMANCE
NOAA Beaufort NC laboratory 101 Pivers Island Rd, Beaufort, NC 28516.
K. HOURS OF OPERATION
Contractor employees shall generally perform all work during normal business hours, Monday through Friday (except Federal holidays). However, there may be occasions when Contractor employees shall be required to work other than normal business hours, including weekends and holidays, to fulfill requirements under this SOW. Prior to each disposal, the Contractor will be notified via telephone or email by the laboratory EH&S contact to negotiate a pickup date, followed by an email of the waste inventory to be removed.
L. GENERAL REPORT REQUIREMENTS
A report shall be submitted to the Government POC detailing wastes disposed of at each pickup for the calendar year, final disposal process, disposal facility, and date of final destruction. These reports are expected by January 31 of each year so the data can be used to meet EPA Biennial Report requirements. The report must be a digital written report for each facility in a format usable for cutting and pasting to meet EPA biennial reporting requirements is required.
In addition to requirements for EPA biennial reporting, written reports minimally shall summarize in table format the amount and type of wastes removed during the calendar year, waste manifest numbers, the extent of conformance with recycling/reuse/reclamation disposal objectives for EMS reporting, and graphic representation for each facility, and a combined NCCOS level report, to indicate the success of the NCCOS requirement to handle wastes in the most environmentally friendly manner with opportunities for improvement.
M. GOVERNMENT FURNISHED RESOURCES
The Government will not furnish any resources to the Contractor in support of this contract.
N. CONTRACTOR FURNISHED PROPERTY
The Contractor shall furnish all facilities, materials, equipment, transportation, and services necessary to fulfill the requirements of this contract.
O. ENVIRONMENTAL COMPLIANCE
Work must be completed observing all federal, state, and local laws and regulations and environmental compliance requirements, including applicable permitting requirements. Environmental compliance may include but is not limited to the National Environmental Policy Act, Endangered Species Act, Clean Water Act, National Historic Preservation Act, Essential Fish Habitat Provisions of the Magnuson- Stevens Act, Resource Conservation and Recovery Act (RCRA), etc.
